60 RULES ACCESSORY BUILDINGS Accessory buildings are permitted with ACC approval only. Sheds or structures built without approval of the ACC will be in violation. (CC&R sec 44 pg 27) ANIMALS Dogs, cats, caged birds, fish in tanks, and other small household pets are the only animals allowed on lots. Excessive animal noise is prohibited. Dogs must be leashed when outside of fenced lots. Leashed animals must be accompanied by an owner, and the owner must pick up and properly dispose of animal waste. No animals may be leashed, chained, or tied to any portion of the front and sides of houses. All animal enclosures must be kept out of view of homes and lots and must be kept clean and odor free. The ACC must approve all animal enclosures prior to construction/purchase/utilization. If any violation may occur, the Board will give the owner ten (10) days written notice of the violation. Violations must be fixed by the owner within the ten (10) day period or a $25.00 per day fine will be assessed. If the owner does not pay the fine, a lien will be placed on the owner s lot, and the Association is permitted to collect the value of attorneys fees and costs for any action taken to collect the unpaid fines. (CC&R sec 18 pg 20) AUTO REPAIR No major auto repair shall be permitted except within enclosed garages, with closed doors. Any minor auto repair shall conclude within one calendar day. Consistent repairs (those occurring more than once every two weeks) outside of the enclosed garage are strictly prohibited. Occasional tune-ups and oil changes are permitted. 61 BUILDING MATERIALS All home construction must be of new materials, except décor items, such as brick, weathered planking, and similar items. The ACC will determine whether used materials are considered décor items considering whether the material matches the character of the development and whether the material would add to the attractiveness of the development. All siding and trim are to be re-sawn wood and/or vertical or horizontal LP type siding, brick, authentic stone siding, Hardie Board or equivalent, or LAP siding of a color approved by the ACC. Exterior construction on all lots shall be designed, built and maintained to blend in with the natural surroundings and landscaping. Exterior colors must be approved by the ACC. Exterior trim, fences, railings, decks, eaves, gutters and exterior finishes of garages and other accessory buildings shall be designed, built and maintained to be compatible with the exterior of the structure they adjoin. (CC&R sec 43 pg 27) DAMAGE REPAIR Owners agree to the immediate repair of any utilities damage on or adjacent to their lot or lots resulting from dwelling construction or other activities by the owner, by persons acting for the owner, or by persons in or around the property at the request and/or with the consent of the owner. (CC&R sec 42 pg 27) DIRT BIKES & ATVS No unlicensed motor vehicles (motorcycles, ATV, dirt bikes, scooter, etc.) shall be permitted on any street within the community, common areas and on sidewalks. (CC&R sec 41 pg 27) DRIVEWAYS All driveways must be paved with concrete, except driveways over one hundred feet, which may be asphalted. Any other materials, painting and staining must be approved by the ACC. Driveways must be kept clean and free of vehicle drainage: oil, transmission fluid or other. (CC&R sec 38 pg 26) EXTERIOR FINISH Exterior finishes on the front of houses must be approved by the ACC. The entire residence must be painted or stained in colors approved by the ACC, and must include a body, trim and an accent. A painted front door may use an accent color. (CC&R sec 36 pg 26) FENCES AND WALLS All fences must be approved by the ACC prior to installation. All fences must be constructed of cedar and be six feet in height, unless otherwise approved by the ACC. Fence boards must be stained with In-wood Pecan Stain. Fences, walls, or shrubs are permitted on side and rear property lines up to the front wall of the primary residence or within 20 feet of the Page 3 of 7

62 front lot line, upon ACC approval. Fences are not permitted between the front lot line and the front wall of the primary residence. Fences are not permitted on portions of side yards between houses where buildings are setback less than four feet. Any fencing installed on any lot that does not meet the required standards may be removed at the owner s expense upon ACC demand. (CC&R sec 25 pg 22 and 1 st Amendment pg 2 & 6) FIREARMS The discharge of firearms is expressly prohibited. (CC&R sec 40 pg 27) FIREWORKS Fireworks are prohibited in common areas. Proper disposal of debris is required within 24 hours of use/holiday. FRONT PORCH OR FRONT DECK All wooden decks or porches must have fascia boards. All wooden stairways must have closed risers (toe-kick boards) and skirt boards. Railings, fascia, toe-kick and skirt boards must be painted to match the house trim or stained with Inwood Pecan stain on those decks or porches facing the street. Street-facing wooden porches or decks over thirty six (36) inches high must be enclosed by landscaping, siding, stone, brick or concrete. All enclosures are subject to review and approval by the ACC. (CC&R sec 37 pg 26) GARBAGE, REFUSE & RECYCLE Garbage and recycled material must be contained in a proper disposal can and remain out of view with the exception of pick-up day. Lawn recycle containers may be kept on the side of the home, as long as all attempts have been made to reduce the view from the street. (CC&R sec 33 pg 26) GARAGE SALES Garage sales are permitted in our neighborhood. Homeowners must remove ALL signs at the completion of the garage sale and everything must be pulled OUT OF VIEW between dusk and dawn. INTERIOR WINDOW TREATMENTS Within sixty (60) days of occupancy, window treatments (i.e., blinds, sheers or drapes) are required on all windows, except unique windows. No sheets, newspapers or similar types of temporary coverings are allowed. (CC&R sec 46 pg 28) MAINTENANCE OF STRUCTURES AND GROUNDS Owners shall maintain their lot and residence in a clean and attractive condition, in good repair and in such fashion as not to create a fire hazard. Grass cannot exceed four inches in height and should not have weeds or other unsightly conditions. (CC&R sec 39 pg 26) Unsightly conditions, include but are not limited to, laundry hanging or exposed in view for drying, litter, trash, junk or Page 4 of 7

63 other debris, excessive toys that are not in use, broken or damaged furniture, plants, nondecorative items, equipment, cans, bottles, ladders, trash barrels and other trash related containers, and awnings are not permitted on any lot. Air conditioning units, heat pump or other projections shall not be placed on the exterior walls of any housing unit unless prior written approval is obtained from the ACC. (CC&R sec 21 pg 22) MINIMUM SIZE OF RESIDENCES Each lot shall consist of (1) single-family residence, and cannot be further subdivided. Each residence must have a private enclosed car shelter for a minimum of (1) car and must have a garage door. (CC&R sec 45 pg 28) NUISANCES No noxious or undesirable thing, activity or use of any lot is permitted. If the ACC shall determine that a thing or use of property is undesirable or noxious, the ACC may recommend and the Board may direct that reasonable steps be taken, including the institution of legal action or the imposition of fines, to stop any activity, remove anything or prevent any use of property that is determined to constitute a nuisance. (CC&R sec 15 pg 19) PARK USE Park hours are dawn to dusk. All pets must be leashed while in park, and pet feces collected. Damage to play structure or park area can result in fines to the homeowner. Violence and vandalism are strictly prohibited. Supervision is recommended on play equipment. RENTAL HOMES A copy of all lease agreements must be on file with the management company. ROOFS All roofs, except lots 201 through 278, are to be standard three tab. Lots 201 through 278 must have an architectural grade composition roof (Certainteed Landmark 30 year or equivalent) material. All colors are to be a darker charcoal hue, as approved by the ACC. (CC&R sec 24 pg 22) SATILLITE DISHES Satellite dishes, less than one meter in diameter are permitted after obtaining ACC approval. Dish should be placed in the least visible location, which still provides a clear signal. (CC&R sec 22 pg 22) SEASONAL DECORATIONS Seasonal decorations can be displayed 30 days prior to a holiday and must be removed within five days of the holiday s/season s end. Page 5 of 7

64 SETBACKS All structures must be built on lots following appropriate requirements provided by local government agencies, and must be submitted for ACC approval prior to the start of construction. (CC&R sec 23 pg 22) SIGNS No signs, billboards, or other advertising structures or device shall be displayed to the public view on any lot or from within, any home window except one sign not to exceed three square feet in area may be placed on a lot to offer the property for sale or rent. Temporary political yard signs, not more than three-square feet in area, are allowed on lots for 30 days during campaign periods. Political signs must be removed within five days of the election date (CC&R sec 28 pg 24) SPEED LIMIT The posted speed limit in our community is 25 miles per hour. TANKS, ETC. Elevated tanks are not permitted to be erected or placed on lots, with the exception of residential construction tanks, which must be buried or walled to conceal them from the view of neighboring lots or streets. All clotheslines, garbage/recycling cans, equipment, ice chests, woodpiles, or debris must be walled or screened to conceal them from the view of neighboring lots, common areas, or streets. Plans for all enclosures of this nature must be approved by the ACC prior to construction. (CC&R sec34 pg 26) USE OF LOTS Lots 1 through 278 and B1 through B14 shall be used solely as private single-family residences and not for business purposes. Any use of these lots as businesses are subject to Board approval. If Board approval is granted, no customers, guests or business invitees are permitted on the lot. No signs or advertising of the business is permitted. Day care businesses are permitted with Board approval provided all of the following requirements be met: 1. All government zoning and land use laws are met 2. The business and all owners are licensed by all required government authorities 3. Operating hours fall between 7 a.m. and 6 p.m., Monday through Friday 4. No more than four children, in addition to those of the owner s immediate family, are enrolled either full or part-time 5. Homeowner is responsible to restrict and supervise the enrolled children 6. Homeowner cannot find the Declarant and Association liable of any action resulting from the operation of the day care business 7. Homeowner must provide proof of liability insurance in the amount of or exceeding $1,000,000 prior to beginning business and at any time during the operation of the business 8. Operation of the business cannot violate vehicle parking, signage or any other restrictions Page 6 of 7

65 (CC&R sec 17 pg 20) VEHICLE PARKING AND STORAGE Sidewalk parking is strictly prohibited. No blocking of mailboxes or driveways. Each lot may contain a combination of two automobiles or regular sized pick-up trucks owned or used by the lot owner on the designated driveway or parking area. All other vehicles must be stored in the garage. No storage of goods, vehicles, boats, trailers, trucks, campers, recreational vehicles or other equipment or device shall be permitted in open view from any lot or right of way. Recreational vehicles and/or boat trailers may be parked in the driveway up to (24) hours. Permanent parking and storage of vehicles is permitted on lots provided they are adequately screened from the view of adjacent streets and lots, upon approval by the ACC. All owners violating these requirements will receive (48) hours notice to resolve the violation. Failure to comply will result in the Board s request to have the vehicle towed at the owner s expense. Parking of commercial vehicles is prohibited, except while performing a service to the lot. (CC&R sec 27 pg 23) Page 7 of 7
