1 CITY OF LAGUNA BEACH COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT HEARING DATE: TO: CASE: APPLICANT: LOCATION: ENVIRONMENTAL STATUS: PREPARED BY: BOARD OF ADJUSTMENTIDESIGN REVIEW BOARD Design Review Variance 7598 Coastal Development Permit Horst Architects 812 Gainsborough Drive APN # Categorically Exempt, Class 1 Nancy Csira, Principal Planner (949) REQUESTED ACTION: The applicant requests Board of Adjustment/Design Review Board approval and a Coastal Development Permit for a 2,515 square-foot single-family residence and a 502 square-foot attached 2-car garage in the Diamond Crestview Specific Plan Area. Design review is required for the new structure, elevated decks (451 square-feet), AC units, grading, retaining walls, fuel modification plan, landscaping, and construction in an environmentally sensitive area due to mapped watercourse and high value habitat. A variance is required to encroach into the watercourse setback [LBMC (D)]. BACKGROUND: The project was before the Design Review Board for an initial hearing on 12/4/08. At that hearing the Board directed the applicant to address issues of concern regarding drainage, parking, glazing, roof color, proposed rustic materials, roof overhang, retaining walls, and landscape lighting. RESPONSE: The applicant has prepared a detailed list of the proposed changes in response to the Board's direction. This list and a copy of the Design Review Board minutes of 12/4/08 are attached to the reduced plans. In summary, the applicant has widened the driveway to accommodate two on-site guest parking spaces, confirmed the location and design of the public on-street parking space, reduced the amount of glazing (less 166 square-feet), reduced landscape lighting 50%, and redesigned the drainage system. Revised material and color selections have been provided (attached). The Diamond Crestview Specific Plan does not allow site retaining walls to be greater than 5 feet without the benefit of a variance. The applicant is proposing 75 degree cuts into the rock at the side property lines and has layered proposed Cor-ten steel faced planters in fiont of the cut at 5 foot increments to offset the appearance. The applicant has provided a detail of the proposed wall (attached). Requested Variances: The variance to encroach into the watercourse setback is justified due to the steep topography, location of the lot, proposal to provide a private storm drain, and the fact

2 that the site is a building site. The City Engineer has provided a memorandum (attached) regarding the revised private storm drain and required procedures. Coastal Develo~ment Permit: Two findings must be made by the Board to grant the Coastal Development Permit. Staff suggests Finding #1(0) Fire Hazards due to adjacent areas with expanses of grasslands and chapparral vegetation are minimized because a fuel mod$cation plan has been submitted and approved by the Fire Department and Finding #3(A) The proposed project is in compliance with the applicable rules and regulations set forth in the Municipal Code and will not cause any signzficant adverse impacts on the environment. COMMUNITY INTEREST: There have been no letters received by the Zoning Division as of the date of this report. 3 DATE: January 9,2009 City of Laguna Beach, Public Works Department MEMORANDUM TO: FROM: Nancy Balmer-Csira, Principal Planner Steve May, Director of Public Works / City Engineer d k SUBJECT: Review of 8 12 Gainsborough Drive Building Proposal (DR ) I have reviewed a revised set of plans date stamped 1/7/09 for the subject project and have the following comments: 1. The revised design will provide adequate drainage protection for the project and adjacent properties from runoff directed to the site by way of concrete drainage ditches from the south and east. With this revised design, the City would be able to accept the relocated drainage easement and new drainage facility as provided for in the existing drainage easement. 2. The revised storm drain design provides for the following: a. 100 year flood protection b. Enlarged pipe size, beyond that required for conveyance of 100 year flows, to avoid clogging. c. A secondary surface drainage path along the east side of the property. 3. Following are recommended conditions of approval that should be completed and satisfied prior to issuance of a building permit: a. Public improvements for drainage and on-street parking shall be shown on a separate set of plans prepared by a licensed civil engineer. The plans shall be submitted to the City Engineer for review and approval. The City Engineer may direct minor modifications to the details of the design as deemed necessary to provide for a reliable public drainage system. b. The site drainage design shall provide that on-site area drains and sub-drains will not be connected directly to the City storm drain. c. The property owner shall dedicate a new drainage easement over the alignment of the new drainage system, five feet in width with no building encroachment for a vertical distance of eight feet above the finished ground surface, with easement over the entire property as may be reasonably necessary for access to the drainage easement, with the following conditions: (I) the City shall repair and restore any damage to property caused by the City's maintenance or repair of the drainage systems, (2) upon completion and acceptance of the new drainage improvements, the City shall quitclaim to the property owner the existing drainage easement as recorded in Book 13920, Pg d. No building or wall structures may impose loading upon the City drainage facilities so that the drainage facilities may be excavated by normal means without removing support for such structures.
