Wood, Councillors P.T. Archibald, D.G. Hoar, R.R. Lorenz, P.J.R. Massier and D.H. Nesbitt. Staff Present: County Manager C. Herzberg, Planning and Development Services Director C. Matthews and Legislative Services Manager N. Lougheed. 1.0 CALL TO ORDER Chairman Councillor G.W. Gehrke called the meeting to order at 9:30 a.m. 2.0 AGENDA MPC Moved by Councillor P.T. Archibald to approve the agenda as submitted. CARRIED UNANIMOUSLY 3.0 APPROVAL OF THE MINUTES MPC Moved by Mayor J.J. Wood to approve the minutes of the July 19, 2011, meeting as submitted. CARRIED UNANIMOUSLY 5.0 NEW BUSINESS 5.1 Kevin Latimer NW (Division 4) 160 acres Agricultural District Ag Requesting approval for a one-year extension for the June 8, 2010, conditional approval to temporarily locate a second dwelling (mobile home) during the construction of a single detached dwelling and garage on the above site. MPC Moved by Councillor D.G. Hoar to approve the application for a one-year time extension for the conditionally approved application to temporarily locate a second residence (mobile home) during construction of a single detached dwelling and garage on NW , with the extension being granted until July 26, CARRIED UNANIMOUSLY 5.2 Beta Surveys Ltd. for Allan and Mary Ann Brown Unit 30, Plan , NW (Division 1) Condominium Resort Residential District R-7 Requesting approval of a 2.4-metre (8 ) rear yard setback relaxation for the location of an existing attached covered deck on the above site. Massier to approve the application for a 2.4-metre (8 ) rear yard setback relaxation for the location of an existing covered deck on Unit 30, Plan , NW , subject to the following conditions being met to the satisfaction of the Development Officer: 1. Receipt of Encroachment Agreements with adjacent landowners regarding the encroachments of the driveways and patios. 2. The decision being advertised in a local paper and no appeal against said decision being successful. CARRIED Councillors Gehrke, Hoar, Lorenz, Massier and Nesbitt in favor Mayor Wood and Councillor Archibald opposed 5.3 Bemoco Land Surveying Ltd. for Roland and Salina Lund Lot 32, Block 4, Plan , SW (Division 5) Direct Control District # 7 DCD-7 Requesting approval of a 4.04-metre (13.3 ) front yard setback relaxation for the location of an existing dwelling on the above site. The property is located within the Hamlet of Benalto on 50 th (Main) Street. MPC Moved by Councillor. R.R. Lorenz to approve the application for a 4.04-metre (13.3 ) front yard setback relaxation for the location of an existing detached dwelling on Lot 32, Block 4, Plan , SW , subject to the decision being advertised in a local paper and no appeal against said decision being successful. CARRIED UNANIMOUSLY 5.4 Dennis Albrecht and Wendy Safron Lot 7, Block 1, Plan , SW (Division 2) 1.02 acres County Residential District R-1 Requesting approval to construct a garage within the front yard of the above site. The property is located approximately 3 miles east of the City of Red Deer, south of Hwy 595 on Rge Rd 265 within Springvale Heights. MPC Moved by Councillor D.H. Nesbitt to approve the application to locate a proposed garage within the front yard of Lot 7, Block 1, Plan , SW , subject to the following conditions being met to the satisfaction of the Development Officer: 1. A development permit shall not be issued and construction of the development shall not proceed beyond grade level until all conditions, except those conditions of a continuing nature, have been met or fulfilled. 2. The proposed development shall be undertaken and completed in accordance with the attached conceptual plans (site layout and building elevations) together with the detailed plans (site layout and building elevations), which are to be prepared pursuant to the conceptual plans and comply with the County s Design Guidelines & General Construction Specifications. 3. Once the permit is issued, the applicant is to provide any revised drawings clearly indicating any changes to the approved drawing set, if applicable. 4. Any contamination of the environment resulting from the Applicant s activities shall be remediated at the Applicant s cost. CARRIED UNANIMOUSLY Alberta Ltd. (Coop Fertilizer Plant) Pt SW (Division 3) acres Agricultural District Ag Requesting approval to locate an Agricultural Supply Depot consisting of a new 12-bin fertilizer plant that will replace the existing plant on the above site. The property is located approximately half a mile east of the Town of Innisfail, east of Hwy 2, north of Hwy 590 on Rge Rd 282. MPC Moved by Councillor P.T. Archibald to approve the application for an Agricultural Supply Depot on Pt SW , subject to the following conditions being met to the satisfaction of the Development Officer: 1. A development permit shall not be issued and construction of the development shall not proceed beyond grade level until all conditions, except those conditions of a continuing nature, have been met or fulfilled. 2. The proposed development shall be undertaken and completed in accordance with the attached conceptual plans together with the detailed plans, which are to be prepared pursuant to the conceptual plans and comply with the County s Design Guidelines & General Construction Specifications. 3. Once the permit is issued, the applicant is to provide any revised drawings clearly indicating any changes to the approved drawing set, if applicable. 4. Subsequent to development completion, the applicant must provide one set of as-built drawings confirming the building location, site work and drainage provisions are in accordance with the approved plans and drawings. 5. Any contamination of the environment resulting from the Applicant s activities shall be remediated at the Applicant s cost. 6. The Applicant shall enter into a Road Use Agreement (for maintenance and paving to a non ban status of Rge Rd 282) with and to the satisfaction of Red Deer County. 7.
