1 CITY AND COUNTY OF SAN FRANCISCO MUNICIPAL TRANSPORTATION AGENCY INVITATION FOR BIDS This is an Invitation for Bids (IFB) for the following public work: Presidio Trolley Coach Facility - Presidio Bus Lifts A. Bid Submittal Deadline and Bid Opening: (Contract No. 1247R) Partial Design-Build Project Sealed Bids with all required documents must be submitted to the San Francisco Municipal Transportation Agency (SFMTA) before 3:00 p.m., April 4, 2019 ( Bid Date ) in the format described and with all the documents required in the Instruction for Preparation and Execution of Forms, Agreement and Bonds in the bid documents. The SFMTA will not accept nor consider a Bid received after that deadline. Postmarks will not be considered in judging the timeliness of submitted Bids. The SFMTA will not accept Bids submitted by telephone facsimile, via , or through the City and County of San Francisco's Supplier Portal website. The SFMTA will open Bids immediately after 3:00 p.m. on the Bid Date at One South Van Ness Ave., 3 rd Floor Conference Room. Bidders may not contact any SFMTA staff member, other than the Contract Administrator identified above, for any reason until after the Contract is awarded. Contract No. 1247R 1.1

2 B. Pre-Bid Conference and Site Visit: The SFMTA strongly encourages potential Bidders to attend a pre-bid conference and pre-bid site visit at the dates and times stated below: Pre-Bid Conference One South Van Ness Ave, 3 rd Floor San Francisco, CA March 7, 2018, 9:00 a.m. Pre-Bid Site Visit 949 Presidio Ave San Francisco, CA March 7, 2018, 11:00 a.m. The pre-bid conference topics will include the Project overview, construction issues, DBE/SBE and non-discrimination requirements, and questions from the prospective Bidders. The pre-bid site visit will allow viewing of the Project work area and existing conditions. All participants must wear proper safety vests, hard hats, and safety shoes. C. Summary of the Work The Work under this Contract is to replace lifts and doors at the SFMTA s Presidio Bus Maintenance Facility in San Francisco. The Work, as detailed in the Plans and Specifications, consists generally of the following: 1. Removal and demolition of one existing parallelogram lift, four existing in-ground lifts, and associated concrete foundations. 2. Removal and demolition of the existing floor slab at the location of the new parallelogram lift. 3. Design-Build Portion of Project: Designing, furnishing and installation of two new flush mount parallelogram lifts and four new in-ground lifts in new foundations. 4. Design-Build Portion of Project: New concrete foundations for the lifts to be designed by the Contractor. The design of the new concrete foundation structures shall be prepared and stamped by a California Registered Structural Engineer. Contractor shall submit the design to the San Francisco Department of Building Inspection for approval prior to SFMTA review. 5. Furnishing and installation of seven motor-operated roll-up doors and two bi-swing gates. Contractor shall demolish and remove the existing doors, door frames and gates. 6. Electrical work required to furnish and install the new lifts and the motor-operated roll-up doors. Contract No. 1247R 1.2

3 7. Soil sampling and laboratory testing for hazardous materials of below-ground soil at the locations of the new lifts. Contractor shall transport excavated soil material for lift foundations to the appropriate landfill sites. 8. Perform Work in phases as specified in the Contract Drawings to minimize construction impacts on the SFMTA s ongoing maintenance activities, The above description of the Work is a general summary only and does not modify the requirements set out in the Specifications, Drawings or other Contract Documents. The estimated cost for this work is $4.0 million. D. Minimum Qualifications of Bidders 1. All Bidders must possess the proper license at the time of Contract award. A California State Contractor's License Classification A is required of the prime bidder for this Contract. Each subcontractor must possess the appropriate license covering the Work it will perform. The firm performing the vehicle lift work shall have successfully completed a minimum of three projects of similar scope and complexity, installing the same vehicle lift types as specified in Technical Specifications section 14450, in the past five-year period. If the firm performing the vehicle lift work is a subcontractor, the subcontractor must be clearly identified in the Listing of Subcontractors form (page 9). The above requirements may be met by a principal of the prime bidder or subcontractor in its capacity as principal of a prior firm. E. Other Requirements of Bidders 1. No contractor or subcontractor may be listed on a bid for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section [with limited exceptions from this requirement for bid purposes only under Labor Code section (a)]. 2. No contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. 4. All Bids must be made on the Bid Proposal Form bound with the Specifications for the Work. 5. To be eligible for award of the Contract, if it is awarded, Contractor must demonstrate that it has the experience, expertise, financial and bonding capacity, personnel, and equipment to Contract No. 1247R 1.3

4 perform the Work. 6. The following small business participation goals have been established for this contract. Participation may occur at the Prime or Subcontract level. a. African American Disadvantaged Business Enterprise (DBE) goal of three percent (3%). b. Female Disadvantaged Business Enterprise (DBE) goal of two percent (2%). c. Small Business Enterprise (SBE) goal of eight percent (8%) for this contract. Contractors may fulfill the SBE participation through use of U.S. Department of Transportation Disadvantaged Business Enterprises (DBEs certified through California UCP agencies), California Department of General Services Small Businesses (SBs) and San Francisco Contract Monitoring Division Local Business Enterprises (LBEs). Participation goals must be achieved separately, and participation towards achieving one goal will not count towards achieving another goal. However, participation in excess of an established individual goal can be counted toward achieving another goal, assuming that the participant s certification status qualifies it to be counted towards the other goals. The type of work, the value of, or the amount for the Allowance Bid Items, as well as items listed in the Schedule of Bid Prices as Alternate or Optional Bid Items, if any, will not be used for determining the participation goal of the Bid. Those items will be calculated toward achievement of the goal as the amounts are expended. 7. The Contractor shall comply with all applicable Equal Employment Opportunity laws and regulations. 8. The Contractor and its subcontractors shall comply with the requirements of the State Apprenticeship Program as set forth in the California Labor Code, Division 3, Chapter 4 (commencing at section 3070) and section The Contractor shall submit proof of a current Business Tax Registration Certificate. 10. Small business enterprises will be afforded full opportunity to submit Bids in response to this invitation and will not be discriminated against on the grounds of race, color or national origin in consideration for an award. 11. The Work described in these Specifications will be financed with the assistance of a grant from the Federal Transit Administration (FTA). All work described in these Specifications shall be performed in accordance with FTA regulations and guidelines. 12. The award of this Contract is subject to the concurrence of the United States Department of Transportation (DOT). All Bidders must certify that they are not on the United States Controller General s list of ineligible contractors. Contract No. 1247R 1.4

Access to Reference Materials, Designs and Specifications No deposit is required for the Bid Documents, which may be procured from the SFMTA on the 3rd Floor, One South Van Ness Ave., San Francisco, California Bid documents may be obtained by contacting SFMTA s assigned Contract Administrator identified in this Invitation for Bids. G. Evaluation of Bids The Award (if an Award is made), will be made as provided in these Bid Documents, provided that, if the City believes that the public interest will be best served by accepting other than the lowest Bid, it shall have the authority to accept the Bid that will best serve the public interest. At any time prior to award, the Agency may in its sole discretion cancel the solicitation or reject all bids received and rebid the Contract or issue a different contract for all or some portion of the Work identified herein. H. Requirements for Award of Contract 1. In accordance with San Francisco Administrative Code Chapter 6 and SFMTA Board of Directors policy, no Bid or Proposal will be accepted, and no contract in excess of $500,000 will be awarded, by the SFMTA until the Director of Transportation recommends the contract for award and the SFMTA Board of Directors then adopts a resolution awarding the contract. Under Charter section 3.105, all contract awards are subject to certification by the City s Controller as to the availability of funds. 2. Contractor is required to comply with the San Francisco Administrative Code Chapter 12B and the provisions of the Equal Benefits Ordinance. The City and County of San Francisco is prohibited from entering into contract with any entity that fails to comply with the Chapter 12B and the provisions of the Equal Benefit Ordinance. To demonstrate compliance, contractor must be determined 12B compliant from the City s Contracting Monitoring Division (CMD). Bidder s failure to timely obtain Chapter 12B compliance certification from CMD may result in Award of the Contract to the next lowest responsible, responsive Bidder, or re-bidding of the Contract at the discretion of the City. 3. The selected Bidder shall cooperate with SFMTA in meeting its commitments and objectives with regard to ensuring nondiscrimination in the award and administration of DOT-assisted contracts, and Contractor shall use its best efforts to ensure that barriers to participation of Small Business Enterprises do not exist. 4. To be eligible for participation in the Contract, each Subcontractor whose estimated cost of work exceeds $10,000 must fully comply with the requirements of the Standard Federal Equal Employment Opportunity Construction Contract Specifications (Executive Order 11246) and the provisions of the Notice to Bidders, Small Business Enterprise Program, copies of which are attached to and made part of the Contract Documents. 5. A certified check or corporate surety bond of not less than 10 percent of the amount of the Contract No. 1247R 1.5

6 Bid must accompany each Bid. 6. The Contract will provide for progressive payments. Liquidated damages for failure to complete the Work and identified portions of the Work within specified times are included in the Specifications, and all Bids must cover the entire Work required under this Contract. 7. Contractor must pay prevailing wages as provided in federal and state law and the San Francisco Administrative Code. Copies of the prevailing rate of per diem wages, as determined by the Director of the State of California Department of Industrial Relations, are available at the City s Office of Labor Standards Enforcement and are also available on the Internet at and Contract No. 1247R 1.6
