1 ARTICLE 12 RESIDENTIAL DISTRICT (R) Sections: 12-1 Application/Purpose 12-2 Permitted Uses 12-3 Conditional Uses 12-4 Development Standards 12-5 Parking Regulations 12-6 Sign Regulations 12-7 Height, Area, Yard and Open Space Regulations 12-8 Infrastructure Requirements SECTION 12-1 APPLICATION/PURPOSE The regulations set forth in this Article, or set forth elsewhere in these regulations, when referred to in this Article, are the regulations in the Residential District (R). The purpose of this district is to provide for platted single-family and certain two-family and multi-family residential development within each city s Growth Area covered by that city s comprehensive plan (a.k.a. gradient area), on lots ranging in size from one-half (½) acre minimum, to three acres maximum, where public sanitary sewers, and adequate public water and other necessary public utilities are present to support the development. The district is also designed to protect and preserve existing development of a similar character. As property zoned R must be located within a city s Gradient Area, or Growth Area established by Interlocal Agreement between the County and a city, the property shall be subject to the subdivision regulations of that city. SECTION 12-2 PERMITTED USES In the Residential District the following uses are permitted: 1. Single-family detached dwellings: All single-family residences shall be constructed in accordance with all County-adopted building-related codes. Single-family dwellings shall include residential-design manufactured homes but shall not include other manufactured homes, mobile homes or trailers. 2. Duplexes: All duplexes shall be constructed in accordance with all County-adopted building-related codes. 3. Public parks, playgrounds, community centers, schools, public libraries, and museums. -1

2 4. Churches and parish halls, temples, convents and monasteries. 5. A business, profession, or trade conducted as a home occupation subject to the conditions and standards established at Section for home occupations in the PRD-A District. SECTION 12-3 CONDITIONAL USES The following conditional uses may be approved by the County Board, for location within the R District, upon application by the owner or the County, and consideration and action all in accordance with the provisions of Article 21 of these regulations. 1. Preschool nurseries, day-care centers or day-care homes, unless otherwise allowed by these regulations; provided: A. The applicant shall submit, as a part of the application, the plans for the proposed facility; giving the type of services to be rendered, the maximum number of children allowed at a facility, the number of staff to be employed, the hours of operation and any other information that will help in determining the extent of services to be provided. B. A letter from the Butler County Health Department Director shall be submitted by the applicant, giving the current status of the applicant s state license to operate the proposed facility and listing all requirements yet to be met in order for the proposed facility to be granted authorization to begin its operation. C. The following requirements shall be provided and sufficient information provided to assure their being met: (1) Off-street parking at a rate of one (1) space per employee plus two (2) additional spaces for guests. (2) Adequate potable water supply sufficient for both domestic and fire protection service. D. A site plan shall be submitted showing the lot, location of all buildings, location of play-ground facilities, location of all off-street parking, location of all utility lines serving the facility, location of septic system if necessary, and any other information that may be relevant. 2. Multi-family dwellings that create a density of 4.0 dwelling units per acre or greater may be allowed as a conditional use, upon the filing of a development plan in accordance with Article 20 of these regulations. 3. Public utility stations, as well as buildings, structures, and premises for public utility services or public service corporations established after the effective date of these regulations. Public utility stations, buildings, structures or premises established prior to the effective date of these regulations shall be considered to be a nonconforming use. -2

3 SECTION 12-4 DEVELOPMENT STANDARDS STANDARDS: The following standards shall apply to any permitted or conditional use within the Residential District: 1. All single-family residential structures and duplexes in the Residential District shall have a roof eave overhang of not less than 18 inches and a roof pitch of not less than three vertical inches for each 12 horizontal inches. 2. Manufactured Housing: A residential-design manufactured home, as defined by these regulations and meeting the following architectural aesthetic design standards, shall be considered a single-family detached dwelling: a. The roof shall be covered with material that is customarily used on site-built dwellings, including but not limited to approved wood, asphalt composition shingles, or fiberglass, but excluding corrugated aluminum, corrugated fiberglass, or metal roof. b. Exterior siding shall be of a material customarily used on site-built dwellings, which does not have a high gloss finish, such as wood, composition, simulated wood, clapboards, conventional vinyl or metal siding, brick, stucco, or similar materials, but excluding smooth, ribbed or corrugated metal or plastic panels. Siding materials shall extend below the top of the exterior of the foundation or curtain wall or the joint between siding. c. At the main entrance door there shall be a landing that meets the minimum of size and construction standards of County-adopted building codes. d. All manufactured home running gear, tongues, axles, and wheels must be removed at the time of installation of the home on the lot. e. The finished floor of the residential-design manufactured home shall be a maximum of 24 inches above the exterior finish grade of the lot on which it is located, as measured at the main entrance into the dwelling. SECTION 12-5 PARKING REGULATIONS Two (2) off-street parking spaces shall be provided for each dwelling unit. Garages shall be constructed of material similar to the dwelling or residence which it serves, and shall be located within fifty (50) feet of the dwelling unit Additional parking requirements are contained in Article 24 of these Zoning Regulations. SECTION 12-6 SIGN REGULATIONS The following signs shall be allowed by permit in the Residential District: 1. One (1) non-illuminated sign per residence or building under construction, not more than -3

4 sixty-four (64) square feet in area showing the name of the architects, engineers, builders or contractors, provided that said sign shall be removed within ten (10) days of project completion. 2. On churches, schools, and other types of buildings and uses allowed in this district as a permitted or conditional use, one (1) non-illuminated, indirectly illuminated, internally illuminated monument sign, which shall not exceed five feet (5 ) in height, and not more than forty (40) square feet in area, naming the organization and indicating the activities and/or services therein provided, and/or one (1) non-illuminated wall sign with only the name of the organization, not to exceed fifteen (15) square feet in area. 3. One (1) non-illuminated home occupation sign per property lot, to be attached to the principal structure, provided said sign shall not exceed six (6) square feet in area; and further provided that the home occupation is permitted as provided for in this Article Additional sign regulations are contained in Article 25 of these Zoning Regulations. SECTION 12-7 HEIGHT, AREA, YARD AND OPEN SPACE REGULATIONS Height: Buildings or structures shall not exceed thirty-five feet (35') and/or two and onehalf (2½) stories in height Front Yard: The depth of the front yard shall be at least thirty feet (30') Side Yard: There shall be a side yard of at least fifteen feet (15') on each side of a dwelling Rear Yard: The depth of the rear yard shall be at least twenty feet (20') Lot Dimensions: The minimum width of a lot shall be one hundred feet (100'). Lots fronting a cul-de-sac with a sixty foot (60') radius may have a width at the front lot line of not less than sixty feet (60') fronting upon a public street. The minimum depth of a lot shall be one hundred fifty feet (150') Lot Area Per Dwelling: Every residential structure shall provide a minimum lot area of 21,780 square feet (1/2 acre), and a maximum lot area of 108,900 square feet (2 ½ acre). For purposes of this requirement a duplex is one residential structure. Lot area for multi-family structures shall be as provided in the approved development plan. SECTION 12-8 INFRASTRUCTURE REQUIREMENTS In the Residential District no building shall be hereafter erected or altered unless : (a) such is otherwise provided for in these regulations; and (b) the following public services are available: 1. Water: Water available for domestic use shall only be provided by a rural water district or incorporated city or other water supply system when approved by the County Board. The lot -4

5 owner shall provide written proof of the adequacy and availability of the water supply from any applicable rural water district or city extending service to the lot. 2. Street and Roads: All new roads providing access to the subdivision must be paved and intersect with an existing paved public road, consistent with Butler County construction standards. 3. Sewage: All sewage collection and treatment facilities shall be in compliance with the Butler County Sanitation Code. All buildings used for residential purposes shall be connected to and utilize a public sewage disposal system. No such building shall connect to or utilize any private sewage disposal system. 4. Fire Protection: Information as to (a) street and road layout, (b) points of ingress and egress to the development and each lot therein, and (c) adequacy of the planned water supply system and/or surface water features for firefighting purposes shall be provided to the rural fire district within which the proposed development is located and the fire chief of the city which the Growth Area adjoins, if the subdivision is located in whole or part within such a Growth Area. The fire chief(s) shall review the information provided and require any alternations or improvements which, in the chief's discretion, are necessary to protect lives and property within the development. 5. Variances Not Allowed: No variances from the standards for infrastructure requirements contained in this Section shall be granted by the Board of Zoning Appeals under Article 26 of these regulations other than variances relating to streets and roads. -5
