11 STONYBROOK LOT RESERVATION AGREEMENT As of today's date and time, the following parties agree to place lot # Stonybrook on reservation for a period of days, until (month/day/year). This lot is being reserved to allow buyer time to secure house plans and builder time to bid and present bid to buyers. BUYERS: agree to the following: 1) Buyer must tender a reservation fee of $2,500 dollars to First American Title Company. This fee will be refundable if buyer decides not to proceed with the construction for any reason, with the exception of the cost of plans modifications and/or related engineering fees. If builder and buyer(s) choose to have plans modified or drawn to buyer s specifications prior to a Construction Agreement and/or Buy-Sell Agreement being executed, builder reserves the right to withhold a portion or all of the reservation funds. (Release shall be in writing by all parties). Developing of new plans with require a Plans Development Agreement to be executed. In the event the buyer does enter in to a Construction Agreement and/or Buy-Sell Agreement, credit will be given to the buyer for the lot reservation fee towards the final purchase price. This fee will be transferred to earnest money at the time the Buy Sell Agreement is signed. 2) Meet with listing agent, Carroll Anne Sowerby, and/or Edgell Building, Inc. to discuss general project goals, budgets, plan design, and financing. 3) Edgell Building, Inc. will prepare cost of construction figures specific to the above reserved lot and the house plan described as: Buyer is aware that the style of house plan chosen, as well as selections in design, layout, amenities, and finishes will greatly affect the per square foot cost to build. Additionally, buyer understands any plans other than those offered will be subject to a design fee and engineering fee. This fee will be plan specific. Buyer's desired price range, including the lot and home to be constructed is $ to $. Minimum Price Maximum Price 4) Edgell Building: To provide a bid from the completed set of plans. This is an estimate to date of the buyers needs and wants. The final purchase price will reflect any alterations to these estimates relating to square footage, building materials, changes or alterations in floor plans, etc.. These selections will be made throughout a series of future meetings and the construction agreement will be generated and attached to the standard Buy-Sell Agreement. All documents are to be signed prior to the expiration of this reservation date. 5) Buyer to, prior to beginning of construction, secure their own construction and end financing unless otherwise agreed to.
