1 ORDINANCE NO. An ordinance amending Section of the Los Angeles Municipal Code by amending the zoning map. THE PEOPLE OF THE CITY OF LOS ANGELES DO ORDAIN AS FOLLOWS: Section. Section of the Los Angeles municipal Code is hereby amended by changing the zone classifications of property shown upon a portion of the Zoning Map incorporated therein and made a part of Article 2, Chapter 1 of the LAMC, so that such portion of the Zoning Map shall conform to the zoning on the map attached hereto and incorporated herein by this reference.

4 CPC GPA-ZC-HD-DB-SPR Q-1 (as approved by PLUM 2/2/16) REVISED (Q) QUALIFIED CONDITIONS OF APPROVAL Pursuant to Section G of the Municipal Code, the following limitations are hereby imposed upon the use of the subject property, subject to the Q Qualified classification. A. Entitlement Conditions 1. Site Plan. The use and development of the property shall be in substantial conformance with the Plot plan and elevations submitted with the application and marked Exhibit B, dated September 24, 2015, and attached to the administrative file. Prior to the issuance of building permits, revised, detailed development plans that show compliance with all conditions of approval, including complete landscape and irrigation plans, shall be submitted to the City Planning Department for review. 2. Use. Use of the subject property shall be limited to the use and area provisions of the R4 zone, permitting a residential development. 3. Height. The majority of the building shall be limited to a height of 85 feet, as defined by Los Angeles Municipal Code (LAMC) Section and allowed per LAMC Section Any structures on the roof, such as air condition units and other equipment, shall be fully screened from view of any abutting properties. 4. Floor Area Ratio (FAR). The total floor area of the structure on the property shall not exceed 6:1 times the buildable area of the lot. 5. Yards/Setback. The project shall provide 12 feet in lieu of 15 feet for the required front yard. The project shall provide 15 3 feet in lieu of 19 feet for the required rear yard. The side yards shall be provided pursuant to LAMC C Residential Density. The project shall be limited to a maximum density of 72 residential units including Density Bonus Units. 7. Affordable Units. A minimum of six (6) units, that is, 11% of the 53 base dwelling units, shall be reserved as affordable units, as defined by the State Density Bonus Law (C)(2). 8. Change in Restricted Units. Deviations that increase the number of restricted affordable units or that change the composition of units or change parking numbers shall be consistent with LAMC Section A.25 (9a-d). 9. Housing Requirements. Prior to issuance of a building permit, the owner shall execute a covenant to the satisfaction of the Los Angeles Housing and Community Investment Department (HCIDLA) to make six (6) units available to Very-Low Income Households, for sale or rental as determined to be affordable to such households by HCIDLA for a period of 55 years. Enforcement of the terms of said covenant shall be the responsibility of HCIDLA. The applicant will present a copy of the recorded covenant to the Department of City Planning for inclusion in this file. The project shall comply with any monitoring requirements established by the HCIDLA. Refer to the Density Bonus Legislation Background section of this determination.

Vehicle parking shall be provided consistent with LAMC A.25, Parking Option 1, which permits one on-site parking space for each residential unit with one or fewer bedrooms; two on-site parking spaces for each residential unit with two to three bedrooms; and two-and-one-half parking spaces for each residential unit with four or more bedrooms. Based upon the number and type of dwelling units proposed, a minimum of automobile parking spaces shall be provided. The project shall provide 20% of the required vehicle parking with electric vehicle conduits. 11. Adjustment of Parking. In the event that the number of Restricted Affordable Units should change, or the composition of such units should change (i.e. the number of bedrooms, or the number of units made available to Senior Citizens and/or Disabled Persons), and no other Condition of Approval is affected, then no modification of this determination shall be necessary, and the number of parking spaces shall be recalculated by the Department of Building and Safety based upon the ratios set forth above. 12. Bicycle Parking. Bicycle parking shall be provided consistent with LAMC A. 16. Long-term bicycle parking shall be provided at a rate of one per dwelling unit or guest room. Additionally, short-term bicycle parking shall be provided at a rate of one per ten dwelling units or guest rooms, with a minimum of two short-term bicycle parking spaces. Based upon the number of dwelling units, a minimum of 72 long-term and 8 short-term bicycle parking spaces shall be provided onsite. 13. Open Space. The project shall provide 8,231 8,384 square feet of common open space areas as follows: a. Rear Yards. The rear yards shall include a total of 1, square feet of landscaped and paved open space areas that are accessible to residents, with amenities such as seating areas, trash cans, and lighting. b. Pool/Patio. The second floor pool and patio that is open to the sky shall include a total of 1,205 1,441 square feet of open space areas. c. Clubhouse/Gymnasium. The project shall provide a clubhouse and gymnasium that is a minimum of 1,448 square feet. d. Roof Deck. The project shall provide a roof deck on the seventh floor that is a minimum of 1,488 square feet. e. Private Balconies. The project shall provide approximately 61 balconies that each measure 50 square feet, for a minimum total of 3,050 square feet. 14. Landscaping. All open areas not used for buildings, driveways, parking areas, recreational facilities or walks shall be attractively landscaped, including an automatic irrigation system, and maintained in accordance with a landscape plan prepared by a licensed landscape architect or licensed architect, and submitted for approval to the Department of City Planning. The landscape plan shall indicate landscape points for the project equivalent to 10% more than otherwise required by LAMC and Landscape Ordinance Guidelines O. 15. Mechanical Equipment. All mechanical equipment on the roof shall be screened from view. The transformer, located in the front yard, shall be screened with landscaping B. Environmental Conditions 16. Aesthetics (Light) Outdoor lighting shall be designed and installed with shielding, such that the light source cannot be seen from adjacent residential properties or the public right-of-way.

The exterior of the proposed structure shall be constructed of materials such as, but not limited to, high-performance and/or non-reflective tinted glass (no mirror-like tints or films) and pre-cast concrete or fabricated wall surfaces to minimize glare and reflected heat. 18. Construction Equipment and Fugitive Dust. All construction equipment shall be equipped with Tier 3 diesel engines or better. The applicant shall apply water every 3 hours to disturbed areas within a construction site. On-site vehicle speeds on unpaved roads shall be limited to 15 mph by radar enforcement. All trucks hauling dirt, sand, soil, or other loose materials shall be tarped with a fabric cover and maintain a freeboard height of 12 inches. 19. Tree Removal (Non-Protected Trees). Prior to the issuance of any permit, a plot plan shall be prepared indicating the location, size, type, and general condition of all existing trees on the site and within the adjacent public right(s)-of-way. All significant (8-inch or greater trunk diameter, or cumulative trunk diameter if multitrunked, as measured 54 inches above the ground) non-protected trees on the site proposed for removal shall be replaced at a 1:1 ratio with a minimum 24-inch box tree. Net, new trees, located within the parkway of the adjacent public right(s)-ofway, may be counted toward replacement tree requirements. Removal or planting of any tree in the public right-of-way requires approval of the Board of Public Works. Contact Urban Forestry Division at: All trees in the public right-of-way shall be provided per the current standards of the Urban Forestry Division the Department of Public Works, Bureau of Street Services. 20. Tree Removal (Public Right-of-Way). The required Tree Report shall include the location, size, type, and condition of all existing trees in the adjacent public right-of-way and shall be submitted for review and approval by the Urban Forestry Division of the Bureau of Street Services, Department of Public Works ( ). The plan shall contain measures recommended by the tree expert for the preservation of as many trees as possible. Mitigation measures such as replacement by a minimum of 24-inch box trees in the parkway and on the site, on a 1:1 basis, shall be required for the unavoidable loss of significant (8-inch or greater trunk diameter, or cumulative trunk diameter if multi-trunked, as measured 54 inches above the ground) trees in the public right-of-way. All trees in the public right-of-way shall be provided per the current Urban Forestry Division standards. 21. Green House Gas Emissions. Only low- and non-voc-containing paints, sealants, adhesives, and solvents shall be utilized in the construction of the project. 22. Emergency Evacuation Plan (Building over 75 feet in height). Prior to the issuance of a building permit, the applicant shall develop an emergency response plan in consultation with the Fire Department. The emergency response

7 CPC GPA-ZC-HD-DB-SPR Q-4 plan shall include but not be limited to the following: mapping of emergency exits, evacuation routes for vehicles and pedestrians, location of nearest hospitals, and fire departments. 23. Increased Noise Levels (Demolition, Grading, and Construction Activities). The project shall comply with the City of Los Angeles Noise Ordinance No. 144,331 and 161,574, and any subsequent ordinances, which prohibit the emission or creation of noise beyond certain levels at adjacent uses unless technically infeasible. Construction and demolition shall be restricted to the hours of 7:00 am to 6:00 pm Monday through Friday, and 8:00 am to 6:00 pm on Saturday. Demolition and construction activities shall be scheduled so as to avoid operating several pieces of equipment simultaneously, which causes high noise levels. The project contractor shall use power construction equipment with state-of-the-art noise shielding and muffling devices. 24. Public Services (Police - Demolition/Construction Sites). Fences shall be constructed around the site to minimize trespassing, vandalism, shortcut attractions and attractive nuisances.

The City Clerk shall certify to the passage of this ordinance and have it published in accordance with Council policy, either in the daily newspaper circulated in the City of Los Angeles or by posting for ten days in three public places in the City of Los Angeles: one copy on the bulletin board located at the Main Street entrance to City Hall; one copy on the bulletin board located at the ground level at the First Street entrance to the Los Angeles Police Department; and one copy on the bulletin board located at the Temple entrance to the Los Angeles County Hall of Records.
