NOVEMBER 2010 is FAST APPROACHING Infrastructure owners (Owners) and other OPS users are asked to visit the OPS website at In the News and Activities area, there is a notice and an update regarding the renumbering of several specifications. The notice will provide you with information regarding: Three Divisions in OPS Volumes 1, 5, and 7 being reallocated Specifications within OPS Volume 1 Divisions being moved (relocated) ACCESSING AND OBTAINING ONTARIO PROVINCIAL STANDARDS The Ontario Provincial Standards for Roads and Public Works (OPS) manuals and the latest published updates for each of the eight OPS manuals are available as follows: Available electronically on the OPS/MTO website. Online access to the current, updated, and archived standards; indexes; OPS User Notes; and publication Revision Information Sheets are available free of charge at the site. ( Rev. 2 Hard-copy format available from Publications Ontario by telephone at or online. Updates and OPS manuals are available for a cost-recovery fee. ( The eight OPS manuals of standards are available on one CD in PDF format. The OPS drawings published in Volumes 3 and 4 are available in AutoCAD format on a separate CD. These CDs are available from Publications Ontario or by telephone at or online for a costrecovery fee. The updates are not available on CDs as an update package. ( At the Publications Ontario web page, you can type Ontario Provincial Standards, OPS, OPSS, or OPSD in the search box, and all related products for the Ontario Provincial Standards will be listed, click on the item you wish to purchase, add the item to your cart, then follow the instructions to complete your order. If trying to order an OPS product online from Publications Ontario and it is shown as Out of Stock, you can backorder the product by telephone at In order to receive the Municipal Engineers Association (MEA) purchase price, MEA members should visit the MEA website ( for the MEA Publications Ontario order form for hardcopy manuals and CDs. YOU SHOULD REGISTER YOUR OPS MANUALS AND CDs Users of OPS do not receive notices of OPS updates as they had in the past. Methods of notification from Publications Ontario for the future are being investigated, and you will be informed of them as they become available. In the interim, an will be sent to OPS users who have registered their OPS manuals and CDs with OPS. Owners of OPS manuals, who have not yet done so, are requested to register their OPS hard-copy manuals and CDs with Marg Gordon. 4 SUMMARY OF REVISIONS TO OPSS.PROV 100 MTO GENERAL CONDITIONS OF CONTRACT The following is an overview at a concept level of the changes to the MTO General Conditions of Contract. There have been many changes to the document both conceptual, technical, and format. Also, many MTO Standard Special Provisions have been incorporated. This listing should not be relied upon as comprehensive in any way, it is provided simply as an indicator of the major changes to the MTO General Conditions of Contract. The final document should be referred to in all cases for the contract requirements. Section 1 Subsection GC 1.07, Definitions, definitions for Abnormal Weather, Claim, Contract Completion, Contractor s Intellectual Property, Inclement Weather, Intellectual Property, Newly Created, Intellectual Property, Record Drawings, Release from Warranty Certificate, and Standard added. Definitions Contract Completion Certificate, Incident, Addendum, Agreement, Change Proposal, Construction Signs, Contract Documents, Controlling Operation, Cut-off Date, CVOR Abstract, Daily Work Records, Hand Tools, Major Item, Owner, Pavement, Quantity Sheet, Roadbed, Shoulder, Special Provision, Standard Specification, Subcontractor, Time and Material, Working Day, and Working Drawings. Section 3 Where CA approval required for Working Drawings must be done in 5 business days. Added a clause to establish/determine if weather conditions are abnormal. Added a clause to specify the amount of Head Office Overhead to be paid for approved Extensions of Time. Incorporated SP 100S57 dealing with Contract Administrator s Authority. Detailed that Consent to Sublet required when more than 50% of work of item is subcontracted. Deleted Extra Work ; it is included with Change in the Work. Moved the provisions dealing with staging changes to this section. Added Intellectual Property language. Moved the Change Proposal Payment language from Section 8 to this section. Incorporated SP 100S55 Claims SP with some changes. Introduced the Request for Clarification document for a wide range of uses and to establish the date on when an issue may become a claim. Contract Administrator within 75 days of submission of Request for Clarification must respond, called the Final Site Response. Relocated clauses for keeping of Daily Work Records to Section 8. Section 6 Removed all language for Aircraft and Watercraft, Property and Boiler and Contactor s Equipment. Modified the language for Commercial General Liability Insurance. Section 7 Incorporated SP 543S02 for sign diary. Modified the scheduling language to clearly require electronic schedules that can be read by scheduling software. Incorporated SP 100S56 for Dust Control. Incorporated SP 100S52 Public Ceremony. Modified CVOR requirements so subcontractors can submit a plan. Created a process for roadway and detour maintenance for seasonal shutdown or start-up. Added requirements for Record Drawings. Incorporated SP 100S54 Environmental Incident Management. Clarified requirements for General Warranty showing defects in design or specifications. Allowed start of General Warranty for major work components. Section 8 Clarified requirements for submission of signed paid invoices for advance material payment. Requirements for a CA to create a deficiency list at Substantial Performance everything on the list, including defects in work yet to be completed must be done to obtain Completion. Any defects in work that was substantially complete and not on the list must be repaired within 60 days of contract completion. Daily Work Records clarified requirements for signing Daily Work Records and noting disagreements. Incorporated SP 100S53 -latest fuel price with some further changes. Requirement for submission of outstanding test results, record drawings, manuals etc, within 20 days of Certificate of Completion otherwise Liquidated damages of $400 per calendar day. Rev. 6 SUMMARY OF REVISIONS TO OPSS.PROV 904 CONSTRUCTION SPECIFICATION FOR CONCRETE STRUCTURES The provincial version of OPSS 904, dated November 2008, has been published in OPS Volume 5 as OPSS.PROV 904, dated April 2010, mainly for MTO use. It is different from the municipal version, OPSS.MUNI 904 in OPS Volume 7. Although OPSS.PROV 904 is based on OPSS 904, several revisions have been made to the technical information. It is recommended that users read the entire specification to become familiar with the differences. Below is a summary of the revisions: Section , Definitions, Dowel, Dowel Type, and Pull Test deleted. High Performance Concrete and Structures revised. Existing clause moved to , revised, and renamed. Existing clause revised and reordered. New clause added. Subsection , Approach Slab Seat and Ballast Wall Elastomers, revised.
