4 STANDARD SPECIFICATION SECTION FOR INFORMATION TO TENDERERS PAGE 2 MUNICIPAL SERVICES JANUARY Tender Opening.1 Tenders will be opened on Friday November 30, 2018, 2:05p.m. at 46 Municipal Drive, Pictou. Opening will be public. 4. Document.1 There is no fee for Project Documents. 5. Accuracy of.1 Indexing and cross-referencing are for convenience Referencing only. 6. Conditions of.1 Take full cognizance of content of all Contract Tendering Documents in preparation of tender. Refer to Section Tender Form, Subsection 3.9 for a complete list of Contract Documents. 7. Tenderers to.1 Tenderers will be deemed to have familiarized Investigate themselves with existing site and working conditions and all other conditions which may affect performance of the Contract. No plea of ignorance of such conditions as a result of failure to make all necessary examinations will be accepted as a basis for any claims for extra compensation or an extension of time. 8. Clarification.1 Notify Engineer not less than two (2) working days and Addenda before tender closing of omissions, errors or ambiguities found in Contract Documents. If Engineer considers that correction, explanation or interpretation is necessary, a written addendum will be issued. All addenda will form part of Contract Documents..2 Confirm in the tender form that all addenda have been received. 8 STANDARD SPECIFICATION SECTION FOR TENDER FORM PAGE 2 MUNICIPAL SERVICES JANUARY To provide evidence of ability and experience within five (5) working days of request, including: experience in similar work, work currently under contract, senior supervisory staff available for the project, equipment available for use on the Work, and financial resources..6 To execute in triplicate the Form of Agreement and forward same together with the specified contract security and insurance documents to the Owner within ten (10) working days of written notice of award..7 That failure to provide post-tender submission documents or failure to enter into a formal contract and provide specified insurance documents and contract security within time required will constitute grounds for forfeiture of tender security..8 That the rule shall apply to the hiring of local trucks and shall apply to all material being moved. At least 80% of the trucks hired on Municipality of Pictou County contracts shall be private trucks hired, on a rotational basis, through the Pictou County Truckers Association so that all trucks in the area shall receive relatively equal amount of work. 12 STANDARD SPECIFICATION SECTION FOR FORM OF AGREEMENT PAGE 1 MUNICIPAL SERVICES JANUARY 2018 This Agreement made on the day of in the year BY AND BETWEEN MUNICIPALITY OF PICTOU COUNTY hereinafter called the "Owner" and hereinafter called the "Contractor" The Owner and the Contractor agree as follows: ARTICLE A1 - THE WORK The Contractor shall:.1 Perform the Work required by the Contract Documents for LINACY SCHOOL DEMOLITION, PROJECT #PC located at_linacy, PICTOU COUNTY for which the Agreement has been signed by the parties, and for which Ebon MacMillan, P.Eng. (Insert above the name of the Engineer) is acting as and is hereinafter called the Engineer and.2 do and fulfill everything indicated by this Agreement, and.3 commence the Work by the day of in the year and attain Substantial Performance of the work as certified by the Engineer by the day of in the Year. ARTICLE A2 AGREEMENTS AND AMENDMENTS This Contract supersedes all prior negotiations, representations or agreements, either written or oral, relating in any manner to the work, including the bidding documents that are not expressly listed in Article A3 of the Agreement.

14 STANDARD SPECIFICATION SECTION FOR FORM OF AGREEMENT PAGE 3 MUNICIPAL SERVICES JANUARY For each lump sum item, multiply the percent complete by the value of the lump sum item..4 The total value of work completed for the payment period shall be calculated by adding the total of the products for all pay items from 3.2 and 3.3 of this Article..5 The amount of the monthly payment shall be determined by deducting the 10% holdback and the total of all previous payments from the total value of such completed work as determined under 3.4 of this Article..6 To the amount calculated above, the Harmonized Tax will be added..4 The last day of the payment period shall be the last of the month..5 Upon Substantial Performance of the Work as certified by the Engineer the Owner shall pay to the Contractor the holdback monies then due in accordance with the provisions of Section General Conditions, subsection GC5.8 PAYMENT OF HOLDBACK UPON SUBSTANTIAL PERFORMANCE OF THE WORK..6 Upon the issuance of the final certificate for payment as certified by the Engineer, the Owner shall pay to the Contractor the balance of monies then due in accordance with the provision of Section General Conditions, subsection GC5.10 FINAL PAYMENT..7 In the event of loss or damage occurring where payment becomes due under the property and boiler insurance policies, payment shall be made to the Contractor in accordance with the provisions of Section General Conditions, subsection GC INSURANCE..8 If the Owner fails to make payment to the Contractor as it becomes due under the terms of the Contract, interest shall be payable as follows:.1 The annual interest rate applicable to the contract is 2% compounded semi-annually..2 Interest shall be calculated on the overdue balance from the due date. ARTICLE A6 - RECEIPT OF AND ADDRESSES FOR NOTICES IN WRITING.1 Notices in writing will be addressed to the recipient at the address set out below..2 The delivery of a notice in writing will be by hand, by courier, by prepaid first class mail, by facsimile or during the

15 STANDARD SPECIFICATION SECTION FOR FORM OF AGREEMENT PAGE 4 MUNICIPAL SERVICES JANUARY 2018 transmission of which no indication of failure of receipt is communicated to the sender..3 A notice in writing delivered by one party in accordance with this Contract will be deemed to have been received by the other party on the date of delivery if delivered by hand or courier, or if sent by mail it shall be deemed to have been received five (5) working days after the date on which it was mailed..4 A notice in writing sent by facsimile or shall be deemed to have been received on the date of its transmission provided that if such day is not a Working Day or if it is received after the end of normal business hours at the place of receipt on the date of its transmission, then it shall be deemed to have been received at the opening of business at the place of receipt on the first Working Day next following the transmission thereof..5 An address for a party may be changed by notice in writing setting out the new address delivered to the other party in accordance with this Article..1 The Owner at 46 Municipal Drive.2 The Contractor at P.O. 16 STANDARD SPECIFICATION SECTION FOR FORM OF AGREEMENT PAGE 5 MUNICIPAL SERVICES JANUARY 2018 ARTICLE A8 - SUCCESSION The aforesaid Contract Documents are to be read into and form part of the Agreement and the whole shall constitute the Contract between the parties and subject to law and the provisions of the Contract Documents shall inure to the benefit of and be binding upon the parties hereto, their respective heirs, legal representatives, successors and assigns. ARTICLE A9 - RIGHTS AND REMEDIES No action or failure to act by the Owner, Engineer, or Contractor shall constitute a waiver of any right or duty afforded any of them under the Contract, nor shall any such action or failure to act constitute an approval of or acquiescence in any breach thereunder, except as may be specifically agreed in writing. ARTICLE A10 - TIME Time shall be construed as being the essence of the Contract.

18 Linacy School Demolition Supplementary Specifications Page 1 Project # MPC November 2018 INTENT OF THE SUPPLEMENTARY SPECIFICATIONS.1 Construct the Work of this Contract in accordance with the Standard Specifications for Municipal Services 2018 revision) as developed and published by the Nova Scotia Road Builders Association and the Consulting Engineers of Nova Scotia Joint Committee on Contract Documents, except as modified herein..2 These Supplementary Specifications modify the specifications to which they refer..3 The Supplementary Specifications take precedence over the Specifications to which they refer. SECTION GENERAL CONDITIONS Page 31, GC 11.2 Contract Security, after clause , add the following: The Contractor shall, prior to commencement of the Work, provide to the Owner a Performance Bond and a Labour and Materials Bond, each in the amount of 50% of the Total Amount Payable. The Contract Security will be retained until the expiration of the Warranty Period. SECTION GENERAL REQUIREMENTS Page 1, delete clause 2.1 in its entirety and replace with the following: 2. Summary of Work.1 The project is located in Linacy, Pictou County, at 7 Willow Lane. The Work can be described as follows:.1 Demolition of the former Linacy School located at 7 Willow Lane, Linacy, Pictou County. Total building area approximately 665 m 2. Structure composed of structural steel, concrete and wood. Exterior cladding plaster, wood and masonry. Owner to obtain Demolition Permit. C&D materials to be disposed of at Pictou County Solid Waste, Mount William. Tipping fees to be paid by the owner. Hazardous materials, as detailed in Pinchin LeBlanc Hazardous Building Materials Assessment, April 26, 2018, to be disposed of as per specifications. Clean concrete and brick may be used as backfill at the site; maximum dimension of 300mm in any direction. Site to be left level, topped with 100mm of topsoil and hydroseeded.

Before the work of the contract begins the Engineer will provide sufficient reference points to identify the site on the ground, on a one-time only basis. Each bag must be independently sealed..7 Respiratory Protection: NIOSH approved air purifying half-mask respirator with either P- 100 particulate filters for mists, dusts and fumes when working with silica and lead, or mercury absorbing cartridges when working with mercury..8 Protective Clothing: Disposable type protective clothing that does not readily retain or permit penetration of hazardous material encountered. Protective clothing to be provided by the employer and consist of a head covering and full body covering that fits snugly at the ankles, wrists and neck, in order to prevent hazardous material from reaching the garments and skin under the protective clothing. Part 3 Execution 3.1 GENERAL.1 The Work Area is to be restricted only to authorized, trained, and protected personnel when handling hazardous materials..2 Workers shall not eat, drink, chew or smoke in the Work Area..3 Compressed air or dry sweeping cleaning methods are not to be used..4 Site Preparation:.1 Signs should be posted in sufficient numbers to warn of the hazard. The signs should display the hazard type (i.e. mercury, lead, or silica), restriction of the Work Area to authorized personnel only, and that respirators must be worn in the Work Area..2 Drop sheets of FR polyethylene shall be placed directly below the work to control fallen materials..3 Washing facilities consisting of a wash basin, clean water, soap and towels must be provided near the Work Area. Part 3 Execution 3.1 SUPERVISION.1 Approved Supervisor must remain within Work Area during disturbance, removal, or other handling of lead-containing paints. 3.2 PREPARATION.1 Work Area:.1 Create an enclosure by constructing framing around the Work Area that extends from the building a minimum of 6 feet. The frame is to be covered with, at a minimum, polyethylene sheeting sealed with tape on the walls and ceiling FR polyethylene on the ground..2 Build airlocks at entrances and exits from Work Areas to ensure Work Areas are always closed off by one curtained doorway when workers enter or exit..3 At point of access to Work Areas install warning signs in both official languages in upper case "Helvetica Medium" letters reading as follows where number in parentheses indicates font size to be used: CAUTION LEAD HAZARD AREA (25 mm). NO UNAUTHORIZED ENTRY (19 mm). WEAR ASSIGNED PROTECTIVE EQUIPMENT AND RESPIRATOR (19 mm). Install mirror to permit workers to fit respiratory equipment properly..3 Construction of Decontamination Enclosures:.1 Construct framing for decontamination enclosure. Line decontamination enclosure with polyethylene sheeting and seal with tape, apply FR polyethylene on floor..2 Construct curtain doorways between enclosures so when people move through, or waste containers and equipment are moved through doorway, one of two closures comprising doorway always remains closed..4 Separation of Work Areas from Occupied Areas.1 Separate parts of building required to remain in use from parts of building used for lead abatement by means of airtight barrier system..5 Maintenance of Enclosures:.1 Maintain enclosures in clean condition..2 Ensure barriers and polyethylene linings are effectively sealed and taped. Repair damaged barriers and remedy defects immediately..3 Visually inspect enclosures at beginning of each work day. 3.3 LEAD - CONTAINING PAINT ABATEMENT.1 Removal of lead-containing flaking paint to be performed by scraping or sanding using non-powered hand tools..2 Remove lead-containing flaking paint and store in appropriate waste containers for transport..3 Seal filled containers. Clean external surfaces thoroughly by wet sponging. Remove from immediate Work Area to Equipment and Access Room. Clean external surfaces thoroughly again by wet sponging and place in second means of containment before moving containers to Clean Room pending removal outside. Ensure containers are removed from Clean Room by workers who have entered from uncontaminated areas dressed in clean coveralls..4 After completion of stripping work, wire brush and wet sponge surface from which leadcontaining flaking paint has been removed to remove visible material. During this work keep surfaces wet..5 After wire brushing and wet sponging to remove visible lead-containing flaking paint, wet clean Work Area including Equipment and Access Room, and equipment used in process. After inspection by Designated Representative, apply continuous coat of slow drying sealer to surfaces. Do not disturb work for 8 hours with no entry, activity, ventilation or disturbance during this period.
