1 ADDENDUM NO. 1 September 12, 2017 ST. CHARLES COUNTY HEPPERMAN ROAD RECONSTRUCTION This Addendum No. 1 modifies original issued bid documents as follows: 1. MODIFICATIONS TO THE PROJECT BID SPECIFICATIONS: a) Replaces Pages P-5 through P-7 of the Project Specifications with Pages Addendum 1 P-5 though Addendum 1 P-7. b) Replacement Page Addendum 1 P-5 revises the following bid items: * Unsuitable Subgrade From No Unit Price to $35 per CY * This quantity is being revised to reflect the Standard Specifications, which govern the unit bid price for Unsuitable Subgrade. c) Replacement Page Addendum 1 P-6 revises the following bid items: ** Temporary Seeding From 1.0 ACRE to 3.0 ACRE ** This quantity is being revised to account for the possible wintering of the project once clearing is complete and utility relocation work is ongoing. d) Replacement Page Addendum 1 P-7 adds the acceptance check box for the Asphalt Cement Price Index. e) Revises Section D UTILITY COORDINATION of the Job Special Provisions on Page JSP-8. Delete Paragraphs 1.1 through 1.4 and replace with: 1.1 It is understood that CONTRACTOR may be unable to complete certain portions of the work due to utility conflicts, therefore additional calendar days have been built into the contract for that possibility. As a result, there shall be no additional days awarded for utility conflicts from Notice to Proceed through March 15, CONTRACTOR shall perform clearing for utilities immediately upon Notice to Proceed. Additionally, CONTRACTOR shall supply, at no additional cost, any necessary staking to facilitate the relocation of utilities. 1.3 Should a level of conflict arise beyond the limitations above whereby the utility relocation work requires a temporary suspension of work due to its impact on the CONTRACTOR S Addendum 1, dated September 12, 2017 Page 1 of 5

2 major operation of work, an adjustment of the contract time for completion of work will made by utilizing the weighted time table, only when said delay occurs after March 15, Suspensions of work will only be granted for conflicts present after March 15, Suspensions will be given where the utility conflicts are such that the CONTRACTOR S major operation is impacted enough to prevent reasonable progress. Reasonable effort to work around the conflict will have to be shown by the CONTRACTOR before any suspension of work will be considered by the ENGINEER. This Job Special Provision supercedes any conflicting language in the Project Specifications and Standard Specifications. f) Adds PRICE ADJUSTMENT FOR ASPHALT MATERIAL to the Job Special Provisions, as follows: PRICE ADJUSTMENT FOR ASPHALT MATERIAL Insert , subsequent section renumbered accordingly: MEASUREMENT AND PAYMENT Asphalt Cement Price Index. Adjustments will be made to the payments due the Contractor for any plant mix bituminous base, plant mix bituminous pavement, plant mix bituminous surface leveling, asphaltic concrete pavement and ultrathin bonded asphalt wearing surface that contains PG64-22, PG70-22 or PG76-22 when it has been determined that the monthly average price for the midpoint of the published prices of PG64-22 for St. Louis, Missouri area and Kansas City area has fluctuated from the monthly average price of the month the project was bid. The St. Louis, Missouri area and Kansas City area prices will be obtained from the Asphalt Weekly Monitor published by Poten & Partners Inc. The monthly base price will be the price from the last published Asphalt Weekly Monitor prior to MoDOT s monthly bid opening. The monthly base price, established prior to the monthly bid opening, shall apply to payment estimates for the following month The adjusted contract unit price will be applied to the actual amount of asphalt binder used by the Contractor for all asphalt items. The adjustment will be applied to projects that have a quantity of asphalt wet ton mix pay items or converted square yard quantity over 1000 tons. For projects that are paid for with square yard pay items, the adjustments will be made for applicable tons calculated based upon the plan square yard quantity and thickness converted to tons excluding the 1:1 wedge. The percentage of virgin asphalt as shown in the job mix formula, in accordance with Sec 401, Sec 403 and Sec 413, will be the basis for adjustments for any asphalt mix type placed on the project during the monthly index period. The effective asphalt obtained from the use of Recycled Asphalt Pavement (RAP) and/or Recycled Asphalt Shingles (RAS) will not be eligible for adjustment. The base price index for PG64-22 will be applied to the asphalt mix for mixes using PG64-22, PG70-22 or PG Basis of Payment To determine the adjustment for any material specified in this provision the following formula will be used. 3 A = (B x C) x (D-E) Where: A = Adjustment for mix placed during monthly average index period B = Tons of Mix Placed during the monthly average index period C = % of virgin asphalt binder as listed in the job mix formula in use D = monthly average price at time mix placement E = monthly average price at time of bid The engineer will make adjustment payments, as defined above, for the applicable work completed during each month except for projects on which the contractor is being charged liquidated damages, due to working beyond the project completion date, in accordance with Sec 108. In this case, the "D" value used for the price adjustment will be either the last "D" value prior to the date that liquidated damage assessment began or the current monthly "D" value, whichever is lower. If the contractor is being charged liquidated damages due to the contract being beyond the project completion date and the current months D value results in a deduction, then the current monthly "D" value will be used Optional This provision is optional. If the bidder wishes to be bound by this provision, the bidder shall execute the acceptance form in the Bid. Failure by the bidder to execute the acceptance form will be interpreted to mean election to not participate in the Asphalt Cement Price Index. If the Asphalt Cement Price Index is accepted, asphalt binder for the project will not be eligible for a material allowance as described in Sec ANSWERS TO CONTRACTOR QUESTIONS FOR CLARIFICATION: Q. Can a DGN or CAD file be sent so prospective contractors can calculate earthwork by stage? A. Any contractors wanting to receive an electronic file should a request to cbostic@sccmo.org. AutoCAD files will be provided by the County via . Q. Is plastic pipe an acceptable substitution to the reinforced concrete pipe noted in the plans and specs? A. Thermoplastic polypropylene (PP) pipe (SaniTite HP or equivalent) will be considered an acceptable substitution. PP pipe in diameter from 12 through 30 shall conform to ASTM F2736, and PP pipe over 30 to 60 diameter shall conform to ASTM F2764. PP shall have a minimum stiffness of 46 psi when tested in accordance with ASTM D2412. Pipes shall be jointed with a gasketed integral bell & spigot joint, and shall be watertight in accordance with the requirements of ASTM D3212. The spigot shall have two gaskets. Pipe shall be installed in accordance with ASTMD-2321 and the current construction specifications of MSD. If PP pipe is used in lieu of RCP, payment will be made at the unit price per linear foot for RCP noted on the bid form. Q. If there is a delay due to utilities, will the calendar day count be stopped while the contractor cannot work? A. The revised UTILITY COORDINATION Job Special Provision language above notes that the calendar day count will not be stopped from Notice to Proceed through March 15, After March 15 th, suspensions may be allowed in accordance with said revised JSP. 4 Q. It appears that the water and sanitary relocations are starting to take place. Do you know the status and schedule of all of the utility relocations for the project? A. The following is not warranted to be exact, but should provide a general summary. City of Wentzville is currently working on water and sewer relocations. Cuivre River and Laclede Gas are expected to start their relocations fairly soon. Ameren will begin work once staking has been completed. A schedule is not currently available for CenturyLink. Q. Will there be any items or work required of the County s contractor to assist in the utility relocations? A. Yes, at no direct pay. The Contractor will need to stake the right-of-way early in the project in order for Ameren to begin work. Other staking, such as drainage structures, may be required to facilitate other relocations. As noted in the Job Special Provisions, it is the contractor s responsibility to coordinate with utility companies, and that should be interpreted to include providing staking, clearing, grading and potentially other types of work to assist with their relocations. Q. Does the County expect any delays due to the utility relocations or can bidders expect to start work on Phase 1 once the Notice to Proceed is issued? A. Delays are anticipated. As noted in the Job Special Provisions, the calendar days were established with the understanding that the contractor might not be able to work due to utility delays. Work can begin on Phase 1 once the NTP is issued, with a particular emphasis on staking and clearing. Q. The pay item for Unclassified Excavation includes Rock or any kind of naturally occurring earth that the contractor may encounter. Without a geotechnical report, it is impossible for the contractor to estimate how much Rock Excavation we may or may not encounter. Is there the possibility for a negotiated price should the contractor encounter rock during grading operations? A. The Geotechnical Report will be made available in PDF format on the County website along with this addendum and the other bid documents. Regarding payment, per Section 203 of the Standard Specifications, there is no additional payment for Class C Excavation material when Unclassified Excavation is the basis for payment. Q. At the MSE wall near Sta 39+00, there is a visible rock outcropping. Wall excavation is not part of the Unclassified Excavation quantity and is incidental to the project. Will the contractor be compensated at the contingency price for Class C Excavation for rock excavation encountered behind the wall face? A. Yes. If Class C Excavation material is encountered in Class 3 Excavations, payment for that material will be made at the fixed unit price of $45 per cubic yard. Q. There currently is no Asphalt Cement Pricing Index clause in the contract to protect the owner and the contractor from asphalt price fluctuations which is very typical on such a large road project as this over 425 Calendar days.. A. This addendum includes the use of the Asphalt Cement Pricing Index on this project. Addendum 1, dated September 12, 2017 Page 4 of 5
