4 National Institute of Science Communication and Information Resources Dr. K.S.Krishnan Marg NEW DELHI NOTICE INVITING TENDER Tenders in two bid system i.e. EMD + Technical bid and Financial bid, Separately (in two envelops) are hereby invited for the following work from contractors of appropriate class of CPWD, Railway, MES, Post & Telegraph Department and/or from those who have worked out for CSIR or its laboratories/institutes and having: (i) Valid sales tax / TIN registration certificate (ii) Average Annual financial turnover during the last 3 years, ending 31 st March of the previous financial year, should be at least 30% of the estimated cost. And (iii) Experience of having successfully completed similar works during last 5 years ending last day of month previous to the one in which applications are invited should be either of the following:_ a). Three similar completed works costing not less than the amount equal to 40% of the estimated cost / or b). Two similar completed works costing not less than the amount equal to 50% of the estimated cost / or c). One similar completed work costing not less than the amount equal to 80% of the estimated cost. (The tenderers are required to attach proof of fulfilling these conditions while submitting the tender documents). 1. The Estimated Cost is Rs 1,10,900/- 2. Time for carrying out the work will be 15 days and the date of commencement shall be reckoned from the 10 th day of issue of award letter. 4. Complete Contract document to be complied with by the tenderer whose tender may be accepted can be seen at the NISCAIR Bookshop on request. 5. Tenders should be on the specified form (Non-transferable) which may be obtained from NISCAIR Bookshop, Dr. K.S. Krishnan Marg, Pusa, New Delhi during office hours upto 01/06/2007 on payment of Rs. 150/- (Rupees One hundred fifty only) by demand draft of a scheduled bank drawn in favour of Director, NISCAIR, New Delhi (Non-refundable). 6. Tenders should be submitted in Two separate sealed covers (Technical Bid & Financial bid) super-scribed with the name of the work, date and time of opening written both on the inner and outer envelopes. They will be received upto 3.00 P.M. on 04/06/2007 and Technical Bids will be opened on the same day at 3.30 PM on the same day in the presence of bidders if any. Tenders should be dropped in the tender box before the closing date and time indicated. 7. The Earnest Money amounting to Rs. 2200/- as demand draft or pay order of a scheduled bank and drawn in favour of Director NISCAIR, New Delhi, should accompany the tender in 4

5 technical bid envelope. Tenders received without earnest money will be invalid. 8. The Director, NISCAIR does not bind himself to accept the lowest or any tender and reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rates quoted. 9. Canvassing in connection with the tenders is prohibited and the tenders submitted by the contractor who resort to canvassing are liable for rejection. 10. The tenderers shall not be permitted to tender for works in the concerned unit of NISCAIR in which a relative is posted in the grade between Controller of Administration and Junior Engineer, (both inclusive). He shall also intimate the names of persons who are working with him in any capacity or subsequently employed by him and who are relatives as mentioned above. NOTE: A person shall be deemed to be a relative or another if, and only if, (a) they are members of a Hindu undivided family; or (b) they are husband and wife; or (c) the one is related to the other in the following manner: Father, Mother (including step mother), Son (including step son), Son s wife, Daughter s (including step daughter), Father s father, Son s son, Son s son s wife, Son s daughter, Son s daughter s husband, Daughter s husband, Daughter s son, Daughter s son s wife, Daughter s daughter, daughter s daughter s husband, Brother (including step brother), Brother s wife, Sister (including step sister), Sister s husband. 11. Tender submitted shall remain valid for 90 days from the date of opening for the purpose of acceptance and award of work, validity beyond 90 days from the date of opening shall be by mutual consent. 12. The tenderer shall quote rates both in figures and words. He shall also workout the amount for each item of work and write in both figures and words. On check if there are differences between the rates quoted by the tenderer in words and in figures or in the amount worked out by him, the following procedure shall be followed: i) When there is a difference between the rates in figures and in words, the rates which correspond to the amounts worked out by the tenderer shall be taken as correct. ii) iii) When the amount of an item is not worked out by the tenderer or it does not correspond with the rate written either in figures or in words, the rate quoted by the tenderer in words shall be taken as correct. When the rate quoted by the tenderer in figures and in words tallies but the amount is not worked out correctly the rate quoted by the tenderer shall be taken as correct and not the amount 13. The tenderer should see drawings and in case of doubt obtain required particulars, which 5

6 may in any way influence his tender from the Engineer as no claim whatsoever will be entertained for any alleged ignorance thereof. 14. Before tendering, the tenderer shall inspect the site to fully acquaint himself about the condition in regard to accessibility of site, nature and extent of ground, working condition of site and locality including stacking of materials, installations of tools and plants (T&P) etc., conditions affecting accommodations and movement of labour etc. required for the satisfactory execution of the work contract. No claim whatsoever on such account shall be entertained by the Employer in any circumstances. 15. Earnest money will be forfeited if the contractor fails to commence the work as per letter of award and he shall not be eligible for any claim. 16. Except writing rates and amount, the tenderer should not write any conditions or make any changes, additions, alterations and modifications in the printed form of tenders. Tenderers who are desirous to offer rebate the same should be brought out separately in the covering letter and submitted along with the tender. 17. Some of he provisions of General Conditions of Contract are given below. Interpretation however shall be as given in the General Conditions of Contract. (a) (b) (c) (d) DEFECTS LIABILITY PERIOD: 12 months from the date of completion as certified by the Director, NISCAIR. MINIMUM VALUE OF WORK FOR THE INTERMEDIATE CERTIFICATE: Rs. NIL (Rupees NIL) Intermediate certificate for a lesser amount can be admitted for payment at the discretion of the Engineer. SECURITY DEPOSIT: Security deposit shall be deducted from the bill at 10% of the total value of work done. which shall be released after defect liability and warrantee period is over. COMPENSATION: Contractor shall pay as compensation an amount equal to one percent or such smaller amount as the Director, NISCAIR (whose decision in writing shall be final) may decide on the cost of the whole work as shown in the agreement, for every week that the work remains un-commenced or unfinished or due quantity of work remains incomplete after the proper dates. Compensation to be paid shall not exceed ten per cent of the estimated cost of the work as shown in the agreement. 18. The contractor shall indemnify NISCAIR for his direct/indirect acts cause loss in any form to NISCAIR. 19. No material will be issued by the department. Contractor has to arrange all materials including cement & steel required for this work. 20. The issues not covered by the NIT clauses will be governed by the clauses in conditions of contract for works. 21. The Contractor should confirm any ambiguity and discrepancy related to the work and 6

7 tender before submitting the tender document. 22. The clause No. 28 of general conditions of contact relating to Escalation is not applicable to this work. 23. The Director NISCAIR will be the owner/employer of the work and wherever CSIR is printed in conditions of Contract for Works and at other places, that to be replaced with NISCAIR Dr K.S.Krishnan Marg, New Delhi Technical evaluation: Technical evaluation will be done based on all the terms and conditions mentioned and also as per details provided by the vendor. Bids of the firm will be rejected out rightly whose performance has been unsatisfactory in past and decision for this will rest with NISCAIR. Arbitration 1. In the event of any question, dispute/difference arising under the agreement or in connection herewith (except as to matters the decision of which is specially provided under this agreement) the same be referred to the sole arbitration DGCSIR or his nominee. 2. The award of the arbitrator shall be final binding on the parties. In the event of such arbitrator to whom the mater is originally referred is being transferred or vacating his office or resigning refusing to work or neglecting his work of being unable to act for any reason whatsoever, the Director-General, CSIR shall appoint another persons to act as arbitrator in place of the out-going arbitrator in accordance with the terms of this agreement and the persons so appointed shall be entitled to proceed with the reference from the stage at which it was left by his predecessor. 3. The expression Director-General, CSIR shall mean and include an acting / officiating Director-General. 4. The arbitrator may give interim award(s) and/or directions, as may be required. 5. Subject to the aforesaid provisions the Arbitration & conciliation act 1996 and the rules made hereunder and any modification thereof from time to time being in force shall be deemed to apply to the arbitration proceedings under this clause. 7

Providing and fixing anodized aluminum work for doors, windows, ventilators and partitions with extruded built up standard tubular and other sections of approved make conforming to IS: 733 and IS: 1285, anodized transparent or dyed to required shade according to IS: (Minimum anodic coating of grade AC 15), fixed with rawl plugs and screws or with fixing clips, or with expansion hold fastners including necessary filling up of gaps at junctions, at top, bottom and sides with required PVC/neoprene felt etc. Aluminium sections shall be smooth, rust free, straight, mitred and jointed mechanically wherever required including cleat angle, Aluminium snap beading for glazing / panelling, C.P. brass / stainless steel screws, all complete as..per architectural drawings and the directions of Engineer-in-charge. (Glazing and panelling to be paid for separately.) : (a) For fixed portion (b) For shutters of doors, windows & ventilators including providing and fixing hinges / pivots and making provision for fixing of fittings wherever required including the cost of PVC / neoprene gasket required (Fittings shall be paid for separately.) Providing and fixing 12mm thick pre-laminated three layer medium density (exterior grade) particle board Grade I, Type II conforming to IS: bonded with phenol formaldehyde synthetic resin, of approved brand and manufacture in panelling fixed in aluminium doors, windows shutters and partition frames with C.P. brass I stainless steel screws etc. complete as per architectural drawings and directions of engineer-in-charge.: (a) Pre-laminated particle board with decorative lamination on one side and balancing lamination on other side. (b) Pre-laminated particle board with decorative lamination on both sides. 8.
