9 ADB Funded Integrate Road Investment Program Annual Environment Compliance Monitoring Report Introduction The iroad program currently operational in Southern (Project 1), Sabaragamuwa and Kalutara District (Project 2), Central Province (Project 3), North Central Province (Project 4) and North Western Province (Project 5). In year 2017 program was under Tranche 3 & PIC2 supervise the implementation of civil works contracts of Project 4 & 5. This is the Annual Environment Monitoring Report 2017 prepared on behalf of the iroad PIC2 of North Western Province and North Central Province. In accordance with the EARF, this is a compulsory report that should be prepared by the iroad PIC2. As per the Environmental Assessment and Review Framework (EARF) time period January to December 2017 of iroad program, it is required to submit Annual Monitoring Report on environmental compliances. In accordance with the agreement, ADB provides $200 million with $23.88 million counterpart of Sri Lanka and total amount is $ million. The Project Implementation Consultants (PIC) were deployed from 15th March 2016 while construction contracts were awarded in 01 st of August 2016 to 15 Contractors as Kurunegala District into 5 Contract Packages, Puttalam District into 3 Contract Packages, Anuradhapura District into 4 Contract Packages and Polonnaruwa into 3 Contract Packages. As per the road categorization, around 683.3km of PS roads, km of PRDA/PRDD roads and 4.6km of RDA roads are included in this program for rehabilitation. The construction activities have to be completed within 24 months by Contractors and completed roads should be maintained by them for 36 months. The roads will be rehabilitated as Conventional Roads Contracts (CRCs). Figure 1 below presents the location of projects 4 and 5. 7

17 1.2 Staffing Setup (PIU/PIC/Contractor) with respect to environmental safeguards This PIC2 of iroad program covers 229 roads in two provinces named North Western and North Central Provinces with two Project Implementation Units (PIUs) for two provinces. Hence PIC-2 has to work with 15 Contractor Packages. During past period of 17 months, all parties taken full effort to recruit Environmental and Social Safeguards Officers and related other officers to implement and monitor the environment safeguards component PIU Staff At the outset of the program, two PIUs recruited two Environmental Safeguards Officers (one for each province) for environmental management. In addition, two Environmental Safeguards Assistants were also recruited. They monitor the project at the level of Project Director s office. Two Social Safeguards Officers and two Social Safeguards Assistants at PIU level were also recruited at the beginning of the Project. They are looking after the environmental related social safeguards activities at PIU level. The Environment Safeguards Assistant recruited for NCP resigned in the year The Social Safeguard Assistant of NWP resigned in the year 2017 and Social Safeguards Officer of NCP also resigned in As well, the Environmental Safeguards Officer of NCP resigned in December At the Contract Package level, Project Engineers (PEs) have been appointed by PIU to manage the engineering activities including Environmental and Social Safeguards requirements. The Project Director directs these officers to manage the environmental safeguards activities in their own provinces by coordinating with people and line agencies. 15

18 Chart 1: PIU Staff (Environmental Related) as per the project requirement Project Director (PIU office) ESO SSO ESA SSA PE 1 for each Contract Package PIC Staff The PIC2 was established from 15 th March 2016 with Pyunghwa Engineering Consultants Ltd. (PEC) and Resources Development Consultants (RDC). An Environmental Specialist (ES) is available from the outset of the PIC2. In addition, a Social, Gender & Resettlement Specialist has been appointed from the beginning. ES covers many activities related to environmental safeguards in accordance with contractual guidelines. These two specialists look after two provinces entirely while Engineer/Team Leader leads and guides the environmental activities in two provinces. Four Residence Engineers have been appointed as one per each district to monitor the environmental activities in their respective district. Depending on the scope of the district, 2 Assistant Resident Engineers (AREs) were appointed for Kurunegala district (NWP) and two for Anuradhapura district (NCP). One Assistant Resident Engineer has been appointed for Puttalam district and another one for Polonnaruwa district. The environmental safeguards monitoring is a major role of their duty. And also, the PIC has appointed 15 Construction Engineers for all 15 contract packages and two Technical Officers for each contract package. They are responsible for the monitoring of environmental safeguards at contract package level. 16

But in practice, all the Contractors faced a big problem of finding out qualified persons as ESOs. On the other hand, it was evident that many of recruited ESOs have been resigned due to various reasons and Contractors faced a big problems to recruit new ESOs again and again. Annexure I shows the situation of this issue faced by Contractors. By the end of year 2017, most of Contractors had to recruit qualified ESOs in to some extent. Even though, Project Managers/Contractors Representatives have got the support of their Site Engineers, Technical Officers and Work Supervisors to implement the environmental safeguards activities at site level. 17

Connectivity between rural communities and socio economic centers will be expected by rehabilitating 1205 km of 229 roads in NWP and NCP. Under this program, following components are included. 18

21 Submitted 1. Road improvement component will design, improve and maintain 705 km in NWP and 500 km rural roads in NCP. 2. Capacity development component will build the capacity of road agencies on road asset management, project management and contract administration. 2.0 Progress of civil works during the reporting period 2.1 Contract KU1 Contractor Maga Engineering PLC The Contract Package KU1 consists of 16 roads totaling 85 km and the accepted contract value is LKR 2,005,790, The Contractor has provided the Engineer s facilities as per the contract with the Resident Engineer s Office located in Kurunegala and the Construction Engineer s office located at Kuliyapitiya. The Contractor has established his own office and yard along with his material testing laboratory located at Bihalpola all now fully operational. The Contract Package KU3 consists of 12 roads totaling km and the accepted contract value is LKR 1,976,721, The Contractor has provided the Engineer s facilities as per the contract with the Construction Engineer s office selected and almost equipped. The Contractor has established his own office, yard and main material testing laboratory near Kurunegala and these are operational and fully equipped. Submitted Page Total LHS RHS Chart 18 - Road construction activities PO3 3 Compliance with environmental safeguards requirements in the loan document The environment component is the crucial part of the iroad program and the implementation of program should assure the safeguards policies of ADB (SPS) and Sri Lanka Government. To ensure the program activities of road rehabilitation in accordance with these polices, the environmental activities should be complied with the Loan Agreement of Tranche 2 and 3, updated FAM (updated in 2015) and EARF. 36

39 3.1. Compliance with Tranche 2 and 3 In accordance with the Appendix 6 of the FAM, Tranche 3 will finance the second slice of five projects that were appraised under Tranches 1 and 2, namely (i) project 1 in Southern Province, (ii) project 2 in Sabaragamuwa Province and the Kalutara District of Western Province; (iii) project 3 in Central Province; (iv) project 4 in North Central Province; (v) project 5 in North Western Province, and (vi) consulting services. Therefore, the PIC2 belongs to Tranche 3. The Covenant 4.01 of the Article IV of Loan Agreement (Special Operations) Numbered SRI (SF) and dated 11 December 2015 has mentioned the Borrower s obligations of environmental safeguards and they have been mentioned in the Schedule 5. As per this schedule, the Sri Lanka government as the Borrower should ensure that the Project preparation, design, construction, implementation, operation and decommissioning and Project facilities comply with followings. a. All applicable laws and regulations of the Borrower relating to environment, health and safety. b. The Environmental safeguards as set out in ADB s Safeguards Policy Statement. c. The EARF and IEEs. d. All measures and requirements set forth in the respective IEE s and EMPs and any corrective or preventive actions set forth in a Safeguards Monitoring Report. Therefore, the Team Leader (Engineer) sent all the safeguards documents including EARF, IEEs, Transect Walk Survey Report-2014, Road Safety Audit Report, RF etc. to all Contractors separately by his letter dated to make them aware on implementation of safeguards activities to comply with above requirements. So all the Contractors of Project 4 and 5 are aware of Environmental Safeguards requirements as per national laws and policies and ADB Safeguards Policy. Clause No. 6, 6(a), 6 (b) and 6 (c) of the schedule mention that the Borrower shall ensure, or cause RDA to ensure that all bidding documents contain provisions that require Contractors to: (a) (b) (c) (d) Comply with the measures relevant to the contractor set forth in any safeguards document (including relevant IEEs, EMPs and road specific EMPs), and any corrective or preventative actions set forth in the Safeguards Monitoring Report; Make available budget for all such safeguard measures; and Provide the Borrower with a written notice of any unanticipated environmental, resettlement or small ethnic community risks or impacts that arise during construction, implementation or operation of the Project that were not considered in the IEEs, EMPs and any other safeguard plans. To ensure the above conditions, the Borrower included relevant clauses to the Volume 5b Schedules of the agreement signed between RDA and Contractors. 37

40 All bidding documents included above information Safeguards Monitoring and Reporting Under clause No. 7 of the Borrower shall do the following or cause RDA to do the following: (a) Submit annual Environmental Safeguards Monitoring Reports to ADB and disclose relevant information from such reports to affected persons promptly upon submission (The Annual Environmental Monitoring Report prepared for year 2016 has been submitted to the Client) This report is prepared for the time period from January to December 2017; (b) If any unanticipated Environmental and/or Social risks and impacts arise during construction, implementation or operation of the Project that were not considered in the IEEs, EMPs, and any safeguards documents, promptly inform ADB of the occurrence of such risks or impacts, with detailed description of the event and proposed corrective action plan. No any unanticipated impact arose during reporting period; and (c) Report any actual or potential breach of compliance with the measures and requirements set forth in the IEEs, EMPs and any safeguard documents promptly after becoming aware of the breach. Contractors of Project 4 and 5 submit monthly progress report to the RDA the Client, Clause - 32 of Loan Agreement (Ordinary Operations) numbered 3325-SRI mentions that the environment component of Tranche 3 has been categorized as category B such as Tranches 1 and 2. Accordingly, two IEEs for NWP and NCP have been prepared by the project. No new roads were considered in Project 4 and 5 under Tranche 3 during the reporting period. 3.3 Compliance with FAM In the Project Organizational Structure of the FAM (Appendix 6) mentioned that Project Implementation Consultants (PICs) as a key organization in the project. Accordingly, PIC2 was deployed from 15 March And PIU of Project 4 and 5 have been appointed with Project Directors. Environmental Management Plan (EMP), Environmental Monitoring Plan (EMOP), IEEs for both provinces and Environmental Assessment and Review Framework (EARF) were submitted by the RDA and the PIC2 and they are implemented at PIC level. On the other hand, the Contractors were advised to conduct refreshing Transect Walks during contract period to update physical information and conduct Public consultations (Clause 51). The Foot Note No. 14 under Clause No. 51 of FAM has clearly mentioned that the Contractors are required to conduct their own Transect Walks to update physical information and conduct consultations to solicit community knowledge and requirements that should be reflected in the design. And also, according to Clause 54, the project is implemented with required clearances, permits and licenses. Refreshing Transect Walk surveys also conducted in year The Grievance Redress Mechanism (GRM) mentioned under Clause 62 is implemented as mentioned in the FAM. In accordance with Clause 66 and 67 (HIV/AIDS and Health), all the 38

41 Contractors have implemented awareness programs on HIV/AIDs for workers and prominent villagers in their contract packages, and Contractors were motivated to supply potable drinking water, quality accommodation facilities, safety measures, first aids facilities etc. for workers. All the Contractors already initiated the second round of HIV/AIDS awareness programs. (Refer Table 24 for conducted HIV/AIDS programs). While Internal Environmental Monitoring is done by PIU, PIC2 monitors Environmental component internally according to Clause 76. The Contractors submitted Site Specific Environmental Management Action Plan (SSEMAP) for each road before constructions are commenced and Environmental Monitoring Checklists (EMCs) for each contract package as per the required stage. Depending on these documents, PIC monitors Environmental activities through REs, AREs, CEs, TOs, ESSO of PIC2 and ES. The Contractors provide periodically Monthly Progress Report on Environment. In addition to them, the Environmental Progress Review Meeting for each contract package is conducted by ES randomly while discussing Environmental component at General Monthly Progress Review meeting of each contract package. And also, joint site visits were conducted. A qualified Environmental Specialist who has a Master Degree in Environmental Management and More than 10 years relevant experience has been mobilized on a full time basis by PIC2 from 15 March 2017 in accordance with the Attachment C-3 to FAM and Attachment C-4 to FAM (Clause 29 and 30 respectively). He checks the compliance of EARF requirements in project implementation. And also, a qualified Environmental and Social Safeguards Officer appointed to the TL s office from 27 February 2017 monitors the Environmental Safeguards activities of 2 provinces. 3.4 Compliance with respect to EARF The EARF prepared for Tranche 1 is valid to other Tranches of iroad in Sri Lanka (Clause 5 and 6). The project is implemented in accordance with this EARF as per following guidelines. To assess and manage the Environmental impacts and obtaining the Environmental Clearance for the project, the National Environmental Act, the key act of the Central Environmental Authority (CEA) in Sri Lanka has been followed by RDA. RDA has obtained a conditional concurrence for all roads in NCP and NWP from CEA. RDA has obtained CEA recommendation with clearance for Projects 3 and 4. It was emphasized that existing rural and national road width should not be widened. No road widening envisaged/observed during year The roads are not fallen through the Wildlife Reserves or any Strict Nature Reserve. No new roads selected. The ADB Safeguards Policies have not been violated. Applicable National Laws and Regulations mentioned in the Table 2 of Clause 11 and Table 3 of Clause 12 are thoroughly followed during year In implementation, international agreements or conventions are not violated. 39

42 The ESDD of RDA provided technical supports and Environmental Safeguards Officers appointed for 2 PIUs supported and worked with together for benefit of the project. Sixteen safeguards training programs except HIV/AIDS programs for PIU, PIC and Contractor s relevant staff were conducted by PIUs with the support of PIC, ESDD and CSD Specialist from the beginning of the contracts (Annexure II). A SSEMAPs for each road were prepared by the Contractor before the construction is commenced in accordance with guidelines of EMP. Standard EMP is available and it was used by Contractors to prepare their SSEMAPs. Details of SSEMAPs are discussed in Table 20. Public consultation had been done during the Project Identification Stage. It is also continued in Road Design Stage and Construction Stage. Grievance Redress Mechanism is already applied by forming GRCs at DS level and GND levels. A complaint registry is used by every contractor and complaint boxes have been placed at many locations of each road. The activities under responsibilities mentioned in the Table 1 of VI. Institutional Arrangement are carried by PIU and PIC. ESDD and TA consultant supported as resource persons during 16 Training Workshops and provided technical assistance when and where required. The Contractors implement their SSEMAPs through their Environmental and Social Officers. They have submitted Environmental Monitoring Checklists (EMCs) also for each road during Design & Pre-construction and Construction Stages. All the Contractors report their progress monthly to PIC2. In addition, Consultancy staff monitor Contractor s activities daily and Progress Review meeting are held at their Contract Packages at least once a month. The Engineer submits the progress to the client monthly. 4. Monitoring of Environmental Compliance at Field level 4.1. Main Environmental Safeguards activities conducted As per the duties of Environmental Safeguards, following activities were conducted during the reporting period. Ensured all the Environmental Mitigation measures required to be implemented in accordance with the Contract Agreement and Environmental Safeguards requirements. Supervised and monitored the Implementation of Environmental Management Plan (EMP). Regarding this subject, ES and ESSO of PIC2 assisted all contractors to prepare SSEMAPs and EMCs for each Contract Package. Technical advises required by Contractors were given at any time, if the Contractor requested. Environmental Information were included in the Monthly Report prepared by PIC2. Following tools were applied to monitor the Environmental Safeguards activities as follows. Daily Site inspections are done by RE s level PIC staff. 40

43 Periodic Site inspections are conducted by Team Leader, ES and ESSO as joint inspections with PIC, PIU and Contractor s staff. CSD Specialist of ADB, TA conducted Joint Site visits. Monthly Environmental Progress Reports are obtained from Contractors. Special Environmental Progress Review meetings are conducted periodically at Contract Package level with PIU, PIC and Contractors staff. At the General Progress Review meetings conducted by Team Leader at Contract Package level, Environmental activities and issues are discussed. The claims of Contractors on Environmental components are certified on monthly performance based. ADB missions conducted Site visits in Puttalam, Polonnaruwa and Anuradhapura districts on 2 & 3 May 2017 and 23 November The documents that Contractor should submit In general, a Contract Package has more than 10 roads spread over more than 5 DS Division to be rehabilitated. Therefore, the rehabilitating activities of all the roads are not commenced at a same time. In accordance with the EMP which should be followed by each Contractor should submit Site Specific Environmental Management Action Plan (SSEMAP) should be submitted and approval of Engineer should be obtained before the commencement of construction activities. In this SSEMAP, critical locations are included by mentioning Mitigation measures. Office premises, storages, stockpile yards, disposal sites, garbage management, traffic management, safety arrangements and other Environmental related phenomena are included in this SSEMAP. And also, Road Specific Environmental issues connected with construction activities are to be included. By considering this situation, Contractors have submitted main SSEMAP with roads considered in the 1 st cluster and road wise SSEMAPs before the commencement of road construction activities. These SSEMAPs were reviewed by ES of PIC2 and some were returned base on the comments. By the end of December 2017, a total of 156 SSEMAPs were accepted by PIC2. Contractors have been advised to commence the construction activities with the close supervisions of CE, ARE, or RE by not violating the Environmental Safeguards. The table No, 20 shows the Progress of submitted SSEMAPs. 41

However, no post construction stage SSEMAPs yet to be submitted as no fully completed roads available in The Environmental Monitoring Checklists (EMCs) are the other important document in the project. All the roads should have an EMC at Design & Pre-construction stage. It is a main Environmental Safeguards activity of the Contractor. And also, EMC should be prepared for the Construction Stage but it depends on the length of the road. If the road length less than 3km, it requires EMC 42

At the end of the Construction period, the Contractor should submit EMCs of Post Construction/Operational Stage for all roads separately. By the end of the year 2017, 144 EMCs for Pre-construction Stage, 67 EMCs at 25%, 53 EMCs at 50% and 18 EMCs at 75% of Construction Stages have been approved by the PIC. Implementation of GRM Clause No.3 of Section 7, Terms of Reference in RFP-PIC2 noted that monitoring of safeguards activities (Environment and Social) is a responsibility of the PIC and 15b of this document mentions in b (vi) to help the establishment of Grievance Redress Mechanism and ensure its proper functioning and management. And also it mentions in b (vii) to carry out the duties of Environmental Safeguards. In formation of GR Committees at DS level and GND level in the two provinces, the PIU was supported by PIC to build up awareness amongst community and GRC representatives. As a result of these awareness programs and the commitment of PIU, PIC and Contractors, 84 GRCs out of 85 DS level and 212 GN level GRCs out of 239 were formed at the end of 2017 as per the table 22 below. 48 Under the GRM process of PIC2, public complaints, requests and suggestions were considered at the Design and Implementation stages to rehabilitate roads for the maximum benefit of the people. In this process, the public has the provision to complain or make requests or suggestions over the phone or by meeting the PIC staff, PIU staff and Contractors staff. All the complaints are forwarded to the Contractors to register them in their Complaint, Suggestions and Requests Registry and is assisted by them to solve issues. The Contract Package wise grievances, requests and suggestions solved or being solved are summarized in the table 23. The accepted complaints/requests/suggestions at GRC meetings or transect walks are in Numbers and rejected/disregarded complaints/requests/suggestions are mentioned in Annexure III. Then GRC Level 2 at GN Level or Level 3 at DS Level will attend these issues to solve. If any issues that cannot be solved in this process, the complainant has the freedom to go to the court. Fortunately no any issue appeared which cannot be solved in this process up to now Licenses The Contractors are bound to obtain licenses/permits/consents from many authorities such as CEA, GS&MB, PS etc. These licenses are checked by RE and other PIC staff where constructions activities are functioned. Specially, borrow pits, quarry, crusher and asphalt plant are significant places which licenses are required. The list of licenses obtained for these major items are mentioned Annexure IV. In addition, stock pile yards, disposal yards, other yards etc. are required permission or licenses. In this iroad project, there no large size disposal sites due to less quantity of debris. However, the licenses of PS and consent of DS are obtained by the Contractor. On the other hand, the CE and RE of Consultant and PE of PIU recommend these licenses. 47

The HIV/AIDS program of PU2 was conducted by Alliance Lanka Institute but due to their unavoidable internal reasons, they failed to conduct this program continuously. The other important thing of this programs that many kind of important posters on good habits are demonstrated during the day of program. Drug prevention, information for good food habits, clinical venues of STD treatments, steps to be followed when symptoms of diseases appeared, preventive measures of spread of HIV/AIDS etc. are appeared on some posters. Issues observed (Environment related) and status of compliance All the Contractors engaged in construction activities more than 140 roads in year Therefore many Environmental issues are evident in their CPs Issues and mitigation measures applied In Sri Lanka, September, October. November and December are heavy rainy months especially in NWP and NCP. But expected amount of rainfall was not received. It can be understood by the following table 28 of weather condition. In this table, days which have not been mentioned are not rainy days. Due to low rain, the natural water bodies have been dried out. Some line agencies such as Department of Agrarian Services advised not to take water from their reservoirs. Many of complaints were received from public regarding dust emission and at some roads, public protested against dust emission. In this situation, some Contractors were faced with lot of difficulties to find suitable water sources to wet the road surface. Most of water bodies such as village tanks, springs and streams have been dried out. Many dialogs with community have be arranged by the contractors to mitigate this issue. Following key Environmental issues were recorded during year Dust Issues The significant Environmental issue was the dust emission at road construction sites. The main mitigation measure to reduce dust is to spray water on road surface under construction. However, the year 2017 was a dry year (Refer table 28) therefore, a lot of water sources got dried off. Hence the Contractors faced the problem of getting water. However, attempts were made to reduce dust emission by watering bringing from available water bodies, controlling vehicle transport at peak times of public places, limiting vehicle speed etc. 63

68 2. Blockage of drainage Most of drains have been blocked and damaged before and after construction activities. Sometimes lead away has been blocked or there was not a proper existing lead away for a long period. These issues were identified by PIC or PIU or Contractors during their site inspections or design stage. Some issues were received from public as complaints or requests. Most of these issues were solved at GRC Level 1 and some issues were solved at GRC Level 2 and 3. If some drains had been blocked, they have been cleaned by the Contractor immediately. Flooding issues Some road sections have been identified to have potential issues of flooding in accordance with available hydrological records/information of the area and suggestions/requests of the public. Contamination of soils and water It was identified that the soils and water are contaminated by dust, fuel and lubricant. Dust deposits in the drinking wells located adjacent to road construction sites. As well, fuel or oil is washed out in to soil and water bodies during rainy days when they are loaded or unloaded in the opening space without proper precautions. If drinking water wells are located near construction sites, they are covered. Loading and unloading of fuel/lubricants are done under roofed building. Most of people are not much concerned on their own safety due to their insufficient know how on safety precautions. All the Contractors have been advised to arrange safety measures for public and workers. On the other hand, safety measures applied by the Contactor are monitored by Consultancy staff and PIU staff periodically. As a result of that safety arrangements at work sites are at acceptable level and personal safety gear for workers have been provided by Contractors. 7. Threaten to vegetation Picture: No. 75-Safety arrangement ID64/PO3 Due to insufficient ROW, some trees have to be removed. But joint inspection is conducted by PIU, PIC and Contractors to identify which trees to be saved. Many trees had to be saved in this way. Some roads are stretched through forest covers. The PIU informed DWLC or FD as per the forest ownership when the construction activities are done at such locations to obtain their conditions if any. 69

Garbage collection The garbage collection was evident at site offices, project officers and camp sites in all the CPs. CPs have installed garbage bins at each site in accordance with the kind of garbage. 73 In addition to dust emission, garbage management issue, debris disposal issues, soil contamination from fuel at some storages, little flood situation or water logging, drainage issues, soil erosion at stock pile yards, not rehabilitated stock pile yards, workers safety issues and mosquito breeding places were some other Environmental issues. But they are not significant like highways, express ways or hilly terrains. The Annexure V shows the Environmental issues and Safeguards compliances. 6. Public consultation and information dissemination The Public consultation is a principle requirement of the iroad program. The importance of this requirement is described in Chapter V of the EARF. When the project is identified, public consultation had been done during the Transect Walk activity. Public had been consulted individually, group wise and public meeting wise at the Transect Walk of relevant roads. The same system was followed during Construction stage where public consultations were conducted. The meetings of GRC formation at DS level and GND level were also used as vehicles to consult public because community leaders, NGO people, women groups, clergies and line agency representatives are invited to participate it. In addition to that, individual consultations, group discussions etc. were also conducted to collect ideas and build awareness in the project. And also, refreshing Transect Walks after the meeting were conducted. The ideas, suggestions and complaints from public were received and they are considered as important inputs in designing the roads. However, the Contractor is bound to conduct a Transect Walk before road design in accordance with the Foot Note No. 14 of Clause No. 51 in the Updated Facility Manual. And also, complaint/suggestions/requests boxes are erected at all roads to obtain the community perceptions for road rehabilitation. 71

The total of trees removed is 116 and estimated No. of trees to be replanted is 348 at the rate of 1:3. However, 626 trees have been planted. The PU1 has planted 52 trees even they do not have removed any tree. This is a very good progress of tree planting programs. Annexure VI shows the progress of tree planting programs of Contract Packages. Most of Contractors used schools as supportive partners in this progress by arranging Environmental School awareness programs for students and sometimes assisting to help those giving required accessories or constructing a physical requirement such as playground. The wild elephant in the area are roaming everywhere for seeking water and food. Due to dry weather condition during past year, elephant roaming is an obvious scenery. So some of them are fallen down in to agro wells when they are going to drink water. This kind of accident was reported from AP4. A wild elephant has been fallen down in to an agro well in the night on 25 th August 2017 in Muslim 81

This is the annual environmental compliance monitoring report for the time period from January to December The Annual Environmental Compliance Monitoring Report 2016 had four recommendations. The first recommendation was to recruit ESOs with academic qualifications disregarding the experiences. Contractors have followed this recommendation and recruited academically sound ESOs. It should be mentioned that they are working very well following the advice of Consultants. And also, other recommendations on rapport development with each party, on the job training and giving facilities to ESO by Contractors have been implemented. 2. Due to policies of new government, the environmental conservation is considered as a major component in the development projects. Therefore, the GS&MB was strict to issues IMLs for borrow pits. At the end of the year, it was eased for some major projects in the country and iroad is a one of them. However, the progress of the rehabilitation activities were very much delayed during the early period of the project and the Contractors were having difficulties to complete the project on deadlines mainly due to insufficient supply of soil. 3. The three parties i.e. Contractor, Consultant and the Client (PIU) are working to complete the iroad project qualitatively and quantitatively. Although they are engaging in the same project, their responsibilities differed from each other. They should have a proper idea and knowledge of their own roles. Some are (not everybody) paying their 82

85 attention on others roles more than their own. Due to this reason, the cohesion of three parties have been threatened. Measures should be taken to firmly state the role of each sector and how they should interact with each other. 4. The Contractor is required to plant trees for removed trees based on 1:3 ratio according to EMP and in the BOQs. However, the girth and height of a plant that is to be replanted is specified as girth of 300mm and height of 2m. Finding such specimens for replanting is a practical problem as it is difficult to find out some endangered or endemic or native plant species in this size. 5. The constructive support rendered by CSD TA Specialist is much appreciated. If any problem faced by Engineer s staff, he comes and involves immediately. Especially in community consultation, his effort is very important and useful. 6. ESDD staff and PDs of NCP and NWP and their staff supported for the implementation of the project to the Engineer. If any issues are met at the field, everybody gathers together and intervene in the issue to solve it as soon as possible. 7. All the REs and their staff (AREs, CEs and TOs) are actively committed in implementation of safeguards component on the ground. At the beginning of the project, they have some doubt whether the environmental safeguards activities can be implemented properly. Now they are very experienced personnel. They know how to implement environmental safeguards activities at sites. 8. The iroad PIC2 has 229 roads scattered everywhere in the North Central Province and North Western Province. The SSEMAPs are required to prepare 458 for Construction Stage and Post Construction Stage. EMCs for Pre-construction Stage, Construction Stage and Operational Stage are required in 1027 numbers. The total of them are They should be reviewed by the ES with the support of only one ESSO/PIC. In addition to this task, ES has to monitor the sites, prepare other documents and participate in meetings. It is suggested to recruit an Environmental Assistant to each district under the RE s office. 9. The tree plantation program is successful. Trees have been planted exceeding the targeted numbers. In this regard, the ESSOs and PMs commitment are much appreciated. 10. The ADB SLRM has introduced a GIS Base environmental monitoring system to be applied in the project. But no sufficient staff for PIC to implement this system. 83

86 8.2 Recommendations 1. A workshop is recommended to be conducted by the Senior Project hierarchy to PIU, PIC and Contractors to understand their role in front of each other to steer the future project activities properly. 2. The workload of the environmental safeguards activities of ES should be taken into considerations when future iroad projects are implemented. 3. On the job training and experience exchange programs should be conducted to develop capacity of staff on environmental safeguards and CSD. 4. The standard size of plants which should be purchased by Contractors for tree planting should be redefined reasonably. Also, the Contractors should be paid for plants hence they have bided earlier to fulfil the requirement of EMP. 84

155 Case Study - 1 Mitigation of Flood Impacts - Puttalam The Road ID44 is called Thabbowa, Karuwalagaswewa, Outer Circular Road which is going from 7 th Mile Post to 8 th Mile Post of Anuradhapura Trincomalee road (A 012) via Thabbowa Irrigation Colony in Karuwalagaswewa DS Division of Puttalam District in North Western Province, Sri Lanka. Chainage to of this road get flooded and become impassable during rainy seasons and villagers have to come through alternative roads by passing around additional 5km to reach Puttalam - Anuradhapura road. Old road situation Starting point of concrete surface Concreted section Puttalam is the closest major town located 15km away from the middle of Thabbowa Colony. Base Hospital, markets, high schools and the urban facilities are available in the Puttalam town. Due to the inundation and damaged road condition people face many difficulties in reaching their destinations in Puttalam and vice versa. Many public consultations were conducted in this road jointly with PIU, PIC, Contractor and CSD TA Specialist. Finally, it was decided to be concrete the section from Chainage to to avoid any damage to the road surface during flood period. During the construction period this road section had to be closed for nearly 2 months, and the contractor had informed the public on possible alternate routes. After the contraction people were very happy with the decision of concreting this section as it will help to sustain and use the road even during the rainy season. 1

156 Case Study - 2 Protection of Forests - Kurunegala The Road ID 71 called Halpara is rehabilitated under KU3 Contract Package. It is located in Kurunegala PS in Kurunegala DS Division of North Western Province, Sri Lanka. Kurunegala Narammala road and Kurunegala - Ambeypussa road are connected by this road which is 4.400km in length. This is a very important short cut road for the people who are living in area of Kurunegla Narammala Roda and Kurunegala Ambepussa Road. There is a secondary forest reserve located in between Chainage and on the road. This area is called Koswatta. A Jack tree Jack and Mahogany trees have been planted in the forest and they have been grown thickly. Road surface not damaged to forest Structures to suit environment It was expected that embankment construction, drain constructions, culvert constructions, and asphalting would affect this forest area. However with the guidance from PIC and PIU the contractor (Ranken Railway Construction) was able to complete the construction works in the forest area without causing any significant damage. The ESO of the contractor paid her fullest attention in the road rehabilitating activities to avoid any damage to the forest and it should be appreciated. 2

157 Case Study - 3 Flood free Access to Katupathwewa Village - Anuradhapura The Katupathwewa village is located at the southern boundary of Wilpaththuwa National Park in Sri Lanka. Even numerous threats of wildlife such as elephants, leopards, monkeys, wild bows, porcupines, birds such as parrots, peacocks etc. the villagers used to cultivate paddy and practice slash and burn cultivations in this area. This village was separated by a vast area of paddy field located in between Phalamaragahawewa and Katupathwewa. Road ID 12, Pahalamaragahawewa-Katupathwewa which is 3km in length is located in Nochchiyagama DS Division of Anuradhapura District in NCP, Sri Lanka. Agricultural and animal products of this village are sold at towns such as Nochchiyagama and Anuradhapura by transporting on this road and outside buyers come and buy products from the village as well. The water flow through the paddy lands has caused flooding situations due to the existing narrow opening size of the existing culverts. All the culverts were hume pipe culverts with 600mm diameter open size. Also, due to the velocity of water flow, embankments of the road had been damaged. Damaged embankment before construction Filled road surface Many discussions were held with people, PIU staff, PIC staff and Contractor s staff before designing of this road section which face flood situation. Finally, it was decided to construct box culverts with large open size of 1000mm to 1500mm width instead of old culverts. The road construction is still going on but the people are very happy on this change in design to design cell culverts rather than replacing the old culverts with new hume pipes. 158 The village Katupathwewa has an ancient temple, school, community hall etc. Because of transport difficulties, most of teachers who come from distance areas as transfer appointments are reluctant to stay and work for a long period. They appeal to the education department and get transfers which result in shortage of teacher staff in the schools which had a significant impact on the student population in the area.
