1 SECTION WATER TREATMENT RESIDUAL REMOVAL, DISPOSAL, AND LAGOON CLEANING PART 1 - GENERAL 1.1 DESCRIPTION A. Scope: 1. The Contractor shall provide all labor, materials, tools, and equipment required to remove existing residuals from the North Lagoon at the Williams Road Water Treatment Plant site, provide on-site dewatering to a minimum of 20% solids content if required, transport residuals, and dispose of all residuals in an approved, New York State Department of Environmental Conservation (NYSDEC) permitted, manner. 1.2 QUALITY ASSURANCE A. Requirements of Regulatory Agencies 1. Comply with the applicable requirements of the NYSDEC, Division of Solid Waste and other agencies or authorities having jurisdiction. Apply for, pay for and obtain necessary and/or required permits for hauling and disposing of residuals at a site approved by NYSDEC. 1.3 SUBMITTALS A. Shop Drawings: Submit for approval the following: 1. Detailed description of the proposed Lagoon cleaning procedures including materials and equipment used to remove residuals and clean Lagoon. 2. Detailed description of the residuals dewatering system including procedures for handling excess leachate from the residuals dewatering process. 3. NYSDEC permitted (or NYSDEC approved alternative) residual disposal location to be used. 4. Material to be used for clay cut off trench and clay liner. 1.4 DEFINITIONS A. Contract Documents may refer to water treatment residuals as sludge. These two (2) descriptions shall be used interchangeably. PART 2 - REQUIREMENTS 2.1 GENERAL A. The North Lagoon at the Williams Road Treatment Plant has been taken out of service as of the time of this Contract. The Contractor will be responsible to removed supernatant water, remove the sludge from the Lagoon, and provide on-site dewatering of the sludge to a minimum of 20% solids content if required. All sludge removed shall be taken to an approved disposal site and disposed of WATER TREATMENT RESIDUAL REMOVAL, DISPOSAL, AND LAGOON CLEANING

2 in an approved manner. All liquid obtained in dewatering process shall be removed from the site and disposed of in an approved manner. B. All sludge removed from the Lagoon shall be processed and treated on-site to twenty percent (20%) (min.) solids and no free moisture shall be evident in the sludge. C. All removal, treatment, transportation, and disposal of sludge and liquid obtained from dewatering process shall be in accordance with the New York State Department of Environmental Conservation, Division of Solid Waste, 6 NYCRR Part 360 Solid Waste Management Facilities and the rules and regulations of the Agency. D. The Contractor shall handle, transport, and dispose of sludge using methods consistent with all regulations of the NYSDEC or other agencies having jurisdiction of the work. E. Upon removal of the sludge from the Water Treatment Plant site, the Contractor shall assume and hold ownership of all removed materials. F. The Contractor shall dispose of all sludge obtained hereunder, at a NYSDEC approved disposal site as identified in the Bid Requirements Section. The Contractor shall not be limited to the use of one approved NYSDEC approved disposal site. The Contractor shall be required to remove from the site all sludge from the North Lagoon at the Water Treatment Plant throughout the terms of this Contract regardless of operating status of any disposal site owned or operated by the Contractor or others. G. The Contractor shall clear and grub the existing vegetation and trees growing in the sludge deposits at the bottom of the existing Lagoon prior to removal of the sludge. All vegetation and trees removed shall be disposed of off-site in an approved manner. Vegetation and grass removed from the side slopes of the Lagoon embankment shall be disposed of off-site in an approved manner. All costs associated with clearing and grubbing shall be included in the applicable lump sum item(s). H. All sludge must be properly disposed as outlined in Section 2.1 of this section. Alternative disposal or private disposal of the sludge is strictly prohibited unless NYSDEC permit documentation is provided showing alternative or private disposal is permitted by the NYSDEC. 2.2 OBLIGATION AND RESPONSIBILITY OF CONTRACTOR A. The Contractor shall, at his own cost and expense, provide any and all manner of superintendence, insurance, taxes, permits, permit fees, testing, labor, materials, apparatus, appliances, tools, machinery, power, transportation and whatever else may be required of every description necessary to do and complete the work as shown and as specified. B. The Contractor shall be capable of providing all aspects of work required for the handling, transportation, disposal, procurement of applicable permits and testing required for the treatment and disposal of the Water Treatment Plant sludge removed from the North Lagoon. 2.3 PERMITS AND TESTING A. Full TCLP, ph, and total solids tests were performed on the sludge and are included in this Specification under Appendix "C". The test results are for informational purposes only and are representative of the sludge on the day the tests were taken. 3 comply with permits, shall be performed by the Contractor and all costs associated with these tests will be the responsibility of the Contractor and included under the applicable lump sum prices. B. The Contractor shall obtain all permits required for the handling, transportation and disposal of all sludge from the Water Treatment Plant site. C. Permits may include transportation permits, disposal permits, NYSDEC permits, and any other permits required to complete the work as shown and as specified. D. All fees required for the procurement of the above mentioned permits and any tests required shall be paid by the Contractor. E. The Contractor shall obtain approved permits prior to the start of any work requiring permits and shall deliver a copy to the Engineer prior to starting any work under this Contract. F. All testing required for disposal of the sludge shall be obtained by the Contractor. G. Appendix "B" contains safety data sheets for chemicals used in the water treatment process from which the sludge originated. These sheets are supplied for information purposes only. PART 3 - EXECUTION 3.1 REMOVAL OF SLUDGE A. The existing sludge shall be removed by the Contractor. The Contractor is responsible for all methods used for the removal of the sludge from the Lagoon; however, any methods employed shall be approved by the Engineer. The Contractor's selection of equipment and methods used to remove the sludge from the Lagoon shall take into account the construction of the existing Lagoon to be cleaned, the sizes of the available work areas, existing Owner's operations in the area and any other factors which may affect the work under this project. B. The approximate quantity of sludge in the Lagoon is 4,980 CY+/-. This calculated volume is only representative of the volume of sludge on the day the field tests and survey was completed. The Lagoon bottom was surveyed in August 2009 after cleaning. The top of sludge was surveyed in March Actual volumes may vary. The Contractor is responsible to remove all sludge in the Lagoon from the existing top elevations to the top of the existing Lagoon bottom. If the amount of sludge to be removed to reach the clay layer exceeds 4,980 CY, no additional compensation to the Contractor shall result. C. The Contractor shall confine his operations to the limits of work areas as designated by the Owner. Any damage resulting from work outside the limits of work areas shall be restored by the Contractor and shall be subject to approval by the Engineer. Upon completion of all work required under this Contract, the Contractor shall restore the areas used for his work to the original condition and to a condition acceptable to the Engineer. Restoration shall include but is not limited to grading as required, furnishing and installing topsoils and seeding. D. An approximate cross section of the existing Lagoon have been included in Appendix D. Prior to excavation and sludge removal, the Contractor will be required to make test excavations to determine and verify the elevation of the top of the existing Lagoon bottom. The cost of the test excavations shall be included in the lump sum price bid by the Contractor for completion of this WATER TREATMENT RESIDUAL REMOVAL, DISPOSAL, AND LAGOON CLEANING

4 Contract. Location and quantity of these test excavations shall be approved by the Engineer. The Contractor shall remove sludge to the elevations and limits as shown on the Contract Drawings or to the top of the existing Lagoon bottom. For the Lagoon bottom, the Contractor shall use care when excavating and removing sludge from the lagoon so as not to over excavate below the proposed elevations as shown. Any over excavation caused by the Contractor's operations may result in removal of sections of the existing Lagoon bottom. These test excavations (to confirm the Lagoon bottom elevation) are not considered test pit excavations and shall not be paid for under the test pit excavation bid item. E. In the event that the Lagoon bottom is disturbed or damaged by the Contractor's operations, the bottom shall be repaired with additional compacted clay material by the Contractor. The Contractor shall not repair the bottom with the disturbed existing material unless directed by the Engineer. Repairs, if required, shall be approved by the Engineer. A shop drawing submittal is required to be submitted by the Contractor outlining materials, equipment and methods used by the Contractor to repair the Lagoon bottom. The Lagoon bottom shall be repaired or replaced to the thickness of the required for the proposed clay liner, as required and approved by the Engineer. Clay material shall have a permeability of 1 x 10-7 centimeters per second or less. Compaction shall meet 95%of maximum density at the approximate optimum moisture content determined by the procedure ASTM D-1557 modified proctor. Compaction shall be obtained by the use of mechanical tamping devices. 3.2 ON-SITE SLUDGE TREATMENT A. The Contractor will be required to ensure that the sludge taken to an approved landfill is a minimum of 20% solids with no free liquid evident in the sludge as per requirements of the NYSDEC Part 360. If the sludge removed meets these criteria, the sludge may be directly taken to an approved landfill. If the sludge does not meet the 20% solids criteria, the Contractor shall provide means to treat the sludge to meet the criteria. As the Contractor's option, the sludge can be mixed with sludge consisting of higher percent solids in order to obtain a uniform mixture of solids meeting the Specification requirements. As solids content requires, the Contractor shall provide a trailer mounted on-site dewatering unit to provide on-site sludge dewatering to meet the 20% solids criteria. The dewatering unit shall be trailer mounted and outfitted with all necessary equipment to make it a complete dewatering facility. Equipment shall include sludge pumps, sludge conditioning equipment, chemicals, and all other equipment necessary to treat and dewater the sludge. The Contractor will not be allowed to add water to the sludge to aid in the removal of the sludge from the Lagoon. B. Liquids produced from the dewatering operation shall be collected and sent to a tank or other approved collection system. No liquids will be allowed to escape from the process. The Contractor shall provide all means necessary to ensure complete collection of liquids resulting from dewatering operations. The liquids obtained from dewatering operations shall NOT be returned to any point of the Water Treatment Plant site. C. The Contractor shall provide all required tanks, trucks, or other methods necessary to contain the water and liquids produced from the sludge removal operations and shall dispose of the liquids offsite in an approved manner. The Contractor is responsible to make all arrangements and obtain all permits required in order to dispose of the liquids produced by his operations. The Contractor will be responsible to perform and pay the associated costs for all testing required by the permits in order to ensure the sludge meets all the criteria including percentage of solids, as well as any additional tests ordered by the Engineer, to ensure conformance with the permits and the Contract Documents. 3.3 SLUDGE HAULING AND DISPOSAL A. Methods employed by the Contractor to haul and dispose of sludge shall meet all permit requirements and local ordinances in effect at the time of this Contract. The Contractor shall use bed liners, covers, and all other equipment necessary to prevent sludge spillage or seepage during transportation. The Contractor shall be responsible for all costs for cleanup of all spilled sludge between the project and disposal sites. B. The Contractor shall coordinate his sludge hauling operations with the Owner's operations and with other Contractors performing work at the site. Any hauling operations by the Contractor shall be scheduled in order to avoid conflicts with Owner's operations and other work and shall be acceptable to the Owner. The Owner will designate routes or roadways at the Water Treatment Plant site for the Contractor's uses. The hauling operation shall be limited to these designated routes or roadways. 3.4 SITE MAINTENANCE A. The Contractor shall be responsible for daily clean-up of the site including the grass area, stone haul road, and asphalt pavement area. B. While cleaning the pavement area, at no time is the Contractor allowed to discharge water into the existing storm sewer system located on the site (within the pavement area). C. The Contractor shall be responsible for all necessary soil and erosion control measures to prevent the discharge of soil or contaminated water into the storm sewer system. D. The Contractor shall be responsible for final cleaning of the site at the completion of the project. This will include stone haul road restoration, site grading, topsoiling, and seeding, and pavement restoration (if necessary).
