Sealed proposals will be received by the Construction Manager, RPR Construction Company, Inc., until 2:00 p.m. on November 2, 2017, at the office of RPR Construction Company, Inc., Tyler, Texas. Sealed proposals will be privately opened by the Construction Manager. Dollar amounts of sealed proposals will not be made public until after the award of the contract or within seven (7) days after the date of final selection of proposals, whichever is later, as required by Senate Bill 669 effective September 1, Proposals will be received until 2:00 p.m. on November 2, 2017 via the following methods: 1. Subcontractors and material suppliers are encouraged to review Instructions for Sealed Proposals to determine if his sealed proposal is to be submitted to a general work category contractor or to the Construction Manager. PROJECT DESCRIPTION In general, the project consist of 4,792 square foot of additions and renovations to an existing press box including but not limited to demolition, erosion control, earthwork, termite control, pavement markings, asphalt paving, utilities, storm drainage, fencing, retaining wall, concrete, masonry, structural steel, rough carpentry, millwork, waterproofing, insulation, composite wall panels, metal wall panels, metal roofing, modified roofing, joint sealants, steel and wood doors, aluminum storefront, hardware, metal studs and drywall, tiling, acoustical ceiling, painting, signage, fire extinguisher cabinets, toilet accessories, elevator, plumbing, HVAC, fire sprinkler, electrical and special systems. 3 INVITATION TO SUBMIT PROPOSALS CONTRACT Sealed proposals will be based on a single lump-sum contract for individual work disciplines or selected groups of work disciplines. Sealed proposals will be awarded based upon the following criteria. The following list is not necessarily in order of importance. 1. Purchase price 2. Past performance 3. Safety record 4. Reputation of the vendor and of vendor s goods and services 5. Quality of vendor s goods and services 6. Extent to which goods and services meet Owner needs 7. Vendor s past relationship with Owner, Construction Manager and Architect 8. Any other relevant factor that a private business entity would consider in selecting a vendor 9. Time required to deliver materials or perform work RPR Construction Company, Inc. is requiring that all Contractors / Suppliers provide a valid address. SEALED PROPOSAL SECURITY Sealed proposal security in the form of a Bid Bond made payable to RPR Construction Company, Inc. in an amount equal to 5% of the proposal is requested of Proposers for all contracts over $200, with capacity of bonding their work. Carefully read all portions of the proposal package and fill out all forms completely. PART 4 METHOD OF SEALED PROPOSAL Sealed proposals will be received by Work Categories as listed below. Proposals that exclude any Specification Section of a given Work Category may not be considered. Sealed proposals combining more than one Work Category will be accepted. PART 5 WORK CATEGORIES A. Each Work Category shall include Specification Sections Division 00, Division 01, Invitation To Submit Proposals, Instructions To Proposers, Sealed Proposal Form, General Conditions, Agreement, Supplementary General Conditions and Special Conditions, and the related Drawings and Specification Sections including all items inferred by the documents for the Work Category. B. Receive, Handle and Install (RHI) DEFINITION When the Instructions to Proposers states that a specific Work Category is to (RHI) materials or equipment furnished by another Work Category, the (RHI) Work Category Sub Contractor is responsible for all materials / equipment management including the following: 1. Accept delivery of material / equipment, confirm material / equipment has not been damaged in transit and confirm bill of laden accurately identifies the material / equipment received. 5 CM INSTRUCTIONS TO PROPOSERS if the material is damaged in shipment the (RHI) Trade Sub Contractor is to notify Construction Manager immediately. 2. Furnish personnel and equipment to unload material / equipment in a manner so as not to damage material / equipment. 3. Furnish personnel and equipment to properly store material / equipment in location(s) acceptable to the Construction Manager and protect material / equipment from damage or loss due to inclement weather, vandalism and / or theft. Any claim for damage or loss will be filed against the Builder s Risk Policy provided by the Owner, but the (RHI) Sub Contractor will be responsible for all justification for the claim to the insurance company and be responsible for payment of the deductible. 4. Furnish personnel to inventory material / equipment received to insure that materials stored are as shown in shipping receipts and as noted in approved submittals. Any discrepancies are to be brought to the attention of the Construction Manager in ample time to avoid any delays to the progress of the project due to insufficient or incorrect material / equipment. This requirement also includes reviewing the submittals and Contract Documents to confirm that ample material is available to complete the installation(s) in accordance with the Contract Documents. Failure to do so will result in the cost of supplementary material being deducted from the (RHI) Contractor s contract. 5. Furnish personnel to properly install material / equipment in accordance with approved shop drawings and the Contract Documents as amended by approved change order(s) without damaging or wasting material / equipment furnished by others. 6. (FO) Denotes furnish FOB to Jobsite. 7. No designation noted, Furnish and Install complete. C. Subcontractor Performance and a Labor and Materials Payment Bonds may be a requirement for Work Categories 4A, 5A, 5B, 5C, 7D, 8D, 9B, 21A, 22A, 23A, 23C, 26A, 27A, 27B, 28A and 28B. Construction Manager and / or Owner may require the other successful subcontractors / suppliers to furnish Performance and a Labor and Material Payment Bonds, each in the amount of 100% of his subcontract amount and written in favor of RPR Construction Company, Inc. The cost of said bonds shall be added to the Sealed Proposal and will be included in the Subcontract. D. ACCEPTABLE PROPOSALS 1. Sealed proposals combining more than one Work Category may not be accepted if any such Work Category is not listed below. 2. Receive, store and assemble door hardware by door number at time of delivery. 11. Remove, store and re-install a minimum of five rows of stadium seating the full length of the new Press Box. 2A. Erosion control as directed by CM including construction entrance, silt fence, filter dyke, sediment traps and soil retention blankets on slopes greater than 4:1 (furnish, install, maintain and remove at project completion). 7. Concrete washout areas as directed by CM (furnish, install, maintain and remove at project completion). 8. Tree protection as directed by CM (furnish, install, maintain and remove at project completion). 9. Saw cut where necessary to provide a clean cut for patching into existing work. 10. Replacement of topsoil once site concrete is complete. 11. Provide sand cushion at site concrete and slab on grade. 12. Provide dust control. 13. Shoring (furnish, install and remove) as required for this scope of work. 14. Excavation for retaining walls and provide backfill material. 15. Patch asphalt at street (curb cuts) as required. 16. No consideration will be granted for any alleged misunderstanding of the material, article or piece of equipment to be furnished or work to be done; it being understood that the tender of a Sealed Proposal carries with it the agreement to all items and conditions referred to herein or indicated in the Contract Documents. PART 11 DISCREPANCIES OR OMISSIONS Should a plan holder find discrepancies or omissions from the Contract Documents, or should the plan holder be in doubt as to their meaning, the plan holder should at once notify the Construction Manager, who will notify the Architect who will, time permitting, issue a written instruction in the form of an addendum to all plan holders of record. Neither the Owner, RPR Construction Company, Inc., nor the Architect will be responsible for any oral explanations or interpretations of the Contract Documents.
