1 CARTER S COVE HOMEOWNERS ASSOCIATION ADDITIONS AND ALTERATIONS In addition to the Declaration of Covenants, Conditions and Restrictions for the Carter s Cove Subdivision (HOA) the following rules, regulations and guidelines shall be considered when evaluating requests for improvements. Note that, even in the event of strict compliance with the following guidelines, prior written approval from the ARC shall be required for each and every one of the following items. (This list is not all inclusive prior permission is required for any lot improvements to the exterior of the home or lot.) 1. Painting. The painting, staining or varnishing of the exterior of the Home, including doors and garage doors, may be approved only if the colors and style are consistent with existing improvements. Declarant's original paint color schemes provided to its original purchasers shall be the basis for determining consistency with existing improvements. a. Identify colors including paint manufacturer, color name, color number b. Provide color chip c. Description of area of structure and elevation that is to be painted. 2. Metal or Aluminum Roofs. Metal or aluminum roofs shall not be permitted. 3. Temporary Structures. No tents, trailers, shacks or other temporary buildings shall be constructed or otherwise placed on a Lot. 4. Antennae. No antennae, microwave receiving devices, aerials or ham radios shall be placed or erected on any Lot or upon any other portion of Carter s Cove, except to the extent applicable law requires the Association to permit any such device, in which case such improvement shall be subject to all of the other requirements of the Declaration, the Rules and Regulations and the ARC to the maximum extent permitted by law. Satellite dishes may be approved if reasonable in size, location, effectiveness and color. a. The antenna is installed in the least visible location on the lot that will not substantially degrade reception. b. The antenna should be placed so as to blend in with the surroundings. Possible locations include rear deck floor, rear section of the roof, adjacent to chimneys, and rear yards. c. All satellite dish antennas must be less than 30 inches in diameter. d. Satellite dishes should not be seen from the front of the home. 5. Driveways. Approval for the widening of driveways may be considered if the width shall be no wider than the outside width of the garage (Corner lots only). Approval for the refinishing of driveways shall be consistent with the Carter s Cove subdivision. Owner assumes the responsibility for continued maintenance. a. Survey indicating location of proposed driveway installation and its relationship to the neighboring homes and surrounding structures and residence. b. Type of materials c. Color scheme and pattern information. 6. Awnings. An Owner shall not install any awnings attached to the front or side of the Home. Awnings in the rear of a home must be submitted for the normal ARC Review Process. 7. Exterior Lighting Fixtures (includes Landscape lighting). Approval may be given for lighting fixtures, subject to fixture sizes which are to scale with others in Carter s Cove and fixture styles which are consistent with others in the Carter s Cove.
2 8. Holiday Lighting and Decorations. Seasonal decorative lights, decorations, and lawn ornaments may be displayed between 45 days prior to the Holiday and must be removed by 15 days after said holiday. All other exterior lights must be approved by the ARC. 9. Above Ground Swimming Pools. Above ground swimming pools shall not be permitted 10.Play Equipment. Permanently installed play equipment must be approved and designed for children. Depending on design it may be seen from the road. No equipment shall be permitted within utility, drainage or access easements, except basketball hoops in the driveway areas. All mobile basketball hoops and backboards in front yard areas shall be permitted in the driveway at a location which is no closer than midway between the garage door and the front property line (if driveway doesn t permit this then basketball hoop is permitted in the most logical place consistent with safety). Permanent basketball goals are not permitted. Play equipment maintenance shall be kept up. No rusting or damage to equipment shall be allowed to be displayed on a permanent basis. No basketball goal is permitted on the structure of the house. 11.Conversions of Garages. Conversions of garages to living quarters shall not be permitted. 12.Mailboxes. Replacement of the mailboxes installed by Declarant (original Declarant, Mr. Griffin) must be submitted for approval. Any replacements must be in conformance to the mailboxes originally installed by Declarant for its original purchasers. Mailboxes must be in conformity and unity with the Carter s Cove Subdivision. 13.Pools and Screen Enclosures. Without limiting the generality of the criteria included on Page 8 of these Rules and Regulations and without curtailing the right of the ARC or the Board in rejecting certain requests or employing judgment in evaluating requests, the following guidelines shall be considered when evaluating requests for screen enclosures, patio extensions and pools. Note that, even in the event of strict compliance with the following guidelines, prior approval from the ARC shall be required for each and every screen enclosure and pool decking installation: a. Approval for screen enclosures shall be consistent with the lot and Carter s Cove. b. Approval for screen enclosures shall be limited to screen meshes on the enclosure which are a standard dark color (e.g. charcoal, bronze, black). c. Obscure screen materials shall be prohibited. d. No enclosures shall be permitted at the front entries e. No aluminum or flat roofing material shall be permitted. Roofing will be consistent with roofing in the Carter s Cove subdivision. Either the existing roof line may be extended or a screen enclosure may be installed if approved by the ARC. f. Screen enclosures, patio extensions and pools must, at a minimum, maintain drainage easements. g. Survey depiction location of proposed pool or screen enclosure. h. Description of proposed enclosure or pool. i. Architectural renderings and specifications indicating dimensions, height, and materials. j. Pool deck type and materials k. Landscaping around enclosure, pool and fence. 14.Utility Sheds. Utility Shed approval is based on line of sight. If the utility shed can be seen (any part) above the fence line or if any portion of the utility shed can be seen when there is no fence line it must conform to the following standards.
3 a. any portion can be seen it must be built such that the siding is of brick the same color as the house or if any portion can be seen it must be built such that the siding is of wood painted the color of the trimming of the house b. roofing shall be the same roofing material and color of the house c. no metal or aluminum utility sheds allowed to be seen (any portion) d. no line of sight your discretion 15.Permanent Structures on Side of Driveway. Permanent structures that go both sides of the driveway over the culvert in front of the lot will be permitted if they meet the following criteria. Structure must be of brick and mortar, which is the same color as the brick and mortar of the house. Stone and mortar structures are permitted that meet the conformity and unity of the standards in Carter s Cove subdivision. 16.Landscaping. All landscaping must be approved. In situations where the landscaping will be done in different phases, it is suggested that you submit a master plan for your lot that may be approved, so each successive phase, without material changes, does not need ARC approval. The following guidelines will be used. Below is the criteria for front and side yard (this is not all inclusive). a. uniformity and consistency with Lot and Carter s Cove subdivision b. No white landscaping stone c. Landscaping stone height standard should meet the conformity and unity of Carters Cover subdivision. d. No Rock Beds e. No trees shall be removed without ARC approval, unless the tree is deemed dead by a professional arborist and in those instances shall be removed in a reasonable time. f. No landscaping will be permitted that impacts water drainage g. Type of plants should be described in the landscaping plans, size and scale should be considered when developing a master landscape plan. h. Growth rates and expected heights need to be submitted to ARC i. Detailed renderings of a master landscape plan may be, professional landscaping drawings, detailed drawings from landscape software package, or homeowner detail drawings j. Existing landscape bed plants may be modified and improved with like plantings, considering the size and scale of the bed, and is within the conformity and unity of the Carter s Cove subdivision without ARC approval. 17.Fences. No fence or wall of any kind, including those used for dog kennels or runs shall be erected, maintained or altered on any Lot without the prior approval from the ARC. a. No style of chain link fence is permitted. b. No fence shall be approved or installed which encroaches into Association Property (Common Areas) or other Lots. c. No fence shall be approved which extends in front of the front corner of a neighbor's Home where the two Homes are immediately adjacent to each other and where both Homes face the same direction d. No fence shall extend in the front of any home in Carter s Cover subdivision. e. The height of the fence shall be the minimum required by the City of Arlington. If the fence is a pool barrier then the height of the fence shall be the minimum height required by the City of Arlington and/or Shelby County. f. All fencing on the Lot connected and tying-in thereto shall be of the same minimum height as the connected Lot and has conformity to Carter s Cove subdivision.
4 g. For any fence, if approved, the Owner shall assume the responsibility to maintain the fence, including trimming any grass or other plants from the fence. h. For any fence, if approved, the Owner shall be responsible to meet all City requirements and criteria including, but not limited to, proper permitting and surveying. i. Submission Guidelines: i. Submit site plan showing location of fence on property. ii. Description on fence, style and materials. iii. Locations of gates. iv. Dimensions of Fence, and its relationship to the home and adjacent houses. v. Staining or painting color and color chip. If clear protectant indicate such in submission. 18.Structural improvement of Lots. All construction of Dwellings, accessory structures and all other improvements within the Property shall be undertaken and completed in accordance with the following conditions: a. All construction shall be carried out in compliance with the laws, code rules, regulations and orders of applicable governmental agencies and authorities. b. Such additions shall not exceed in height the original roof line of the structure, and shall conform in exterior design quality to the dwelling on the said Lot. c. The ARC shall have the right to approve the plans and specifications of any improvement d. Clotheslines. No outside clothes lines shall be placed on any lot. e. No window air conditioning unit may be located in any part of any dwelling or accessory structure which is visible from any street. MAINTENANCE AND APPEARANCE OF HOMES AND LOTS 1. General. Each Owner shall keep and maintain his Home and Lot in good order, condition and repair, and shall perform promptly all maintenance and repair work within his Home and Lot which, if omitted, would adversely affect Carter s Cove, other Owners or the Association. Maintenance obligations are more fully defined in the Declaration. 2. Personal Property. The personal property of an Owner shall be stored inside his Home or garage and not be visible to surrounding neighbors or from Association Property. 3. Window DÄcor. Window treatments (drapery, blinds, decorative panels or other tasteful window coverings) are permitted. No newspaper, aluminum foil, sheets or other temporary window treatments are permitted, except for periods not exceeding 3 months after an Owner first moves into a Home, or when permanent window treatments are being cleaned or repaired. 4. Alteration of Drainage. No change in the condition of the soil or the level of land shall be made which would result in any permanent change in the flow or drainage of surface water within Carter s Cove or on the Lot.
5 5. Air Dying. No linens, cloths, clothing, curtains, rugs, mops, laundry of any kind or other articles shall be hung dried and aired from any window, door, fence, or balcony in such a way as to be visible to any other Owner. Clotheslines are not permitted. TRASH AND OTHER MATERIALS 1. No rubbish, trash, garbage, refuse, tree limbs, grass clippings, hedge trimmings or other waste material ("Trash") shall be kept or permitted on the Lots or Association Property. For curbside pick-up, if possible and reasonable, Trash shall be placed in containers. 2. Trash that is required to be placed at the front of a Lot in order to be collected may be placed and kept at the curb after noon (12:00 p.m.) on the day before the scheduled day of collection, but not sooner. Any trash containers shall be removed after pick-up on the day of collection. 3. No odors shall be permitted to arise from trash containers so as to render any portion of Carter s Cove unsanitary, offensive or a nuisance to any Owners, to the Association Property or to any other property in the vicinity. 4. No stripped-down vehicles, lumber or other building materials, grass, tree clippings, metals, scrap, automobile pieces or parts, refuse or Trash shall be stored or allowed to accumulate on any portion of Carter s Cove. 5. Each Owner shall regularly pick up all Trash around his Home and Lot. 6. A person, who owns, possesses or controls a dog, cat or other animal shall remove immediately any feces left by such animal on any public or private place and to dispose of such feces in a sanitary manner. PARKING AND VEHICULAR RESTRICTIONS 1. Parking shall be permitted only on driveways and inside garages. No overnight parking on the streets is permitted 2. No vehicle or other possessions belonging to an Owner or to an Owner s family member, guest, invitee or tenant, shall be positioned in such a manner as to impede or prevent ready ingress or egress to another Owner s driveway. 3. No overnight parking of boats is allowed unless within the garage of the Home and with the garage door closed or in the backyard that has fencing and the boat cannot be seen from the outside of the fence. 4. No overnight parking of commercial vehicles is allowed unless within the garage of the Home and with the garage door closed. Trailers, motor homes and recreational vehicles shall not be parked in the Carter s Cove.
6 5. No repairs of vehicles shall be made within Carter s Cove unless the repairs take less than twenty-four hours. The only exceptions to the preceding shall be (a) emergency repairs; and repairs made within the garage of the Home. 6. Disposal of drained automotive fluids is not allowed within Carter s Cove. 7. All vehicles shall be kept in proper operating condition so as not to be hazard or a nuisance by noise, exhaust, emission, appearance or other wise. 8. No Owner shall keep any vehicle on the Lot which is deemed to be a nuisance by the Board. 9. No Owner shall perform restoration of any motor vehicle, boat or other vehicle within Carter s Cove unless made within the garage of the Home. The Board shall make a reasonable attempt to give notice to the owners of offending vehicles. If such vehicle is not removed or if the violation is not corrected, the Board may have the offending vehicle towed at the expense and risk of the owner of the vehicle.
