Thank you for the information. Attached is the ordinance that requires erosion and sediment controls, as well as sanctions to ensure compliance, to the extent allowable under state and local law. I have also attached the Civil Engineering (CE) Plan Submittal Process document that is on our website and outlines the steps for the Construction Site Stormwater Runoff Control Program in McKinney. Another document I have attached is a sample from the Pre Construction Conference, mentioned in the CE Plan Submittal Process document. Other documents we use to address stormwater runoff from construction are the Stormwater Design Manual, Erosion and Sediment Control Manual, Residential Builders Packet and Commercial Builders Packet, of which I have hyperlinked to save on space. Hopefully these references will provide the information needed to show that the requirements mentioned below are being met. There is some additional information that I will need before I can consider the technical review complete. Page 23 of appendix C is referenced for the following requirements a. Program requires soil stabilization measures, and implementation of BMPs to control pollutants from equipment and vehicle washing and other wash waters. b. Program requires operators to minimize exposure to stormwater of building materials, fertilizers, pesticides, herbicides, detergents, sanitary waste, and other materials. c. Minimize the discharge of pollutants from spills and leaks. As an alternative, ensure that the construction site has developed a stormwater pollution prevention plan in accordance with the TPDES construction General Permit TXR
3 Page 23 references the city s ordinance but without the ordinance I cannot confirm whether these requirements are being met. In compliance with page 19 of the TPDES general permit the City of McKinney has determined that stormwater from the MS4 discharges directly into two water quality impaired water bodies where a TMDL has not yet been approved by TCEQ and EPA. As summarized on page 8 of the SWMP stormwater in McKinney discharges to CWA 303(d) listed segments of Wilson Creek and East Fork Trinity River which are listed as impaired for bacteria. Bacteria is likely to be found in stormwater discharges and may contribute to the impairment of the water bodies. Therefore the SWMP includes focused BMPs, along with corresponding measurable goals, that McKinney will implement to reduce the discharge of bacteria to the maximum extent practicable. Specifically focused BMPs, along with corresponding measurable goals, will address sanitary sewer systems, on site sewage facilities, illicit discharges and dumping, animal sources and residential education and are referenced in Appendix C. The annual report will include information on compliance with these BMPs and corresponding measurable goals. Hopefully this response provides the additional information that will be required to complete the review process. Ms. Annita McCormick, I am the permit coordinator assigned to the application for coverage under TCEQ's Phase II MS4 General Permit, TXR for the City of McKinney, and I am currently conducting a technical review of the city s Stormwater Management Program (SWMP). TXR Upon reviewing the SWMP I have found that there is some additional information that will be required to complete this review process. Please review the following information and provide a response by Friday June 20 th. On page 19 of the TPDES general permit, an MS4 that discharges to an impaired water body without an approved TMDL is subject to the following requirements: (a) Discharges Directly to Water Quality Impaired Water Bodies without an Approved TMDL The permittee shall also determine whether the permitted discharge is directly to one or more water quality impaired water bodies where a TMDL has not yet been approved by TCEQ and EPA. If the permittee discharges directly into an impaired water body without an approved TMDL, the permittee shall perform the following activities: (1) Discharging a Pollutant of Concern a. Within the first year following the permit effective date, the permittee shall determine whether the small MS4 may be a source of the pollutant(s) of concern by referring to the CWA 303(d) list and then determining if discharges from the MS4 would be likely to contain the pollutant(s) of concern at levels of concern. b. If the permittee determines that the small MS4 may discharge the pollutant(s) of concern to an impaired water body without an approved TMDL, the permittee shall, no later than two years following the permit effective date, ensure that the SWMP includes focused BMPs, along with corresponding measurable goals, that the permittee will implement, to reduce, the discharge of pollutant(s) of concern that contribute to the impairment of the water body. c. In addition, no later than three years following the permit effective date, the permittee shall submit an NOC to amend the SWMP to include any additional BMPs to address the pollutant(s) of concern. (2) Impairment of Bacteria Where the impairment is for bacteria, the permittee shall identify potential significant sources and develop and implement focused BMPs for those sources. The permittee may implement the BMPs listed in Part II.D.4(a)(5) or proposed alternative BMPs as appropriate. (3) The annual report must include information on compliance with this section, including results of any sampling conducted by the permittee. 82 CITY OF MCKINNEY ENGINEERING DEPARTMENT CIVIL ENGINEERING PLAN SUBMITTAL PROCESS INTRODUCTION: The City of McKinney s Engineering Department is responsible for the review and approval of all new construction and reconstruction projects within the City limits as well as within its ETJ. The Engineering Department assists developers and design engineers in assuring that all public improvements for construction are designed to meet current City specifications. The following information is intended as a guide to aid developers/engineers/architects through the City of McKinney s civil engineering plan submittal process and to meet approval requirements. The City of McKinney s Engineering Department reserves the right to request additional information necessary to complete the review of specific development projects in addition to the information list here within. PRIOR TO CIVIL ENGINEERING PLAN SUBMITTAL: 1. Schedule a Pre-Development Meeting - A pre-development meeting is encouraged for all projects, and especially if you are new to McKinney or have a complicated development proposal. A pre-development meeting will be scheduled with representatives from the Fire, Engineering, Planning, Parks, and Building Inspection Departments to meet with the applicant or developer prior to the formal submittal of development plans. If needed, Contact Kathy Wright, Planning Tech, in the Planning Department to schedule a pre-development meeting. Please PlanningInfo@mckinneytexas.org or call for any additional information. 2. Obtain Record Drawings - The design engineer or licensed professional is responsible for obtaining and reviewing record drawings of all existing improvements and shall verify information related to paving and underground utilities within, adjacent to, and associated to the project area. Record Drawings may be obtained from the GIS department using the following form: Record Drawing and Other GIS Information Request Form Additional record drawings may need to be obtained from other governmental agencies or franchise utility companies. 3. Planning Submittals - All necessary City of McKinney Planning applications must be submitted prior to construction plan review. A conditional approval letter may be granted by the Planning Department to allow the civil engineering plan review process to begin. Once a submittal is made, the Civil process begins; review will continue until circumstances prevent the project from moving forward. Planning applications include, but are not limited to annexations, rezoning requests, general development plans, plats, and site plans. Obtain and Review Design Manuals - The design engineer is responsible for obtaining and reviewing all City of McKinney design manuals and related documents as well as all federal, state and local project specific associated documents. Civil Engineering Plan Contents - All civil engineering plans and related reports submitted for review and approval must be prepared under the direct supervision of a licensed Professional Engineer registered in the State of Texas and shall bear the seal of the Engineer of Record. All plans shall include minimum site specific civil sheets (per Art. III, Sec , 8) in addition to the following mandatory sheets: Cover Sheet Plat (recorded or pending version) Site Plan (commercial only) City of McKinney General Notes - Revised October 2011 Tree Survey & Tree Preservation Plans (if any trees onsite) City of McKinney Construction Details (detail updates currently under construction) All projects shall be tied to at least one of the City of McKinney s GPS Monuments with horizontal and vertical control points clearly defined in the plans. Should a construction project require the interruption of traffic on any existing roadway, a detailed traffic control plan shall be included in accordance with the Texas Manual on Uniform Traffic Control Devices (TMUTCD) and the City s Street Design Manual (1 MB file). All work and materials shall be in accordance with the City of McKinney Construction Standards and Specifications and the North Central Texas Council of Governments (NCTCOG) Public Works Construction Standards. Should a conflict be found between publications, the City of McKinney Standards and Specifications shall take precedence. In the event that an item is not covered by the City of McKinney Construction Standards and Specifications, the most current edition of NCTCOG Public Works Construction Standards shall apply with concurring notification by the contractor to and with approval from the City Engineering Department and Consulting Engineer. The Director of Engineering shall make the final decision regarding all construction materials, methods, and procedures specified in construction plans. Reference to any other documents contained in the project specifications shall be made to the latest edition of such documents and shall include the referenced specification in its entirety. Every attempt by the design engineer shall be made to ensure that all civil engineering plans are complete and comprehensible. Clean and concise plans are necessary for an efficient review, and to minimize confusion during construction. 2. Initial Plan Submittal - Two (2) complete 22 x 34 bound sets (one for Fire Dept., one for Engineering Dept.) of all the civil engineering plans shall be submitted to the City Engineering Department for review and approval. The initial submittal shall include a completed and signed Civil Engineering Plan Review Development Checklist. Each submittal shall be checked for completeness. Plans not meeting the above requirements will be returned without a review and marked Incomplete. 2 Rev. June 2010
84 All submittals (initial and subsequent, fire and engineering) shall be submitted through the project expeditors located on the first floor of the Development Services Building located at 221 N. Tennessee, McKinney, Texas Additional Submittal Requirements Tree Surveys and Tree Preservation Plans shall be submitted with all civil engineering plans for review. An Affidavit of No Trees may only be used if a property contains NO trees on site. Construction Tree Permits are required prior to the issuance of a development permit and building permit. Tree Permit Requirements Please submit two copies of any study and/or report completed in support of the project. These include, but are not limited to: Traffic Impact Analyses, Flood Studies, Geotechnical Reports, Utility Studies, etc. If routing software is used to design any detention basin (i.e. HEC-HMS), provide a CD with the original files at time of civil plan submittal. Note that if civil plans are submitted for review prior to site plan/plat approval, changes to the plans may be required as a result of site plan/plat approval conditions. If a site plan/plat has not been conditionally approved by Staff, we reserve the right to stop the review of civil plans until that has occurred. Provide room (3 in height x 5 in width) for the City Approval Block in the lower right-hand corner for approval signatures once plans are approved. Development projects where off-site extensions of public utilities are required, in accordance with the Subdivision Ordinance, are eligible for such reimbursements or prorations as made part of by a facilities agreement. It is recommended that the original developer provide the city with acceptable documentation of actual construction costs and quantities from which calculation of reimbursable amounts will be made for inclusion in a facilities agreement. The facilities agreement must be filed prior to the collection of any reimbursements. Finalization of the facilities agreement shall be done prior to filing of the Record Plat. In the event that the original developer does not wish to create a facilities agreement for Pro-Rata reimbursement, a waiver letter shall be submitted to the City. Please refer to Section of the Subdivision Ordinance for more information on Pro-Rata and Section of the Subdivision Ordinance for more information on Facilities Agreements. Easements by Separate Instrument (Offsite Easements) - All easements by separate instrument as necessary for the completion of all improvements shown in the construction drawings must be submitted to the City for review prior to filing at the County. All offsite easements must be executed prior to the release of a construction permit. Easement Document Templates and Instructions 4. Civil Engineering Plan Review & Resubmittals - The City of McKinney Engineering staff will review plans on a first in, first out basis. Initial review times will typically take 7-10 business days. Depending on complexity of project and/or case loads, additional time may be needed for review. Applicant will typically be notified electronically via (or phone call if requested) when review is complete and with instructions on picking up the reviewed submittal. Subsequent submittals shall include a complete set of civil engineering plans with the original City mark-ups. Provide written responses and/or explanations to any comments that need further clarification or are unable to be addressed. This can be done directly on the plans, or via a formal letter. Please use a different color ink if responding directly on the plans. Communication with the City Engineering staff via is encouraged to help provide clarifications and address any questions throughout the review process. 85 Department to schedule a meeting. When requesting a meeting, an agenda must be included so City Staff can prepare for a productive and efficient meeting. 5. Fire Department Review One of the two sets submitted in the initial plan submittal shall be forwarded to the Fire Marshall s Office for review. From there, the review and any subsequent submittals will be independent of the Engineering Department s review and any questions regarding Fire Department comments shall be directed to the Fire Marshall s Office. Submittal requirements along with the most current adopted codes and ordinances can be found on the City of McKinney Fire Department s webpage in the Fire Prevention Section. Plan Submittal Information Plan Submittal Guidelines Codes and Standards 6. Civil Engineering Plan Approval - Once all of the City Engineering and Fire Department comments have been appropriately addressed and the plans are deemed complete, City Staff will notify applicant with instructions for the Master Civil Set submittal. Applicant shall submit one full mylar (minimum 3 mil thickness) set of civil engineering plans with the City Approval Block located in lower right-hand corner. The City Approval Block is to be placed only on sheets with an Engineering seal. Do not place stamp on City or TxDOT standard construction detail sheets (modified detail sheets shall require the Engineer of Record s seal), landscape plans or other noncivil engineering related plans. The Engineering Department will sign and date the Master Civil Set and return it to the applicant. Developer is responsible for making enough copies of the Master Civil Set in order for all necessary contractors, sub-contractors, construction staking surveyors and private consultants whom the developer deems essential to have a copy. The developer shall supply seven (7) full size copies and one half size to the City. Developer is also responsible for supplying a CD of tif formatted electronic files of the signed Master Civil set. More specific, each sheet should be a separate tif file, and the files should be labeled according to the title of the plan sheet including sheet numbers, i.e. C1-Paving Plan, C2-Water Plan, C3-Grading Plan, etc. The order of the drawings on the CD should match the same order on the cover page. AFTER APPROVAL OF CIVIL ENGINEERING PLANS: 1. Prior to Construction - Prior to any construction taking place on the project site, a Pre- Construction Conference must take place. Once plans are approved and the City has received their seven (7) full size copies and one half size copy of the Master Civil Sets and all permits have been issued, the developer shall contact Blenda Sims, bsims@mckinneytexas.org, or to schedule a pre-construction meeting. Once a date has been set, the developer is responsible for contacting all of his/her contractors and consultants to inform them of the meeting time and location. All required inspection fees shall be due at the time of the pre-construction conference along with a detailed breakdown of the public infrastructure construction costs (per Art. I, Sec. 2-1, b). Inspection fees shall be 3.5% of the cost of all public infrastructure. All erosion control and tree preservation fencing shall be installed and approved prior to any site work commencing on project. Contractor shall notify the City 48 hours prior to any weekend work and 72 hours for work on a City Holiday. Weekend and holiday work is not guaranteed and contingent on Inspector s availability. Onsite during Construction - Each contractor or subcontractor must possess a copy of the stamped approved Master Civil set at the project site. At least one (1) copy of the SWPPP, the NOI, and TxDOT Permits as applicable shall be onsite at all times. 3. Revisions during Construction - All changes to plans and specifications must be routed through the City of McKinney Engineering Department. The design engineer shall provide a sealed drawing of the requested change for review. Not until the City Engineering Department has approved the revision, will work commence on said revision with the exception of emergency situations. 4. Requirements for Final Acceptance When project nears 95% completion, a Pre-Walk Final shall be scheduled by the Developer or representative with the City Inspector to review the project and discuss final acceptance requirements. Upon project completion and prior to the Final Walkthrough, the design engineer shall submit one set of preliminary record drawings for review. The record drawing set shall include any field changes and show actual built conditions. The City of McKinney Inspectors shall review this set for accuracy and use it during the Final Walk-through. The developer then shall schedule a Final Walk-through for the public improvements with the City Engineering Department. Developer must give the City 72 hours prior to requested walk-through date and is responsible for contacting all relevant non-city personnel. For final acceptance, developer must complete final acceptance checklist and submit all required information. Record Drawings In order to receive final acceptance, the design engineer must submit final record drawings including revisions per comments made during the final walk-through to the City of McKinney Engineering Inspector for review and approval. Record drawing requirements are provided on website: Record Drawing Submittal Process ADDITIONAL INFORMATION: 1. Project Specific Permits It is the responsibility of the Developer to obtain all necessary City of McKinney permits or letter(s) of permission from other public agencies including, but not limited to TxDOT, NTMWD, USACOE, TCEQ and FEMA. Copies of these permits shall be submitted to the City for review and record retention. The standard permits required for construction are as follows: a. City of McKinney Permits - All development or re-development within the City of McKinney requires a permit prior to the start of any construction. 87 Below is a list of the more frequently needed permits for construction: Development Permit Grading Permit (Please contact Dana Stillwell at ) Utility, Paving and/or Foundation Permit (Please contact Dana Stillwell ) Construction Tree Permit Building Permit b. Texas Department of Transportation (TxDOT) Permits - All TxDOT permits are issued to the City of McKinney and not the private developer. Permit plans shall be submitted to the Engineering Department for review and processing. All TxDOT permits shall be obtained prior to construction. TxDOT Permit Process 2. Texas Department of Licensing and Regulation (TDLR) - Developer shall submit a set of plans with the required review and inspection fees to TDLR. Proof shall be provided to the City Engineering Department that all fees have been paid and that all construction meets TDLR criteria. If not required, developer shall provide verification. TDLR website is 3. Early Grading Permits - In order for an Early Grading permit to be issued, an applicant must have the following submitted and approved by the appropriate City department: Grading Plans approved by the Engineering Department Erosion Control Plans approved by the Engineering Department Tree Permit and Tree Preservation Plan approved by the City Arborist Offsite drainage easements as needed If it is for a commercial project (as opposed to just public improvements required by the Subdivision Ordinance), a site plan must be approved with a conditional approval letter issued by the Planning Department note that all conditions required prior to issuance of a grading permit must be met. Pending record plat or minor plat approved with letter issued by the Planning Department, or copy of plat if on existing platted lot. 4. Retaining Walls - Retaining walls greater than 2 in height require a separate permit from the Building Inspections Department. Retaining walls over 4 must be structurally designed by an engineer registered in the State of Texas. The design must be reviewed and permitted by Building Inspections. 5. Storm Water Pollution Prevention Plan - The Owner is responsible for the preparation of the storm water pollution prevention plan (SWP3) per federal, state and City of McKinney guidelines. Copies of the filed Notice of Intent (N.O.I.) and Notice of Termination (N.O.T.) must be provided to the City of McKinney s Engineering Department via the project expeditor. 6. Facility Agreements - Per Article II, Section , a facility agreement is required for all improvements required by the City of McKinney subdivision regulations for platting, if said improvements will not be complete prior to filing a record plat, a minor plat, a minor replat or a final plat. 6 Rev.
