For the purpose of regulating the erection, site construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings and structures or portions thereof in the City and Borough, there is adopted by reference, as the building code of the

3 City and Borough, that certain compilation of rules and regulations prepared by the International Conference of Building Officials, a nationally recognized technical trade organization, which compilation is entitled "Uniform Building Code, 1997 Edition," (UBC) and five copies each of which have been filed in the office of the municipal clerk of the City and Borough, or places designated by the municipal clerk for public use, inspection and examination, and which compilation is made a part of this chapter as if fully set forth in this section, subject only to the enumerated additions, deletions and changes in this chapter Administration. Delete UBC Chapter 1, Administration, except as referred to elsewhere in this code "B" definitions. In UBC Section 203, Definitions, B, delete the definition of Building, Existing and add the following: "Building, existing, is a building that: (A) was erected before December 5, 1956; or (B) was erected before March 27, 1999 and complies with the building code regulations in effect at the time of construction." "M" definitions. In UBC Section 214, Definitions, M, add the following definitions: In Section 214, add the following: "Mechanical ventilation is a system that delivers tempered or controlled supply air to a space using air handling equipment. See AIR, SUPPLY in the Uniform Mechanical Code." "O" definitions. In UBC Section 216, Definitions, O, add the following: "Office is an area used by employees in which services, clerical work, professional duties and such tasks are performed." "V" definitions. In UBC Section 223, Definitions, the definition of "value" or "valuation," delete the reference to Section

4 107.2 and substitute therefor section , Fees Heating equipment room occupancy separation. In UBC Section 302.5, Heating equipment room occupancy separation, delete Group E and add Group I to the first exception. All references to boiler and central heating systems in the paragraph immediately preceding the exception apply only to boilers and central heating systems that are fuel-fired Special hazards in Group A occupancies. In UBC Section 303.8, Special hazards in Group A occupancies, all references to boiler and central heating systems apply only to boilers and central heating systems that are fuel-fired Group E occupancies defined. In UBC Section 305.1, Group E occupancies defined, delete Division 3 and add the following: "Division 3. Any building, or portion of a building, used for day care purposes for more than six persons, including children under the age of 12 related to the staff." Requirements for Group E occupancies. In UBC Section , Requirements for Group E occupancies, special provisions, add a new paragraph as follows: "Group E, Division 3 occupancies that are licensed to care for more than six persons between the hours of 10:00 p.m. and 6:00 a.m. shall be equipped with an approved automatic sprinkler system throughout, designed and installed in accordance with NFPA Standard 13D-1994 or approved equivalent system." Add the following exceptions: "4. Family child care homes operating between the hours of 6:00 a.m. and 10:00 p.m. may accommodate a total of eight children without conforming to all the requirements of this regulation except for smoke detectors as specified in Section 310.9; exiting, including operable windows in napping or sleeping rooms as specified in Section 310.4; and fire extinguisher requirements." "5. Day care facilities that are operated in a primary residence between the hours of 6:00 a.m. and 10:00 p.m. accommodating a total of 12 children may use the second story of the building without complying with Section Exception 2, Table 3-B, Table 5-A and Type V-1 hour requirements set out in Table 5-B provided all other applicable legal provisions for an E-3 occupancy are met."

5 Add a new third paragraph as follows: "Rooms used for sleeping or napping purposes within an E-3 occupancy shall be provided with a smoke detector that complies with Section " Requirements for Group E occupancies. In UBC Section 305.8, Requirements for Group E occupancies, all references to boiler and central heating systems apply only to boilers and central heating systems that are fuel-fired Requirements for Group F occupancies. In UBC Section 306.1, Division 1, Requirements for Group F occupancies, delete item 35, Refuse Incinerators Requirements for Group F occupancies. In UBC Section , Division 3, Requirements for Group F occupancies, add a new item as follows: "11. Refuse Incinerators." Requirements for Group I occupancies. In UBC Section 308.8, Requirements for Group I occupancies, all references to boiler and central heating systems apply only to boilers and central heating systems that are fuel-fired Requirements for Group R occupancies, access and exit facilities and emergency escapes. In UBC Section 310.4, Requirements for Group R occupancies, access and exit facilities and emergency escapes, in the third paragraph after "... sleeping room...," add the following: "or other habitable room over 70 square feet and not used for cooking, eating or living room uses." At the end of the third paragraph, add the following sentence: "The building official may accept a recorded deed restriction as an alternative to this requirement when the current use of the space will clearly not include sleeping." Additions, alterations or repairs to Group R occupancies.

6 read: In UBC Section , Additions, alterations or repairs to Group R occupancies, revise paragraph to "When a plan review is required in an existing Group R occupancy, smoke detectors shall be installed in accordance with Sections , and of this section." Smoke detector requirements for Group R occupancies. In UBC Section , Requirements for Group R occupancies, smoke detectors, location within dwelling unit, in the first sentence after "... sleeping room...," add the following: "or other habitable room over 70 square feet and not used for cooking, eating or living room uses." Revise the fourth sentence as follows: "When sleeping rooms are on an upper level, the detector shall be placed at the ceiling of the upper level in close proximity to the stairway if there is no door or other obstruction at the top of the stairway to block the path of smoke and near the ceiling at the bottom of the stairway if there is such an obstruction at the top of the stairway." At the end of the paragraph, add the following sentence: "The building official may accept a recorded deed restriction as an alternative to this requirement when the current use of the space will clearly not include sleeping." Smoke detectors and sprinkler systems requirements for Group R occupancies. In UBC Section , Requirements for Group R occupancies, smoke detectors and sprinkler systems, location in efficiency dwelling units, congregate residences and hotels, in the first sentence after "... congregate residence sleeping rooms...," add the following: "or other habitable room over 70 square feet and not used for cooking, eating or living room uses." At the end of the paragraph, add the following sentence: "The building official may accept a recorded deed restriction as an alternative to this requirement when the current use of the space will clearly not include sleeping." Heating in Group R occupancies. Change UBC Section , Heating in Group R occupancies, to read:

7 "Every dwelling unit or guest room which is situated on a lot any part of which is within one-quarter mile of a public or private road from which the owner may gain legal access to the lot or which is situated on a lot any part of which is within one-quarter mile of a public utility electric power distribution line shall be provided with heating facilities capable of maintaining a room temperature of 70 degrees F at a point three feet (914 mm) above the floor in all habitable rooms without involving the combustion of a solid fuel." UBC Section 412. In UBC Section 412 change "Section 101.3" to "Section , Scope." UBC Section 413. In UBC Section 413 change "Section 101.3" to "Section , Scope." UBC Section 414. In UBC Section 414 change "Section 101.3" to "Section , Scope." UBC Section 415. In UBC Section 415 change "Section 101.3" to "Section , Scope." UBC Section 416. In UBC Section 416 change "Section 101.3" to "Section , Scope." UBC Section 417. In UBC Section 417 change "Section 101.3" to "Section , Scope." UBC Section 418. In UBC Section 418 change "Section 101.3" to "Section , Scope." Fire resistive substitution. In UBC Section 508, Fire resistive substitution, add the following exception:

8 "Exception: In one-story E-1 occupancies, a fire sprinkler may be used in accordance with this section for fire-resistive substitution under the following conditions: 1. The fire sprinkler system must be fully compliant with UBC Standard The total square footage of the building must be 20,000 square feet or less, or area separation walls or occupancy separations having a fire-resistive rating of not less than two hours must be provided to subdivide the building into separate compartments that contain an aggregate floor area not greater than 20,000 square feet. When two-hour rated occupancy separations are used, they must extend up through the attic to provide a complete fire break." Fire-extinguishing systems; state permit. In UBC Section 904, Fire-extinguishing systems, add subsection as follows: " State permit. No sprinkler systems shall be designed, modified, installed or maintained except under the supervision of an individual or company holding a valid permit issued by the state fire marshal as required in 13 AAC The requirement for such a state fire marshal permit is not required in one- and two-family dwellings and mobile homes." Fire-extinguishing systems; floor area. In UBC Section , Fire-extinguishing systems, all occupancies except Group R, Division 3 and Group U occupancies, in the first sentence, delete the following: "the floor area exceeds 1,500 square feet (139.4 m 2 ) and" Fire-extinguishing systems; automatic sprinkler system. Revise UBC Section , Fire-extinguishing systems, all occupancies except Group R, Division 3 and Group U occupancies, by deleting the fifth paragraph and exceptions and adding the following paragraph: "5. In all newly created buildings that have floors used for human occupancy over 35 feet above the lowest level of fire department vehicle access shall be equipped throughout the building with an automatic sprinkler system that complies with Chapter 9 of the Uniform Building Code and Chapter 10 of the Uniform Fire Code. This shall not affect the provisions of UBC Section 505, Allowable Area Increases or UBC Section 508, Fire Resistive Substitution." Add subsections 6, 7 and 8 as follows: "6. When new construction, addition or remodeling creates a building where the ground floor area

9 exceeds 12,000 square feet. For this section only, not less than four-hour area separation walls may be used to divide larger buildings into buildings less than 12,000 square feet, however, automatic closing door openings with three-hour fire resistive ratings are allowed at a rate of no more than one opening in every 50 lineal feet of area separation wall." "7. When new construction, addition or remodeling creates a building where the total area under roof, regardless of area separation walls, exceeds 24,000 square feet." "8. In all buildings more than three stories in height." Fire-extinguishing systems, Group E occupancies. In UBC Section , Fire-extinguishing systems, Group E occupancies, delete exceptions 1 and Fire-extinguishing systems; alarms. In UBC Section , Fire-extinguishing systems, alarms, in the second sentence, add "visual strobe" after "audible." Permissible sprinkler omissions. In UBC Section 904.4, Permissible sprinkler omissions, a new item as follows: "6. In elevator mechanical rooms when all of the following criteria are met:" "6.1. The building is otherwise protected throughout with an approved automatic sprinkler system and;" "6.2. Such rooms are separated from the remainder of the building by a two-hour fire resistive occupancy separation with all openings in the separation protected by a fire assembly having a 1 1/2 hour fire protection rating and;" "6.3. Such rooms are used exclusively for such equipment and;" "6.4. An approved automatic smoke detection system is installed in such rooms and the system is supervised by an approved central, proprietary or remote service or a local alarm which will give an audible signal at constantly attended locations and;" "6.5. Other approved fire-protection equipment such as portable fire extinguishers or class II standpipes are provided adjacent to the entry into the room." "The above does not apply to elevator shafts. The fire sprinkler head for the top of elevator shafts may have a marked globe valve sealed open installed so the single head can be turned off in an emergency."

10 Definition of "private stairway." In UBC Section 1002, Definitions, "Private stairway", add the following to the end of the definition: "and not used by the public." Handrails. Following UBC Section , Handrails, insert a new paragraph reading: "In stairways serving a Group E, Division 3 occupancy, additional handrails located midway, plus or minus two inches, between the normal handrails and the nosing of the treads shall be provided if the stairway serves as an exit for children five years of age or younger." "The additional handrails shall have a space of not less than 1 1/2 inches between the wall and the handrails. The handgrip portion of the additional handrails shall be 1 1/4 to 1 1/2 inches in cross sectional dimension." Building security. Delete UBC Section 1009, Building security, in its entirety Accessibility, scope, general. In UBC Section , Accessibility, scope, general, add new paragraphs as follows: "Building owners are responsible to meet certain federal laws and regulations which regulate accessibility for disabled individuals in construction, addition, remodel, repair, and use of buildings. Among these regulations are the Americans with Disabilities Act (ADA) and the Federal Fair Housing Amendments Act (FHA)." "The Uniform Building Code and Title 19 do not necessarily meet the minimum requirements of the ADA or the FHA. The City and Borough of Juneau does not enforce those federal laws. Compliance with this code does not constitute compliance with the federal laws and does not provide immunity from liability under the federal laws." "Under section and section , Modifications and Alternative Materials and Methods, the City and Borough review plans prepared under the federal laws and approve construction work performed under the federal laws as meeting this code without thereby certifying that any federal requirements have been met. The design and construction of buildings to meet the federal laws are the exclusive responsibility of the owner of the building or structure."

11 Accessibility, standards of quality. In UBC Section , Accessibility, standards of quality, change adopted standard to "ICC/ANSI A " Design. In UBC Section , Design, change adopted standard to "ICC/ANSI A " Definitions, CABO/ANSI A In UBC Section 1102, Definitions, CABO/ANSI A117.1, change adopted standard to "ICC/ANSI A " Accessibility, Group R occupancies, general. Add the following sentence at the end of the first paragraph of UBC Section , Accessibility, Group R occupancies, general: "At least one building entrance shall be on an accessible route unless it is impractical to do so because of the terrain or unusual characteristics of the site." Accessibility, Group R occupancies, multifamily dwellings. Change the first sentence of UBC Section , Accessibility, Group R occupancies, multifamily dwellings, as follows: "In Group R, Division 1 occupancy apartments containing five or more dwelling units and Group R, Division 3 occupancies where there are five or more dwelling units in a single structure, all dwelling units shall be Type B dwelling units." For reference: A. Group R, Division 1 occupancies are apartments, hotels and condos with three or more dwelling units. B. Group R, Division 3 occupancies are houses with one or two units as well as zero-lot line homes and zero-lot townhouses. C. Type A dwelling units are required to be fully accessible for the disabled.

Type B dwelling units are "adaptable", roughly meaning that room and door dimensions are adequate and fixture controls are mounted for use by disabled individuals but grab bars do not need to be installed and cabinets and fixtures can be installed at standard heights as long as they can be easily adjusted for use by disabled individuals. E. Adaptable (Type B) units are only required on the ground floor unless an elevator is installed and the building code does not require elevators in any residential building. (UBC , Exception 1) F. Individual units that extend up more than one story in height and do not have elevators do not require adaptability. (UBC , Exception 3) G. The number of units requiring adaptability may be reduced by the percentage of the site with original grades in excess of 10 percent. (UBC , Exception 4) The UBC requirement for adaptable dwelling units in four-unit and larger projects is based on the Federal Fair Housing Amendments Act of 1988 and is required by federal law regardless of whether federal funds are involved. The Federal Fair Housing Amendments Act is enforced by lawsuit in federal court similar to the Americans with Disabilities Act Building accessibility, Group S occupancies. In UBC Section , Building accessibility, Group S occupancies, add the following exception: "Exception: For the total number of accessible for-rental storage units, use the same number of units as the number of required parking spaces in Table A-11-A, Number of Accessible Parking Spaces, in UBC Appendix Chapter 11. At least one of every type of for-rental storage unit shall be accessible." Temporary structures. Add a new UBC Section , Temporary structures, as follows: " Temporary structures. Temporary structures as defined in shall be accessible as follows:" "1) Construction related: no accessibility requirements," "2) Event related: the structure shall meet the accessibility requirements of the code, except that in regard to toilet facilities: when approved by the building official, temporary accessible bathrooms may be used, and/or accessible bathrooms in another accessible building on the same site or an adjacent or nearby site may be used when a signed use agreement is provided."

13 "3) Seasonal structures: Toilet facilities may be as per (2) above. The seasonal building itself shall be wheelchair accessible per the ICC/ANSI A117.1 or ADA-AG guidelines if more than the owner(s) will be allowed in the building." "Exception: Access is always required for kiosks used by the public. For employee-only kiosks, a "broker" kiosk requires a five-foot turning diameter due to potentially more than one person working inside; "vendor" or one-person working kiosks can delete the fivefoot circle as long as the door is wide enough for a wheelchair and the employee can back into the vendor kiosk and work from within. Also, when only employees use these vendor kiosks (never the public), then ICC/ANSI A117.1 or ADA-AG complying entrance platforms and ramps are not required; rather, a portable ramp stored on-site is an acceptable alternate." "4) First phase buildings: Toilet facilities may be as per (2) above. The first phase building itself shall be wheelchair accessible per the ICC/ANSI A117.1 or ADA-AG guidelines." "5) Temporary fabric covered buildings: Access for the disabled is required when building permits are required by title 19 for uses which require access for persons with disabilities. Access is required per (2) or (3) above when more than the owners enter or occupy the building." "6) Caretaker facilities: no accessibility requirements." Facility accessibility, toilet facilities. In UBC Section , Facility accessibility, toilet facilities, add a new paragraph as follows: "In all occupancies, change the required clearance for toilets (water closets) in ICC/ANSI , Section and Figure from "16 inches (405 mm) minimum to 18 inches (455 mm) maximum" to read "17 inches (432 mm) minimum to 19 inches (483 mm) maximum"." Ventilation generally. In UBC Section , General, add the following to the end of the first paragraph: "In newly-created Group B, occupancies, mechanical ventilation will be required in all spaces that are used as offices if the total aggregate area for the office use exceeds 1,000 square feet on each floor. No allowance for natural ventilation by openable windows is allowed. The system shall deliver not less than the air volume of outside or return air or both as required by this code." In the second paragraph, delete the following: "... a fully openable exterior window with an area not less that three square feet (0.279 m 2 ), or... "

14 Light in Group R occupancies. In UBC Section , Light in Group R occupancies, change the first sentence to read: "All guest rooms, dormitories and habitable rooms within a dwelling unit or congregate residence shall be provided with natural light by means of exterior glazed openings with an area not less than eight percent of the floor area of such rooms." Ventilation in Group R occupancies. In UBC Section , Ventilation in Group R occupancies, change the first sentence to read: "Guest rooms and habitable rooms within a dwelling unit or congregate residence shall be provided with natural ventilation by means of openable exterior openings with an area not less than 4% of the floor area of such rooms." Delete the third paragraph and replace the first sentence of the fourth paragraph with the following: "All bathrooms, water closet compartments, laundry rooms with more than one clothes washer and one clothes dryer and similar rooms shall be provided with a mechanical exhaust system connected directly to the outside with a minimum rated exhaust capacity of 50 cubic feet per minute and 100 cubic feet per minute for kitchens." Weather-resistant barriers. In UBC Section , Weather-resistant barriers, delete exceptions 1, 2, and Attic ventilation. In UBC Section , Attic ventilation, delete the following: "Where determined necessary by the building official due to atmospheric or climatic conditions." Roof drainage. In UBC Section 1506, Roof drainage, add subsection 6 as follows: " Sliding snow and ice. Roofs shall be designed so that snow is not discharged onto public ways, onto adjoining property, onto or against other buildings or in a manner that blocks any required exit from any building excepting yards."

15 Alternate basic load combinations. In UBC Section , Alternate basic load combinations, delete Exception 2 and add the following to the end of the section: "A minimum of 25 percent of the design snow load shall be included with seismic loads." Snow loads. In UBC Section 1614, Snow loads, add the following as the second paragraph: "For all elevations up to and including 500 feet above MLLW, the minimum basic ground snow load shall be 70 pounds per square foot and the minimum roof snow load shall be 50 pounds per square foot. For elevations more than 500 feet above MLLW, the snow load shall be determined by the building official." Basic wind speed for determining design wind pressure. In UBC Section 1618, Basic wind speed, change the first sentence to read: "The minimum basic wind speed for determining design wind pressure shall be determined by the building official using the Juneau Basic Wind Speed Map, dated 11/17/98." Minimum design lateral forces and related effects. In UBC Section , Minimum design lateral forces and related effects, delete item three and add a new item three to read: "A minimum of 25 percent of the design snow load shall be included." Table_16-I Seismic zone factor Z. In UBC Table_16-I, Seismic zone factor Z, change seismic zone factor Z for Zone 2B to 0.26 and use this modified Zone 2B for the City and Borough of Juneau Table_16-Q Interpolating values, Table_16-Q. In UBC Table_16-Q interpolate the values using Z = 0.26.

16 19.03.Table_16-R Interpolating values, Table 16-R. In UBC Table_16-R interpolate the values using Z = Structural masonry. In UBC Section , Structural masonry, add the following to the exception: "This does not relieve the requirements in Section 2105, Quality Assurance." Nondestructive testing. In UBC Section 1703, Nondestructive testing, delete "in Seismic Zones 3 and 4" from the first sentence Foundation investigation. In UBC Section 1804, Foundation investigation, add a new subsection reading as follows: " Each application for a permit for construction in an area which has been previously filled without a grading permit, was an exception to UBC Appendix Chapter 33, Excavation and Grading, of the applicable building code or was not filled in compliance with the applicable provisions of UBC Appendix Chapter 33 in effect when the fill was made or which appears to the building official to have an inadequate soil bearing capacity shall be accompanied by an engineering report and recommendation by a qualified engineer with substantial experience in soils or geologic engineering licensed to practice in the state; the building official shall incorporate in the permit those recommendations contained in the report which the building official deems necessary together with such other requirements as may be necessary to ensure the stability and safety of the proposed structure." Footings. In UBC Section , Footings, add new sentences to the end of the first paragraph reading: "The minimum depth of frostline shall be presumed to be 32 inches. Walls retaining more than four feet of unbalanced earth shall be designed as retaining walls. Exterior decks, landings, and platforms not rigidly attached to the building and not greater than 30 inches above grade may bear directly on the ground.
