1 EAGLE HARBOR HOMEOWNERS ASSOCIATION RULES AND REGULATIONS The following Rules and Regulations have been approved by the Board of Directors. These have been formulated to provide criteria for consistent decisions by the Committees and between successive committees and to assist the Committees and the Owners of Lots in keeping the community attractive for the enjoyment of residents and for the protection of property values: pursuant to the Eagle Harbor HOA Declaration of Covenants; Article II and Article III, Florida Statute ; section INDIVIDUAL GARAGE SALES: No individual garage sales are permitted. An individual may have an estate sale prior to moving out of the community with a 4 hour time limit. The estate sale has to be approved and scheduled thru the board. A community garage sale will be scheduled in October/November of each year unless a majority of the community requests an additional garage sale. 2. Landscape flower beds and tree rings: No cement curbing, edging, brick border edging is allowed. Except for the black plastic edging originally installed by the builder. 3. Brick walkways front or sides of house: Requests for walkways to be installed on the side of the house will be reviewed on a first come first serve basis. No owner may install a walkway adjacent to another existing walkway on a neighboring lot. All walkways must be as close to matching as the existing driveway of the property. 4. Mailboxes/maintenance: Mailboxes and posts must be black in color and of same style and size as existing within the community. Posts and mailboxes must be maintained in good condition and periodically treated and painted when fading or rusting occurs. Both sides to have 2 gold numbers. Mailboxes and posts must conform to the current Building Department and USPS Guidelines. No mailboxes are allowed to be mounted on the residence. 5. Sheds: No sheds are allowed to be erected on any part of the property. There are 2 sheds currently in existence (1320 and 1330 Talon Way) when these sheds get in a condition of disrepair they must be removed and not replaced.
2 6. Satellite Dishes and Antennas: Satellite dishes and antennas are permitted and not subject to ARC approval but must be located to the rear of the property. Satellite Dishes may not be larger than 39 and the latest FCC Guidelines must be referred to by the owner to ensure compliance. 7. Trash Cans: All exterior trash receptacles shall be placed no further forward than 3 feet behind the front building line of the residence or in the rear yard with landscape, fence, lattice or wall screening so as to make the same not visible from the street (including side street in the case of a corner lot) or other residences. No fence, lattice, or wall screening device shall be constructed without the written consent and approval of the Architectural Review Control Committee. Trash cans may be put out at 3: pm the day before the scheduled service day and must be put away by 9: am the day after the scheduled service day. For example: (if the scheduled service day is Monday you may put your trash out at 3: pm on Sunday and the trash cans must be put away by 9: am on Tuesday). Any tree / shrubs or yard waste is to be left out for that day s pickup only and left in piles no larger than 4 x 4 or carting company will not remove debris. 8. Plaques and House Numbers and Yard Ornaments: The Plaque size is 6 X9 and the font size of the numbers is 3 and must be a bronze style plaque. All Yard Ornaments and Figurines must be approved by the ARC before installation. 9. Pool Fences and Enclosures: Safety fences installed as part of the pool and as required by the building department and homeowner s insurance companies may not be the only source for enclosing a pool. All pools must have a perimeter fence or pool enclosure that matches one of the other approved existing perimeter fences or pool enclosures within the community. The perimeter pool fence or pool enclosure must be installed within 3 months of the pool construction being completed. This must be defined as part of the ARC application by the owner at the time of seeking approval for installing a pool. 10. Coach Lamps and Maintenance: All lots must have a yard light installed and operational in the front of the property at all times. All yard lights must be black in color, may not exceed 8 in total height, and must be carriage style fixture, one globe head only. Fixture may not be less than 12 in height no more than 16 in height. All light posts and fixtures must be kept in good condition and must be treated and painted when fading or rust occurs. Light bulbs must be white or clear.
3 11. Replacement of Trees in the Right of Way: Owners will be responsible for the maintenance, trimming, fertilization, pest control and replacement of the trees in the right of way. Replacement trees must meet the criteria as noted in the Declaration of Covenants and must be a minimum of 4 caliper at breast height. The only replacement trees permitted is a foxtail or queen palm tree. 12. Awnings and Hurricane Shutters: No awnings of any kind are permitted. Storm shutters are allowed to be put up 72 hours before a named storm is scheduled to hit Brevard County according to the local weather channel and must be removed within 72 hours after the named storm has passed. 13. Window Coverings: All Windows must have proper window coverings according to the Covenants. No mirror or silver film is allowed to be installed on any window. No bed sheets, blanket or other unsightly interior window covering allowed. 14. Garage Doors: All garage doors must meet the hurricane code and must be kept in good condition. No screen doors may be installed in garage door opening. Doors may not be left open for more than 2 hours when the garage is not being used /occupied by the resident. 15. Front Doors: Front doors must conform to the existing door style within the community and must be approved by the ARC. No screen doors or hurricane doors are permitted. 16. House Window Replacement: Window style must conform to the existing windows in the community and must be bronze color frame. Window style must be approved by the ARC. 17. House Paint Colors: Colors must be approved by the ARC before any painting can begin and must be one of the colors provided in the established paint color book. Available from management or board member upon request. 18. Fences/Style and Color: Fence colors and materials are as follows; black aluminum, bronze aluminum, white vinyl and beige vinyl. An ARC form is required to be submitted. Fence style and height will be determined by the ARC depending on the location of the lot. All fences must be approved by the ARC before any fence project is started. Two wood T/G fences exists in community currently, untreated and weathered, along with one unapproved 3 high wood picket perimeter fence. These fences will be brought under compliance with these guidelines when the need for replacement is required.
4 19. Basketball Goals: Portable basketball goals are permitted but must be kept at the side of the house when not in use. Basketball goals must not be used or placed any closer than 25 from the street curb. Basketball goals must be kept in good condition at all times. No permanently installed basketball goals are allowed. No basketball goal may be attached to any part of the house. Two existing permanent basketball goals are installed without approval currently. These goals will be brought under compliance with these guidelines when the need for replacement is required. Basket ball equipment may only be used from dawn to dusk absolutely no night lighting is permitted. 20. Replacement Roofs: All roofs must be shingle material, 3 tabs architectural; color to be matched with the only color used threw out the community, used by builder. All roof replacements have to be approved by the ARC before any roof project is started. 21. Boats/Trailers, Recreational and Commercial Vehicles: No parking of any recreational or commercial vehicles on the property, in the street or in the subdivision. Under no circumstances is a recreational or commercial vehicle to be parked within the subdivision other than vehicles for services being provided to the residence. Unauthorized parking of vehicles in the street is subject to being towed at the owner s expense. Random inspections by the contracted towing company will be made at their discretion to enforce this rule. At no time is any vehicle permitted to block the sidewalk. 22. Flowerbed Ground Covering: No mulch or any other ground covering is permitted except for Crimson Rock. 23. Personal items stored outside: No front/side lawn chairs, benches left outside. No tire rope swings hung from any tree. 24. Pets and animals: All animals to be kept supervised on a lease at all times when through out community, any waste from animals to be picked up and discarded properly.
5 25. Traffic Laws: Obey 20 mp speed limits through out the community. 26. Approved colors for exterior improvements: Paint gutters, fascia, top deck railings with same color brown paint approved by ARC Committee. Replacement or additional roof vent to be low profile, brown in color same used by builder. 27. Exterior maintenance of improvements: Clean exterior house, sidewalks, drive ways, fences. For mold, mildew, rust as needed. 28. Street parking: Limit car parking in the street and away from neighbor s property or driveway to avoid causing a driving hindrance. 29. Exterior grounds maintenance: Treat all shrubs, trees, lawns with fertilizer, weed and insect control, water as needed. Keep flower beds, walkway, and driveways clear of weeds. 30. Preapproval for Exterior Improvements: Any exterior changes need architectural approval. Need to submit proper ARC application form along with $35 application fee. 31. Covenant Enforcement and the Enforcement of the Rules and Regulations: The enforcement of the Covenants and the Rules and Regulations will be processed with a first letter of non compliance. Approximately 30 days later the second letter is a sterner letter again outlining the violation mailed to the owner. The 3 rd letter is an intent to fine letter giving the owner 14 days to comply or have the fine of $50 per day according to the Covenants be imposed against their property or request a Hearing. It is the preference of the board to not have to impose any fines on any property and that all owners comply with the letters when they are received. The whole purpose is to protect and preserve property values by keeping up the curb appeal within the community.
