1 Report BLD THE TOWNSHIP OF CENTRE WELLINGTON REPORT TO COUNCIL TO: Mayor Kelly Linton and Members of Council DATE: March 29, 2016 SUBJECT: Building By-Law Amendment to Revise Schedule A - Permit Fees RECOMMENDATION: THAT the Council of the Township of Centre Wellington authorizes the Mayor and Clerk to execute a by-law amending the Centre Wellington Building By-law , being a by-law respecting construction, demolition and change of use permits and inspections, to replace Schedule 'A' Permit Fees. SUMMARY: A fee increase averaging 2 to 3 percent is recommended, based on the staff analysis. Some other fees are proposed to increase by a greater amount to bring the fees to full cost recovery. For example, the minimum permit fee is proposed to increase from $88.00 to $ This level is consistent with other municipalities and is in line with the lowest fee currently charged for a deck permit. If approved, the building permit fee increase will take effect on April 1, REPORT: Prior to the implementation of major changes to the Building Code Act with Bill 124, the Township followed an industry standard of practice to annually adjust building permit fees by the rate of change in the Construction Price Index as reported by Statistics Canada each year. With Bill 124, this practice was discontinued and the setting of fees must be based on cost recovery according to Section 7 of the Building Code Act. Municipalities are not permitted to include costs associated with enforcement of property standards or other by-laws, nor can building permit fees be used to fund the costs of such work, or to fund the operation of other municipal departments. Municipalities are mandated to report annually the amount of building permit fees collected, and all costs related to the administration and enforcement of the Ontario Building Code Act. In addition, the Building Code Act also authorizes a Building Stabilization Reserve Fund. The purpose of this fund is to place any cumulative operating surpluses in the reserve fund to help offset any potential permit revenue declines inherent with the economic cycles of the building industry. The 2005 C.N. Watson Report on Building Permit Fees recommended a Building Stabilization Reserve Fund in the amount of 125% of the annual direct operating costs of the department. A statement of financial position of the Building Stabilization Reserve Fund is reported annually. To date the recommended reserve fund balance has not been attained, so permit fees should continue to contribute to the reserve fund. The Township s building permit fees have not been reviewed since Staff have been reviewing the fee schedule and consulting with other municipalities to determine if the fees being charged are appropriate and in line with other Building Departments fees. With this review now complete, it has been determined that the building permit fees being charged by the Township of Centre Wellington should be increased to cover the costs of delivering the services of the Building Division and also to ensure that adequate contributions are being made to the reserve fund. Therefore, it is being recommended that for 2016, the adjustment in permit fees deemed to be appropriate based on research completed by staff averages between 2.0% and 3.0%. Some fees are more of an increase due to being substantially out of line with the average fees collected by neighboring municipalities. The minimum permit fee, for example, is currently substantially lower than most other municipalities and as such it is being proposed that the fee be increased from $88.00 to $ which puts this fee the same as a deck permit fee. Staff compared similar and surrounding municipalities fee schedules and found that minimum fees and deck fees are almost always equal (See Attachment 2).

2 2 Report BLD BUDGET IMPLICATIONS: Cost Stabilization and Cost Recovery. Contributions to Reserve Fund for Future Business Continuity. CONSULTATION: Staff researched service delivery and permit fees of a number of neighboring municipalities to determine the appropriate increase to Centre Wellington s Building Permit Fees. Pursuant to Section 7 (1) (c) of the Building Code Act, 1992, S.O., 1992, c.23 and Building Code, O. Reg. 350/06), A Notice of Public Meeting was placed in the February 26, 2016 and March 4, 2016 editions of the Wellington Advertiser making the public aware of the intention to amend the Township of Centre Wellington Building By-Law to increase the Building Permit Fees. An was sent out to local home builders and the Centre Wellington Contractor s Association on February 23, 2016, which included the notice that would be appearing in the newspaper. Floor area of the proposed work is to be measured to the outer face of exterior walls (excluding residential attached garages) and to the center line of party walls, firewalls or demising walls. 2. In the case of interior alterations or renovations, area of proposed work is the actual space receiving the work (e.g. tenant suite). 3. Mechanical penthouses and floor, mezzanines, loft, habitable attics and interior balconies are to be included in all floor area calculations. 4. Except for interconnected floor spaces, no deductions are to be made for openings within floor area (e.g. stairs, elevators, service shafts). 5. Unfinished basements and garages for single-family dwellings (including semis, duplexes, and townhouses etc.) are not included in the floor area calculation. 6. Where interior alterations and renovations require relocation of sprinkler heads or fire alarm components, no additional fee is applicable. 7. Ceilings are included in both new and finished (partitioned) buildings. The permit fees for ceilings apply only when alterations occur in existing buildings. Minor alterations to existing ceilings to accommodate lighting of HVAC improvements are not chargeable fees. 8. Where demolitions of partitions or alterations to existing ceilings are part of an alteration or renovation permit, no additional fee is applicable. 9. Corridors, lobbies, washrooms, lounges etc. are to be included and classified according to the major occupancy classification for the floor area on which it is located. 10. The classes of building permits and occupancy categories in the schedule correspond with the definitions of major occupancy classifications in the Ontario Building Code. For mixed occupancies, the permit fees for each of the applicable occupancy categories may be used. 11. For rack storage use, apply the square footage fee that was used for the building. 12. A temporary building is considered to be a building that will be erected for not more than one year. 13. The Chief Building Official shall determine fees for classifications of permits not described or included in the schedule. Unless otherwise noted all definitions of building classifications shall be as defined in the Ontario Building Code for Major Occupancies.

11 11 Report BLD ATTACHMENT 4 Proposed Building By-Law #2016-XXX Schedule A THE CORPORATION OF THE TOWNSHIP OF CENTRE WELLINGTON BY-LAW NUMBER 2016-XXX BEING A BY-LAW RESPECTING CONSTRUCTION, DEMOLITION AND CHANGE OF USE PERMITS AND INSPECTIONS AND TO AMEND BY-LAW Whereas Section 7 of the Building Code Act, S.O. 1992, Chapter 23, as amended, empowers Council to pass certain by-laws respecting construction, demolition and change of use, transfer of permits, inspections and the setting and refunding of fees. Now therefore, the Corporation of the Township of Centre Wellington enacts as follows: 1.0 SHORT TITLE 1.1 This by-law may be cited as the Centre Wellington Building By-Law. 2.0 DEFINITIONS In this by-law, 2.1 Act means the Building Code Act, R.S.O including amendments thereto. 2.2 As constructed plans means as constructed plans as defined in the Building Code. 2.3 Applicant means the owner of a property or building who applies for a permit or any person authorized in writing by the owner to apply for a permit on the owners behalf, or any person or corporation empowered by statue to cause the demolition of a building or buildings and anyone acting under the authority of such a person or corporation. 2.4 Architect means the holder of a license, a certificate of practice or a temporary license under the Architects Act. 2.5 Building means a building as defined in the Building Code. 2.6 Building Code means the regulations made under Section 34 of the Act. 2.7 Chief Building Official means the chief building official appointed by by-law of the Corporation of the Township of Centre Wellington for the purposes of enforcement of the Act. 2.8 Construct means to do anything in the erection, installation extension or material alteration or repair of a building and includes the installation of a building unit fabricated or moved from elsewhere and construction has a corresponding meaning. 2.9 Construction site means any construction site in respect of which a building permit has been issued for construction of a new building within or adjacent to a residential zone except where the site is within a registered plan of subdivision when that subdivision is being developed for the first time Corporation means The Corporation of the Township of Centre Wellington Demolish means to do anything in the removal of a building or any material part thereof and demolition has a corresponding meaning Farm Building means a farm building as defined in the Building Code 2.13 Inspector means an inspector appointed under Section 3, 3.1, 4 32 or 32.1 of the Building Code Act Model Home means a new uninhabited single detached dwelling, semi-detached dwelling or street townhouse unit which is constructed to the requirements and provisions of the zoning category in which the model is proposed and is situated on lands in a draft approved plan of subdivision, with or without service connections, for the purpose of display and sale of the dwelling units to the general public Owner means the registered owner of the property and includes a lessee, mortgagee in possession, and the authorized agent in control of the property.

12 12 Report BLD Permit means written permission or written authorization from the Chief Building Official to perform work regulated by this by-law and the Act, or to change the use of a building or part of a building or parts thereof as regulated by the Act Person includes a corporation and a partnership and the heirs, executors, administrators and other legal representatives of a person to whom the context can apply according to law Plumbing means plumbing as defined in Section 1 (1) of the Act Professional Engineer means a person who holds a license or a temporary license under the Professional Engineer s Act, as defined in the Building Code Sewage System means a sewage system as defined in Section 1(1) of the Act Private Sewage Disposal System means sewage system or a sewage works which not owned and operated by the Crown, a municipality or an organization acceptable to the Director responsible for issuing a Certificate of Approval under the Ontario Water Resources Act Register Code Agency means a person or entity that has the qualifications and meets the requirements described in Subsection (4) of the Building Code Act Residential Construction Site means any construction site in respect of which a building permit has been issued for the construction of a new building of a single dwelling unit except where the site is within a registered plan of subdivision which subdivision is being developed for the first time Any word or term not defined in this Chapter that is defined in the Act or Building Code shall have the meaning ascribed to it in the Act or the Building Code unless inconsistent with the context thereof 3.0 CHIEF BUILDING OFFICIAL 3.1 The Chief Building Official is responsible to enforce the Building Code Act, the Building Code Regulations and the Building By-law. 3.2 It is important that the authority to regulate rests with the Council and that the Chief Building Official does not have the discretion to vary the procedures set out in the by-law established by Council. 3.3 The Chief Building Official is authorized to enter into and sign contracts for service agreements with registered code agencies and appoint them to perform specified functions from time to time in order to maintain the time periods for permits prescribed in Subsection of the Building Code. 3.4 The registered code agency may be appointed to perform one or more of the specified functions described in Section of the Building Code Act. 4.0 CLASSES OF PERMITS 4.1 No person shall construct, alter or demolish or cause to be constructed, altered or demolished a building, nor install, alter or cause to be altered plumbing, nor change or cause to be changed the use of an existing building in the Township unless a permit has been issued therefore, by the Chief Building Official in accordance with this By-law. 4.2 Classes of permits with respect to the construction, demolition and change of use of buildings and permit are as follows and their fees shall be as set out in Schedule D to this By-law are hereby established Building Permit Authorized under Subsection 8 (1) of the Act include plumbing, farm buildings, heating and ventilation, and swimming pool permits Demolition Permit Authorized under subsection 8 (1) of the Act Conditional Permit Authorized under subsection 8 (3) of the Act Change of Use Permit Authorized under subsection 10 (1) of the Act Partial Permit Authorized under subsection 8 (1) of the Act.

13 13 Report BLD Sewage System Permit Authorized under subsection 8 (1) (c) of the Act Alternate Solution Permit Authorized under section of the Code Sign Permit Authorized under subsection 8.(1) of the Act Material Change Permit Authorized under subsection 8.(12) of the Act Occupancy Permit Authorized under subsection 11.(1) of the Act 5.0 REQUIREMENTS FOR PERMIT APPLICATIONS To obtain a permit, the owner or an agent authorized in writing by the owner shall file an application in writing by completing a prescribed form available at the offices of the municipality or from the Building Code website Forms prescribed by the municipality under clause 7(f) of the Act are set out in Schedule "D" of this bylaw In addition to the requirements of Section B of the Building Code, the drawings, specifications and documents required in Schedule E of this bylaw shall be submitted prior to a building permit application to be deemed a complete permit application and therefore subject to the time periods within to make a decision to issue or not issue the building permit set out in Table B Where an application for a building permit is found to be incomplete and does not comply with Section B (5) of the Building Code, the application may be accepted for processing if the applicant acknowledges the same and completes the form set out in Schedule D of this Bylaw. 5.1 BUILDING PERMIT Where application is made for a building permit construct under subsection 8 (1) of the Act, the application shall: a) Use the provincial application form, Application for a Permit to Construct or Demolish ; and b) Identify and describe in detail the work and occupancy to be covered by the permit for which application is made, b) Describe the land on which the work is to be done, by a description that will be readily identified and locate the building lot, c) Include complete architectural, structural, site services and electrical plans and specifications as described in this by-law as determined by the scope of the work involved, except that for alterations or repairs the Chief Building Official may accept less. d) Indicate the occupancy of all parts of the building, e) State the area of the propose work and their occupancy classifications, f) State the names, addresses and telephone numbers of the owner, contractor, Architect or Engineer or, where applicable, other designer or person who will carry out the work g) A written undertaking of the owner that he has retained an architect or professional engineer to carry out the design and field review of the construction where required by the Building Code, including confirmation by the professional consultants of the Field Review and Rational Sampling Program Schedule, identity of the prime consultant, h) State estimated valuation of the proposed work including materials, labour and related direct costs associated with the work exclusive of land costs. i) Where applicable, an individual lot grading and drainage plan bearing the seal of a professional engineer or Ontario Land Surveyor who certifies thereon that the plan generally conforms with any approved overall subdivision or Site plan development agreement Grading and Drainage Plan. j) Where the subject property is located in an area of known termite infestation, a statement of confirmation identifying the proposed method and means of disposal of any infested wood products and or soil. k) Signed by the owner and or the owners authorized agent who shall certify the truth of the contents of the application.

14 14 Report BLD DEMOLITION PERMIT Where application is made for a permit to demolish under subsection 8 (1) of the Act, the application shall: a) Use the provincial application form, Application for a Permit to Construct or Demolish ; and b) Contain the information required by clauses 5.2 (a) to (g), and c) Be accompanied by satisfactory proof that arrangements have been made with the proper authorities for the cutting off and plugging of all water, sewer, gas, electric, and telephone or other utilities and services; d) Provide the reason for the demolition; e) Proof of liability insurance coverage to not less than $1,000, that relates to the proposed demolition; f) A description of the structural design characteristics of the building and a method of demolition prepared by a professional engineer where deemed necessary by the Chief Building Official; g) Information concerning the rehabilitation of the site to a graded, level and landscaped condition upon completion of the demolition. 5.4 CONDITIONAL PERMIT Where application is made for a conditional building permit under subsection 8 (3) of the Act, the application shall: a) Use the form, Application for a Permit to Construct or Demolish set out in Schedule "D" of this bylaw; and b) Contain the information required by clauses 5.2 (b) to (g), c) Contain such other information, plans and specifications concerning the complete project as the Chief Building Official may require, c) State the reasons why the applicant believes that unreasonable delays in construction would occur if a conditional permit is not granted, d) State the necessary approvals which must be obtained in respect of the proposed building and the time in which such approvals will be obtained, and e) State the time in which plans and specifications of the complete building will be filed with the Chief Building Official. f) Be accompanied with a completed Conditional Permit Agreement and security deposit as prescribed by the Chief Building Official 5.5 PARTIAL PERMIT When, in order to expedite work, approval of a portion of the building or project is desired prior to the issuance of a permit for the complete building or project, and an application is made for a partial permit under subsection 8 (1) of the Act, the application shall: a) Use the form, Application for a Permit to Construct or Demolish set out in Schedule "D" of this bylaw; and contain the information required by clauses 5.2 (b) to (g), b) Contain such other information, plans and specifications concerning the complete project as the Chief Building Official may require, c) State the reasons why the applicant believes that unreasonable delays in construction would occur if a partial permit is not granted, d) State the necessary approvals which must be obtained in respect of the proposed building and the time in which such approvals will be obtained, and e) State the time in which plans and specifications of the complete building will be filed with the Chief

15 15 Report BLD Where a permit is issued for part of a building or project this shall not be construed to authorize construction beyond the plans and specifications for which approval was given or that approval will necessarily be granted for the entire building or project Where a partial Building Permit is requested the full building or project application is deemed to be incomplete. 5.6 CHANGE OF USE Every application for a permit to authorize a change of use of a building issued under subsection 10 (1) of the Act shall be submitted to the Chief Building Official, and shall: a) Use the form, Application for a Permit to Construct or Demolish set out in Schedule "D" of this bylaw; and b) Describe the building in which the occupancy is to be changed, by a description that will readily identify and locate the building, c) Identify and describe in detail the current and proposed occupancies of the building or part of a building for which the application is made, d) Include plans and specifications showing the current and proposed occupancy of all parts of the building, and which contain sufficient information to establish compliance with the requirements of the Building Code, including: floor plans; e) Details of wall, ceiling and roof assemblies identifying required fire resistance ratings and load bearing capacities, details of the existing on-site sewage system, if any, f) Be accompanied by the required fee, g) State the name, address and telephone number of the owner, h) Be signed by the owner or his or her authorized agent who shall certify the truth of the contents of the application. 5.7 PRIVATE SEWAGE SYSTEM PERMIT Every application for a permit to construct a private sewage system issued under subsection 8 (1) (c) of the Act shall be submitted to the Chief Building Official, and shall: a) Use the form, Application for a Permit to Construct or Demolish set out in Schedule "D" of this bylaw; and b) Include a site evaluation prepared by a Professional Engineer which shall include all of the following items, unless otherwise specified by the Chief Building Official: i. The date the evaluation was done; ii. The name, address, telephone number and signature of the person who prepared the evaluation; and iii. Soil properties, including soil permeability, and soil conditions, including the potential for flooding c) A scaled map of the site showing: i. The legal description, lot size, property dimensions, existing rights-of-way, easements or municipal / utility corridors; ii. The location of items listed in Column 1 of Tables A., B. and C.; iii. The location of the proposed sewage system; iv. The location of any unsuitable, disturbed or compacted areas; v. Proposed access routes for system maintenance; vi. Depth to bedrock; vii. Depth to zones of soil saturation;

16 16 Report BLD d) Be accompanied by the required fee, e) Include design plans and specifications prepared and stamped by a professional engineer for the private sewage system which show all parts of the building and which contain sufficient information to establish compliance with the requirements of the Building Code f) State the owners, designers and installers name, address and telephone number, g) Proof that the person or persons who will, pursuant to Clause (1) (a) of the Act, supervise the construction on site, installation, repair, servicing cleaning or emptying of the sewage system is the holder of a current Provincial License. h) Be signed by the owner or authorized agent who shall certify the truth of the contents of the application. 5.8 REVISIONS TO PERMIT (Notice of Change) After the issuance of a permit under the Act, notice of any material change to an approved plan, specification, document or other information on the basis of which the permit was issued, must be given in writing on the township form Notice of Change set out in Schedule "D" of this bylaw, to the chief building official together with the details of such change Such change to the approved plans, specifications of documents shall not be made without the Chief Official s written authorization. 5.9 USE of EQUIVALENTS Where an application for a permit requests authorization to permit the use of an equivalent material, system or building design for which authorization under Section 9 of the Act is requested, the following information shall be provided: a) A description of the proposed material, system or building design for which authorization under section 9 of the Act is requested, b) Any applicable provisions of the Building Code; c) Evidence that the proposed material, system or building design will provide the level of performance required by the Building Code MODEL HOME PERMITS Every application for permit to construct a Model Home issued under subsection 8(1) of the Act shall: a) Use provincial application form, Application for a Permit to Construct or Demolish ; b) Include complete plans and specifications, documents and other information as required by Article B of the Building or the work to be covered by the permit; c) Include a certified cheque or Letter of Credit for 10% of the construction value of the model(s) being constructed; d) Include a site plan indicating the following: a. location and treatment of driveway access and parking; b. temporary storm drainage, grading, siltation and erosion control measures if necessary, until grading is completed in accordance with the requirements of the Director of Engineering; c. location and treatment of pedestrian access to the site; d. location and treatment of emergency vehicle access; e. proposed landscaping, fencing and signage; f. hydro facilities, 6.0 PLANS and SPECIFICATIONS 6.1 Sufficient information shall be submitted with each application for a permit to enable the Chief Building Official to determine whether or not the proposed construction, demolition or change of use will conform with the Act, the Building Code and any other applicable law. 6.2 Each application shall, unless otherwise specified by the Chief Building Official, be accompanied by two complete sets of the plans and specifications required under the by- law and Schedule E of this bylaw.

17 17 Report BLD Plans shall be drawn to scale on paper, cloth or other durable material, shall be legible and, without limiting the generality of the foregoing, shall include such working drawings as set out in Schedule E to this By-law, unless otherwise specified by the Chief Building Official. 6.4 Site Plans shall be referenced to an up-to-date Real Property Report (Survey Plan) and, when required to demonstrate compliance with the Act, the Building Code or other applicable law, a copy of a Real Property Report (Survey Plan) shall be submitted to the Chief Building Official and shall show: a) Lot size and dimensions of the property lines and setbacks to any existing or proposed buildings, b) Existing and finished ground levels or grades, and c) Existing rights-of way, easements and municipal services. d) Proposed fire access routes and existing fire hydrant locations e) A zoning compliance matrix. 6.5 A surveyor s certificate, prepared by a registered Ontario Land Surveyor, shall be submitted and approved prior to the commencement of the above grade portion and show the location of the foundation or foundations on the lot for the buildings, and for single family, semi-detached, duplex, four-plex, and row house, elevations shall be given for the top of foundation. 7.0 PAYMENT OF FEES 7.1 The Chief Building Official shall determine the required fees for the work proposed and calculated in accordance with Schedule A of this Bylaw and are due and applicant shall pay such fees. 7.2 The fees payable in respect of an application for a construction or demolition permit issued under subsection 8(1) of the Act or a conditional permit issued under subsection 8(3) of the Act are based on floor area, 7.3 Floor area shall mean the total floor space of all storeys above grade (or below grade for an underground home) measured as the horizontal area between the exterior walls of the building provided that where application is made for a conditional permit, fees shall be paid for the complete project. 7.4 Where fees payable in respect of an application for a change of use permit issued under subsection 10(1) of the Act are based on a floor area, floor area shall mean the total floor space of all storeys subject to the change of use. 7.5 Where there is no specific fee listed in schedule A for the proposed work the in respect of an application for a construction or demolition permit issued under subsection 8(1) of the Act or a conditional permit under subsection 8(3) of the Act fees payable shall be based on a construction cost valuation of the proposed work, the construction cost valuation of the proposed work shall mean the total cost of all work regulated by the permit, including the cost of all material, labour, equipment, overhead and professional and related services. 8.0 REFUNDS 8.1. In the case of withdrawal of an application or the abandonment of all or portion of the work or the noncommencement of any project, the Chief Building Official shall upon written request of the owner / applicants, determine the amount of paid permit fees that may be refunded to the applicant, if any, in accordance with Schedule C attached to and forming part of this By-law. 9.0 REQUIRED NOTICE FOR INSPECTIONS 9.1 The owner or authorized agent/permit holder shall notify the Chief Building Official or registered Code Agency where one is appointed, at least two (2) business days (48 hrs) prior to each stage of construction for which notice in advance is required under section of the Building Code and set out in Schedule C. 9.2 With respect to additional notices under of the Building Code and set out in Schedule C, the owner or an authorized agent shall notify the chief building official or an inspector at least 2 business day(s) prior to each stage of construction for which notice in advance is required under the Building Code. 9.3 The owner or authorized agent/permit holder shall provide the notice of completion as

18 18 Report BLD prescribed by Section 11 of the Act, or where occupancy is required prior to completion, notice of inspection to ensure that the requirements of Section 11 of the Act and subsection of the Building Code are complied with. 9.4 Upon receipt of proper notice, the inspector or Register Code Agency, if one is appointed, shall undertake a site inspection of the building to which the notice relates in accordance with the time periods stated in Article of the Building Code and Section 11 of the Act PRESCRIBED FORMS 10.1 The forms prescribed for use as applications for permits, orders and for inspections reports shall be as set out in Schedule D to this By-law AS CONSTRUCTED PLANS 11.1 The Chief Building Official may as a condition of approval of a permit require that a set of plans of a building or any class of buildings as constructed be filed with the Chief Building Official an completion of construction under such conditions as may be prescribed in the Building Code FENCING 12.1 The person to whom a building permit is issued in respect of construction which will take place in respect of construction which will take place at a Residential Construction Site shall erect or cause to be erected and maintained a fence enclosing the Residential Construction Site in accordance with the provisions of this Bylaw Where there is fencing on or adjoining a Residential Construction Site erected prior to the application for a building permit in respect of that site, such fencing shall be deemed to be in compliance with this By-law provided it is extended along the entire perimeter of the Residential Construction Site as determined by the Chief Building Official and the extended fencing is erected in accordance with this by-law Despite sections (1) & (2) above, the requirements of this by-law do not apply where the building permit has been issued prior to this By-law coming into effect The height of every fence shall be a minimum of 4 feet ( 1.2 meters) and a maximum of 6 feet ( 1.8 meters), to be measured from the highest adjacent grade Every fence required under this by-law shall be located on the perimeter of the Residential Construction Site as determined by the Chief building Official and constructed as follows a) Where chain link fence is used, the chain link shall be fastened to a 1 1/2 inch diameter metal bar which is securely fastened to metal posts at not over 10 feet on centre and embedded into the ground to provide a rigid support; b) If of wood construction, the exterior face shall be of 1/2 inch exterior plywood, particle board or equivalent material, that will not provide footholds for climbing. The facing shall be supported by 2 in. X 4 in. nominal size posts spaced at not more than 8 feet on centre and embedded in the ground to provide a rigid support; c) If the fence is of the snow fence or plastic mesh type, the fence should be securely fastened to T-bar posts at not over 10 feet on centre and which are embedded into the ground to provide a rigid support. The snow fence or plastic mesh shall be supported along its top and bottom edge with wire; d) Other materials or methods may be substituted provided that there is a equivalent barrier between properties and an equivalent degree of safety is provided. e) The fence may provide for openings sufficient to accommodate construction vehicles, machines and any other equipment providing services to the residential Construction Site provided that these openings are closed off and locked when the site is shut down for the day TRANSFER OF PERMITS 13.1 Any permit issued grants a privilege with respect to a specific building at a specific location in accordance with the plans, specifications and other documents filed and may be transferred when the land changes ownership subject to; a) Use the Township application form, Application for a Transfer of Building Permit Ownership set out in Schedule "D" of this bylaw; and

19 19 Report BLD b) A payment of the fee in accordance with Schedule A. c) Written statement from the new owner acknowledging assumption of responsibility for all conditions of approval upon which the permit was issued d) Where applicable, proof of engagement of design professionals to undertake field review e) Submission of information required by clauses 5.2 (1) (e) (f) (g) SEVERABILITY 14.1 If any section, subsection clause paragraph or provision of this by-law is found to by a board of competent jurisdiction to be invalid or beyond the powers of Council to enact, such section subsection, clause, paragraph or provision shall be deemed to be severable from the remainder of this By-law and all other parts or sections of this By-law shall be deemed to be separate and independent there from and are enacted as such METRIC CONVERSION Where the text of this By-law refers to imperial measurement, conversion to metric equivalents may be accepted as considered appropriate by the Chief Building Official. Floor area of the proposed work is to be measured to the outer face of exterior walls (excluding residential attached garages) and to the center line of party walls, firewalls or demising walls. 2. In the case of interior alterations or renovations, area of proposed work is the actual space receiving the work (e.g. tenant suite). 3. Mechanical penthouses and floor, mezzanines, loft, habitable attics and interior balconies are to be included in all floor area calculations. 4. Except for interconnected floor spaces, no deductions are to be made for openings within floor area (e.g. stairs, elevators, service shafts). 5. Unfinished basements and garages for single-family dwellings (including semis, duplexes, and townhouses etc.) are not included in the floor area calculation. 6. Where interior alterations and renovations require relocation of sprinkler heads or fire alarm components, no additional fee is applicable. 7. Ceilings are included in both new and finished (partitioned) buildings. The permit fees for ceilings apply only when alterations occur in existing buildings. Minor alterations to existing ceilings to accommodate lighting of HVAC improvements are not chargeable fees. 8. Where demolitions of partitions or alterations to existing ceilings are part of an alteration or renovation permit, no additional fee is applicable. 9. Corridors, lobbies, washrooms, lounges etc. are to be included and classified according to the major occupancy classification for the floor area on which it is located. 10. The classes of building permits and occupancy categories in the schedule correspond with the definitions of major occupancy classifications in the Ontario Building Code. For mixed occupancies, the permit fees for each of the applicable occupancy categories may be used. 11. For rack storage use, apply the square footage fee that was used for the building. 12. A temporary building is considered to be a building that will be erected for not more than one year. 13. The Chief Building Official shall determine fees for classifications of permits not described or included in the schedule. Unless otherwise noted all definitions of building classifications shall be as defined in the Ontario Building Code for Major Occupancies.

23 23 Report BLD SCHEDULE B REFUND SCHEDULE FOR CONSTRUCTION, DEMOLITION AND CHANGE OF USE PERMITS Attached to and forming part of By-law 2016-XXX 1.0 In the case of withdrawal of an application or the abandonment of all or a portion of the work or the non-commencement of a project, the fees that may be refunded shall be a percentage of the fees payable under this By-Law as follows based on the following functions having been performed: a) Administrative functions only: 80% b) Administrative and zoning certification functions: 70% c) Administrative, zoning certification and plans examination: 45% d) Permit issued and no field inspections have been performed 35% e) Subsequent to permit issuance additional deduction for each inspection performed: 5% 2.0 Notwithstanding subsection 1.0, above, no refund shall be made of an amount less than One Hundred Dollars ($100.00). 3.0 No refund shall be made unless the owner or his agent therefore makes a written application within 6 months of withdrawal of application, or abandonment or non-commencement of the work or project and the permit is returned for cancellation. 4.0 Notwithstanding subsection 1.0, above, no refund shall be made where the Chief Building Official has revoked a permit under Section 6 (4), (a), (b), and (c) of the Building Code Act R.S.O

24 24 Report BLD SCHEDULE C REQUIRED NOTICES AND INSPECTIONS FOR CONSTRUCTION, DEMOLITION AND CHANGE OF USE PERMITS Attached to and forming part of By-law 2016-XXX 1.0 Required Notices and Inspections The person to whom a permit under Section 8 of the Act is issued shall notify the chief building official or, where a registered code agency is appointed under the Act in respect of the construction to which the notice relates, the registered code agency of: 1 Commencement of construction, Part 3 buildings 2 Readiness to construct footings, 3 Substantial completion of footings and foundations prior to commencement of backfilling, 4 Substantial completion of a) structural framing and ductwork and piping for heating and air-conditioning systems, if the building is within the scope of Part 9, or b) structural framing and roughing-in of heating, ventilation, air-conditioning and air-contaminant extraction equipment, if the building is not a building to which Clause (c) applies; c) For other than Part 9 buildings, substantial completion of structural framing for each storey 5 Substantial completion of insulation and vapour barriers; 6 Substantial completion of air barriers systems; 7 Substantial completion of all required fire separations and closures and all fire protection systems including standpipe, sprinkler, fire alarm and emergency lighting systems, 8 Completion of construction (Occupancy Permit) and installation of components a) required to permit the issue of an occupancy permit under Sentence (2) or b) to permit occupancy under Sentence (1), if the building or part of the building to be occupied is not fully completed, c) to permit occupancy of a residential dwelling under section of Div C. d) substantial completion of fire access routes 9 Completion of interior finishes (Final Inspection) a ) heating, ventilating, air-conditioning and air-contaminant extraction equipment, b) exterior cladding, c) site grading, 10 Completion and availability of drawings of the building as constructed. 26 26 Report BLD SCHEDULE E SCHEDULE OF DOCUMENTS, DRAWINGS AND SPECIFICATIONS REQUIRED FOR CONSTRUCTION, DEMOLITION AND CHANGE OF USE PERMITS Attached to and forming part of By-law 2016-XXX The following types of drawings at a legible scale, specifications and documents are required to be submitted in order for the various types of Building Permit Applications listed to be considered a complete application pursuant to section 2.4 of the Building Code as amended and the Building Bylaw. Depending upon the nature, scope and scale of a project other additional supporting drawings, specification and documents may be required to demonstrate Ontario Building Code compliance at the discretion of the Chief Building Official. A minimum of 2 sets of drawings, specifications and documents shall be submitted with each building permit application. For all new construction and major renovations for all Part 3 buildings the required plans shall be submitted in a digital PDF or DWG ACAD format compatible with the municipality s software system unless exempted by the Chief Building Official. Demolitions a) Description of the structural design characteristics of the building and a method of demolition prepared by a professional engineer as per the Professional Engineers Guidelines. b) Site Grading and Rehabilitation Plan including soil erosion and siltation management details. c) For additions, submit confirmation that the final lot grading and drainage is in accordance with the overall subdivision lot grading and drainage plans or a waiver signed by the homebuilder who posted the lot grading and drainage deposit permitting the construction. d) Confirmation that arrangements have been made with the proper authorities for the cutting off and plugging of all water, sewer, gas, electric, and telephone or other utilities and services. e) Proof of liability insurance coverage to not less than $5,000,000.00, that relates to the proposed demolition, f) Where a building is designated under the Heritage Act, approval of the Township Council to dedesignate the building and permit demolition. g) Where the building is located within an area of known termite infestation, the owner/contractor s undertaking confirming that all waste wood and cellulose materials shall be destroyed or disposed at a provincially licensed waste disposal site.

Depending upon the nature, scope and scale of a project other additional information may be required to demonstrate Ontario Building Code compliance at the discretion of the Chief Building Official. 1.1 The Site Plan shall show: a) The location, use, height and dimensions of any existing and proposed buildings including front, side, and rear yard dimensions and relationships to adjoining property lines, condominium corporation lines and buildings, b) Existing and proposed elevation contours of the building site and adjacent properties c) Relation of buildings and finished grade to existing elevations and storm water drainage control plan on site where applicable, d) All existing and proposed site services, parking layout, retaining walls, swimming pools accessory buildings and any other such physical additions necessary to the site. e) Parking and G.F.A calculations, location and size of typical parking, loading and handicapped spaces including aisle widths serving the parking spaces. f) Site statistics that may be relevant to what is being proposed, such as but not limited to: number of residential units, gross floor area, amenity area, proposed height etc.

30 30 BLD g) Elevation drawings clearly indicating compliance with height regulations including various calculations such as average grade calculations where require h) The location of all fire hydrants, fire access routes and where applicable on-site fire fighting water reservoirs. 1.2 The Architectural Drawings shall show: a) Designers and/or Firms Building Code Identification Number including statement of responsibility for the building design b) Architects/designer s Ontario Building Code data matrix c) Foundation plans and grade details d) Each floor plan with exact dimensions of the layout of all proposed areas and their use, e) All wall thicknesses and type of construction, window and door openings and schedules elevator, sections and details of all walls, stairs and exits, fire walls, fire separations, shaft and duct openings sand other related pertinent information. f) Building elevations, cross sections and wall sections showing all floor to floor heights, materials and thickness etc. g) Spatial separation table and calculations h) Energy Efficiency Design Summary Matrix 1.3 Structural Drawings shall show: a) All foundation, floor, roof and wall structural elements indicting sizes shapes and proper location and all dead and live design loads and condition of loading. b) All reinforced concrete work indicting thickness and strength of concrete, size spacing minimum cover and type of reinforcing steel, c) All lintel locations and sizes. d) Where applicable i. Engineered Roof and Floor Truss drawings 1.4 The Mechanical Electrical and Plumbing Plans shall show: a) For buildings defined in Part 9 of the Building Code, provisions for heating, ventilation and air conditioning, electrical and plumbing systems may be shown and indicated on the architectural drawings, b) For Buildings defined in Part 3 of the Building Code, a separate set of drawings for heating ventilation air conditioning, electrical and plumbing systems. c) The location of all fire protection equipment such as early warning, detection and suppression systems. d) Energy Efficiency Design Summary Matrix (ASHREA 90.1) e) Where the primary heat source is provided by heat/hot water combination unit, a solar or geothermal system the all design drawings and documents must be prepared by a Professional Engineer f) Optional: i.
