Q 1 NCEBC Q: If there is already one accessible bathroom in a commercial building, does the inaccessible bathroom have to be made accessible? A: Yes 1. If new. 2. If on Path of Travel (to maximum extent feasible). 49
Q 2 NCPC Exc. 5 Q: If the NCPC Exc. 5 permits two unisex facilities in lieu of a single M and F toilet room, can NCBC Exc. 3 be applied to reduce the number of accessible restrooms to 50%? A: No, NCBC Exc. 3 requires at least 50% but not less than one room for each use at each cluster to be accessible. The M and F restrooms are different uses, so each use is required to be maintained in its unisex configuration. 50
Q 3 NCPC Exc. 5 Q: If a building has inaccessible restrooms, can one restroom be changed to an accessible unisex facility (to meet ADA barrier removal obligations) while still labeling the other restroom for its original use? A: No, while NCBC Exc. 3 permits 50% to be accessible in a cluster, such an action does not address the not less than one room for each use at each cluster to be accessible requirement. Let s say the M s room remained (multifixture) while the W s room (single fixture) became the accessible unisex. When the unisex is used by a male, no F restrooms are available at all. 51
4 NCBC Q: NCBC states assisted-use toilet and bathing rooms are required in recreational facilities where separate-sex bathing rooms are provided. Does this apply to racquet-ball clubs? A: Yes, NCBC requires assisted-use toilets in Assembly and Mercantile where 6 or more aggregate M + F water closets are required Does not apply to nightclubs [NCBC Exc. 2] Recreational facilities where separate sex facilities are provided [a racquet ball club is considered recreational] 52
Questions For further questions: TEL FAX On the , please include: name firm phone number project name/location Reference On-line aids at Engineering and Codes AccessibilityUpdates 53
3 NCBC A: NCBC states Family or assisted-use toilet and bathing rooms. In assembly and mercantile occupancies, an accessible family or assisted-use toilet room shall be provided where an aggregate of six or more male and female water closets is required. In buildings of mixed occupancy, only those water closets required for the assembly or mercantile occupancy shall be used to determine the family or assisted-use toilet room requirement. In recreational facilities where separate-sex bathing rooms are provided, an accessible family or assisted-use bathing room shall be provided. Fixtures located within family or assisted-use toilet and bathing rooms shall be included in determining the number of fixtures provided in an occupancy. 54
