3 RESTAURANT REQUIREMENTS (International Building Code 2006) (State Regulations And Local Ordinances) This information sheet is designed to help you meet the needs for opening and operating you new restaurant. The following requirements that shall be met prior to the opening of any restaurant. 1. Fire safety inspection 2. Grease trap 3. Backflow assembly 4. State Health Inspection and permit 5. Sales tax permit (business name) Existing public and/or commercial buildings are required to complete an Asbestos Survey prior to any renovation or remodeling work is started. The fire safety inspection will determined type of occupancy and occupancy load. City of Mount Vernon

4 ORDINANCE AN ORDINANCE BY THE CITY OF MOUNT VERNON, TEXAS AMENDING SECTION 5-9 OF ARTICLE 1, CHAPTER 5, AMEND BUILDING PERMIT FEES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOUNT VERNON, TEXAS. Sec Building Permit Fees. A. Introduction. Prior to issuing a permit, a drawing showing the measurements of the lot shall be furnished to the city. The drawing shall also show the location of the proposed structure on the lot. It should also show the square feet of the structure. In some cases, it will require up to ten (10) days for permit review and site inspection before a permit can be issued. Citizens are urged to visit with city staff to determine applicability of the provisions of this ordinance. General fee provisions are set out in the following paragraphs. General fees for new construction of structures and the remodeling or renovation of existing structures are based on the tables at the conclusion of this Ordinance. B. Fences, Driveways, Residential Roofs. Residential Fences Permit Fee Shall Be $25.00 Residential Driveway Permit Fee Shall Be $25.00 Residential Roof (remove old or roof over) $25.00 Note* Commercial Roof, Fences, & Driveways Permit Fees will be based on the cost of the project. C. Homestead Fee Limits (65 and over only) Citizen s Homestead. The maximum permit fee for any permit for the Citizen s Homestead Property, with the exception of new construction, will be a maximum fee of sixty dollars ($60.00) each. Proof (copy of tax receipt showing homestead status and driver s license) shall be provided with the application in order to receive the homestead status fee. D. Demolition of Building or Structures. The permit fee for the demolition of any building or structure shall be one hundred dollars ($100.00). E. Moving of Building or Structures. The permit fee for the moving of any building or structure shall be one hundred dollars ($100.00). City of Mount Vernon

5 F. Re-Inspections. The permit fee in circumstances requiring a re-inspection mandated by code (i.e., building code, state plumbing code, insurance or other circumstances requiring additional building code, natural gas or electrical certification) shall be thirty dollars ($30.00) for each reinspection. G. Bonding required of applicant. Each applicant for a permit shall furnish a good and sufficient indemnity bond or insurance policy. The city shall be held harmless from all claims on account of any injury done to any person or property by any reason for which the permit is required. Proof of such bond or insurance coverage shall be filed with the permit application. H. Penalty. Double Permit Fee. Where work for which a permit is required by this Code is commenced prior to obtaining the appropriate permit, the applicable fee shall be doubled. The payment of such penalty fee shall not relieve any person from fully complying with the requirements of all applicable laws in the execution of the work nor from any other applicable penalties I. Permits Requiring a License Permits For Plumbing, Electrical & Mechanical, Require A State License, Applicant Will Be Asked to Show Current License. Permit Fee Other Than New Construction Plumbing $40.00 Electrical $40.00 Mechanical $40.00 Fire Safety Inspection $50.00 with Certificate of Occupancy J. Fee Structure and Tables. The Fees set forth in the following tables are based on project cost and shall be determined based on project cost, regardless of valuation established for property tax purposes. *note Permit shall include total value of work, including materials and labor for which the permit is being issued, such as electrical, gas, mechanical, plumbing equipment and permanent systems. If, in the opinion of the building official, the cost is underestimated on the application, the permit shall be denied, unless the applicant can show detailed estimates to meet the approval of the building official.

8 On August 10, 2001, the Texas Department of Health (TDH) sent a list of Frequently Asked Questions to all Texas Building Permit Officials. The FAQ s addressed Senate Bill 509. Senate Bill 509 requires Municipalities to verify that an Asbestos Survey has been conducted prior to issuing renovation or demolition permits for public or commercial buildings and affects renovation and demolition permits for public or commercial buildings issued by Municipalities on or after January 1, Was an Asbestos Survey performed in accordance with Texas Asbestos Health Protection Rules (TAHPR) and the National Emission Standards for Hazardous Air Pollutants (NESHAP)? Applicant s Initials Please check if information on Application is to be kept Confidential: Yes No SERVICE AGREEMENT The Texas Commission on Environmental Quality (TCEQ) requires that water supplies have an agreement with every water customer that allows the supplier to check the customer s system for possible cross connections between the customer s private lines and the public water system. A cross connection is a connection that may allow contamination to enter the public water system from the private system. Potential contamination must be prevented from entering the public system by either installing and annually testing a TCEQ approved back-flow device or utilizing a 6 air gap. Additionally, use of lead pipe (greater than 8%) or solder/flux containing more than 0.2% lead is prohibited. By signing this agreement, you are authorizing City officials to inspect your plumbing for possible cross connections. In the event a cross connection is located, the customer must immediately correct the problem with one of the methods mentioned above to prevent termination of service. 20 Certificate Of Occupancy Inspection Information NOTE: A Building Permit is required for any alteration or construction work. To receive an inspection for Certificate of Occupancy, it is important that the following instructions are followed: 1. Complete Certificate of Occupancy application. 2. Return application to the City and pay fee. 3. Request a Certificate of Occupancy inspection. 4. Post your approved permit application (tape to door or window). 5. Have space or building open from the hours of 8:00a.m-5:00p.m. The Certificate of Occupancy inspection is an inspection for life safety items and general maintenance. Some common items noted during inspection are listed below. This list is not intended to be an all-inclusive list. 1. Doors to the exterior should not have double key locks, slide bolts, or other locking devices other than a thumb turn lock or bolt. 2. When required, illuminated exit signs must be in good working order. 3. Address and suite # must be posted on the building in 6 minimum numbers on a contrasting background clearly visible from the street. 4. Every space must have 24-hour access to the electric panel, which serves that space. 5. Missing circuit breakers or knockouts in electric panels and junction boxes must be filled. 6. Broken or damaged electrical fixtures and cover plates must be repaired or replaced. 7. Added electrical fixtures and outlets must comply with the National Electric Code. 8. Hose bibs should have vacuum breakers. 9. Plumbing fixtures must be in good working order. 10. Any unused plumbing must be capped 11. Gas appliances and heaters must be properly vented and installed.
