ADDENDUM NO. 2 ADDITIONAL BIDDER QUESTIONS 1. Question 1: Hard Surfaces Q: As per Addendum No. 1, the shading/coloring for the asphalt road and the area behind the dugouts is now the same. I saw that there was supposed to be stone dust around the dugouts. In the drawing it looks as though you have changed everything to asphalt. A: The hatched area around the dugouts, backstop and over to the ADA ramp at field level only is to be 4 stone dust. 2. Question 2: Scoreboard Q: The scoreboard is to go in center field. Are we responsible for electric lines? If so, where is start point and what is the layout to get there? A: The scoreboard along with footings and electrical work will be installed under a separate contract. 3. Question 3: Warning Track Q: Addendum No. 1 - Question #3 says to provide an alternate cost for warning track. How do you want this listed on the bid form? A: See attached updated bid form.

2 4. Question 4: Backstop and Fence Q: Addendum No. 1 Questions please clarify. The backstop is to be galvanized, and the fence black vinyl coat? A: The fence is to be black vinyl coated and the backstop fencing is to be black vinyl coated as well. All support framework structures to be schedule 40 galvanized pipe complying with ASTM F1083 finished with thermally fused vinyl coating. 7 mil minimum on chain fabric, and mils on frameworks. 5. Question 5: Frost Free Hydrant Q: What are the specifics on the frost-free hydrant? Can you provide some direction? A: See attached sketch. END OF ADDENDUM NO. 2 2

To the Allegany College of Maryland, Willowbrook Road, SE, Cumberland, MD, (hereinafter called OWNER ). In compliance with your Advertisement for Bids, BIDDER hereby proposes to perform all work for the construction of ACM SOFTBALL FIELD in strict accordance with the CONTRACT DOCUMENTS, within the time set forth herein, and at the prices stated below. By submission of this BID, each BIDDER certifies, and in the case of a joint BID each party thereto certifies as to its own organization, that this BID has been arrived at independently, without consultation, communication, or agreement as to any matter relating to this BID with any other BIDDER or with any competitor. BIDDER acknowledges receipt of the following ADDENDUM: *Insert a corporation, a partnership, or an individual as applicable. BIDDER agrees to perform all the work described in the CONTRACT DOCUMENTS for the following unit prices or lump sum: 1. The undersigned Bidder proposes and agrees, if this bid is accepted, to enter into an Agreement with Owner in the form included in the contract documents to complete all work as specified or indicated in the contract documents for the contract price and within the contract time indicated in this bid and in accordance with the contract documents. 2. Bidder accepts all of the terms and conditions of the Instructions to Bidders. This Bid will remain open for 60 days after the day of the bid opening. Bidder will sign the Bid Proposal Page 1 of 4

4 agreement and submit any other documents required by the contract documents within fifteen (15) days after the issue date of Owner's Notice of Award. 3. In submitting this bid, bidder represents, as more fully set forth in the Bidding Documents That: a. Bidder has examined copies of all the contract documents and of the following addenda: (receipt of all which is hereby acknowledged) and also copies of the bidding requirements including or Invitation to Bid and the Instructions to Bidders; b. Bidder has examined the site and locality where the work is to be performed, the legal requirements (federal, state, and local laws, ordinances, rules, and regulations) and the conditions affecting cost, progress or performance of the work; and has made such independent investigations as Bidder deems necessary; c. This bid is genuine and not made in the interest of or on behalf of any undisclosed person, firm or corporation; and is not submitted in conformity with any agreement or rules of any group, association, organization or corporation; Bidder has not directly or indirectly induced or solicited any other bidder to submit a false or sham bid; Bidder has not solicited or induced any person, firm or corporation to refrain from bidding; and Bidder has not sought by collusion to obtain for himself any advantage over any other Bidder or over Owner Bid Proposal Page 2 of 4

The undersigned Bidder, having carefully examined the Procurement and Contracting Requirements, Conditions of the Contract, Drawings, Specifications, and all subsequent Addenda, as prepared by Murphy & Dittenhafer, Inc. and Owner / Architect's consultants, having visited the site, and being familiar with all conditions and requirements of the Work, hereby agrees to furnish all material, labor, equipment, and services, including all scheduled allowances, necessary to complete the work according to the requirements of the Procurement and Contracting Documents will complete the work for the following price(s), which excludes sales tax on material permanently incorporated into the work, as indicated in the conditions of the contract. Description: Unsatisfactory soil excavation and disposal off site and replacement with satisfactory fill material or engineered fill from off site, as required, according to Sections "Earth Moving", Common Work Results for Utilities and Storm Utility Drainage Piping. 2. Unit of Measurement: Cubic yard of soil excavated, based on survey of volume removed. Dollars ($ ) per unit. B. Unit Price No. 2: Rock excavation and replacement with satisfactory fill material. 1. Description: Classified rock excavation and disposal off site and replacement with satisfactory fill material or engineered fill from off site, as required, according to Sections "Earth Moving", Common Work Results for Utilities and Storm Utility Drainage Piping. 2.
