The following clarifications, along with the attached estimate, further detail Kinley s scope of work: Includes: Supply and install seventy (70) roll down shutters with operating crank accessible from inside the building Supply and install an additional thirty six (36) shutters that were left off the architectural drawings and were discovered during the walkthrough. All equipment and supervision Restoration of any grass areas damaged from equipment $1,000 contingency Clean up daily Exclusions: Repairs to existing conditions not mentioned in this proposal. Unforeseen conditions. Premium time for work required outside of normal business hours. 4 Attachment 4 Failure to Comply with Completion Dates- 1. Re-Setting Final Completion Date. If Construction Manager fails to attain Substantial Completion on or before the agreed upon Substantial Completion Date, the Final Completion Date shall be re-set to the ninetieth (90th) day after the date of actual Substantial Completion. 2. Liquidated Damages. Construction Manager acknowledges that if Substantial Completion is not attained on or before the agreed upon Substantial Completion Date, Owner will suffer damages, which are difficult to determine and accurately specify. 3. Substantial Completion Liquidated Damages. Construction Manager shall pay to Owner One Hundred ($100) Dollars a day as liquidated damages and not as a penalty, for each day, including Sundays and Holidays that Substantial Completion extends beyond the Substantial Completion Date. 4. Final Completion Liquidated Damages. Construction Manager shall pay to Owner Two Hundred ($200) Dollars a day as liquidated damages and not as a penalty, for each day, including Sundays and Holidays, that Final Completion extends beyond the originally agreed upon or re-set Final Completion Date.
