4 Attachment 4 Failure to Comply with Completion Dates- 1. Re-Setting Final Completion Date. If Construction Manager fails to attain Substantial Completion on or before the agreed upon Substantial Completion Date, the Final Completion Date shall be re-set to the ninetieth (90th) day after the date of actual Substantial Completion. 2. Liquidated Damages. Construction Manager acknowledges that if Substantial Completion is not attained on or before the agreed upon Substantial Completion Date, Owner will suffer damages, which are difficult to determine and accurately specify. 3. Substantial Completion Liquidated Damages. Construction Manager shall pay to Owner One Hundred ($100) Dollars a day as liquidated damages and not as a penalty, for each day, including Sundays and Holidays that Substantial Completion extends beyond the Substantial Completion Date. 4. Final Completion Liquidated Damages. Construction Manager shall pay to Owner Two Hundred ($200) Dollars a day as liquidated damages and not as a penalty, for each day, including Sundays and Holidays, that Final Completion extends beyond the originally agreed upon or re-set Final Completion Date.
