The Rules and Regulations inform River Ridge residents of restrictions that have been adopted by the ARC/BOARD in the past and will allow the homeowner a better perspective of subdivision restrictions prior to homeowners presenting plans to the ARC/BOARD for review or on violations of the covenants and declarations. The ARC members serve at the discretion of, and report to, the River Ridge Board of Directors. Meetings are held following the submittal of a complete set of plans for review. 2 These Rules and Regulations are not all inclusive. All issues or proposals need to be submitted to the ARC/BOARD for approval. All applicable articles in the Declaration of Covenants, Conditions and Restrictions for River Ridge are still in effect. Any lot improvement will still need to be approved by the ARC/BOARD. The committee will then incorporate any new guidance into this document. 1) Garages (attached and detached): reference Covenants IV, Section 2 a) The garage must be architecturally compatible and subservient to the primary house on the lot: i) Must be brick veneer; ii) The roof pitch of the detached garage must match the house using the same style and color of the shingles; iii) The trim color of the garage must match the house; iv) The windows should match or be similar to the style of those on the house; v) A gutter must be installed and must match the house; b) If the detached garage door is facing the street, the garage door must remain closed at all times except when entering or exiting; c) The front wall of the garage should be no closer to the street than the rear wall of the house; i.e., the garage is set back from the house. Corner lot setback shall also conform to all other setback restrictions as outlined in Section VIII Setbacks and Unintentional Violations; d) The garage must have concrete floor, and the entrance to the garage must be finished concrete; e) The garage must not be used as a place of business for any private or commercial operation; River Ridge HOA Rules and Regulations Page 2

3 f) The interior walls of the garage must be finished as not to expose any stud walls; g) The original garage cannot be closed in for living space unless an additional garage is attached to the house and has the garage opening facing away from the street; h) The maximum size of an additional garage is limited to 24 wide and 30 deep, single story, with a maximum ceiling height of 12 ; i) Driveway for new garages shall be a continuance of the existing driveway. 2) Fences: reference Covenants VII a) No fence can be any nearer to the street than the front façade of the house. There should be no fence of any type, decorative or other, in the front yard of the property; b) No barbed wire, Chain-link, or hurricane type fencing of any type is permitted; c) No pasture-type fencing consisting of 4 x 4 posts and 1 x 4 rails for example is permitted; d) Split rail fencing is permitted; e) Wooden fencing must be stained to a natural wood finish and cannot be painted. Fence should be 50/50 and must be maintained; f) Black cast iron fencing is acceptable; g) Swimming pool fences must also meet Cabarrus County building codes. h) All fence plans must be submitted to the Architectural Review Committee and should include the following: i) A site plan survey of the property, accurately depicting where the fence will be located; River Ridge HOA Rules and Regulations Page 3

4 ii) A professional quality drawing, photo or brochure of the fence type planned for use that must remain with the Architectural Review Committee files; i) Any screening material used in conjunction with a split rail fence must be attached to the inside of the fence perimeter. The screening material should be a vinyl-coated wire that is natural to the landscape; j) Fencing landscape should be adequately maintained from the inside and outside; grass should be kept neatly trimmed; k) With the exception of an invisible dog fence, all pet containments must not be any nearer to the street than the rear façade of the house; l) Fence gates must match the architectural construction of the fence itself. 3) Playsets, Sheds & Other outside buildings: reference Covenants IV, Section 2 a) All playsets, sheds, gazebos and outbuildings must not be visible from the road from the front side of the property; b) Sheds and other out buildings (pool houses, gazebos, playhouses, etc.) must match the architectural style of the residence and if visible from the road must be completed using the same criteria as the garage guidance in Section 1.a above; c) The maximum size of outbuildings (pool houses, gazebos, playhouses, etc.) is limited to 12 x 12, single story, with a maximum ceiling height of 10 ; d) Multiple additional structures, excluding the primary residence, are not in keeping with the intent of the community. Submitted plans will be thoroughly reviewed in accordance with Part IV, Section 2 for neighborhood compatibility. e) No playground, recreational or other yard structure shall be installed or constructed on any lot prior to approval by the Architectural Review Committee. 5 4) Pools: a) All pools must be approved by the Architectural Review Committee; b) Pools must be fenced and comply with all fencing guidelines and Cabarrus County requirements; c) No above ground pools are allowed; d) Pools should be located behind the house and not visible from frontage road. 5) Prohibitions against In Ground Satellite Dish: reference Covenants VI a) Satellite dishes shall not be mounted on the front of the house. 6) Temporary markers: a) Plastic marking flags, lawn stakes, or other lawn markers can only be used on a temporary basis, not to exceed 30 days. b) Driveway Reflectors are only allowed to be installed within 4 on either side of the driveway 7) Driveways and Parking: reference Covenants IV, Section 5.a a) Additional parking areas shall be solid areas, not trackways and conform to the existing driveway. All plans for concrete/brick additions require board approval. 8) Maintenance of lot: reference Covenant IX a) Examples of maintenance of lots not in a suitable state of repair, as referenced in Section IX of the Covenants, include but are not limited to the following: i) Peeling or chipping paint; River Ridge HOA Rules and Regulations Page 5

6 ii) Deteriorating trim; iii) Missing or broken shutters, shingles, window panes, house numbers, bricks, siding, rain gutters, etc.; iv) Visible mold or mildew on doors, windows and trim; v) Plants growing from rain gutters; vi) Dented, damaged, rusted mailboxes and posts in need of replacing, painting or straightening; vii) Fences with leaning, broken, deteriorating or missing parts; viii) Storage of play items, yard equipment, landscaping materials and other clutter in front, side or rear yards; ix) Decks with missing or broken railings, missing parts or in unsafe condition; x) Brush piles remaining more than 14 days. b) Lawn and Landscaping Maintenance: i) Turf areas shall be mowed at regular intervals. Grass clippings should not be swept or blown into the road. ii) Turf area bare spots visible from roadways shall be replanted as soon as feasible to maintain a vigorous and healthy condition. iii) Bushes and shrubs shall be trimmed or pruned to control their size and enhance their appearance iv) Weeds, pests and foliage diseases shall be controlled and eliminated whenever possible; v) Ground cover, including mulch, pine straw or other ground cover shall be maintained on a regular basis to sustain the landscape and garden areas in a neat and orderly fashion; River Ridge HOA Rules and Regulations Page 6

7 vi) Plant beds shall be maintained in a neat and orderly fashion; vii) No live trees with a diameter greater than six (6) inches may be removed without prior approval of the ARC. If a tree must be removed for any reason, the tree stump must not be visible from any roadway. viii) All homes must have neat and maintained foundation planting/bushes at the front façade of the house.
