2 OWNER ACKNOWLEDGMENTS I the undersigned property owner understand, acknowledges and agrees that: No work on this request shall commence until I have received approval of the ; Any construction or alteration to the subject property prior to approval of the ACC is strictly prohibited. If I have commenced or completed any construction or alteration to the subject property and any part of this application is disapproved, I will be required to return the subject property to its original condition at MY OWN EXPENSE. If I refuse to do so and the WYNHA incurs any legal fees related to my construction and/or application, I will reimburse the WYNHA for all legal expenses incurred; Any approval is contingent upon construction or alterations being completed in a neat and orderly manner; There are architectural requirements covered by the Covenants and a board review process as established by the Board of Directors; All proposed improvements to the property must comply with city, county, state and local codes. I understand that applications for all required building permits are my responsibility. Nothing herein shall be construed as a waiver of modification of any codes. My signature indicates that these standards are met to the best of my knowledge; ANY variation from the original application must be resubmitted for approval; IF approved, said alteration must be maintained per the Homes Association Declaration for Wyndham Hill and the Declaration of Restrictions for Wyndham Hill; This alteration will not detrimentally affect the proper drainage of any common areas or surrounding lots. I will be responsible at my expense to correct any drainage problems to such areas that may occur because of this work or alteration; That the ACC and WYNHA assume no liability resulting from the approval or disapproval of any plans submitted. The Committee and the Association assume no liability and make no representations regarding the adequacy or quality of any submitted plans or whether such plans comply with any or all governing authority requirements. The Committee's review, comments, and/or approvals do not relieve the Builder/Applicant of their responsibility and obligation to comply with the Declarations, Restrictions, Guidelines, or City of Lansing Subdivision regulations as applicable. The Owner agrees to grant the Association accesses to property at any reasonable hour to inspect for compliance issues; It is the duty of the owner and the contractor employed by the owner to determine that the proposed improvement is structurally, mechanically and otherwise safe and that it is designed and constructed in compliance with applicable building codes, fire codes, other laws or regulations and sound practices. The Wyndham Hills Homeowners Association, its ACC Committee and any employee or member thereof, shall not be liable for damages or otherwise because of the approval or non-approval of any improvement; I certify that the above information is an accurate representation of the proposed improvements and that the work will conform to applicable codes, covenants and standards. 3 INFORMATIONAL ADDENDUM REVIEW PROCESS The ACC will make every reasonable effort to expedite the review process. Applications will be reviewed for completeness and the ACC may request additional information to help clarify your proposal. APPLICATION The application must be accompanied with necessary documents, photos, drawings, brochures, and information necessary to present to the ACC. Property owners must sign the application. Contractor s signatures for property owners will not be accepted. Modifications are not permitted to commence until the modification has been reviewed and approved by the ACC. 4 IMPROVEMENT REQUIREMENTS AND GUIDELINES The Wyndham Hills Home Owners Declarations and Restrictions establish several requirements and/or restrictions that may affect the budget and constructability of your project. Please be aware of the requirements. We have summarized some of them and offer some guidelines for your project below. As a rule of thumb, if you have any questions as to if your project requires ACC approval, please ask early in your planning stage and well before you begin any construction. 1. All decks must be constructed of Cedar. The underside and supporting members can be treated lumber, however surface decking, rails and viewable structural members must be comprised of Cedar wood. In some cases, the ACC will allow the use of composite lumber components. All proposed deck construction and materials must be submitted to the ACC for review and approval. 2. Fences must be constructed of either Cedar Wood or Wrought Iron. No fence can exceed 72 in height unless specifically approved by the ACC. All fencing projects must be submitted to the ACC for review and approval. 3. No Animal Pens or Runs are permitted within the subdivision. No submittals for Animal Runs or Pens will be considered. 4. All external driveways must be concrete. No temporary surfaces are allowed. 5. A complete lawn restoration requires the placement of sod and ACC approval. Normal over seeding of an established lawn area is allowed without ACC approval. 6. All homes are considered single-family residences and shall be occupied only as such. 7. No exterior clothes lines or poles (including flagpoles unless attached to a home) may be erected or maintained on any lot. 8. No radio or television aerial wire, antenna, antenna tower, or energy collector, or satellite dish more than 18 in diameter shall be erected or maintained. Satellite dishes less than 18 in diameter require approval of the ACC. The ACC can specify location, screening or other aesthetic requirements for satellite dishes submitted for approval. 9. No above ground or below ground storage tanks are allowed. Rain barrels will be considered on a case by case basis. The ACC can specify location, screening or other aesthetic requirements for rain barrels submitted for approval. 10. Lawns shall be kept in good condition as soil, climate and other natural conditions permit. Grass shall not be permitted to reach a height of six (6) inches or more or otherwise create an unsightly appearance. (excessive dandelions, clover, chickweed and other weeds shall be considered an unsightly appearance). 11. One inground swimming pool is allowed per Lot with approval of the ACC. No above grade or above ground pools will be allowed or considered.

5 IMPROVEMENT REQUIREMENTS AND GUIDELINES 12. No tennis courts or sport courts shall be allowed unless they are constructed on common areas of the HOA. 13. No storage buildings / sheds shall be allowed without approval of the ACC. Storage Buildings or Sheds shall be limited to a maximum dimension of 10 x12 and shall be single-story in nature. Shed materials must be approved by the ACC. Plastic/composite buildings or metal buildings will not be allowed or considered. 14. No solar panels or solar collectors shall be installed or maintained on the exterior of any residence or on any lot. Solar Shingles, Solar Systems for Community Lighting may be approved by the ACC. 15. Any basketball goal shall be free-standing and pole mounted. No basketball goal shall be attached to any residence or building. Backboards must be of transparent (clear) material. All poles, nets, hardware, backboards and braces shall be maintained in good condition free of viewable rust and fray. 16. Playground structures must be wood or wood products. Metal playsets are not allowed. Playground structures shall be removed once they are no longer used and/or unsightly. 17. No sign of any type shall be erected, placed or maintained on any residential lot or structure within the subdivision. Real Estate signs shall be allowed during the period that a home is being actively listed for sale. Garage Sale signs are permissible for no more than a 72-hour period and are to only be located on the lot at which the sale is being conducted. 18. No artificial vegetation/plants shall be permitted on the exterior of any lot. Exterior sculptures, fountains and other similar yard decoration shall be subject to the approval of the ACC. 19. All residences shall have wood, wood or vinyl clad, or vinyl windows. 20. All composition roofing materials shall carry a twenty-five (25) year manufacturer warranty. All roofing materials (including color) are subject to prior approval of the ACC. Wood or Standing Seam Metal roof materials shall not be allowed or considered. 21. The ACC has absolute discretion to approve building, construction and fencing materials and which would otherwise be prohibited by the Declaration of Restrictions. 22. If you are unclear as to the allowable materials, colors or process for any intended improvements or projects please contact the ACC for clarification. It is not intended that the restrictions be arduous to a homeowner, rather required so that we can continue to maintain a neighborhood community that is clean, harmonious in nature and supporting of improvements that are not injurious to the property values of all property owners. The very things that attracted you to Wyndham Hills are the things that the ACC hopes to protect and improve upon as the years go by.
