1 Resolution CANNON RIDGE HOMES ASSOCIATION ARCHITECTURAL STANDARDS AND GUIDELINES ADOPTION OF ARCHITECTURAL CONTROL COMMITTEE; RULES RELATED TO EXTERIOR PAINT AND STAIN COLORS, WINDOWS, ROOFS, DECKS, FENCES, GARAGE DOORS, AND LIGHTS, SECURITY LIGHTS, OR AUDIO/VIDEO RECORDING DEVICES POLICIES AND PROCEDURES WHEREAS, Section of the Virginia Property Owners Association Act (hereinafter referred to as Act), Article IV of the Articles of Incorporation and Article VI, Section 1, of the By-Laws (hereinafter referred to as By-Laws) of the Cannon Ridge Homes Association, Inc. (hereinafter referred to as Association) empowers the Board of Directors (hereinafter referred to as Board) to set policies for the Association and to adopt Rules and Regulations (hereinafter referred to as Resolutions) governing the use of the common area and facilities, and the personal conduct of members and their guests; and WHEREAS, Article IV of the Articles of Incorporation, Article VI of the By-Laws, and Article VIII, Section 1, of the Declaration of Covenants, Conditions And Restrictions (hereinafter referred to as Declaration) of the Association empowers the Directors to enforce all Covenants, Conditions and Restrictions of the Declaration and to establish, adopt and enforce Resolutions governing the use of the common area and facilities, and the personal conduct of members and their guests; and WHEREAS, Section of the Act, Article VI, Section 1 of the By-Laws, and Article II, Section 1, of the Declaration provide the Board with the power to suspend use rights and assess charges against lot owners for violations of the Association Instruments and Resolutions for which the lot owner and family members, those entitled to occupy a lot, guests and other invitees are responsible; and WHEREAS, Section of the Act requires that all lot owners, all those entitled to occupy a lot, all guests and invitees shall comply with all lawful provisions of the Act, all provisions of the Declaration, and Resolutions of the Association; and WHEREAS, Article VIII of the By-Laws provides that an Architectural Control Committee shall be appointed and shall operate in accordance with the terms of the Resolution of the Board designating the Committee and with rules adopted by the Board; WHEREAS, Article V of the Declaration of Covenants, Conditions, Conditions and Restrictions for the Cannon Ridge Homes Association (hereinafter referred to as Declaration ) provides that no exterior change or alternation to buildings, fences, walls, or other structures on the properties within the Association shall be made until the plans and specifications showing the nature, kind, shape, height, materials, and location of the same shall have been submitted to and approved in writing as to harmony of external design and location in relation to surrounding structures and topography and/or comparability with existing structures, by the Board or by an Architectural Control Committee composed of three (3) or more representatives appointed by the Board: WHEREAS, the Board has established architectural standards and guidelines in order to (1) assist homeowners in preparing an acceptable application to the Architectural Control Committee, (2) increase homeowner s awareness of and understanding of the requirements set forth in the Covenants, Rules and Regulations, and Resolutions, (3) provide basic design principles and concepts in order to aid homeowners in developing exterior improvements which will be compatible and comparable with those of other homes and the immediate neighborhood and community as a whole,

2 and (4) provide uniform minimum standards to be used by the Architectural Control Committee in reviewing applications; and WHEREAS, the Board recognized a need to formally designate an Architectural Control Committee and to appoint members thereto, and to implement uniform standards and guidelines related to the colors of exterior paint and stain. NOW, THEREFORE, BE IT HEREBY RESOLVED THAT The Board adopts the following Rules and Regulations: 1. The following addition shall be made to the Cannon Ridge Homes Association architectural review: Color Color plays an important role in the overall appearance of a property. A change that is inconsistent with the approved color scheme of the existing townhouse and/or the community could have a negative impact, both visually and financially, on other properties. Colors should be selected from the approved list, the Exterior Maintenance Color Catalog, for the Cannon Ridge Homes Association. Trim colors, including those of roof shingles, should be comparable with the original color scheme of the townhouse as chosen by the developer. When possible, no two adjacent, diagonal, or opposite townhouses shall be of the same or similar color scheme. 2. An Exterior Maintenance Standards Book will be established and made available for current owners. This book will be updated as necessary, at the discretion of the Board. 3. Owners must use the Exterior Maintenance Standards Book to select appropriate colors for siding, trim, shutters, door, and gutters. Other colors will not be accepted. However, the referenced manufacturer need not be used, as colors selected from the Standards Book may be matched by other manufacturers, provided they are substantially identical in color, tone, and shade. a. Shutters and doors to be painted in a solid color from the approved colors list. Doors may be painted to match shutters from the approved colors list. If doors are not to match shutters, they may be painted a solid black, white, brown, or red from the approved door colors list. Trim, gutters, and downspouts to be painted a solid color from the approved trim, gutters, and downspouts colors list. 4. Owners must submit an Architectural Change Request for approval prior to painting. Stain 1. Decks and fences constructed on lots in the Association must be constructed of cedar, oak, or pine and be stained with the clear pigmented stain. 2. The only colors of stain that will be allowed on decks shall be Behr Cedar Naturaltone #DP-533 or Behr Antique Brass #DP-374 or colors that have been approved by the Association as equivalent to one of those two (2) colors. 3. Owners must submit an Architectural Change Request for approval prior to staining a deck or fence. Windows

3 1. Windows on the street facing side of each unit shall have white window grilles, mullions, or grids. Windows without grilles, mullions, or grids shall install white snap in grilles, mullions, or grids no later than one (1) year from the effective date of this Resolution. 2. Windows on the rear of each unit are not required to have grilles, mullions, or grids. Replacement windows shall be of the same style as the window being replaced, e.g. double hung or sliding. 3. Owners must submit an Architectural Change Request for approval prior to installing windows. Roofs 1. Roofs shall be of a material consistent with the original unit material. Ceramic, metal (with the exception of copper), corrugated, galvanized, slate, wood, thatch, or materials other than asphalt are not acceptable. 2. Roof colors shall be compatible with the aesthetics of Cannon Ridge. A change of color requires an approved Architectural Change Request. Replacement of the same color does not require color approval. 3. No two consecutive units shall have the same roof color. Fences 1. All fences shall be built within the lot property lines. Fences shall not obstruct vehicular traffic sight lines. End unit extended side fences shall not exceed beyond the front corner of the unit. Fences shall be set back a minimum of three (3) feet from any common sidewalk edge to accommodate Fences are limited to the following designs: Privacy or Runner Shadowbox or Board-on-Board Basketweave 2. The highest points of a fence shall follow the natural contour of the land, as originally graded. The height of the fence shall not exceed six (6) feet. Fence posts shall not exceed the height of the fence. All fence posts must be capped for maintenance purposes. 3. Chain link or wire fencing is not permitted for any purpose. 4. No picket fences of any height, color, or stain. 5. Owners must submit an Architectural Change Request for approval prior to installing a fence. Garages 1. All units with garage doors must be the sectional type garage door, with or without windows. The style of door must be in keeping with the aesthetics of Cannon Ridge. Garage doors must be painted a color from the Exterior Maintenance Standards Book.

4 Sectional One Piece One Piece Roll Up R Q Q Q 2. Owners must submit an Architectural Change Request for approval prior to installing a garage door. Lights, Security Lights, or Audio/Video Recording Devices 1. Owners must submit an Architectural Change Request for approval prior to installing lights, security lights, or audio/video recording devices on the exterior of their units. 2. Front entry lights must be in keeping with the overall architectural aesthetic of the community, such as coach or lantern style. Flood lights, spot lights, security lights, industrial lights, sports lights, etc. for front entryways are not within the architectural aesthetic. 3. Security lights or audio/video recording devices are to be used to monitor that unit s property only. Security lights or audio/video recording devices may not be directed or focused on neighboring yards, entries, windows, or parking spaces. Owners must obtain prior written approval from the Architectural Control Committee before making any exterior changes to their lot or dwelling. Owners must submit an Architectural Change Request form (see attachment) to the Association s property management company to apply for written approval. Written approval or disapproval by the Architectural Control Committee shall be given to owners within thirty (30) days of submission. If no response is made by the Committee after thirty (30) days have elapsed from submission, the application will be deemed approved. Approval is valid for three hundred sixty-five (365) days from the date of approval. If the improvement is not completed by that time, the approval expires and a new Architectural Change Request must be submitted. Damage to Association Property All damage to Association property or grounds must be repaired as it occurs. If not repaired within twenty-four (24) hours of the homeowner receiving notice, the Association will complete the repair and assess the charge against the homeowner at the time the homeowner was notified of the damage. EFFECTIVE DATE This Resolution shall become effective on 1 January 2013.
