2 PURCHASING DEPARTMENT 151 Willowbend Road Peachtree City, GA Phone: Fax: INVITATION FOR PRE-QUALIFICATION OF BIDDERS PEACHTREE CITY LAKE SPILLWAY REPLACEMENT PEACHTREE CITY, GEORGIA (City) is soliciting PRE-QUALIFICATIONS from experienced contractors that are interested in providing the required materials, labor, tools, and equipment for the work necessary to construct the rehabilitation measures associated with the Peachtree City Lake Dam spillway. The project generally consists of the following: Construction of a cast-in-place, reinforced concrete piano key weir spillway Construction of ancillary reinforced concrete structures Demolition of existing broad crested weir spillway Identifying, hauling, placing, and compacting structural fill Implementing and managing pollution control Implementing and managing surface and ground water control measures Permanent stabilization of disturbed areas Funding for the project will be through a combination of local funds and a loan extended by the Georgia Environmental Finance Authority. Applications for PRE-QUALIFICATION from interested Bidders will be received by the City at the Purchasing Department until 2:00 P.M. local time on June 8, Applications for PRE- QUALIFICATION shall be sealed and mailed or delivered to the City, attention Ms. Angela Egan, so that they are received no later than the specified date and time. Applications received after this time will not be opened or considered. PRE-QUALIFICATION of Bidders for this project is required by the City. All requests for a copy of the Invitation for Pre-qualification of Bidders requirements, and all questions regarding the invitation, should be submitted in writing to Jonathan T. Dean, PE, Schnabel Engineering, LLC., by at jdean@schnabel-eng.com. Only those contractors that can demonstrate to the Owner and Engineer that they have the experience and financial capability to successfully perform the work will be considered qualified to bid on the project. A contractor will be considered qualified to bid on the project if they meet either of the following criteria and can demonstrate the financial capability to complete the project in a timely manner. 1. Has completed the construction of a high hazard or Category One (1) dam or a major rehabilitation of a high hazard or Category One (1) dam within the past five (5) years either in this state or in some other state that regulates high hazard dam construction. 2. Has completed the construction of a labyrinth spillway within the past five (5) years or can demonstrate moderate to complex cast-in-place concrete construction experience.

3 In order for the Owner and the Engineer to determine whether or not a Contractor is qualified to bid on the work, information described below must be submitted by the date specified. The City intends to award a single contract for all work required on the project. Solicitation of bids for the project is anticipated to occur in the Summer of Copies of contract documents, as well as other site specific information, to be used in preparing bids will be made available at that time. ONLY THOSE CONTRACTORS THAT THE CITY DETERMINES TO BE QUALIFIED TO PERFORM THE WORK THROUGH THE PRE-QUALIFICAITON PROCESS WILL BE INVITED TO SUBMIT A BID FOR THE PROPOSED PROJECT. 4 I. GENERAL INFORMATION Peachtree City is planning to replace the existing concrete overflow spillway at the Peachtree City Lake Dam. The existing impoundment is located in the western portion of Fayette County approximately 0.8 miles east of the intersection of State Route 54 with State Route 74; the dam is located on Kelly Drive, approximately 0.25 miles east of the intersection of Kelly Drive with State Route 74. The dam consists of an earthen embankment section and a concrete spillway section. The proposed rehabilitation measures include the demolition of the existing concrete spillway structure, and the construction of an approximately 170 foot wide reinforced concrete piano key weir spillway and appurtenant structures. Major construction considerations that the Contractor is responsible for are as follows: A. Timely and adequate control of both surface and subsurface drainage at the site during construction. Additionally, the contractor should be prepared to control surface water from the contributing 18.7 square mile drainage basin throughout construction. B. Placement of reinforced concrete for the proposed piano key weir spillway. Careful and thoughtful foundation preparation, to include dewatering and subsurface drain installation, will be necessary. C. Site security and managing local residents in this area will be important, as this is an active area for citizens. Plans and specifications for the replacement of the Lake Peachtree Spillway have been prepared by Schnabel Engineering, LLC. Provided with this Invitation are select sheets that provide a general characterization as to the construction effort that is anticipated. The project team anticipates that a total of 250 consecutive calendar days will be allowed for the completion of the project after the Notice to Proceed is issued. Any company interested in submitting an application will be required to submit one (1) unbound original and three (3) bound copies of the application for pre-qualification of bidders. All copies of the application must be identical, and shall be signed in ink by a company official who has authorization to commit company resources. All questions or requests for additional information shall be submitted in writing to Jonathan T. Dean, PE, Schnabel Engineering, LLC, by at jdean@schnabel-eng.com no later than 2:00 P.M. on May 30, No company and/or any member of the company s team shall solicit information on any aspect of the Invitation for Pre-Qualification of Bidders in any other manner. 5 II. APPLICATION REQUIREMENTS A. Company Identification 1. At a minimum, the Application shall include the following information on the Company that intends to bid the project as the Prime Contractor: a) Company name. b) Company business addresses, telephone and fax numbers, addresses, and contact person. Include local office information, if the local office is different than above, and is to be responsible for this project. c) Company background including history, number of full time employees, number of years operating as a company; describe organization (corporation, partnership, etc., where organized, and if not organized in Georgia but licensed in Georgia, indicate who is the registered agent). d) Provide a statement that the Company has never failed to complete a project or had a Performance Bond called by an Owner. If this is not the case, provide explanation. e) Provide a statement indicating whether the Company has or has not been involved in litigation as a plaintiff against an Owner or Engineer in the past ten years. If Company has, provide an explanation. f) Provide a statement that you presently possess, or that you are able to obtain in sufficient time to prosecute the work, such governmental licenses and contractor licenses as may be required. g) Provide a list of all Trade Union Agreement(s), both national and local, to which you are a signatory, if any. h) Provide a list of major pieces of equipment in your possession which will be available for this project. i) Describe which portions of the work on the proposed construction of this project you would anticipate being self-performed, and which portions would be subcontracted, if any. j) Provide a statement of the Company s current financial conditions, including a copy of the latest financial report. May 3, 2017 Page 4 Schnabel Engineering, LLC k) Provide a statement of the Company s ability to furnish a 100% performance bond and a 110% payment bond, and any limits thereon; and the name, address, telephone number, and contact for the Company s bonding firm. Include a statement that the proposed bonding company is listed in the latest issue of the U.S. Treasury Circular 570.

At a minimum, the Application shall include the following information about potential subcontractors to be utilized in the project to perform any of the four areas of work described in Paragraph C below. (NOTE The utilization of local subcontractors and suppliers is encouraged): a) Company name b) Locations of home and satellite offices to include business addresses, telephone and fax numbers, and addresses. c) The role the subcontractor will play in the project. d) Work history between the Company and the subcontractor. e) Relevant project experience of subcontractor. Provide a minimum of three similar projects in the last ten years. The projects listed should, as a minimum, include the information required for Paragraph D.4. a through h below. f) Subcontractor supervisory personal to be used for the project. g) References that have experience with the work of the subcontractor. 3. Provide a statement describing any intended utilization of local labor, companies and/or suppliers, if any. 4. Describe any significant technical challenges you currently envision for this project, and propose potential innovative solutions to meeting these challenges. Use examples from previous projects as appropriate. B. Company Personnel 1. The Application shall identify the potential personnel (and their experience) to be utilized in the project, to include members of the Company and anticipated subcontractors. 2. The name and title of the Company s proposed project manager and project field superintendent shall be provided. Either the proposed project manager or the project superintendent should have relevant dam and spillway construction experience. The location of the project manager s office(s) during the project duration shall also be provided. May 3, 2017 Page 5 Schnabel Engineering, LLC 3. Resumes of the Company s project manager, project field superintendent, and other key members of the project team, including potential key subcontractors shall be provided. Note: If the Company is the successful bidder, these key employees must be actively involved in the daily operations of the project unless substitutions are agreed to in advance by the City and the Engineer.

7 C. Areas of Work 1. For the purposes of this project, the major items of work requiring prequalification of the Prime Contractor and his or her subcontractors are for the following areas. a) Earthwork. b) Reinforced-Concrete Construction. c) Subsurface Drains. d) Surface water control and groundwater control. 2. The Prime Contractor will be required to complete at least sixty (60) percent of the monetary value of the work, with his or her own resources. D. Relevant Experience The following required experience shall be provided by the Applicant for his or her Company and, if pertinent, teaming partners which might include specialty subcontractors if the Applicant does not have the necessary specialty experience within the Company. 1. List at least three significant earthen embankment dam projects that are in progress or have been completed by your Company within the last ten years where control of water during construction was an important consideration and reinforced-concrete spillway construction was involved. Describe any additional project(s), for additional consideration, where reinforced-concrete and earthwork construction was involved. At least one of these projects must have been a high hazard structure regulated by a state or federal agency. 2. List at least two significant earthen embankment dam projects that are in progress or have been completed by your Company within the last ten years where internal filter drain systems were installed and the forming and casting of reinforced-concrete for hydraulic structures was involved. 3. For the projects listed, indicate the percentage of work that was performed by your Company. The projects should clearly demonstrate the Company s construction experience. At a minimum, the following information shall be included for each of the listed projects: a) Name of the project as bid, location of project, name of the design engineering firm, and percent of labor-related items performed by the Company s own work force. 8 b) Name and address of client. c) Name and telephone number of client contact. Also, list the name and telephone number of the design engineering firm contact person for each respective project. d) Description of the project; clearly indicate project elements in conjunction with the dam construction, including quantities of work for the significant project elements. e) Dollar value of the amount bid and the final cost to the owner, with an explanation of cost overruns, including charge orders, if any. f) The contract time as bid and the actual time to complete the project, with an explanation of time overruns, if any. g) Name of the Company s project manager and project field superintendent. h) Projects should include references that may be contacted by the City or Engineer to discuss your performance. E. Application Submittal Applications must be returned in a sealed container marked on the outside with the Company s name and Peachtree City Lake Dam Spillway Pre-Qualification of Bidders for the Construction clearly marked on the front. Applications will be received until 2:00 P.M. local time on Thursday, June 8, 2017 at the Peachtree City Purchasing Department with attention to Ms. Angela Egan. Any applications received after this date and time will not be accepted. The City reserves the right to retain all applications submitted. All Applications and supporting materials, as well as all correspondence relating to this Invitation, shall become the property of the City when received. Any proprietary information contained in the Application should be so indicated; however, a general indication that the entire content or major portion, of the Application is proprietary will not be honored. The attached Affidavit must be signed, notarized, and included with the Application submitted by the Applicant. Applications submitted by telegraphic, facsimile, , or other electronic means are not acceptable and will be rejected upon receipt. Companies are advised to allow adequate time for delivery of their Applications. F. Changes to Application. May 3, 2017 Page 7 Schnabel Engineering, LLC No changes to the Applications will be allowed after the date and time fixed for receipt of the Application.

9 G. Addendum to Invitation. Changes to the Invitation shall be transmitted via written, ed or faxed addendum only. Copies of addenda will be furnished to all Prospective Companies via the City s website no later than five (5) business days prior to the date fixed for receipt of the Application. Any addendums will be placed on the City s website at It is the Prospective Companies ultimate responsibility to ensure that they have all applicable addenda prior to submittal. This may be accomplished via contact with the Purchasing Agent or by visiting the City s website ( prior to submittal. All questions or requests for additional information should be submitted in writing to Jonathan T. Dean, PE, Schnabel Engineering, LLC by at jdean@schnabeleng.com no later than 2:00 P.M. on May 30, III. SUPPLEMENTAL INFORMATION A. No bid for the construction of the spillway at Peachtree City Lake Dam will be accepted and opened unless the bidding Company has been pre-qualified pursuant to this Invitation for Pre-Qualification of Bidders prior to the date of the first public advertisement of the project. B. A bid bond of 5 percent of the total bid must be submitted with the bid. C. This construction project requires the successful bidder to furnish satisfactory performance and payment bonds each in the amount of 100 percent AND 110 percent respectively of the bid. D. The contractor will be required to obtain builders risk insurance. May 3, 2017 Page 8 Schnabel Engineering, LLC E. The Prime Contractor is expected to utilize the services of the subcontractors submitted in his or her PRE-QUALIFICATION package and approved by the City and Engineer during the PRE-QUALIFICATION process. However, the City and Engineer recognize that there are circumstances when, between the approval of subcontractors and the time when the subcontractor is to perform his or her work, the approved subcontractor is not available to perform the intended work. If this situation arises, the Prime Contractor must submit in writing to the City and Engineer a detailed explanation of why the approved subcontractor will not be utilized, as well as a proposal for a new subcontractor to perform the services of the previously approved subcontractor that is no longer available. This proposal shall include all of the PRE-QUALIFICATION requirements for subcontractors as outlined in Section II, Paragraph A.2 of this Application. The prequalifications of this subcontractor will be reviewed by the City and Engineer. The services of this subcontractor shall not be utilized without approval from the City and Engineer. Furthermore, if this situation arises after the contract has been awarded to the Prime Contractor; no monetary allowances will be made by the City. In order to reduce the potential for this situation to occur, the City and Engineer recommend that the Prime

10 Contractor consider submitting more than one subcontractor for prequalification for each major item of work described in Section II, Paragraph C not to be performed by the Prime Contractor. F. Final determination of an Applicant s qualification will be decided by the City and Engineer. G. Applicants who are disqualified from bidding on the project, as judged by a review of his or her application, may request a conference with a representative of the City and the Engineer to respond to the Applicant s disqualification. This request must be made in writing to Jonathan T. Dean, PE at jdean@schnabel-eng.com within 14 calendar days from the date of notice of not being qualified. 11 PEACHTREE CITY LAKE DAM SPILLAY PROJECT APPLICANT AFFIDAVIT The undersigned hereby attests under penalty of perjury and by personal knowledge to the following: 1. The contents of the Application for PRE-QUALIFICATION (including all submitted attachments and other documentation) are true, correct and not misleading. 2. To the best of my knowledge neither the Applicant, nor its agents, affiliates, partners, employees, officers, directors or other associates of any kind, have colluded with any individual or entity on behalf of the Applicant, or themselves, to produce an unfair advantage over others or to gain favoritism in the award of any contract resulting from this Invitation for Pre-qualification of Bidders. 3. By responding to this Invitation for Pre-qualification of Bidders and submitting the Application for PRE-QUALIFICATION the Applicant agrees to indemnify and hold harmless all parties to this Invitation for Pre-qualification of Bidders, including, but not limited to, the City and Engineer for any conceivable damages arising there from; and affirms that no compensation is expected as a result of the preparation of said response. 4. Applicant agrees that the City, or their representative, may contact any or all of the individuals or firms listed as references to enquire about the Applicants performance on projects. 5.
