1 JORDAN EAST ZARQA WASTEWATER PROJECT- CONSTRUCTION OF NEW FORCE MAIN (PHASE 1) CONSTRUCTION SUPERVISION TERMS OF REFERENCE 1. BACKGROUND General Jordan is ranked amongst the most water-stressed countries in the world and has very limited water resources. Consequently, the water sector in Jordan faces many issues that place it on top of the Kingdom s list of priorities. Jordan's renewable water resources are limited and do not, even under the current situation, meet the country s water needs. Climate change scenarios all predict a further decline of country water resources. The future water supply is expected to fall short of forecasted demand, unless remedial measures are put in place. These challenges are amplified by the continued high population growth and the influx of Syrian refugees into the country. The proposed Project is part of a larger comprehensive As-Samra Wastewater Treatment Plant and related infrastructure expansion programme initiated by Water Authority of Jordan ( WAJ ) and the Ministry of Water and Irrigation ( MWI ). The expansion programme will address the growing need for extension of the wastewater systems to accommodate the ever increasing wastewater flows due to the continued high growth of population, the Syrian refugee influx and increased wastewater flows resulting from the connection of the Disi Water Conveyor to Amman. The European Bank for Reconstruction and Development (the EBRD or the Bank ) is considering a sovereign loan of up to USD 14.5 million to the Hashemite Kingdom of Jordan (the Borrower ). The Bank s financing will be complemented by an investment grant of up USD 5.5 million. The WAJ (the Tendering Authority ) is an implementing agency under the jurisdiction of the MWI in Jordan and is the beneficiary of the loan. The proceeds of the loan and the grant will finance construction of a new 9 kilometre wastewater pipeline and rehabilitation of the existing 7.4 kilometre wastewater pipeline (the Project ). The structure of the Project is a sovereign loan to be on-lent to WAJ. However, the infrastructure financed under this transaction will be operated by a private company under a separate O&M contract providing a strong example of public/private cooperation in a traditionally public sector in Jordan, in addition to the introduction of higher quality standards of service. The proposed TC assignment is designed to assist WAJ in project supervision, health and safety, and Environmental and Social Action Plan ( ESAP ) implementation for which the WAJ will be the main project implementation partner. In addition to supporting the implementation of the Project, the Consultant will play a role in helping to raise implementation capacity within WAJ. 1

2 The Water Authority of Jordan (WAJ) the Project Execution Agency (PEA) intends to engage an Implementation Consultant for the Consulting Services for Supervision concerning related investment measures. All the services of the Consultant described in the ToR shall be carried out in close cooperation with the PEA and as far as relevant with the representatives of other authorities. To do this, the Consultant shall introduce regular consultations on relevant aspects of project implementation with PEA and concerned authorities. It has been attempted to outline the Consultant s tasks during execution of his services in suitable detail. However, the Consultant shall bear in mind that the list of tasks and activities can by no means be considered as a complete and comprehensive description of the Consultant s duties. It is rather the Consultant s responsibility to verify critically the scope of services indicated and to extend, reduce or amend it, wherever he deems necessary according to his own professional judgement and the knowledge he will acquire during the preparation of his proposal. It is understood that the Consultant carries out all work as necessary to fulfil the objectives of the Project. In order to get familiar with the programme framework and to respond to the project requirements, Tenderers are explicitly encouraged to visit the project area and to enter into contact with the PEA. During the Consultant s assignment, other experts and advisors may provide services to the PEA or other local authorities. It will be the duty of the Consultant to meet and co-ordinate his work with the activities of these other experts and advisers relevant to the programme. Project Background Wastewater collection in the Amman-Zarqa River basin is a gravity system based on topography. The majority of the wastewater generated in the Amman area is conveyed to the Ain Ghazal Pre-Treatment Plant (AGTP) from where it is discharged to the treatment plant site at As-Samra by gravity through either a siphon (39km, 1200mm) or a wastewater conveyer line (32km, 1500mm). At present, the siphon from AGTP to the West Zarqa Pump Station (WZPS) is being maintained as standby, leaving the conveyor to discharge flows from the AGTP to As-Samra. Zarqa sewerage collection system has two existing pump stations (WZPS and East Zarqa Pumping Station, EZPS 1 ) that deliver wastewater to As Samra WWTP. WZPS and EZPS are currently operated and maintained by the As Samra Plant Operation and Maintenance Co. Ltd (SPC). Wastewater collected from East Zarqa catchment area and Al Hashmieh is a gravity wastewater collection system to East Zarqa pumping station (EZPS). All wastewater flows to As Samra WWTP via two existing 500mm force mains with a total length of around 7,400 m. The new East Zarqa catchment area system expansion, which is currently under construction, will be served by the East Zarqa Pumping Station (EZPS) which include filling gaps of the existing served areas, new expansion of new areas such as Hai Al Batrawi and Hai Al Hashmieh Al Janoubi as well as the new development areas like King Abdulla ben Abd Al 1 Wastewater collected from East Zarqa and Hashemiyyeh is discharged at the East Zarqa (Hashemiyyeh) pump station (EZPS) which pumps to the treatment site at As-Samra through two force mains (500mm, 7.4km). 2

3 Azeez City and Al Majd City. In addition to the above, East Zarqa Pumping Station will also receive flow from the proposed Sukhneh Pumping Station catchment area. Institutional Background The Project Executing Agency (PEA) and Employer, i.e. Water Authority (WAJ) was established as an autonomous corporate body, with financial and administrative independence linked with the Ministry of Water and Irrigation (MoWI). WAJ carries full responsibility for the public water supply, wastewater services and related measures as well as for the overall water resources planning and monitoring, construction, operations and maintenance. The organizational structure of the WAJ is still centralized. The regional branches of WAJ in the Governorates are fully dependant on WAJ headquarters with respect to human resources management, workshop services and billing. Directed from the central head offices in Amman, WAJ operations are structured by the regions of Jordan as follows: Greater Amman The Northern Region (Ajloun, Mafraq, Jerash and Irbid) The Middle Region (Zarqa, Balqa and Madaba) The Southern Region (Karak, Ma an and Tafileh) Aqaba Greater Amman is operated by Miyahuna Company since The Northern Governorates are operated by Yarmouk Water Company (YWC) since 2010, while Aqaba is operated by Aqaba Water Company (AWC) since As Project-Executing Agency, WAJ is responsible for overall implementation of the investment measures. WAJ is represented through the Programme Management Unit (PMU) which will manage and coordinate all aspects on this project, which are considered to be an integral part of the global wastewater system for As Samra Wastewater Treatment Plant. 2. OBJECTIVES The Objective of this Consulting Services is to assist to WAJ in Site Supervision. The consultancy services will comprise: Construction supervision of the new force main (including provisional acceptance of construction works and supplies); Reporting. Programme Objective The objective of the overall project is to ensure a cost-efficient and improved sanitation services for the population in the programme areas with the overall goal to contribute to an efficient and sustainable management of the scarce water resources in Jordan. The focus of this tender is in the field of wastewater. Proposed Investment Measures 3

4 The present Programme component covers the following measures located in Zarqa Governorate of Jordan: Construction of a new Force Main (DN 900 mm, 9 km) from East Zarqa Pumping Station to As-Samra Waste Water Treatment Plant (WWTP) ; Refurbishment of the existing Force Main (DN 500 mm, 7.4 km, from East Zarqa Pumping Station to As-Samra Waste Water Treatment Plant (WWTP). Implementation Concept WAJ as the Project Executing Agency (PEA) is responsible for the overall implementation of the Project. In general, WAJ/PMU will act as focal counterpart of EBRD for the implementation of the Project. The procurement of supply and work contracts shall follow an international tendering process (pre-qualification and tender) in accordance with EBRD s "Guidelines for the Procurement of Supply and Work Contracts". The total implementation period of the present Project is estimated to be 25 months. Feasibility Study Report East Zarqa Force Main, Arabtech Jardaneh, March Design Report East Zarqa Force Main, Arabtech Jardaneh, August SCOPE OF WORK The duties of the Implementation Consultant shall comprise (but not necessarily limited to) the following tasks. Construction Supervision of Works for the New Force Main (Phase 1) Within two weeks after the issuing of the letter of acceptance Award Letter to the construction contractor(s), the Consultant will commence his site supervision duty, not before the contractor(s) start his/their activities. The Consultant shall act as the representative of the PEA on all the construction activities for this program and carry out the duties of the Engineer as defined in the Contractor s contract. He shall provide adequate and competent site supervision staff with sufficient experience to ensure that the construction is carried out to the quality, quantity, cost and program agreed in the contract with the successful bidder(s). The Supervision includes general and site supervision of works, continuous project management and monitoring, periodic reporting, participation in the preliminary acceptance and compilation of the Project Final Report. General and site Supervision of Works shall be performed on a continuous basis. Permanent presence of the Consultant on site shall be provided during all ongoing construction and installation work. 4

5 The Consultant will also need to supervise and monitor the implementation of the Environmental and Social Action Plan (ESAP) by the Borrower and the contract conditions by the contractors. Moreover, the Consultant shall ensure that all reasonable precautions will be made to maintain the occupational health and safety of the contractor s personnel. The consultant s personnel must include an Occupational Health and Safety Expert. The Consultant shall report about the implementation of the occupational health and safety measures as part of its regular reporting. 1. Coordination and liaison with the PEA, Local Authorities (if required), Contractors and other relevant institutions. 2. Carrying out any necessary factory inspection of plant and equipment (if required). 3. Testing and approval of material and equipment as well as of all works done (as applicable). 4. Technical site supervision including day-to-day inspection of the contractor s work including control that the construction is carried out in a safe manner. 5. Financial supervision including continuous control of cost schedules. 6. Administration of contracts including continuous control of time schedules and keeping up to date programme records including technical and financial information. 7. Control that the contractors respect the rules (standards) of occupational health and safety requirements. 8. Measurement of the works done. 9. Certification of the application for payments from the contractors/suppliers. 10. Reviewing of Contractor's drawings, equipment and systems to be incorporated into the works for conformity with design requirements and amendment of any specific design details, if so required. 11. Preparation of any additional designs, plans and drawings, which are necessary for the execution of the works. 12. Assistance to PEA in dealing with any variation orders and/or claims for additional remunerations or extensions of time. 13. Assistance to PEA in dealing with the settlement of disputes or differences that may arise between the PEA and the Contractor(s). 14. Preparation of operation manuals including maintenance plans for systems. 15. Supervision of the preparation of as-built drawings by the Contractor. 16. Establishment of records and submission of certified as-built drawings (based on the Contractor s drawings). 17. Assistance to PEA on the preparation and implementation of provisional acceptance and hand over of the completed works. 18. Preparation of periodic reports and final project reports and assistance to PEA in compiling required reporting to EBRD (if applicable), including assistance in preparation of Annual Environmental and Social Reports to the Bank. 4. IMPLEMENTATION ARRANGEMENTS AND DELIVERABLES Working schedule The Consultancy Services outlined in Chapter 2 ( Scope of Work ) of the present ToR shall be scheduled tentatively in accordance with the following time schedule: - Construction supervision of works (12 months) 5

6 Time Schedule for Reporting The consultancy services outlined in Chapter 2 ( Scope of Work ) of the present ToR shall be scheduled tentatively in accordance with the time schedule stated below: PHASE 1 Submission of the Periodic Monthly and Quarterly after Construction Supervision Month 1 Month 12 Commencement of Services Progress Reports Submission of the Final Project 1 Month after issuing the Taking Month 13 Report Over Certificates for the Contractor In accordance with the services described in Chapter 3 the Consultant shall prepare and submit the following reports in the English language: Periodic Construction Supervision Progress Reports (5 copies to the PEA and 2 copies to EBRD) The Monthly and Quarterly (summarising) Reports during implementation period shall contain information on state of advancement and time schedule as well as cost and financing. Special regards shall be given to current problems and the reasons for deviations from time and cost schedules. The reports shall contain all circumstances that might jeopardize the achievement of the programme overall objective and purpose or the progress of its implementation. It shall include detailed suggestions for measures to be undertaken by the Consultant, the Client or other stakeholders for rectification. The periodic report shall also consider the implementation of the environmental and occupational health and safety measures. Moreover, the reports shall include staff assignments of the Consultant. Monthly and Quarterly Reports shall be submitted within one respectively two weeks after the end of the reporting period. Final Project Report (5 copies to the PEA and 2 copies to EBRD) The Final Project Report shall be submitted after completion of construction and issuing the Taking over Certificates. It will summarise all important information and data for the project implementation. Moreover, it shall contain among others a comparison between the Project results and the Project objectives. The Consultant shall present all information required for the Final Follow-Up Evaluation Report including: - Short description of the Project; - Project measures and their results; - Comparison of planned and implemented measures and reasons of deviations; - Comparison of planned and actual time schedule and reasons of deviations; - Total project cost (subdivided in consulting costs and costs of individual measures); - Project financing; - Major risks for sustainability of the project measures; 6

7 - Recommendation for future operation of the facilities. One part of the Project Completion Report would basically compare the situation before implementation and after completion of project measures. Logistics WAJ has named a focal department (WAJ department), which will take the responsibility to act as focal counterpart on working level for overall Project implementation matters. This department is the Programme Management Unit (PMU) which is responsible for all projects which form part of the Global As-Samra Wastewater System. Moreover, WAJ will nominate for the purposes of the Project execution a member of this department as Project Manager with the Consultant. It will be the Consultant s duty to maintain close contact to him on all aspects of work. As a matter of principle, all formal communications relating to the work will be directed to the attention of the PMU Director. The Consultant has to provide the necessary staff (administrative/technical, foreign/local personnel), which is required for the execution of his services. In order to enhance the local technical skill and experience, cooperation with Jordanian Consultants or independent specialists is recommended. The Consultant is invited to give details on the envisaged logistical set-up (international and local transport, programme office etc.) for the execution of the services in his technical offer. All goods (if any) procured by the programme budget shall be handed over to WAJ after termination of the services. Contribution of WAJ WAJ will provide free of charge all existing information, data, reports and maps as far as available and will assist the Consultant in obtaining other relevant information and materials from Jordanian institutions and authorities as far as possible. However, it is the duty of the Consultant to check availability, quality and suitability of this information. The information, data, reports etc. as mentioned above will be available for the Consultant s unlimited use during execution of the proposed services. All these documents used by the Consultant must be returned to WAJ upon completion of the assignment. In general the Jordanian Authorities will facilitate all staff permits, authorisations and licenses required for performance of the Consultant s services in Jordan. WAJ will assist the Consultant in customs clearance of all equipment, materials and personal effects to be imported (and re-exported upon completion of his assignment) for the purpose of the execution of the works. Quality Control The home office of the Consultant shall maintain continuous support to the team in Jordan. Before submitting any report, the home office is obliged to carefully screen the respective document to ensure the required quality. The Consultant should keep in mind that the measures of the project have to follow the requirements of the Water Policy and Standards of Jordan. The correspondent cost shall be included as a separate item in the Financial Proposal. Donor visibility 7

8 Given the assignment is funded through the EBRD s donor funded technical cooperation programme; the Consultant will be required to support the Client to ensure visibility of these resources. Support on these visibility aspects can be obtained from the Bank s Communications Department. Measures could include but not be limited to: All documents produced by the Consultant should mention donor support and bear the logo of the donor, when appropriate. Donor support to the project should be acknowledged in any public communication (press releases, launch of facilities). Local representatives of donors should be invited to any public event organised to promote the project (press conferences, inaugurations, possibly stakeholder participation programmes). CONSULTANT PROFILE It is proposed to carry out the consultancy services with the following (Key) experts: Team Leader/ Project Manager (Site Supervision/Pipelines Engineer) Sewerage / Design Engineer Electrical Engineer Mechanical Engineer Resident Engineer / Deputy Team Leader (DTL) Environmental/Social Expert Local Experts Nominated key-personnel shall comply with the minimum requirements described below. Team Leader/Project Manager Qualifications and skills: Experience in the region Specific experience and expertise related to the task : University Degree in Civil Engineering; Good knowledge of the English Language; Preferably at least 15 years of professional experience in similar projects; Sound experience in project management of a team composed of international and local experts. Experience in the region will be an advantage. Professional experience in construction supervision of water and wastewater construction works; Previously worked on and expert knowledge on administration of FIDIC based (Red Book) conditions of contracts. Other Key-Experts 8

9 Qualifications and skills: Experience in the region Specific experience and expertise related to the task : University Degree in Engineering (Relevant field to the task); Good knowledge of the English language; Preferably at least 10 years of professional experience in similar projects. Experience in the region will be an advantage. Professional experience in related technical matters; Know-how in water and wastewater works.
