Item No. 6, REVISE Liquidated Damages: Time is of the essence for all work under this Agreement. It is hereby understood and agreed that it is and will be difficult and/or impossible to ascertain and determine the actual damage that the District will sustain in the event of and by reason of Contractor's delay; therefore, Contractor agrees that it shall pay to the District the sum of Three Hundred and Fifty dollars ($350.00) per day as liquidated damages for each and every day's delay beyond the time herein prescribed in finishing the Work. DELETE paragraph Quality Assurance 1.4 A in its entirety. B. DELETE paragraph Definitions 1.2 D in its entirety, and REPLACE with the following: BAS Contractor: The Contractor to provide the work of this Section under separate contract direct to Owner. The Contractor shall be the primary manufacturer, installer, commissioner and ongoing service provider for the BAS work. TTUSD has a 5 year Master Agreement with EMCOR Services Nevada for all DDC controls Projects. Contact Scott Cooper (no exceptions).
