1 RIVER BEND OF HILLSBOROUGH COUNTY HOMEOWNERS ASSOCIATION, INC. The following community information has been summarized in order to provide you with a very brief overview of your community. Please refer to the information immediately following this summary as well as the sections entitled Rules and Regulations and Association Documents for additional details concerning these topics. Board of Directors River Bend of Hillsborough County Homeowners Association, Inc. is governed by a five member Board of Directors. Please see Important Numbers and Property Information for current listing of Board Members. Community Information River Bend consists of 761 homes. Exterior Modifications Any exterior modification such as fencing, screen enclosures, pools, screen/storm door, etc. must be approved by the Architectural Control Committee ("ACC"). You may obtain a copy of the ACC request form by calling the HOA Property Manager at or downloading the forms from the River Bend website. Community Development District River Bend is also subject to a Community Development District (CDD). The fees for the CDD are billed on each owner's annual real estate tax bill. In general terms, the CDD owns all of the common land within the community and is responsible for the maintenance thereon. See Important Numbers for name and contact information for the CDD management company. Fences Please refer to the fencing standards located in the Planning Criteria section of this handbook. Specific styles of fences are reserved for use in River Bend. Insurance The Association maintains insurance policies for property and liability for the community. Please refer to Important Numbers & Property Information for the name of the Association's insurance agent and telephone number. Please contact your personal insurance agent for guidance concerning appropriate coverage on your home. Maintenance The homeowner's association management company acts as a field supervisor for the CDD to assist this entity in maintenance of the landscaping and ponds located within the community. The homeowner is responsible for all maintenance to their home site as well as the exterior and interior of their home.

Please refer to the Association Documents section of this booklet for specific details concerning maintenance responsibilities. Mailboxes Each homeowner is responsible for the care and maintenance of the mailbox situated on the home site. Plants may be installed in the planter box at the rear of the mailbox, but must be kept in a first class condition at all times. No artificial plants shall be installed in this area. Pets The community's Use Restrictions provide that pets may be maintained within the community. Please refer to the Use Restrictions for additional details concerning pets. Ponds River Bend has ponds located throughout the community. All homeowners are encouraged to enjoy the ponds, but are requested to refrain from fishing, boating or swimming in them as they are full of wildlife that may be disturbed should this activity occur. Property Management Meritus Associations, Inc. is the managing agent for the community. Meritus can be contacted at (813) between 8:3 a.m. and 5: p.m. Signs Signs are not permitted on the individual home sites within the community. Community approved For Sale or For Rent signs may be obtained through South Shore Signs (813) No signs may be placed in the window of a home.

3 River Bend of Hillsborough County Homeowners Association PLANNING CRITERIA All lots and dwellings in the property are subject to architectural review in accordance with this Article and the Planning, Construction and Development Criteria adopted and revised from time to time by the Architectural Review Board. The Planning Criteria shall be written and made available to all builders in the property and to all owners or prospective owners. The Planning Criteria may include any matters considered appropriate by the ARB not inconsistent with this Declaration. Please refer to Article VII - Architectural Control and Article IX Restrictive Covenants- for the exact wording of the architectural control and restrictions for River Bend of Hillsborough County Homeowners Association. This Planning Criteria serves to further clarify the intent of the restrictions. Architectural Review Board- Shall consist of no fewer than three members. Submittals and re-submittals of applications/plans shall be approved/disapproved within thirty (3) days after receipt by the ARB. Owners will receive a written response to their application. All applications must include a lot survey showing the location of the proposed improvement on the survey. The fee for review of architectural applications is $25.. Air Conditioning Units/Pool Equipment & Heaters/Water Softeners- All air conditioners, pool equipment, pool heaters and water softeners installed on the side of the homes shall be screened from view from the street and neighboring lots with shrubbery. Plantings that will form a hedge around the equipment are required. Recommended hedge plantings are Viburnum, Hibiscus, Podocarpus or Lorepetulum. Signs - One street number or name sign shall be permitted as provided in Article IX Section 9; however, they are restricted in location to a front landscaped bed and may be no taller than twelve (12) inches and eighteen (18) inches wide. Owner must submit a layout of the street number or name sign along with dimensions for approval by the ARB. For sale or rent signs may not be placed on the easement between the street and the sidewalk in front of a home. Only approved For Sale or Lease signs as specified by the association (see attached sign layout) shall be used. Individual realtor or for sale/lease by owner signs are not permitted at any time. Mailboxes & Posts - All mailboxes and posts shall be maintained as originally installed by the builder of the home. No deviations from the originally installed color, style or height shall be permitted. Mailboxes and posts are to be kept clean and properly maintained at all times. There shall be no decorative items placed on mailboxes or posts except during holiday periods. Said holiday decorations may be placed on the mailbox one week prior to the holiday and must be removed within one week after the holiday has ended. The exception to this rule is during the Christmas/Hannuka season; decorations may be installed after Thanksgiving and shall be removed by January 15th of each year. See Exhibit A attached to the Planning Criteria for the approved mailbox post design. Animals -Homeowners shall not permit their cats or dogs to stray upon the private property of the association or others within the community. All feces deposited by cats or dogs upon private property belonging to the association or another homeowner shall be removed immediately and disposed of properly. A maximum of two (2) dogs and/or two (2) cats may be owned or housed by homeowners within River Bend. Homeowners shall adhere to Hillsborough County's Animal Ordinance with regard, but not limited to, nuisance behavior, leashing of pets and disposal of feces upon private property. Dog runs, cages or kennel are not permitted on any lot within River Bend. Garbage & Trash -Any sanitary container stored outside of the home must be screened from view with approved landscaping. Prior approval from the ARB is required. Any fencing used to screen garbage or trash containers must conform to the Fencing Guidelines for River Bend. The preferred method for storage of garbage or trash is concealment in the garage of the home. Vehicles- No vehicle may be parked on the grass anywhere within River Bend. There shall be no parking on the streets within River Bend. Boats, boat trailers, utility trailers, motor homes, travel trailers, coaches, jet skis, commercial vehicles (with advertising or tool racks) are not permitted upon any lot within the community except when present on business during the normal course of the day. Exterior Electronic or Electric Devices - The preferred location for satellite dishes shall be on the side or rear of the home below the roof line. All wiring for the satellite dish shall be attached to the home and painted to match the exterior body color of the home. Ground mounted satellite dishes shall be screened from view with approved shrubbery.

4 Page 2 River Bend of Hillsborough County Homeowners Association Planning Criteria Fences and Walls - Please refer to the Fencing Guidelines attached to this documents for specifications on size, material, color, style and location of fencing within the community. Exhibit B Yard Accessories and Play Structures - All play structures shall be located in the rear of the home and shall require prior approval of the ARB prior to installation. Play sets may not exceed 12 feet in height and 12 feet in width and shall be constructed of wood or similar material. Entirely metal or aluminum play sets are not permitted. Play sets shall be positioned behind the home and buffered by an approved fence or substantially buffered by landscaping as required by the ARB. Trampolines are not permitted on any lot or common area within the community. Yard or landscape ornaments are limited to two per home site and shall be located in the front landscape beds of the home and may not exceed 18 inches in height or width. All benches, patio furniture, picnic tables, etc., shall be located on a front covered porch or in the rear of the home. They shall not be placed on the grass, walkways or in driveways of the home. Landscape edging as shown are the approved styles for River Bend. Poured in place concrete edging may be used. The owners shall receive prior approval for the poured concrete edging. A color sample is required to be submitted with the. Trees on the easement between the street and sidewalk shall not have any type of landscape edging around them ' Lawn & Landscape Maintenance Standards- The following lawn and landscape standards shall apply to all home sites within River Bend: 1. Trees. Trees are to be pruned as needed and shall be maintained with a canopy no lower than eight feet (8') from the ground on mature trees. 2. Shrubs. All shrubs are to be trimmed as needed. 3. Grass. Grass shall be maintained in a neat and appropriate manner. In no event shall an Owner's lawn get in excess of five inches (5") in height. Edging of all streets, curbs, beds and borders shall be performed as needed. 4. Mulch. Mulch is to be turned several times each year and shall be replenished as needed on a yearly basis. 5. Insect Control and Disease. Disease and insect control shall be performed on an as needed basis. 6. Fertilization. Fertilization of all turf, trees, shrubs, and palms shall be performed at a minimum of three (3) times a year during the following months: February, June and October. 7. Irrigation. Sprinkler heads shall be maintained and/or replaced on a monthly basis as needed. 8. Weeding. All beds are to be weeded upon every cut. Weeds growing in joints in curbs, driveways, and expansion joints shall be removed as needed. Chemical treatment is permitted. 9. Trash Removal. Dirt, trash, plant and tree cuttings and debris resulting from all operations shall be removed and all areas left in clean condition before the end of the day. Yard debris may not be placed at curb until scheduled trash pickup day.

5 Page 3 River Bend of Hillsborough County Homeowners Association Planning Criteria Basketball Hoops - Basketball hoops are permitted within the community. However, they shall be pole mounted permanently and cemented into the ground. The pole shall be solid black and maintained in a like new condition at all times. The backboard of the hoop shall be clear and have no identifiable writing or graphics upon it and shall be kept in a like new condition at all times. The base of the pole shall be landscaped with appropriate shrubbery not to exceed three feet in height. The pole-mounted basketball hoop shall be positioned on the side of the driveway no closer than midpoint between the sidewalk and garage door of the home. It shall be located on the side of the driveway farthest from the front door of the home. Rentals - Homes must be rented in their entirety. Individual rooms of the home may not be rented out. A rental application included with this Planning Criteria, must be completed by the landlord and tenant prior to occupancy of the home. An application fee of $1. is required at the time of submittal. The owner is responsible for providing the tenant with all applicable rules and regulations of the association. The association may evict tenants who refuse or fail to abide by the Covenants and/or rules of the community. Swimming Pools, Screen Enclosures & Sunrooms - Only in-ground swimming pools will be permitted within River Bend. Above ground spas/hot tubs may be approved by the ARB provided that they are located within a screen enclosure at the rear of the home. In-ground swimming pools must be covered by either a white or bronze aluminum screened cage which shall not exceed the height or the width of the home. Screened porches shall not have aluminum pan roofs. Only solid aluminum structural roofs are permitted. All screening shall be charcoal in color and kick plates on enclosures shall not exceed 12 inches in height. Sunrooms will not be permitted within the community unless constructed of materials substantially similar to the exterior of the home and painted to match the exterior color of the home. Furthermore, if approved, sunrooms will be required to have a solid roof shingled to match the existing roof shingles on the home. Front Doors, Garage Doors and Front Porches - Front doors and porches of homes shall not be screened, nor shall screen/storm doors be installed on front of the door to the home. Screening may not be placed in front of a garage door. Hidden or retractable screening installed behind a front door or garage door may be considered by the ARB. Driveways - The driveways of homes shall not be painted or sealed with any pigmented or colored material. Decorative coatings, pavers, etc., may be permitted in the sole discretion of the ARB. Tree Removal & Landscaping -Trees planted on the easement between the street and sidewalk in front of each home shall remain Oak trees. No other trees, shrubs or landscape shall be planted in this area. The base of the tree shall not be surrounded with landscape curbing or edging. Prior approval from the ARB to add additional landscape beds or trees on the home site is required. All landscape beds shall be mulched Landscape rock, pebbles, stones, etc., may be used on a very limited scale with prior approval of the ARB. Energy-Saving Devices - Clotheslines may be used by homeowners in the rear of the home. The clothesline must be concealed from view from the street and removed from view when not in use. Solar heating panels shall be located on the rear elevation of the roof of the home. Any piping attached to the solar panels running down from the roof shall be painted to match the exterior body color of the home. Hurricane Shutters - With prior approval of the ARB, hurricane shutters may be installed on homes. All permanent hardware attached to homes shall be painted to match the exterior of the structure. Hurricane shutters may be put into place on the home at the time of a hurricane watch and shall be removed when the watch or warning expires. Plywood panels may also be used to protect the home in the event of a hurricane. All regulations with regard to hurricane shutters shall apply to plywood panels. Window Treatments - Only white, off-white or neutral color window treatments may be used on windows facing the street. Newspaper, aluminum foil, sheets, etc., may not be placed in the windows of the homes a t a n y t i m e. The Covenants, Conditions and Restrictions of River Bend shall take precedence over the Planning Criteria. Owners must first refer to the CCR's and then the supplemental information in the Planning Criteria document in order to fully comply with all restrictions.

6 River Bend of Hillsborough County Homeowners Association FENCE STYLE & SPECIFICATIONS Fences within River Bend shall be constructed of PVC material and shall conform to the styles and specifications stated below. Wood fences are not permitted within the community. The first step before beginning installation of your fence is to complete an architectural application. The application must be submitted to the Architectural Review Board c/o management company with a lot survey showing the location of the proposed fence installation on the survey. Approval may take up to 3 days to receive from the ARB. Do not begin your fence installation until you have received a written approval from the Architectural Review Board. All fences shall be at a height of six feet if your home backs up to another home. If the rear of your lot faces a conservation area or pond the fence may be six feet in height up to the last panel of the fence on either side wherein it shall transition diagonally from six feet to four feet in one panel length and continue at a height of four feet across the rear of the lot. The four foot section of fence across the rear of the lot shall be an open picket PVC style. Greater transitions in two panel sections may be required if visibility is hindered for another homeowner and shall be determined by the ARB. Fences with a rear lot line adjacent to a roadway must remain at a height of six feet at the rear lot line and tie into the fences on either side of the lot. Alleys or spaces will not be permitted. Only the good side of the fence may face outward. No posts or stringers may be visible from the outside of the fence. All fences that will abut an existing fence or perimeter wall must be installed with the final end side section graduating in height to meet the height of the existing fence or perimeter wall, leaving no gaps. No fence shall be constructed closer to the street, which the house faces, than fifteen feet (15') back from the forward facing comers of the house. No fence shall be permitted to extend beyond the front corners of the house in any circumstance. Fences for corner lots require close coordination with the ARB due to their unique layout and concerns for vehicle visibility/safety and compliance with existing easements and county building code setback requirements. All fences on corner lots will be required to set the fence back 15 feet from the interior edge of the sidewalk alongside the home. In addition, the side of the fence facing the street will be landscape buffered with either Viburnum or Podocarpus hedges. Any and all required governmental approvals/permit fee for fence construction are the responsibility of the homeowners and must be obtained prior to construction, but after approval of the ARB. It is the responsibility of the Owner to comply with all County and/or Association requirements, whichever is most stringent. Fences may not be installed in drainage easements or wetland conservation buffer easements on any home sites within the community.

The transition from 6ft to 4ft in two panel sections on either side of the fence (if it abuts a conservation area or pond) shall be accomplished by stepping the second to last panel down to a five foot height then the last panel down to a four foot height and continuing across the rear of the lot with the picket style fence as show below. Alton Picket Style Fence This picket fence style to be used only across the rear of the lot if it abuts a conservation area or pond. The picket fence shall not have post caps or decorative finials. The height must be 4ft.
