1 Fairway Pines Estates Owners Association Architectural Review Committee Monthly Meeting Monday, June 5, 2017, at 9:35 AM (MDT) 49 South Badger Trail Ridgway, CO Minutes The minutes of June 5, 2017, were reviewed and amended at the August 10, 2017, ARC meeting. The amended minutes are below: The monthly meeting was originally called to order at 9:35 AM but stopped and restarted at 9:50 AM by Chairman Terry Thomas. Members present were Chris Blumke, Frank Connolly, Erich Montgomery, Phyllis Ward, and Deb Yoder; a quorum. Mike Forstner, Board liaison, was present. Barry Zane was a visitor. Mary Ann Guilinger, recording secretary, was present. 1. Review and approve the minutes for April 27, 2017, ed by Mary Ann to committee members on May 15, Terry Thomas asked if there were any questions about the April 27, 2017, ARC meeting minutes. A few changes were made by ARC. Terry Thomas questioned the minutes about the two sentences in the minutes because he does not remember the discussion: Jim Baxter asked about the Association adding a culvert in front of his house. The Association does not have a budget or plan for new culverts. Phyllis Ward made a motion to accept the April 27, 2017, ARC meeting minutes. Chris Blumke seconded the motion. ARC unanimously approved the motion After discussion about what Jim Baxter asked about, the culvert or the ditch, ARC changed the minutes to state: Jim Baxter asked about the Association cleaning out and deepening the road ditch adjacent to the culvert to his driveway. The Committee advised the owner it was his responsibility to do this. Terry Thomas is going to do more research on the ditches and whose responsibility it is to deepen the ditches. Another motion was made by Phyllis Ward to accept the ARC meeting minutes as amended. Frank Connolly seconded the motion. ARC unanimously approved the motion. 2. Association member comments: Any association member or representative may attend and will be given up to 5 minutes to comment on an ARC-related matter not on this agenda.

2 Page 2 Barry Zane was a visitor. Barry Zane has a representative, Paul Ashmead, of Divide Ranch Homes on the phone, and he will be taking notes so his partner can hear the notes of the meeting. The meeting is not being electronically recorded but handwritten. Terry Thomas questioned why Barry Zane was taking minutes of the meeting. Barry Zane stated that his partner wants to know what is happening. Barry Zane has no problem with ARC notes except for the change made to the April 27, 2017, meeting minutes. Jim Baxter did not ask about the culvert in front of his house but the ditch in front of his house. As a result of Barry s comment. Terry Thomas started the meeting over. 3. Review and ratify decisions made by ARC Chair/Alternate since last meeting. Barry Zane requested a change to his walkway from colored gravel to patterned concrete in front of his house. Terry Thomas and Phyllis Ward reviewed the request on site and Terry Thomas ed Barry Zane on May 9 th and gave approval with some conditions for the walkway. 4. Lot 248, 53 Antler Court, Erich and Pat Montgomery, Owners Modifications to balcony. Erich Montgomery is requesting a modification to his house at Lot 248, 53 Antler Court. Erich Montgomery passed out a document for the projected scope of the project. His home is 21 years old in August. The deck has weathered. The project is to improve the deck with a composite decking material, Trex in a spiced rum color, 5 ½-6 inches wide, and 1 inch deep. The decking material will not require painting. Erich provided a sample of the composite decking material. Erich hopes that the composite decking material will last longer than the present decking material. The balusters, with 1½ inches channels, for the railing of the deck will be the flat black metal outlined in the brochure. Erich will keep the 8 x 8 supporting posts in the existing color because they are in good condition; instead of completely tearing down the old deck and rebuilding it. Erich advised a future improvement to the deck may include a pergola or a sun covering of sail fabric material. Erich provided a picture of a deck that has the same material. The project will add an outside staircase from the deck to the ground for safety purposes. Erich provided the original plans to the house; he is keeping the support columns. The new columns for the outside staircase will match the color of the existing columns. Erich provided a

3 Page 3 site plan for where the deck is situated on the house; the deck faces the east looking into Elk Meadows. The outside staircase is, also, identified on the site plan. Patrick Beecher from Ridgway will be the contractor; he has 25 years experience. O Brien s Custom Welding from Ridgway will put together the railings which will be first welded then black powder coated. The top of the railing will be the same black color. Erich will get a permit from the county for the project. Erich wants to start in the next couple of weeks and estimates it will take approximately three weeks to complete. All the flooring will be replaced with a new support system; replacing the joists and ledgers. The Trex material has special clamps that go into the joists so there are no screws. Erich hopes that the new deck will be sturdier than the present deck. The job documents provided by Erich were assembled into a project package during the meeting. This package was presented for approval. Frank Connolly made a motion to accept the project as presented and a project start date in June and estimated construction period to be two months. Phyllis Ward seconded the motion. ARC approved the motion unanimously. Terry Thomas will send Erich Montgomery a signed, Certificate for Final Plan Approval for Construction. 5. Review status of active Projects: American Classic Homes spec home, 1878 Marmot Drive, Lot 565 Shingles installed on roof. Interior rough-in work continues. House wrap appears complete or nearly so; no stucco, stone or siding. Some timber frame exterior elements installed. Additional road base installed in front of garage area. ARC discussed building progress versus construction schedule provided by Contractor and apparent progress to complete within 12 months after Project s July 14, 2016, date of construction start. Contractor was requested to provide an updated construction schedule via letter on April 8, 2017, but no response received to date. Another communication will be sent to the Owner and Contractor to advise that if construction is not likely to complete by July 14, 2017, then an extension must be requested as per ARC standards.

4 Page 4 Jones home, 38 Marten Court, Lot 562 Jones have moved-in. A driveby review of the Jones house reveals significant progress has been made toward completion of their landscape plan. Collins home, 38 Antler Place, Lot 256 House construction was completed during May. The Owner notified the ARC Chair they have received a CO from Ouray County. They have moved into the house. Work is in progress on landscaping, reseeding, and other yard and driveway improvements. Terry Thomas sent the Collins an dated May 31, 2017, about what needs to be completed for return of their conformance deposits. Three Quails, LLC spec home, 284 South Badger Trail, Lot 440 Framing and sheathing in progress for house and roof. Roofing underlayment appears near complete. Shingle installation has not started. Some exterior timber frame elements installed. Rough-in plumbing has started and window installation has begun. A site visit found both dumpsters are covered but fire extinguishers could not be located. Frank Connolly could not find fire extinguishers. Another site visit will be made when workers are present to try to locate the fire extinguishers. If fire extinguishers cannot be found, are not present, then the Contractor will be sent a courtesy letter. Construction progress remains slow. Not much progress during the month. The start date of the home is August 15, 2016, when foundation work started. The home does not appear it will complete within the allocated 12 month period. Saville home, 112 South Badger Trail, Lot 436 Interior finish work continues. Asphalt shingles completed on remainder of roof. Significant progress on exterior rock masonry. Exterior siding installation continues. Exterior timber frame elements installed. Rough grading of disturbed areas of lot was progressed. Significant progress during this period. A member asked about the construction sign on the golf course. Terry Thomas will visit with the Contractor about the sign; only one construction sign is allowed per construction site. Baxter home modifications, 180 Puma Lane, Lot 229 Work has begun on fencing, landscaping, and porch and deck extension changes which were approved during the April 27, 2017, ARC meeting. Foundation

5 Page 5 work is underway for deck construction. Landscaping and fence construction is in progress. Barry Zane s spec house, 181 Woodchuck Place, Lot 229 The Owner requested a change for the front walkway from colored gravel to stamped concrete; noted in Agenda Item No. 3 above. The change was reviewed on-site on May 9 th by Terry Thomas and Phyllis Ward. Barry Zane was at the jobsite and explained the walkway change. This change was verbally approved by Terry Thomas and Phyllis Ward. A follow-up confirming approval was sent on May 9, Via an on May 11 th, the Owner requested a Conformance Review for May 22 nd. On May 19, 2017, the ARC Chair notified Barry Zane the Conformance Review could not be accommodated on May 22 nd and that this requested review would be discussed at the next ARC meeting. During the month the concrete walkway, address monument, and the concrete street apron were installed. Driveway work is in progress. During the ARC meeting Terry Thomas advised the Committee that Barry Zane requested that Phyllis Ward complete the conformance review, and that the ARC Chair, Terry Thomas, not participate in further reviews of his Project. Terry Thomas stated Phyllis Ward should not conduct the Conformance Reviews by herself, but the Reviews should be conducted by the entire Committee. Frank Connolly recommended that Dan Choate and Doug Macfarlane be included in the conformance reviews so as to not leave any lose ends. Erich Montgomery stated that that seems to be a reasonable recommendation. Barry Zane disagreed that Doug Macfarlane, the Committee s consulting architect, should be involved in any conformance reviews because when Doug Macfarlane reviewed the original project construction drawings he found issues with which Barry Zane did not agree. Barry Zane s opinion is that Doug Macfarlane should only review if the proposed home looks like a mountain home; no other details should be reviewed by him. Terry Thomas stated that the purpose of Dan Choate, ARC Construction Inspector, and Doug Macfarlane, ARC Consulting Architect, being involved in these reviews is to ensure the Committee members have access to their expertise. Barry Zane did not agree and a discussion ensued.

6 Page 6 Barry Zane requested that the first half of the conformance review be done as soon as possible, and Barry Zane wants a partial refund of the conformance deposits. The process to permit a partial refund of the Conformance Deposit of was agreed to the previous month and follows recommendation in pending recommended changes to ARC Standards. Terry Thomas requested Barry Zane Project color board be made available during the first Conformance Review. The first Conformance Review will address all project construction and improvements except landscaping. The second Conformance Review will be related to landscaping with reseeding in evidence, plants planted, and soils stabilized and compacted so the drainage does not allow soil to wash away with rains. Tentative on-site review dates were identified as June 9 or June 12 for the Construction Conformance Review and June 29 or June 30 for the Landscape Conformance Review, all to be confirmed by after participant availability is determined. 6. Other Business a. Status of proposed ARC Standards update The ARC standards were reviewed by the Covenants and Rules Committee with some minor tweaks to grammar. The CRC suggested in light of concerns about projects being completed in a timely fashion, that to Section IX, Financial Responsibility, be added that a builder be given one extension of time to complete any improvement of a lot granted by ARC with the length of the extension to be the sole discretion of ARC. However, if after the expiration of the extension, the improvement has not been completed, the posting of a bond shall be required. It was noted that when past house construction projects have fallen behind schedule they usually have financial issues. The CRC felt strengthening this area with a bond may offer some remedies to the Association. All changes were accepted by the CRC and Terry Thomas approved the changes on behalf of ARC. Barry Zane stated that as a builder, it is his opinion that the reason for the $7,500 conformance deposit is a monetary hold over the owners to get them to conform. b. Other Terry Thomas stated that he needs a better understanding about who has the responsibility for the road ditches and deepening the road ditches; the owner or the Association. Terry Thomas took an action item to check with the Road Committee on

7 Page 7 Jim Baxter s behalf to see if ARC provided the correct advice at the April 27, 2017, ARC meeting about the road ditches. Terry Thomas will report back. The meeting adjourned at 11:45 AM with a motion by Terry Thomas and seconded by Frank Connolly. ARC approved the motion unanimously. 7.
