Under Section 16.0 Liquidated Damages a) Progress of the Work and Time for Completion Tenderers are advised of the revision to the Stage 1 and Stage 2 completion dates. d) Liquidated Damages Tenderers are advised of the revision to the Liquidated Damages. Insert the attached pages 8 & 9 with revised Special Information to Tenderers of Section 16 Liquidated Damages and delete original. 2. 9 Tender No Walker Road Corridor Improvements Phase 1 Digby Road to Foster Avenue Addendum No. 4 Geotechnical Investigation Bid Bond and Performance and Maintenance Bonds Drawings All addenda to the Contract Documents 15.0 OWNER The Owner is The Corporation of the City of Windsor 350 City Hall Square West Windsor, Ontario N9A 6S LIQUIDATED DAMAGES a) Progress of the Work and Time for Completion The Contractor shall commence the work within seven (7) calendar days after the receipt of an order in writing to this effect from the Engineer, and shall proceed with the same with due expedition and without delay, except as may be expressly sanctioned or ordered by the Engineer. The Contractor shall complete Stage 1 of the Contract before Saturday 15 December The Contractor shall complete Stage 2 of the Contract before Saturday 29 June If this time limit above specified is not sufficient to permit completion of the work by the Contractor working a normal number of hours each day or week on a single daylight shift basis, it is expected that additional and/or augmented daylight shifts will be required throughout the life of the Contract to the extent deemed necessary by the Contractor to ensure that the work will be completed within the time limit specified. Any additional costs occasioned by compliance with these provisions will be considered to be included in the prices bid for the various items of work and no additional compensation will be allowed therefore. Working time shall be charged until the date of acceptance of the work by the Engineer. b) Working Day A Working Day is defined as any day: i) Except Saturdays, Sundays and Statutory Holidays ii) Except a day on which the Contractor is prevented by inclement weather or conditions resulting immediately therefrom adverse to controlling operation or operations, as determined by the Engineer, from proceeding with at least 60% SPECIAL INFORMATION TO TENDERERS Page 8 of 17

10 Tender No Walker Road Corridor Improvements Phase 1 Digby Road to Foster Avenue Addendum No. 4 of the normal labour and equipment force engaged on such operation for at least (5) hours toward completion of such operation or operations is to be construed to include any feature of the work considered at the time by the Engineer and the Contractor, which if delayed, will delay the time of completion of the Contract. The Engineer will furnish the Contractor with a biweekly statement showing the number of working days charged to the Contract for the preceding two weeks, the number of working days specified for completion of the Contract, and the number of working days remaining to complete the Contract. The Contractor will be allowed one week in which to file a written protest setting forth in what respects the said statement is incorrect, otherwise the statement shall be deemed to have been accepted by the Contractor as correct. c) Extension of Time Should the amount of extra or additional work of any kind, or other special circumstances of any kind whatsoever which may occur, be such as fairly to entitle the Contractor to an extension of time for the completion of the work, the Engineer shall determine the amount of such extension. Provided that the Engineer is not bound to take into account any extra or additional work or other special circumstances unless the Contractor has, within fourteen (14) calendar days after such work has been commenced, or such circumstances have arisen, or as soon thereafter as is practicable, delivered to the Engineer full and detailed particulars of any claim for an extension of time to which he may consider himself entitled, in order that such claim may be investigated at that time. d) Liquidated Damages It is agreed by the parties to the Contract that in case all the work called for under the Contract is not finished or completed within the number of working days as set forth in this "Special Information to Tenderers", damage will be sustained by the Owner and that it is and will be impracticable and extremely difficult to ascertain and determine the actual damage which the Owner will sustain in the event of and by reason of such delay and the parties hereto agree that the Contractor will pay to the Owner the sum of Two Thousand Five Hundred ($2,500.00) for liquidated damages for each and every calendar day delay in finishing the work in excess of the specified completion dates prescribed and it is agreed that this amount is an estimate of the actual damage to the Owner which will accrue during the period in excess of the specified completion dates, for each of Stage 1 and Stage 2 respectively. The Owner may deduct any amount due under this paragraph from any monies that may be due or payable to the Contractor on any account whatsoever. The liquidated damages payable under this paragraph are in addition to and without prejudice to any other remedy, action or other alternative that may be available to the Owner. The Contractor shall not be assessed with Liquidated Damage for any delay caused SPECIAL INFORMATION TO TENDERERS Page 9 of 17

11 Tender No Walker Road Corridor Improvements Phase 1 Digby Road to Foster Avenue Addendum No. 4 The intent of this specification is to ensure that there will be no delays between completion of the underground works and the road works on the street, and to ensure minimum clearance distances for active water mains from active sewers are maintained GAS MAINS Prior to construction, the Contractor shall meet with Union Gas to discuss the construction practices to be followed around existing gas mains. Union Gas will provide the Contractor with their specifications regarding utility support, backfill, compaction, etc. around gas mains. The Contractor shall submit to Union Gas, prior to construction, specifications of compaction equipment to be utilized around dry gas mains. Union Gas will provide third party inspection while the Contractor is working around any critical mains to ensure that proper construction techniques are followed. The Contractor shall include all costs associated with excavating around utilities in his unit price bid under Part A - Item 2 of the Form of Tender, since no extra payment will be made TEMPORARY BATCH PLANTS The Contractor is advised that as per Council Resolution 9/2012, the Contractor and/or Operator of a proposed temporary batch plant within the City limits is required to submit, at their own expense, a request for written approval from the Zoning Coordinator for a specific site prior to erecting and operating any such plant. This applies, but is not limited, to concrete and asphalt temporary batch plants. Temporary batch plants are only permitted in Manufacturing Districts MD2.2, MD2.3 and MD2.5, as per the Zoning Bylaw CERTIFICATE OF SUBSTANTIAL PERFORMANCE Publication of the Certificate of Substantial Performance must be in a construction trade paper having circulation throughout Ontario for the publication to be in compliance with the Construction Lien Act. Since the only newspaper that currently meets the criteria is the Daily Commercial News, the City will henceforth only accept publication of the Certificate of Substantial Performance in the Daily Commercial News. 12 Tender No Walker Road Corridor Improvements Phase 1 Digby Road to Foster Avenue Addendum No CONSTRUCTION STAGING AND COMPLETION INCENTIVE Stage 1: The Tenderers shall be aware that all of the concrete pavement, including curbs, and permanent pavement markings along with complete restoration in its entirety from Digby to STN (C.B. #24) on Walker Road shall be completed by Saturday, 15 December In addition the watermain and appurtenances along with the new storm sewer will be completed in its entirety as well by Saturday, 15 December 2012 from STN to completion. These trenches will be restored temporarily with 100mm thick asphalt (2 lifts of 50mm each). There will be a separate Substantial Completion given for the above noted works once the works are deemed substantially complete for each respective stage. Incentive for Concrete Pavement Completion (including curb): The Contractor will be paid a lump sum incentive of one hundred thousand dollars ($100,000.00) for completion of the concrete pavement, including curbs and permanent pavement markings from Digby to STN (C.B. #24) on Walker Road by Friday, 16 November This completion must be approved by the City Engineer prior to the lump sum incentive being issued. Stage 2: The remaining work from STN southerly to Foster must be completed in its entirety by Saturday, 29 June There will be an additional Substantial Completion given for these works once this work is deemed substantially complete. NOTE: All other conditions (i.e. Substantial Completion per the Construction Lien Act, Working Days per Specification, etc.) will remain as such. See revised completion date and liquidated damages (Section 16). A 10% holdback will apply for any work performed after Substantial Performance and that this holdback will not be released until the entire completion of the contract PRIVATE PROPERTY ACCESS The Tenderers are advised that at municipal address No. s 3100, 3132, 3134 and 3202 Walker Road there could be a delay to access the private properties to complete the work as shown on the contract drawings. Proposed works in these areas will be limited to the City right-of-way until access is granted by the Engineer. This condition will not impact the incentives/disincentives as stated in Item 36 of the Special Information to Tenderers and no claims will be entertained from the Tenderer that he was uninformed of this condition.
