17 GENOTEK Terms & Conditions warranty Liability and Remedy GENOTEK LEED DOCUMENT Subject to the conditions and limitations in this document warrants to the original owner that Genotek products listed in this document will be free from manufacturing defects and will, with normal usage, perform in accordance with the published specifications In effect on the date of its application or installation. For this warranty to apply, the products must be installed properly as part of the System in accordance Genotek Installation guidelines and must be approved by a Genotek Technical Professional after installation. The warranty applies to the products mentioned below only: Expansion Joint System Description The Expansion Joint Cover material is comprised of a thermal plastic rubber and aluminum or aluminum only. Warranty Period This limited warranty shall extend for a period of 2 10 (Two to Ten) years only. Warranty Requirements Substrate The substrate must comply with the following requirements in order for the system to be available for installation. Genotek will not be responsible for the system failures from the use over a damaged, defective or improperly prepared substrate which is not levelled in accordance with the Genotek guidelines. Care and Maintenance General care and cleaning is achieved using a commercial grade cleaner and water. In no instance should an acid based product be used to clean the aluminum or rubber surfaces. For heavy cleaning of scuffmarks, a commercial grade spray cleaner can be used for spot cleaning and touch-up. For unexposed Expansion Joint Covers there is no cleaning required to maintain performance. Any roof Expansion Joint Covers can be cleaned with a mild soap and water. Again, no acid based products should be used. The company shall not be responsible or liable for consequential or incidental damages resulting from any defect in the product including floor covering. The company is not responsible for structural failure or workmanship that is not in accordance with the product specifications, applicable ANSI standards and applicable building code requirements. This warranty does not cover the normal wear and tear or cracking due to structural movement, excessive deflection or other failures in the substrate, including damage from the weather, fire and acts of god. In the event of defect, the company shall repair and/or replace the defective material provided the following conditions have been satisfied: 1. The Client shall notify the Company, in writing, that the product has become defective, stating the nature of the defects within the warranty period; and 2. The Client must permit the Company, its agents, and employees access to examine the product after notification so that the cause of the problem can be determined and repairs or replacements made. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, THE COMPANY EXPRESSLY DISCLAIMS ANY OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES ARISING FROM SAMPLES OR ORAL STATEMENTS OR OPERATION OF LAW, STATUE, COURSE OF DEALING, CUSTOM, TRADE OR OTHERWISE. THE COMPANY SHALL NOT BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSSES TO DELAYS OR DISRUPTIONS. Claims Procedure To make a claim under this limited warranty, you must notify the company within 15 days after discovering any alleged System defect and before performing any repair work. You may be required to provide proof of product purchase and installation. GENOTEK GREEN BUILDING AND SUSTAINABILITY Genotek embraces and enables sustainability in its operations, culture and through the performance of its products. Genotek supports green building practices and energy efficient design in all new and remedial construction. The unique features of Genotek products are synchronous with LEED design principles and, as has been demonstrated in numerous projects can contribute towards achieving LEED certification. GENOTEK(TM) EXPANSION JOINT SYSTEMS QUALIFY FOR THE FOLLOWING LEED CREDITS: MR CREDIT 4.1 & 4.2, RECYCLED CONTENT Genotek expansion joint cover s aluminum contains a minimum of 70% recycled aluminum. Of the 70% recycled content, 30% is postconsumer recycled content and 40% is pre consumer recycled content. MR CREDIT 4.1 & 4.2, RECYCLED CONTENT Genotek expansion joint cover s stainless steel contains a minimum of 86% recycled stainless steel. Of the 86% recycled content, 54% is postconsumer recycled content and 32% is pre consumer recycled content. EQ CREDIT 4.1, LOW EMITTING ADHESIVES All adhesives or sealants supplied with Genotek expansion joint covers for field-application within the interior of the building meet the requirements of SCAQMD Rule #1168. The aerosol adhesive supplied with Genotek fire barrier is also compliant with GS-36 requirements, as it contains no VOC s. EQ CREDIT 4.2, LOW EMITTING PAINTS AND COATINGS Genotek expansion joint covers offer environmentally-friendly powder coat finishes that contain no VOC s. MR CREDIT 5.1, REGIONAL MATERIALS In many cases our products are processed and manufactured within the required 500 mi. radius, however, with extraction sites varying with raw material global price fluctuations, it is not possible to identify exact extraction sites for materials that will be used on this project.
