IMPORTANT NEWS FOR USERS OF OPS TAKE TIME TO READ THIS NOTICE April Two New Initiatives for the Ontario Provincial Standards Both of the following initiatives may have an impact on your Tendering Documents and Contract Documents. Beginning with the April 2007 publication, the Ontario Provincial Standards for Roads and Public Works (OPS) organization will be publishing three different types of Ontario Provincial Standards and will be changing its once a year publishing to twice a year. 1) Three Types of Ontario Provincial Standard Specifications (OPSS) The three types of OPSSs will be: Common for provincial and municipal use specifications Construction and material specifications developed for use in both provincial and municipal oriented Contracts. The administration, testing, and payment policies, procedures, and practices reflected in this type of specification correspond to those used by many municipalities and the Ontario Ministry of Transportation (MTO) alike. This type is the same type of specification that has been published by OPS since its inception. Common specifications will continue to be published in the current: OPS Volume 1, (renamed) Common General Specifications and Construction Specifications for Use in Municipal and Provincial Contracts, and OPS Volume 2, (renamed) Common Material Specifications for Use in Municipal and Provincial Contracts. 2 Provincial oriented specifications Construction and material specifications developed to reflect the administration, testing, and payment policies, procedures, and practices of the Ontario Ministry of Transportation. Provincial oriented specifications will be published in the new: OPS Volume 5, Provincial Oriented General Conditions of Contract, General Specifications, and Construction Specifications, and OPS Volume 6, Provincial Oriented Material Specifications. Municipal oriented specifications Construction and material specifications developed to reflect the administration, testing, and payment policies, procedures, and practices of many municipalities in Ontario. Municipal oriented specifications will be published in the new: OPS Volume 7, Municipal Oriented General Conditions of Contract, General Specifications, and Construction Specifications and OPS Volume 8, Municipal Oriented Material Specifications Each specification type will be identified by its specification designation: Common for provincial and municipal use specification OPSS nnn Provincial oriented specification OPSS.PROV nnn Municipal oriented specification OPSS.MUNI nnn (where nnn is the number that represents the subject matter of the specification) It is suggested that Owners indicate clearly in their Contract Documents to the Contractor which type of Ontario Provincial Standards apply to their Contract, for example: For municipal Contracts, Only the common standards in OPS Volumes 1 to 4 and the municipal oriented specifications in OPS Volumes 7 and 8 apply to this Contract, unless specified elsewhere in the Contract Documents. For provincial Contracts, Only the common standards in OPS Volumes 1 to 4 and the provincial oriented specifications in OPS Volumes 5 and 6 apply to this Contract, unless specified elsewhere in the Contract Documents. This initiative affects only OPS specifications. The OPS drawings in OPS Volume 3 and OPS Volume 4 are not affected. For more information go to the OPS website ( News and Information. 2) Twice-A-Year Publishing Ontario Provincial Standards ready and approved for publishing in April or November of each year will be published at the end of that month. The April publication will contain municipal or provincial oriented specifications and common specifications that are revised because of the publishing of a municipal or provincial specification. The November publication will contain the specifications and drawings developed and revised by the OPS Specialty Committees. Once-a-year publication began to avoid problems and claims for municipal Contracts that contained statements such as, The most current Ontario Provincial Standards apply to this Contract in their Contract Documents. When the Contract Documents contain this sort of statement, and, if a revised standard is published part way through the term of a Contract and it contains new or changed material, methods, quality assurance, measurement, or payment information, there is a chance that confusion, disputes, and claims may occur when one party or the other of the Contract attempts to apply the new or old standard. 3 Due to the need for publishing specifications twice-a-year, Owners are encouraged to review their Contract Documents and revise the above such statements to, The Ontario Provincial Standards in affect when the call for Tenders for this Contract were advertised shall apply for the duration of the Contract, or other such wording. This initiative affects all OPS specifications and drawings. ONTARIO PROVINCIAL STANDARDS NOTICE OF ACCESS Current users of the Ontario Provincial Standards for Roads and Public Works (OPS) will not be receiving notices for OPS updates as they have in the past. Methods of notification from Publications Ontario for the future are being investigated and you will be informed of them as they become available. In the interim, an will be sent to OPS users who have registered their OPS manuals and CDs with Marg Gordon, Clerk, (OPS) Standards Management New OPS manuals and the latest published updates for each of the four OPS manuals are available as follows: Available electronically on the MTO website. Online access to the current, updated, and archived standards; indexes; OPS User Notes; and publication Revision Information Sheets are available free of charge at the site.
