2 TENDER FOR CONSTRUCTION OF UG WATER TANK CAPACITY OF LTRS FOR CRICKET GROUND AT SAGAR On behalf of MADHYA PRADESH CRICKET ASSOCIATION (hereinafter referred as M P C A), sealed item rate tenders are invited from the Contractors for the work of Construction of UG Water tank capacity of ltrs for Cricket Ground at Sagar for Madhya Pradesh Cricket Association. Drawing is as per ANNEXURE I Layout of the Under Ground Water Tank shall be as per Master Plan of the cricket Ground and before execution of the work at site approval for the marking of the tank at site is to be taken from MPCA authority. Shape of the water tank me be change according to the available of the physical space at the site and it may be square or Rectangle in the shape. 1. PRE QUALIFICATION CRITERIA FOR CONTRACTOR i. The Contractor should have an experience in construction field for at least last 5 years. (Proof to be attached). ii. The Contractor should have completed relevant construction works for an amount of Rs. 10 lacs per year during last 2 years. (Proof to be attached). iii. The Contractor should have valid Service Tax Registration, Sales Tax Registration & P.F. Registration. (Proof to be attached). iv. The Contractor should be accustomed of working at Sagar, or surrounding region upto a distance of 50 kms. 2. 3 3. SUBMISSION OF TENDER : 1. THE TENDERER SHALL SUBMIT THE DOCUMENTS IN TWO SEPERATE ENVELOPES MARKED AS ENVELOPE 'A' - TECHNICAL SPECIFICATION ENVELOPE 'A' - TECHNICAL SPECIFICATION SHOULD CONTAIN a. Covering letter (as per the specimen) on the letterhead of the firm with signature & seal of the authority submitting the tender on behalf of the firm. b. Adequate documents / photographs / work completion certificate etc. to establish fulfillment of the eligibility criterion. AND ENVELOPE 'B' BILL OF QUANTITIES ENVELOPE 'B'- QUANTITIES & PRICES SHOULD CONTAIN THE PRICES AS PER THE FORMAT. 2. THESE TWO ENVELOPES SHALL BE PACKED IN ONE COVER ENVELOPE ADDRESSED AS UNDER HON. SECRETARY - MADHYA PRADESH CRICKET ASSOCIATION HOLKAR STADIUM, RACE COURSE ROAD, INDORE THE COVER ENVELOPE SHOULD MENTION TENDER FOR CONSTRUCTION OF UG WATER TANK CAPACITY OF LTRS FOR CRICKET GROUND AT SAGAR 3. INDIA Dear Sirs, This has reference to the Notice Inviting Tender (NIT) for the work of Proposed Construction of UG Watertank capacity of ltrs, for Cricket Ground at Sagar, for Madhya Pradesh Cricket Association. I/We have received the Tender Documents in details with Bill of Quantities containing Tender Drawings. I/We hereby offer to execute the works under contract at the respective rates mentioned in the schedule of quantities herein attached. I/We have examined the drawings and read the general and Special Conditions of contract, articles of agreement and specifications. I confirm herewith that I have inspected the site of works, access to the works and local prevailing conditions. I/we agree to complete the whole of the works within the stipulated time of completion of 1 month after the commencement of works as per the work order. I/We do hereby agree that this work of road shall be as per the guidelines and specifications followed in P.W.D. SOR for Building work in force from 2012 and issued by E-IN-C. M.P. PWD. 5 GENERAL CONDITIONS OF CONTRACT 1. Type of Contract The Contract shall be an item-rate contract. The Contractor shall be paid for the actual quantity of work done, as measured at site, at the rates quoted by him in the Contract Bills. 2. Schedule of Quantities The schedule of Quantities given in the Contract Bill are provisional and are meant to indicate the intent of the work and to provide a uniform basis for tendering. The Owner reserves the right to increase or decrease any of the quantities or to totally omit any item of work and the Contractor shall not claim any extras or damages on these grounds. Any error in description or in quantity or omission of items from the Contract Bill shall not vitiate this Contract but shall be treated as a variation. 3. Contract Drawings In general the Drawings shall indicate dimensions, position and type of construction; the Specifications shall indicate the qualities and the methods; and the Bill of Quantities shall indicate the quantum and the rate for each item of work. Any work indicated on the Drawings and not mentioned in the Specification or vice versa shall be furnished as though fully set forth in both. Work not specifically detailed, called for, marked or specified shall be the same as similar parts that are detailed, marked or specified. The Contractor's work shall not deviate from the Drawings and the Specifications. 4. Progress Chart The Contractor shall prepare progress charts and submit the same for approval of the Architect and for his record within twenty-one days of the Award of the Contract. The chart shall indicate the expected date of commencement and completion of each of the items of the work. 5. Taxes The Contractor shall add to the amount of his tender the amount of sales tax duty, any other taxes, legally payable and it shall be assumed that his rates cover for all taxes and duties and no claim on this account will be entertained. 6. Licenses and Permits for Materials under Government control Licenses and Permits for all materials under Government control shall be obtained by the Contractor through the collaboration and help of the Owner, the Contractor shall include in his tender all transport charges and other expenses likely to be incurred to bring the materials to the Site. 7. Water and Electricity for construction MPCA will provide single point connection for water and electricity (if required). 8. Certificates and payment Payment shall be made as per mutual agreed terms and condition and 10 % of total contract value shall be as Retention money for 12 months. 9. Materials and Workmanship All materials and workmanship shall be as per the relevant code of I.S.I Specification and of approved type and the Contractor shall immediately remove from the works any material and/or workmanship which in the opinion of the Architect are defective or unsuitable and shall substitute proper materials and/or workmanship at his own cost. The term approval used in connection with this contract shall mean the approval of the Architect. 5

6 10. Defects Liability Period The Contractor shall make good at his own cost and to the satisfaction of the Architect, all defects, shrinkages or small faults, arising in the opinion of the Architect from work or materials not being in accordance with the Drawings or Specifications or Schedule of Quantities or the Instructions of the Architect, which may appear within "Defects Liability Period" referred to in the appendix. "Defects Liability Period" shall be for 12 months after handing over the tank to MPCA. 11. Injury to Persons and property Owner & Insurance The Contractor shall be liable Insurance for and shall indemnify the Owner against any liability, loss, claim or proceedings whatsoever arising under any statute or at common law in respect of personal injury to or the death of any person whomsoever arising out of or in the course of or caused by the carrying out of the works, unless due to any act or neglect of the Owner or of any person for whom the Owner is responsible. The Contractor shall in the joint names of the Owner and Contractor insure against loss or damage by fire, storm, tempest, lightning, flood, earthquake, aircraft or anything dropped there from, aerial objects, riot and civil commotion for the full value thereof all work executed and all unfixed materials and goods intended for, delivered to and placed on or adjacent to the work, but excluding temporary building plant, tools and equipment owned or hired by the Contractor or any Sub-Contractor and shall keep such work materials and goods so insured until Virtual Completion of the work. 12. Arbitrator All dispute and difference of any kind whatever arising out of or in connection with the Contract or the carrying out of the works (whether during the progress of the works or after their completion and whether before or after the determination, abandonment or breach of the Contract) shall be referred to and settled by the Architect who shall state his decision in writing. Such decision may be in the form of a Final Certificate or otherwise. The decision of the Architect with respect of any of the excepted matters shall be final and without appeal. But if either the Owner or the Contractor be dissatisfied with the decision of the Architect on any matter, question or dispute of any kind (except any of the excepted matters) or as to the withholding by the Architect of any certificate to which the Contractor may claim to be entitled then and in any such case either party (the Owner or the Contractor) may within 28 days after receiving notice of such decision give a written notice to the other party through the Architect requiring that such matters in dispute be Arbitrated upon. Such written notice shall specify the matters which are in dispute and such dispute or difference of which such written notice has been given and no other shall be and is hereby referred to the Arbitration and final decision of a single Arbitrator being a conveyer of the supervising committee appointed by the High Court of Madhya Pradesh. 13. Cleaning The Contractor shall properly clean the work as it progresses and shall remove all rubbish and debris from the site from time to time as is necessary and as directed. On completion the Contractor shall ensure that the premises and/or site are cleaned surplus materials debris, sheds etc. 14. NEGOTIATION AND OTHER RIGHTS RETAINED BY THE M P C A: i. If deemed fit, M P C A may call any or all the tenderer who have participated in the tender for further negotiation of rates or any of the conditions. ii. However, M P C A reserves the right to reject any or all the tenders with or without any negotiations, without assigning any reasons thereof. 6

7 iii. Reject or accept any application, cancel the tender process, and reject all applications; iv. Amend the scope and value of any contracts tendered under this project. In such an event, tender will only be invited to submit needful documents / offers for the revised requirements; M P C A shall not be liable for any such actions and shall be under no obligation to inform the tenderer of the grounds for such actions Signature of Tenderer Date : 7
