1 City of Eagle Point 2017 Paving Instruction to Bidders Issued: August 2, 2017 Closing Date and Time: Wednesday August 16, 2016 at 2:00 pm Project Summary The City of Eagle Point is requesting bids for City of Eagle Point 2017 Paving. The project includes paving, cold planning, and minor grading. Sealed bids will be received until Wednesday, August 16, 2017 at 2:00 pm, by Robert Miller, PE, Public Works Director/City Engineer, at City of Eagle Point, P. O. Box 779/17 S. Buchanan Avenue, Eagle Point, OR, Cost Estimate: $200,000 to $240,000. All proposers are required to comply with provisions of Oregon Revised Statutes, Oregon Administrative Rules, Oregon Standard Drawings and Specifications (ODOT/APWA), and the Eagle Point Standard Details. A business license from the City of Eagle Point is required. The City of Eagle Point reserves the right to 1) reject any or all proposals not in compliance with Oregon bidding procedures and written instructions if it is in the best interest of the public to do so, 2) seek clarifications of each response, 3) waive informalities in the proposals, 4) choose different proposers for each task, 5) modify the project to fit within budgeted amounts, and 6) negotiate a final contract that is in the best interest of the City. Bids received after the time established for receiving bids will not be considered, and will be returned unopened. Bidders on this work must comply with Federal Construction Labor Standards and with all other applicable federal governmental requirements including, but not limited to, equal employment opportunity actions as specified. Prequalification To be eligible to bid, the Bidder must be prequalified by the City of Eagle Point. Prequalification submittals by interested Bidders must be received by the City at least five (5) calendar days prior to the bid opening date. Prequalification application forms may be obtained at the City of Eagle Point. As prescribed in ORS 279C.435, proof of prequalification by the Oregon Department of Transportation, State Highway Division, may be submitted to the City in lieu of a Prequalification Statement. Prequalification from other agencies are also accepted, with approval from the City, indicating projects of similar size and scope on public streets. City of Eagle Point 2017 Paving Page 1

2 Construction Contractor Board No bid for a construction contract shall be received or considered unless the bidder is registered with the Construction Contractors Board or licensed by the State Landscape Contractors Board as required by ORS Prevailing Wage This project is a prevailing wage project. Submission of a bid constitutes agreement by the bidder stating that provisions of ORS. 279C.800 to 279C870 will be met. First Tier Subcontractor Disclosure Form Bidders are required to disclose information about certain first-tier subcontractors when the contract value for a public improvement is greater than $100,000 (see ORS 279C.370). Specifically, when the contract amount of a first-tier subcontractor is greater than or equal to (I) 5% of the project Bid, but at least $15,000, or (II) $350,000 regardless of the percentage, the following information about that subcontract must be disclosed within two (2) hours of Bid closing: The subcontractor s name and address, the subcontractor s Construction Contractor Board registration number if one is required, and the subcontract dollar value. Bidders shall disclose first-tier subcontractor information on the First-tier Subcontractor Disclosure Form. If you will not be using any subcontractors that are subject to the above disclosure requirements, you are required to indicate "NONE" on the accompanying First Tier Subcontractor Disclosure form. Oregon Residency All bidders must state at the appropriate place in the bid documents, whether or not the bidder is a resident as defined in ORS 279A.120. A percentage increase, as determined by the Department of General Services, will be added to non-resident's bids for the purpose of determining the lowest qualified bidder. The Contract, if awarded, is to be awarded to the lowest responsive, and responsible bidder. Asbestos This project does not contain asbestos abatement work and the contractor or (any) subcontractor will not be required to be licensed by the Department of Environmental Quality (ORS 468A.720). Substitutions Bidders are to submit requests for approval of brands or manufacturer other than those specified five (5) days prior to bid opening. City of Eagle Point 2017 Paving Page 2

3 Interpretation No oral interpretations will be made to any bidder as to the meaning of the Contract Documents or any part thereof. Every request for such an interpretation shall be made in writing to the City. Any inquiry received five (5) or more days prior to the date fixed for opening of bids will be given consideration. Every interpretation made to a bidder will be in the form of an Addendum to the Contract Documents, and when issued, will be on file in the office of the Owner at least three (3) days before bids are opened. In addition, all addenda will be mailed or faxed to each person holding Contract Documents, but it shall be the bidder s responsibility to make inquiry as to the addenda issued. All such Addenda shall become part of the Contract and all bidders shall be bound by such Addenda, whether or not received or acknowledged by the bidders. Bid Bond A Bid Bond or certified check payable to the City of Eagle Point, Oregon in the amount of five (5) percent of the Bid sum shall be included. Security shall be either certified check or bid bond issued by surety licensed to conduct business in the State of Oregon and acceptable to the Owner. The successful bidder s security will be retained until he has signed the Contract and furnished the required payment and performance bonds. Performance Bond CONTRACTOR shall, within ten days after award of the contract and prior to doing any work under this contract, furnish to the CITY, in a form and with a surety thereon satisfactory to the CITY: 1) A performance bond in an amount equal to the full contract price conditioned upon the faithful performance of this contract upon the part of CONTRACTOR in accordance with the plans, specifications, and conditions of this contract, and also complying with the provisions of Oregon Revised Statute 279C.380(a) and any other laws of the State of Oregon relating to faithful performance bonds for construction of public works. 2) Pursuant to ORS 279C.380(b), a payment bond in an amount equal to the full contract price, solely for the protection of claimants under ORS 279C.600. Public Works Bond Pursuant to ORS 279C.836 before starting work on a contract or subcontract for a public works project with a contract price that exceeds $100,000, the contractor or subcontractor shall file with the Construction Contractors Board a public works bond with a corporate surety authorized to do business in this state in the amount of $30, The Bid Bond, Performance Bond, and Payment Bond (as required) may be submitted on the bonding company s form, provided that a contact phone number for the agent is provided. 4 Resident Bidder Bidders will be required to attest as to whether they are resident or nonresident bidders in accordance with provision of ORS 279C.365. Resident Bidder is defined in ORS 279A.120. Submission of Bids The submission of a Bid shall be prima facie evidence of the following: that the Bidder has carefully examined a full and complete set of the bid documents for this project as indicated on the document acknowledgement; that the Bidder has personally inspected the site; that the Bidder has satisfied himself/herself as to the quantities involved and acknowledges that the description of the quantities of work and materials included herein is brief and is intended to indicate only the general nature of the work; and that this Bid is made according to the provisions and terms of the full and complete bid documents, which documents are hereby made part of this Bid. All bids received must be in writing and sealed upon presentation to the City. Site Examination Each bidder shall visit the sites and fully acquaint themselves with the existing conditions there relating to construction and labor, and should fully inform themselves as to the facilities involved, the difficulties and restrictions attending the performance of the Contract. The bidder acknowledges that he/she is satisfied as to the nature and location of the work, the various street surface conditions to be encountered and the general and local conditions including, but not limited to, those bearing upon transportation, disposal, handling and storage of materials, availability of water, surface water, storm drainage system, access to the site and coordination with the City. Examination of Contract Documents The bidder shall thoroughly examine and familiarize themselves with any drawings, technical specifications and all other contract documents. The bidder's own judgment shall be relied upon in preparing the proposal and include a bid sum sufficient to cover all items required by the contract, with good construction and workmanship standards. Information and data furnished or referred to herein is furnished for information only. It is the responsibility of the Contractor to acquaint themselves with the available information here in the attached Special Provisions. Failure to accurately assess the difficulty or costs involved any consequent conclusions or interpretations are the sole responsibility of the Contractor. Base Quote Contractors shall acknowledge that estimated quantities are not guaranteed, and shall be based on the actual amounts to complete the work as outlined. 5 Schedule Bid Opening August 16, 2017 at 2:00 pm Scheduled Award of Contract August 22, 2017 (City Council meeting) Begin Work September 6, 2017 Completion of Work October 27, 2017 Time and Completion Liquidated Damages The Bidder must agree to commence work on or before a date to be specified in a written "Notice to Proceed" from the Owner, and to fully complete the project by October 27, 2017; The Bidder must also agree to pay as liquidated damages, the sum of $ (two hundred and fifty dollars) for each consecutive calendar day thereafter until all the construction is complete. Allowance will be made for inclement weather. Licenses All Contractors and subcontractors performing work within the City limits must possess valid City of Eagle Point business licenses. Contractor shall possess all licenses required by the State of Oregon pertaining to the work set forth in this bid. Standard Drawings/Specifications The Oregon Standard Specifications for Construction, Oregon Standard Drawings, and Eagle Point Standard Details shall apply for this project. The Special Provisions attached as part of the bid documents shall apply for the project.
