1 Office of the Executive Officer CONSENT CALENDAR September 11, 2007 To: From: Honorable Chairperson and Members of the Redevelopment Agency Phil Kamlarz, Executive Officer Submitted by: Dan Marks, Director, Planning and Development Subject: Contract Amendment: Joint Trench Design for Undergrounding in Aquatic Park Connection RECOMMENDATION Adopt a Resolution authorizing the Executive Officer to amend the Agency s contract with Bellecci and Associates (Contract # 6834) to 1) provide plans and coordination for a joint trench for undergrounding utilities on Addison from Bolivar to Second Street and below the railroad tracks as part of the design and construction documents for the Aquatic Park Connection Streetscape Improvements; and 2) increase the contract amount by $57,900 for a total not to exceed $202,900. FISCAL IMPACTS OF RECOMMENDATION Funding is available in the Redevelopment Fund: Existing Contract Amount.$145,000 Proposed Increase..$57,900 New Total Amount $202,900 Contract Management System (CMS) No. GBZUA CURRENT SITUATION AND ITS EFFECTS On September 27, 2005, the Agency adopted Resolution No. 1,227 authorizing the Executive Officer to execute a contract not-to-exceed $135,000 with Bellecci & Associates, Inc. for streetscape improvement design and engineering services along Fourth and Addison Streets. Utility undergrounding was not considered feasible at the time, and was not included in the scope of services. On January 24, 2006, the contract was amended to add $10,000 for surveying work. The contract expiration date is June 30, 2008, and can be extended if needed administratively. 2 Contract: Joint Trench Design for Undergrounding CONSENT CALENDAR September 11, 2007 Undergrounding is now considered feasible within the existing APC budget and funding priorities, and was included as part of the project as approved by the Agency. Staff has applied to PG&E for undergrounding of numerous transformers and several poles on Addison Street from Bolivar (Aquatic Park) to Second Street as well as vaults on both sides of the rail tracks to allow undergrounding for properties adjacent to the tracks. PG&E is prepared to draft preliminary design upon receipt of an Engineering Advance. A joint trench needs to be incorporated into the APC construction, which has been delayed to incorporate the undergrounding. Staff proposes expanding the scope of services for Bellecci & Associates, Inc to provide plans and coordination for a joint trench. Utility undergrounding is expected to commence in Spring BACKGROUND Bellecci & Associates, Inc. have provided streetscape improvement design and engineering services along Fourth and Addison Streets sufficient to require developer conformance with the design development plan and are preparing construction drawings for the Agency s construction of streetscape improvements on Addison from Second to Bolivar and at the rail tracks at Addison Street. The contract was made prior to the decision to underground utilities in the construction areas. By integrating undergrounding with the streetscape improvements, the streetscape improvements will not be destroyed if and when subsequent undergrounding is scheduled. The PAC endorsed undergrounding adjacent to the park on Addison at their May 2007 meeting. The project is located outside of the West Berkeley Project Area. The Redevelopment Agency Board made all of the findings required by Health and Safety Code for use of West Berkeley Redevelopment Project Area funds in Resolution No. 1,227, which authorized the original contract with Bellecci & Associates, Inc, and in Resolution No. 1,235, which approved the APC Streetscape Improvement Design Development Plan as the Master Plan for streetscape improvements and which explicitly included utility undergrounding. RATIONALE FOR RECOMMENDATION Bellecci & Associates, Inc. was hired to provide streetscape improvement design and engineering services along Fourth and Addison Streets. The Contractor is now being asked to provide additional services. It is therefore recommended that their contract be increased to reflect these additional services. Doing so now avoids destruction of streetscape improvements in the future to accommodate utility undergrounding. ALTERNATIVE ACTIONS CONSIDERED City of Berkeley staff does not have the available resources required to perform the engineering support for undergrounding before next year. Another contractor would increase the coordination demands of Bellecci and Associates and raise costs. Page 2

CONTRACT AMENDMENT BELLECCI & ASSOCIATES, INC., DESIGN JOINT TRENCH FOR UNDERGROUND UTILITIES IN AQUATIC PARK WHEREAS, on September 27, 2005, the Agency Board adopted Resolution No. 1,227 authorizing the Executive Officer to execute a contract and any amendments with Bellecci & Associates, Inc. (Contract # 6834) for streetscape improvement design and engineering services along Fourth and Addison Streets in an amount not to exceed the amount of $135,000, and on January 24, 2006, the Agency Board adopted Resolution No. 1,229 increasing the contract to $145,000 to include additional surveying; and WHEREAS, on December 5, 2006, the Agency approved the Aquatic Park Connection (APC) Streetscape Improvement Design Development Plan as the Master Plan for streetscape improvements for Addison Street from Bolivar to Fourth Street and Fourth Street from Addison to Hearst Street; and WHEREAS, utility undergrounding is desirable and was included as part of the project as approved by the Agency; and WHEREAS, the contract with Bellecci & Associates, Inc. needs to be modified to provide plans and coordination for a joint trench for undergrounding utilities on Addison from Bolivar to Second Street and below the railroad tracks; and WHEREAS, the contract amount needs to be increased by $57,900 for a total not to exceed $202,900, to provide the additional services; and WHEREAS, sufficient funds are available to pay for the additional services in the Capital Project Fund ; and this contract has been set up in the citywide contracts database, CMS No. GBZUA; and WHEREAS, the project is consistent with the Redevelopment Plan and the Five-Year Implementation Plan. NOW THEREFORE, BE IT RESOLVED that the Agency Executive Officer is hereby authorized to execute a contract amendment with Bellecci & Associates, Inc. to provide plans and coordination for a joint trench for undergrounding utilities on Addison from Bolivar to Second Street and below the railroad tracks for a total contract amount not-toexceed $202,900. A record signature copy of said contract and any amendments to be on file in the Office of the City Clerk.
