1 RFP - #BC T Page 1 of 4 UMBC Patapsco Hall Addition Project The purpose of this ADDENDUM NO. 1 dated October 15, 2009, is to distribute information in response to questions received from proposers. All other specifications, terms and conditions of this solicitation not expressly amended by the responses in this ADDENDUM remain as originally stated. 1. RFP Document, Section 0100, H. TERMINOLOGY, #3: Add the following defined term: - Design/Build Project Delivery Method: A project delivery system based on an agreement whereby the design services and construction services are provided through a single entity and that entity is obligated to the owner for the combined services. Design-build contract entities include a contractor led design/build team, an architect led design/build team, a developer led design/build team, and an integrated firm that provides both design and construction services. (Note: In the case of RFP #BC T, the University will be contracting with the Design/Build Contractor (DBC) as the single entity obligated to the Owner for the combined services; the DBC is required to contract with their identified prime architect including all of the identified design consultants per its technical proposal to provide the necessary and required design services.) 2. RFP Document, Section 00300, Article 2, Technical Proposal: - Subparagraph A., (5) Prime AE Firm Experience: This subparagraph is deleted and replaced with the following: (5) Project Completion: One (1) of the two (2) projects must have had construction completed in the last ten (10) years with higher consideration if completed in the last seven (7) years and, occupied for at least 6 months; and the other project may be in construction but must be at least 50% complete for construction with higher consideration if completed. - Subparagraph 4.1 Design Build Contractor Profile: - #4.1.3 Financial Information: Add the following: The audited financial statements or independently prepared financial statements submitted must include balance sheet and profit and loss information. - #4.1.5 GMP/Open Book Project Experience: In this new subparagraph, Proposers shall provide a narrative describing their firm s experience with project delivery methods that are based on a guaranteed maximum price (GMP) with open book accounting. This narrative shall include a listing of the projects their firm has completed in the last five (5) years that were based on a GMP with open book accounting with the project name and owner, project dollar amount and applicable delivery method for each. This narrative shall not be more than one (1) single spaced page.

Structural System: The University requires a construction type of 2B, or more restrictive type, to be compatible with existing adjacent construction. 4. RFP Document, Section Additional UMBC Amendments to the UMBC General Conditions: Add the following to the RFP document under Section 00801: - Paragraph 1.03D: Delete second sentence in Paragraph 1.03D. The Contractor s Confined Space Program is described in another article of these General Conditions. - Paragraph 1.03E (2): Add the following phrase at the end the second sentence of subparagraph 1.03E (2): unless directed in writing by the University. - Paragraph 1.03G (1): Add the following phrase in the first sentence after City of Baltimore : Baltimore County. - Paragraph 2.07E: Change number of shop drawings for University s Office of Facilities Management from 2-copies to 4-copies. - Paragraph 2.07J: Change the end of the first sentence as follows: within 5-days of receiving the shop drawing rejection or notation. - Article 3.07: Change the word University at the end of the sentence to the following phrase: University s Office of Procurement. - Paragraph 4.01A: Add the phrase or specifications after the phrase any drawings in the first sentence of Paragraph 4.01A. - Paragraph 4.12B: Add the following phrase at the beginning of the first sentence: When confined space work is indicated,. - Paragraph 4.13A: Delete Paragraph 4.13A. - Paragraph 4.13B: Change the word All at the beginning of the first sentence to Contractor. - Paragraph 4.13C: Add the phrase employees and before trade contractor personnel. - Article 4.15: Delete and replace Article 4.15 Parking with the following: Parking of employees of the Contractor and their subcontractors shall be the responsibility of the Contractor. Follow parking rules of the University for Contractor parking.

3 RFP - #BC T Page 3 of 4 UMBC Patapsco Hall Addition Project - Article 4.16: Add ARTICLE 4.16 KEYS as follows: For temporary use of University keys, Contractor shall sign Key Request Form and submit to University Project Manager. When required, keys will be issued to the Contractor by University Work Control office. Contractor is responsible for complying for University requirements for key usage. Contractor is responsible for costs associated with lost keys. - Paragraph 6.02 D: Replace Paragraph 6.02D with the following: Before starting work involving welding, burning, brazing, or similar activities, obtain a Hot Work Permit from University Environmental Health and Safety Office. Permit must be requested not less than two full working days prior to the requested work. Post a copy of the Hot Work Permit near the location of the work involved. - Article 7.02: Replace Article 7.02 Project Signs, Paragraphs A, B, and C, with the following: Provide project sign for any construction project costing in excess of $100,000. Refer to University standards for size, construction, mounting system, and location. - Paragraph 8.01 F: Add paragraph 8.01 F as follows: If requested by University, submit updated schedule indicating work completed with each application for payment. 5. Section Prevailing Wage Rates: Attached please find the prevailing wage rates for this project and the instructions to the contractor issued by the State of Maryland Department of Labor, Licensing and Regulation. 6. RFP Document, Section 00200, D. 1: Add the following document: - Patapsco Hall Addition/Renovation Project, #SK 1.0, Sketch Site Plan dated 9/21/09 (copy attached herein)

RFP Document Section 00400, Article 2, University Role, #2.4 Document Review: Add the following to this subparagraph: The University agrees to conduct its review of the Schematic Design and Design Development documents within a scheduled workshop review meeting with the Design Build Team under the following conditions: - The Design Build Contractor must provide the documents to the University for review one (1) week prior to scheduled workshop meeting; and, - The Design/Build Contractor must document the results of the workshop review meeting to the University within two (2) days of this meeting; that is, the results of the workshop are the final review comments which the AE will be required to incorporate into the design documents. 8. Question: Was a specific material specified for the Patapsco Hall project for Alternate #2 for the hardscape material. UMBC Response: Plaza areas for the referenced project have not yet been design nor have materials been specified. At other projects on campus the university has accepted, concrete paving, high compressive strength concrete pavers, integrally colored concrete paving, exposed aggregate concrete paving, as well as, combinations of the above. A minimum of a LEED Silver rating for this project is required. Porous concrete paving may be considered for limited areas only. 9. Question: Section (c), page 28 of the RFP notes one project within 7 years and the other two at least 50% complete. Can we submit one of our projects that was completed more than 7 years ago if the other 2 are completed within 7 years? UMBC Response: Yes, although higher consideration will be given to projects completed within the last 7 years. 8. The attached Acknowledgement of Receipt of Addendum form is to be completed/signed and included with the Technical Proposal. 9 PREVAILING WAGE INSTRUCTIONS FOR THE CONTRACTOR The contractor shall submit TWO complete copies of his payroll records and the payroll records of each of his subcontractors-one copy to the Contracting Officer and ONE to the Commissioner of Labor & Industry, Prevailing Wage Unit, 1100 N. Eutaw Street, Room 607, Baltimore, Maryland 21201, where they will be available for inspection during business hours. These payroll records must be submitted within 14 calendar days after the end of each payroll period and shall contain the following information: Contractor's name, address & telephone number; location and project number of the job; Employees name, address, social security number, exact and specific work classification, hours-straight time and overtime-worked each day, total hoursstraight time and overtime-worked rate of pay and gross wages earned. Employee's address may be dropped after it has been reported one time. Payrolls shall be submitted on U.S. Department of Labor Wage and Hour Public Contracts Division Payroll Form WH-347 or its equivalent and contain only information relevant to the job and be serially numbered starting with payroll number one. The contractor shall be responsible for submission of all subcontractors' payroll records covering work performed directly at the work site. Each copy of the payroll records shall be accompanied by a statement signed by the contractor or the subcontractor, indicating that the wage rates contained therein are not less than those established by the Commissioner as set forth in the contract, that the classification set forth for each worker or apprentice conforms with the work performed, and that the contractor or subcontractor, as the case may be, has complied with the provisions of the law. A contractor or subcontractor may make deductions that are (1) required by law; (2) required by a collective bargaining agreement between a bona fide labor organization and the contractor or subcontractor; or (3) contained in written agreement between an employee and an employer undertaken at the beginning of employment, if the agreement is submitted by the employer to the public body awarding the public work and is approved by the public body as fair and reasonable. If the contractor is delinquent in submitting payroll records, processing of partial payment estimates may be held in abeyance pending receipt of the records. In addition, if the contractor is delinquent in submitting the payroll records, the contractor shall be liable to the contracting public body for liquidated damages. The liquidated damages shall constitute the sum of $10.00 for each calendar day that the records are late. Only apprentices REGISTERED WITH THE MARYLAND APPRENTICESHIP AND TRAINING COUNCIL shall be employed on Prevailing Wage Projects. Apprentices shall be paid a percentage of the determined journey person's wage for the specific craft. Overtime rates shall be paid by the general contractors and subcontractors under its contracts and agreements with their employees, which in no event shall be less than time and one-half the prevailing hourly rate of wages for all hours worked in excess of ten (10) hours in any one calendar day; in excess of forty (40) hours per workweek; and work performed on Sundays and legal holidays. Contractors and subcontractors employing a classification of worker for which a wage rate was not issued, SHALL notify the Commissioner of Labor & Industry, Prevailing Wage Unit, for the purpose of obtaining the wage rate for said classification PRIOR TO BEING EMPLOYED on this project. To obtain a prevailing wage rate, which was NOT listed on the Wage Determination, send a WRITTEN request for the specific omitted rate or craft to the Division of Labor & Industry, Prevailing Wage Unit, 1100 N. Eutaw Street, Room 607, Baltimore, Maryland The fringe benefit packages of the contractor, and all subcontractors working under him, must be submitted indicating the hourly dollar amount paid, along with proof of payment, on behalf of each employee working on 1

A valid copy of the Construction License for the contractor and subcontractors, permitting them to perform construction work in the State of Maryland must be submitted. Forward the subcontractors list, the fringe benefits packages, the apprenticeship papers and the construction licenses to the above address. Under the MARYLAND APPRENTICESHIP AND TRAINING COUNCIL laws and regulations, "A minimum ratio of one journey persons regularly employed for one apprentice consistent with proper supervision, training and continuity of employment and applicable provisions in collective bargaining agreements. No deviation from the minimum shall be permitted unless first submitted to the council, in writing, for its approval." The apprentice ratio is as follows: JOURNEYMEN APPRENTICES Laborers may NOT assist mechanics in the performance of the mechanic's work, NOR USE TOOLS peculiar to established trades.
