1 CITY OF CEDARBURG PLAN COMMISSION PLN A regular meeting of the Plan Commission of the City of Cedarburg was held on Monday, at Cedarburg City Hall, W63 N645 Washington Avenue, second floor, Council Chambers. The meeting was called to order at 7:05 p.m. by Mayor Kip Kinzel. Roll Call: Present - Mayor Kip Kinzel, Council Member Patricia Thome, Mark Burgoyne, Greg Zimmerschied, Mark Poellot, Heather Cain, Daniel von Bargen Also Present - City Planner Jon Censky, Administrative Secretary Darla Drumel, interested citizens STATEMENT OF PUBLIC NOTICE Secretary Drumel confirmed that the agenda for the meeting had been posted and distributed in compliance with the Wisconsin Open Meetings Law. APPROVAL OF MINUTES A motion was made by Commissioner Cain, seconded by Commissioner Zimmerschied, to approve the minutes of July 6, 2015 as presented. The motion carried without a negative vote. COMMENTS AND SUGGESTIONS FROM CITIZENS No comments were offered at this time. PUBLIC HEARING REGARDING CONDITIONAL USE REQUEST FOR A RESTAURANT PLUS SITE, ARCHITECTURAL, LANDSCAPING AND LIGHTING PLAN REVIEWS FOR A PROPOSED NEW MULTI-TENANT BUILDING AT W62 N182 WASHINGTON AVENUE CONCORD DEVELOPMENT Mayor Kinzel declared the public hearing open at 7:03 p.m. Secretary Drumel confirmed that proper legal notice of the public hearing had been given. Planner Censky advised that Andrew Petzold of Concord Development is requesting conditional use approval for a restaurant to be located in the north tenant space of his proposed multi-tenant building to be located just south of the Walgreens Drug Store. Mr. Petzold is also requesting approval of site, architectural, landscaping and exterior lighting plans for the new project.

2 PLN This parcel and the Walgreens parcel were created by combining several nonconforming lots into two buildable ones and the access and drainage requirements were addressed for both lots together when the Walgreens project was developed. Accordingly, access to this project will be via a shared drive with Walgreens to the north and one shared with the Super Sales gas station to the south. Furthermore, the shared stormwater management system was installed as part of that project under where the front parking lot is now being proposed for this multi-tenant project. Architecturally, the plans are designed to complement the look of the Walgreens building in terms of colors, design and material. Specifically, they propose an attractive brick building with accenting stone material at the corners and limestone CMU concrete block above. The building will be flat roofed behind a parapet wall with decorative cornices and fascia at staggered heights on the front elevation. The top of the front elevation will be covered with pre-finished bronze aluminum break coping. Pre-finished dark bronze aluminum canopies are shown above the entryways and dark spandrel glass windows will dominate the west elevation. In support of the restaurant, proposed is an outdoor seating area at the northwest corner enclosed by a 48 high dark bronze decorative fence. The applicant is proposing a 7,030 square foot multi-tenant building which will be set back from Washington Avenue 148 feet. A 27-stall parking lot is located in front of the building and an additional 21 stalls are behind. Staff notes that the parking stall sizes are shown at 9 X18 typical of many codes; however, Cedarburg s Code requires either 10 X18 or 9 X20 ; therefore the plans will need to be adjusted accordingly. The plans propose a one-way lane extending from the front parking lot along the south side of the building where it then wraps around the east side of the building ultimately leading to a drive-thru window on the north elevation. Traffic is then directed through the parking lot to the site s driveways. Access to the back parking lot will be from the Walgreens drive over a shared access easement. The landscape plan shows a display of ornamental grass, perennial flowers and low growth ornamental shrubs in street-side green area where this area is also anchored by a Swamp White Oak tree at the north end and an Autumn Blaze Maple tree at the south end. This planting scheme is reflected on the islands in the front parking lot as well but with Skyline Honey Locust trees. The rear parking lot will include two Honey Locust trees, Prairie Fire Flowering Crab trees, Norway and Black Hills Spruce Trees. This plan complies with Code requirements. The dumpster enclosure for this development will be located off the rear parking lot at the northeast corner of the parcel. The enclosure will be constructed of brick material to match that of the building and the access gate on the west side of the enclosure will be of cedar board material. The dumpster enclosure measures 18 X18 and will stand 6- feet high.

3 PLN Centered on the street side green area, set back 7-feet from the right-of-way line will be their monument sign. This sign measures 5-feet high and 6.2-feet wide and will be on a 1 3 base the base will be constructed of matching brick material with cast stone cap. The plan also includes four wall mounted signs above the tenant spaces. While the Building Inspector typically approves signage for all commercial buildings outside the Historic District, the applicant asked that the Commission approve his sign package for this project as submitted. Commissioners agreed to include that in their action. The plans show three pole-mounted light fixtures in the front parking lot and two in the back lot. These fixtures will be single head LED lights directing light downward mounted on 16-foot high poles on 2-foot concrete bases. Three different types of wall mounted fixtures will illuminate the building including sconce lights, surface lights under the entrance awnings and decorative wall lights. The lighting plan complies with Code requirements. Commissioner Zimmerschied questioned whether the tenant would be a high-impact restaurant, which could create a traffic flow issue on Washington Avenue and in the site. Commissioner Poellot did not want to see a building that was the same as the Walgreens store to the north and preferred a smaller brick size. After clarification of the specific brick size by Mr. Petzold, the Commission consented on the brick. Mr. Petzold advised that the type of restaurant was not yet determined, but believed that the layout would accommodate vehicular traffic adequately. The building design is to complement the Walgreens building and the brick size would be 4-inches tall by 16- inches long. Action to Close the Public Hearing: Mayor Kinzel moved to close the public hearing at 7:20 p.m. The motion was seconded by Vice Chairperson Burgoyne and carried without a negative vote. Vice Chairperson Burgoyne pointed out that because of the prior work with Walgreens, the project does not require any additional curb-cuts on Washington Avenue. The Plan Commission adopted a policy to reduce the curb cuts in south Washington Avenue, but has had little success in convincing property owners to share access points. Planner Censky reported that several lots were combined to create both the vacant lot and the Walgreens lot and shared access was part of the approval. Council Member Thome noted that Concord Development is known for its quality projects. Vice Chairperson Burgoyne opined that the proposed project will be a valuable asset to south Washington Avenue. Action: A motion was made by Mayor Kinzel, seconded by Council Member Thome, to approve the conditional use permit for a restaurant at W62 N182 Washington Avenue and to

4 PLN approve the site, architectural, landscaping and lighting plans, including signage plans, subject to: Engineering department review and approval of the grading, drainage and erosion control plans. The building shall have a fire alarm system installed throughout. Parking stalls shall be 180 square feet in size. The curbing at the south driveway shall be extended to the back of the sidewalk along Washington Avenue. Impact fees will be due at the time of building permit issuance. The motion carried without a negative vote. DUMPSTER AND UTILITY ENCLOSURE FOR W63 N583 HANOVER AVENUE LaBUDDE GROUP/RICH ERICKSON Planner Censky advised that the owner, Rich Erickson, is requesting approval to install a safety/screening fence/dumpster enclosure along the west side his office building (former Library). While the main objective is to screen his dumpster, the fence will also serve to screen the existing HVAC units and will prevent people from falling down the two-foot drop in elevation from the adjacent sidewalk down to his property. According to their plans, the fence will have decorative lattice treatment above, be of vinyl material and be in dark mocha walnut in color. The fence will stand 7-feet high and be in 8-foot sections. A pedestrian access door is to be located on the north side of the enclosure and the gate for accessing the dumpster will be located at the south side of the west end. Planner Censky added that since access to their dumpsters will be across the Historical Society site, the applicant was asked to inform them of these plans. Action: Vice Chairperson Burgoyne moved to approve the plans as proposed for a dumpster and utility enclosure at W63 N583 Hanover Avenue. The motion was seconded by Council Member Thome and carried without a negative vote. COMMENTS AND ANNOUNCEMENTS BY PLAN COMMISSIONERS In response to Commissioner Zimmerschied s request for an update on the activity related to the construction of an approved parking lot at the southwest corner of Zeunert Street and Cardinal Avenue to serve the tenant located at W60 N171 Cardinal Avenue, Commissioners agreed to have this item placed on the next agenda to provide direction for staff.

5 PLN MAYOR S ANNOUNCEMENTS Commissioners determined that the next meeting date would be changed to Wednesday, September 9, 2015 due to the Labor Day holiday. ADJOURNMENT A motion was made by Commissioner Cain to adjourn the meeting at 7:43 p.m. The motion was seconded by Mayor Kinzel and carried without a negative vote.
