1 SOUTHEASTERN PENNSYLVANIA TRANSPORATION AUTHORITY ASBESTOS AND LEAD AIR MONITORING AND SAMPLING SERVICES SCOPE OF WORK I. General Information: The Southeastern Pennsylvania Transportation Authority (SEPTA) is soliciting a qualified company to provide asbestos and lead air monitoring and sampling services for a three year period. The work defined in this specification is to provide the removal of asbestos containing materials and/or lead based paint at any location throughout SEPTA. II. 2 Page 2 Facility Location: Any SEPTA Location. This can include but is not limited to SEPTA facilities, yards, tunnels, right-of-ways, cable vaults, substations, manholes and confined spaces. Work hours: anytime on a project to project basis. Provide: Arrival to the site within a specified amount of time after being contacted by SEPTA, assessing the scope of work needed to obtain the materials needed, production of proper notifications, mobilizing the labor needed, and conducting requested services. Emergency Service: A project that has to be addressed within 24 hours or less. The Contractor shall respond to the SEPTA Project Manager within one hour. When contacted by SEPTA for a service, the Contractor must respond to the site to assess and begin the removal activities within the timeframe designated by the SEPTA PM. Work: Any and all labor, supervision, service, materials, machinery, equipment, tools, supplies, insurance, disposal and facilities necessary to provide the requested services per the terms and conditions of the Contract. Labor Cost: Direct wages with fringe benefits, and payroll taxes paid by the Contractor. This shall be based on an hourly man hour rate per employee and subject to the following guidelines: SEPTA shall not pay Travel Time to and from the site. SEPTA shall not pay a Shift Premium SEPTA shall not pay a Night Differential SEPTA shall not pay a vehicle fee SEPTA shall not pay a fuel charge SEPTA shall not pay for site visits to assess the scope of work III. General Requirements: Bidders must solely perform all asbestos and lead activities requested by SEPTA Project Manager. Bidders shall provide Time and Material (T&M) rates at the time of bid. Bidders must have at least five years experience performing commercial and/or industrial asbestos and lead inspections/surveys, sample collection, onsite analysis, air monitoring, report writing, specification writing, cost estimates and training. Bidders must provide SEPTA with three customer references with address and telephone numbers for projects of similar size and scope of work which the contractor serviced in the past year. References must be submitted within 10 calendar days after notification of being the lowest responsible bidder. Bidders shall have and maintain, during the performance of this Contract, any and all permits, licenses, certifications, accreditations, and other qualifying credentials required by law, regulations, ordinance, or Contract specifications at the time of the bid submission for

3 Page 3 conducting business in Pennsylvania, New Jersey, and Delaware. Said documents must be submitted with bid documents at time of the bid submission. Bidders shall submit their OSHA incident Rate, EMR and OSHA 300 log with bid documents. Bidders shall comply with all Local, City, State, and Federal regulations, including SEPTA policy and procedures including but not limited to OSHA, EPA, L&I, PADEP, AMS, DOT, NESHAP, PennDOT, NFPA70e, New Jersey Department of Community Affairs, New Jersey Department of Environmental Protection, and Delaware Department of Health and Social Services, during the life of this Contract. Bidders shall furnish all labor, materials, supplies and equipment necessary to conduct requested services of all ACM/LBP at a SEPTA location. No extra charges are allowed for consumables used in inspections, surveys or sampling. As part of the contract, the contractor is expected to provide PPE, sample collection supplies, equipment and tools to conduct the inspections and/or sampling. Bidders must send all personnel who will be assigned to work in the tunnel or close to SEPTA s track area to SEPTA s Track Safety and Roadway Worker certification classes at no cost to SEPTA. SEPTA will provide this training as required. This is an eight hour class and is required prior to working in the tunnel or close to the track area. The certification is valid for one year. A current, valid certification must be maintained for all personnel who will be assigned to work in the tunnel or close to SEPTA s track area for the duration of the contract. Bidders must ensure that only SEPTA track safety certified personnel are assigned to those locations that require work in the tunnel or close to the track area. Bidder shall provide his own service equipment including but not limited to fork lift truck, high reach, ladder, scaffolding, HEPA equipped vacuums, generators, temporary lighting or any other specialized equipment required to complete the services of this Contract. The Bidder must provide trained personnel for operating said equipment. Equipment must be kept in good working condition. Bidder must ensure workers are provided and don fall protection for said equipment. Bidder shall submit to SEPTA all SDS for all chemical products proposed to be used during the requested services for review. SDSs must be submitted within 10 calendar days after notification of being the lowest responsible bidder. SEPTA reserves the right to reject or refuse the use of any chemical product on property. Bidder shall maintain complete and accurate records relating to services performed for the SEPTA and shall retain those records for a minimum of three years following the expiration of the contract.

4 Page 4 Bidder shall implement all necessary work control procedures to ensure timely accomplishment of work, as well as tracking and reporting work in progress. The Bidder shall plan and schedule work to ensure material, labor, equipment, and supplies are available to meet the work requirements within the specified time limits and in conformance with the quality standards established. Bidder shall have the ability to respond and perform up to three project requests at the same time. Bidder shall be responsible for assigning sufficient personnel to the performance of this contract to ensure timely completion of all requirements. Staff reductions shall not be used as a rationale for services not being performed. Contractor shall ensure adequate staffing levels at all times. Bidder must be able to provide emergency service to any SEPTA location at any time with potential short notification time (less than one hour). Bidder may be required to conduct awareness training for SEPTA employees. Bidder shall submit the name, address, and telephone number of the contact person authorized to handle project requests herein. Bidder shall submit the name, address and telephone number of the NVLAP, ELAP and AIHALAP accredited analytical laboratory proposed to be used. The Contractor shall provide the sampling results directly to the SEPTA Project Manager (sbaer@septa.org) in conjunction with the contractor s results for all sampling activities. The Contractor shall have the ability to have results to the SEPTA PM for any analytical analysis requested with turnaround times designated by SEPTA PM. (i.e. 6 hour, 12, hr, 24 hr, etc). This contract can be terminated at SEPTA s convenience at any time for the duration of the contract. Bidders must provide a list and copies of licenses of the certified Inspectors, Investigators, Project Designers, Management Planners, Risk Assessors (including their certification numbers) currently employed with the company. This list will need to be updated upon the employment of any new personnel that will be servicing this contract. SEPTA Project Manager may request this information at any time during the contract period and the Bidder must comply. This list of employees must be submitted within 10 calendar days after notification of being the lowest responsible bidder. If during the performance of the work, due to the Contractor s fault or neglect, or that of the Contractor s agents or employees, any SEPTA property, stock, or supplies are damaged or lost, the Contractor shall be responsible and, SEPTA, at its option, may either require the Contractor to replace all property or reimburse SEPTA for the full value of the lost or damaged property. The Contractor shall replace the lost or damaged property with

5 Page 5 materials of equal or better quality. Repairs and replacement of materials are to be approved by SEPTA prior to the project completion. Contractor shall coordinate and cooperate with other contractors as directed by SEPTA to share information, schedule activities to minimize facility or operational impacts, and expedite overall project progress. IV. Personal Protection: V. Safety The Contractor shall provide proper PPE to their personnel working on SEPTA property. This includes but is not limited to the following: The workers shall don approved, air-purifying respirators (or higher protection factor) and cartridges in the work area. The respirators shall be fitted properly; long side burns, beards, etc. which interfere with proper fit are unacceptable. The workers shall don disposable, full body coveralls with head and foot coverings, gloves and eye protection in the work area when warranted. The Contractor shall ensure that all workers remove asbestos/lead debris from clothing and equipment before leaving the work area. The workers shall don fall protection when utilizing lifts and other elevated work locations. The workers shall don appropriate eye protection. The workers shall don safety vests (Fluorescent Yellow-Green, ANSI/ISEA 107, Class 2 and ASTM F1506 compliant), long pants and work boots when on SEPTA property. The workers shall don ear protection when applicable on SEPTA property. The workers shall don hard hat when applicable on SEPTA property. The workers shall don appropriate FR clothes when applicable on SEPTA property. The Contractor shall in the performance of the work follow all the industry standard safety practices including Federal, State, Local and SEPTA Safety Rules and Policies. The Contractor shall provide to SEPTA after the contract award, a copy of the Contractor s Safety Programs as well as a HASP. This should also include medical examination and fit testing documentation. These documents must be submitted within

6 Page 6 10 calendar days after notification of being the lowest responsible bidder. A Site Specific HASP will be required for each project location and shall remain onsite for the duration of the project. The HASP shall be submitted to the SEPTA Project Manager no later than two days prior to the commencement of work. The Contractor shall keep the work area and immediate vicinity free of accumulations of waste materials and rubbish. At the completion of work, the contractor shall remove all rubbish, tools, scaffolding, and surplus materials from the Site. The Contractor shall establish emergency and fire procedures for evacuation including identifying the locations of exits and fire extinguishers. Emergency and fire procedures shall have priority over decontamination procedures. The Contractor shall have a first aid kit onsite for each project. Eating, drinking, smoking and chewing tobacco or gum shall not be permitted in the work area. The following is a listing of typical project requirements; the work requested by the SEPTA Project Manager is not limited to the following as other activities may be requested. VI. Asbestos Projects The Contractor shall provide API or Building Inspector oversight for abatement projects. Duties of the API/Building Inspector include by are not limited to: The API shall conduct inspections throughout the project. Each step of the abatement project will require the API inspection/approval before proceeding to the next step. This shall include inspecting the filters for damage and/or cross contamination from other offsite projects. Materials and workmanship shall be subject to examination by the API at all times during the construction and use of the containment. The API shall have the authority to reject defective material and workmanship and require its correction. The API will immediately suspend any work which is being conducted in an unsafe manner. The API will ensure that the abatement contractor and their employees licenses are current and issued by the Commonwealth of Pennsylvania and the City of Philadelphia. The API will inspect all containment bags prior to the commencement of removal activities utilizing a smoke tube and aspirator bulb to detect leaks or other approved detection methods.

7 Page 7 Project clearance will be based on thorough visual inspections conducted by the API as well as the air monitoring results. If the criteria for clearance have not been fulfilled to the satisfaction of the API, then re-cleaning of the entire removal area will be required until the desired results are achieved. The API will complete an Alternative Method Request when applicable. The API should coordinate this through the abatement contractor. All requests must be submitted to the SEPTA PM for review/approval prior to submitting to AMS. A report documenting the abatement shall be submitted to the SEPTA Project Manager no later than one week from the conclusion of the abatement work. The Project Manager may require a daily report of site activities. The Contractor is expected to complete a full written report for inspections, surveys and sampling conducted on SEPTA property. These reports shall include but are not limited to: date of the inspection/sampling/abatement event, site drawing with sample locations, analytical results and chain of custody, condition classification of ACM, identification of material types, site conditions, quantities, observations, conclusions, recommendations and site photographs. The Contractor may be required to submit daily/weekly progress reports to the SEPTA PM. The Contractor may be required to prepare Specifications and Cost Estimates of surveyed materials for abatement projects. Specifications are required to be written by current licensed Project Designers. The Contractor shall conduct onsite analytical analysis of air monitoring results when applicable. The Contractor may be expected to submit a status report or results of onsite analysis to the SEPTA Project Manager. Bidder shall submit copies of the NIOSH 582 certification with the bid documents. Only Bidders with NIOSH 582 certification at the time of submission will be considered. The Inspector or Investigator may be required to conduct destructive testing during inspection/survey/sampling work. The Contractor shall be responsible for any asbestos fiber contamination of adjoining areas which may occur during sampling, inspection or survey work. All equipment and/or materials within these areas shall be totally decontaminated or disposed of and replaced by the Contractor at his expense. Replacement of materials is to be approved by SEPTA prior to the project completion. The Contractor is required to cover sampling locations with duct tape, encapsulate or other appropriate sealant on insulation materials. The Contractor shall remove, transport and dispose of all asbestos contaminated materials associated with inspection, survey or sampling from the site in compliance with all Federal, State and local regulations.

8 Page 8 VII. Lead Projects The Contractor shall utilize lead safe work practices for all projects on SEPTA property. The Contractor shall ensure that all workers remove lead debris from clothing and equipment before leaving the work area. The Contractor shall provide air monitoring services for removal activities or other requested activities on SEPTA property. This may include exposure assessments for removal activities as well as an Inspector to verify paint has been adequately removed or recommendations for PPE. A report documenting the removal activities shall be submitted to the SEPTA Project Manager no later than one week from the conclusion of the removal work. The Project Manager may require a daily report of site activities. The Contractor is expected to complete a full written report for inspections, survey and sampling conducted on SEPTA property. These reports shall include but are not limited to: date of the inspection/sampling event, site drawing with sample locations, analytical results and chain of custody, copies of XRF data, condition of paint and location, quantity, conclusions, recommendations and site photographs. The Contractor must have the ability to utilize an XRF analyzer on SEPTA property. The Contractor shall ensure the XFR is properly shielded. A list of trained employees along with proof of training certification, proof of manufacture compliance testing, and regulatory licenses/permits must be submitted within 10 calendar days after notification of being the lowest responsible bidder. The Contractor shall provide TCLP testing when requested. The Contractor shall remove, transport and dispose of all lead contaminated materials associated with inspection, survey or sampling from the site in compliance with all Federal, State and local regulations. VIII. 9 Page 9 IX. Invoicing Contractor invoice must contain the correct charge number. Additionally, they must refer to the SEPTA work location, and provide a statement of work summary in narrative form. This information must be the lead information on the invoice. Each project must be invoiced separately. Travel time, mileage, travel time to and from warehouse, travel to contractor's vendor, lunch, or similar type charges, will not be accepted as part of this contract. Damage created by or caused directly by Contractor: Involves damage to equipment as a result of the Contractor s means of work. If these conditions occur, the Contractor must notify the SEPTA Project Manager. SEPTA reserves the right to withhold payment for the work and/or back charge the Contractor for any necessary repairs. Final invoice must reflect the actual work and labor charges for the project. The Contractor is shall track expenditures and schedule Work such that the total budget does not exceed the awarded contract amount. Contractor shall not incur costs exceeding this amount without prior authorization from SEPTA. With submittal of each project cost proposal, Contractor shall reconcile with the SEPTA Project Manager the remaining contract balance. The Contractor may be required to hold periodic project meetings with SEPTA. The project manager reserves the right to perform a complete audit of any and all charges prior to authorizing payment. If contractor fails to perform services in accordance with contract requirements, SEPTA may obtain those services through other means including the use of internal resources or issuing a contract or purchase order to another contractor for the services. Additionally, SEPTA's increased cost to have the service performed by other means will be deducted from contractor s account. The contractor is not permitted to invoice SEPTA for any losses due to the rescheduling of work to SEPTA internal personnel or other service provider.
