3 The National Construction Code now Free The National Construction Code (NCC) is an initiative of the Council of Australian Governments (COAG) developed to incorporate all on-site construction requirements into a single code. The NCC comprises the Building Code of Australia (BCA), Volume One and Two; and the Plumbing Code of Australia (PCA), as Volume Three. From now you can register online at the ABCB website for access to a free electronic copy of the NCC Adopted by State & Territory building legislation: new buildings new building work in existing buildings changes in building classification or use 3

4 The National Construction Code of Australia Each State's and Territory's legislation consists of an Act of Parliament and subordinate legislation which empowers the regulation of certain aspects of building work or plumbing and drainage installations, and contains the administrative provisions necessary to give effect to the legislation. 4

8 Deemed to Satisfy intent The goal of the BCA is to enable the achievement of nationally consistent, minimum necessary standards of relevant safety (including structural safety and safety from fire), health, amenity and sustainability objectives efficiently. This goal is applied so: there is a rigorously tested rationale for the regulation; the regulation generates benefits to society greater than the costs (that is, net benefits); the competitive effects of the regulation have been considered and the regulation is no more restrictive than necessary in the public interest; and there is no regulatory or non-regulatory alternative that would generate higher net benefits. Proposals to change the BCA are subjected, as applicable, to a Regulatory Impact Assessment process. 8

11 Alternative Solutions assessment methods Evidence A report from a Registered Testing Authority. A current Certificate of Conformity or Certificate of Accreditation. A certificate from a professional engineer. A current certificate issued by a product certification body that has been accredited by the Joint Accreditation System of Australia and New Zealand (JAS-ANZ). Any other form of documentary evidence that adequately demonstrates suitability for use Verification Method Calculations - using analytical methods or mathematical models; and/or Tests - using a technical operation either on-site or in a laboratory to directly measure one or more performance criteria of a given solution. comparison with DtS This method permits a comparison to be made between a Deemed-to-Satisfy Provision and a proposed Building Solution. If it can be demonstrated to the appropriate authority that the Building Solution complies in an equivalent or superior way to a Deemed-to-Satisfy Provision, then it can be deemed to meet the relevant Performance Requirement Expert Judgement Where physical criteria are unable to be tested or modelled by calculation, the opinion of a technical expert may be accepted. This is referred to as the use of Expert Judgement, that is, the judgement of a person who has the qualifications and experience necessary to determine whether a Building Solution complies with the Performance Requirements. 11

12 Alternative Solutions Evidence for products Providing evidence via documentation and certification of the product in accordance with CodeMark The ABCB and New Zealand s Department of Building and Housing (DBH) manage the scheme in their respective countries. The Joint Accreditation System of Australia and New Zealand (JAS-ANZ) accredits certification bodies, who in turn evaluate and certify building products. Relevant legislation requires building control authorities to accept CodeMark certified products 12

20 Examples of Alternative solutions Residential Glazing systems DtS compliance Clause (a) Performance Requirements P2.1.1 and P2.2.2 are satisfied for glazing and windows if designed and constructed in accordance with AS 2047 for the following glazed assemblies in an external wall: (b) Performance Requirement P2.1.1 is satisfied for glazing if designed and constructed in accordance with AS 1288 for all glazed assemblies not covered by (a) and the following glazed assemblies:

22 Examples of Alternative solutions Conditioned space means a space within a building, including a ceiling or under-floor supply air plenum or return air plenum, where the environment is likely, by the intended use of the space, to have its temperature controlled by air-conditioning, but does not include (a) a non- habitable room of a Class 2 building or Class 4 part of a building in which a heater with a capacity of not more than 1.2 kw or 4.3 MJ/hour provides the air-conditioning; or (b) a space in a Class 6, 7, 8 or 9b building where the input energy to an air-conditioning system is not more than 15 W/m2 or 15 J/s.m2 (54 KJ/hour.m2); or (c) a lift shaft.
