1 707 RESIDENTIAL RECREATION ZONE () 1. Permitted Uses of Land, Buildings, and Structures Subject to the provisions of Divisions Three and Four of this bylaw, the following uses and no others shall be permitted in the Residential Recreation Zone (): a. accessory residential; b. community care facilities (if they are permitted to be carried out pursuant to the provisions of the Community Care Facility Act) subject to the provisions of Section 402 of this bylaw; c. home occupation use subject to the provisions of Section 403 of this bylaw; d. public parks and playgrounds; e. single family dwellings. 2. Buildings Per Lot The number of buildings allowed per lot shall be not more than: a. one (1) single family dwelling; and b. one (1) accessory residential building. 3. Floor Area a. The floor area for a single family dwelling shall be not less than 70 square metres (753.5 square feet). b. The floor area for accessory residential buildings shall be not greater than 80.3 square metres ( square feet) having a horizontal dimension of not more than 11 metres (36.09 feet) for domestic garages and carports; 80.3 square metres ( square feet) having a horizontal dimension of not more than 12.2 metres (40.06 feet) for covered swimming pools; and be not larger than 15 square metres (161.5 square feet) for all other accessory residential buildings and structures. 2 Height of Buildings and Structures a. The height of residential dwellings shall not exceed the lesser of 8 metres (26.25 feet) or two (2) storeys except where the average natural slope of the lot exceeds five percent (5%), in which case the height of residential dwellings on the downhill side of a road shall not exceed a height of 5 metres (16.40 feet) above the centre line of the road immediately adjacent to the center of the front of the residence and residential dwellings located on the uphill side of the road shall not exceed a height of 5 metres (16.40 feet) above the mid point of the rear property line on which the residence is located. b. The height of garages and carports shall not exceed 5 metres (16.40 feet) above the driveway at the entrance to the garage or carport. All other accessory buildings shall be constructed with a maximum height of 5 metres (16.40 feet). 5. Lot Area Lots that are proposed to be subdivided within this zone shall have an area of not less than 835 square metres (8988 square feet) where the lot is serviced by community sewer and community water, and not less than 1 hectare (2.471 acres) where the lot is serviced with community water and septic tank. There shall be no minimum lot area required for lots created for public parks and playgrounds. Where a lot is a panhandle lot, that access strip or panhandle shall not be calculated as part of the minimum lot area. 6. Lot Coverage Lot coverage shall be not greater than thirty-five percent (35%) of the lot area for all buildings and structures, except that lot coverage shall be not greater than forty five percent (45%) for lots that are 300 m 2 (3229 square feet) or smaller in size; forty two and one half percent (42.5%) for lots that are larger than 300 m 2 (3229 square feet) in size but not larger than 350 m 2 (3767 square feet) in size; forty percent (40%) for lots that are larger than 350 m 2 (3767 square feet) in size but not larger than 400 m 2 (4306 square feet) in size; thirty seven and one half percent (37.5%) for lots that are larger than 400 m 2 (4306 square feet) in size but not larger than 450 m 2 (48 44 square feet) in size; and not greater than thirty five percent (35%) for lots that are more than 450 m 2 (4844 square feet) in size. 3 Lot Frontage Lots that are proposed to be subdivided within this zone shall have a lot frontage of not less than 23 metres (75.46 feet) except that corner lots shall have a lot frontage of not less than 24.5 metres (80.38 feet). There shall be no minimum lot frontage required for lots created for public parks and playgrounds. Notwithstanding the lot frontage requirements cited above: (1) the frontage of a parcel fronting a highway shall in no case be less than one-tenth of the perimeter of the parcel; and (2) lot frontages of lots located at the turnabout area of cul-de-sacs may be reduced to not less than 11 metres (36.09 feet) in width provided that the average lot width, throughout a depth of 30 metres (98.42 feet) measured along a perpendicular line commencing at the centre of the property on the frontage street, complies with the required minimum lot width; and (3) lot frontages of lots located on the outside curve of a road having a radius of not more than 120 metres ( feet), that are located in residential zones, may be reduced by not more than 3 metres (9.842 feet) provided that the average lot width, throughout a depth of 30 metres (98.42 feet) measured along a perpendicular line on the centre of the property on the frontage street, complies with the required minimum lot width. 8. Off-Street Parking Two (2) off-street parking spaces shall be provided and maintained in accordance with the provisions of Schedule B, attached to and forming part of this bylaw. 9. Setbacks: a. Exterior Side Yard Where applicable, exterior side yards free of all buildings and structures shall be provided with a depth of not less than 1.5 metres (4.921 feet) except where a greater setback is required pursuant to the provisions of Section 407 of this bylaw. Front Yard DIVISION SEVEN RESIDENTIAL ZONES Except where a greater setback is required pursuant to the provisions of Section 407 of this bylaw, a front yard free of all buildings and structures shall be provided with a depth of not less than: (1) 1.5 metres (4.921 feet) except that; (2) garages or carports may abut the front lot line on lots exceeding twenty percent (20%) average natural slope. c. Rear Yard A rear yard free of buildings and structures shall be provided with a depth of not less than: (1) 7.5 metres (24.61 feet) for single family dwellings; (2) 1.5 metres (4.921 feet) for accessory residential buildings and structures. d. Side Yards Side yards free of all buildings and structures shall be provided with a width of not less than 1.5 metres (4.921 feet). e. (Water Bodies deleted by Amendment Bylaw No. 1475) 10. Other Requirements a. Unenclosed parking and storage No person at any time shall park or store any commercial vehicle, truck, bus, self-propelled camper, travel trailer, tow truck (or parts of any of the above) or any equipment or building material on a lot in a residential zone, except: (1) one (1) truck or commercial vehicle not exceeding 6,350 kg G.V.W. (14,000 pounds G.V.W.) rated capacity; and/or (2) one (1) self-propelled camper or travel trailer provided that the overall length does not exceed 10 metres (32.81 feet); and/or (3) trucks or equipment required for construction, repair, servicing, or maintenance of the premises when parking during normal working hours; and/or District of Coldstream Zoning Bylaw No. 1382, 2002 (CONSOLIDATION) Page 106

(4) one (1) boat or vessel not exceeding a length of 10 metres (32.81 feet); and/or (5) building materials when the owner, lessee, or occupier of the premises is in possession of a valid building permit, provided that the materials stored are in connection with the construction or development of the building situated on the same property as which the material is stored pursuant to the building permit.
