2 authorisation to the engineering design plans for the intersection changes and site access on the state highway, including, but not limited to: 3 NZTA approval road safety audit 4 Construction Management Plan the roundabout at the intersection of State Highway 1, Te Arahori Street and Pihanga Road; and slip lane access off State Highway 1 as shown on the approved plans. Prior to any works commencing on the site, written confirmation from the New Zealand Transport Agency (NZTA) shall be provided to Taupō District Council s Consents and Regulatory Manager of NZTA s authorisation of road safety audits on the design and construction of the final intersection form, including (but not limited to) a focus on facilities for cyclist and pedestrians and a dedicated pedestrian movement plan with a specific purpose of directing and encouraging pedestrian movement to utilise the safety of the existing underpass. Prior to any works commencing on the site, a Construction Management Plan shall be submitted to Taupō District Council s Consents & Regulatory Manager for approval. This plan shall detail the timing and process for construction on site. It shall include but not be limited to details on the timing and methodology of all works on site, including: i. Clearance of the existing site vegetation ii. Removal of any existing buildings iii. Temporary traffic management on Te Arahori Street iv. Site preparation v. Sequencing of construction work with details of the requirements for the provision of onsite services (water, wastewater & stormwater) and their position on site vi. Provision for parking and access during construction vii. Continued operation of existing motel viii. Maintenance regime for construction equipment to reduce noise from deterioration of equipment ix. Erection of temporary construction noise barriers including their location, height and design x. Any potential sources of vibration associated with compaction and other construction activities and how these shall be managed so as not to create a nuisance to adjoining properties xi. The name, telephone number and address of the site manager xii. Measures to be used to maintain the site in a tidy condition including the storage and disposal of rubbish, unloading and storage of building materials and location of workers conveniences e.g Portaloos xiii. Proposed staging of works, timeframes and proposed working hours This Construction Management Plan shall be provided to Taupō District Council at least 20 working days prior to the Plan needing approval.

3 5 Construction works All construction works, including site preparation, earthworks and building construction, shall be undertaken in accordance with the: approved Earthworks and Sediment Control Plan prepared by Opus dated October 2017; and approved Construction Management Plan [Condition 5] The specific works involved in establishment of the underground fuel tanks and BP service station forecourt and buildings shall also be undertaken in accordance with the: approved BP Construction Environmental Management Plan dated December Construction Hours Construction work hours shall be restricted to: Monday to Friday 7.00am to 6.00pm [7.30am for work involving mechanical digging equipment and/or commercial earth moving equipment] Saturday 8.00am to 1.00pm No work is to occur on Sundays and Public Holidays. 7 Construction Noise All construction work shall be designed and conducted to ensure that construction noise does not exceed the noise limits. Sound levels shall be measured and assessed in accordance with the provisions of NZS6803:1999 Acoustics Construction Noise. 8 Construction Vehicles All construction vehicles shall use the site access off Te Arahori Street and shall ensure that all trade vehicles are accommodated on site during construction. Parking of construction vehicles within the adjoining road reserves of Te Arahori Street and State Highway 1 is not permitted. 9 Lighting Plan Prior to any works commencing on the site, the consent holder shall submit a detailed Lighting Plan demonstrating that the lighting is designed to comply with the following requirements: i. No aspect of the activity on site shall result in greater than an 8 lux spill (horizontal and vertical) of light onto any residential property, ii. That all lighting is shielded in such a manner that light emitted by the fixture is projected below a horizontal plane running through the lowest point on the fixture. 10 Lighting The Lighting Plan shall be implemented and maintained on an ongoing basis and tested for compliance with the above requirements [Condition 9] with the evidence provided to Taupo District Council s consents and Regulatory Manager prior to commencement of trade from the BP and/or QSR activities. 11 Notification Written notification shall be provided to Taupō District Council s Consents and Regulatory Manager of the following: i. 5 workings days prior to the clearance and site preparation works (including tree felling and demolition works) ii. 5 working days prior to completion of works and commencement of trade for the BP and/or QSR.

4 12 Repairs within Road Reserve The notification is required to enable site inspections associated with the works. Any damage to footpaths, kerbs or berms due to earthworks or construction activity shall be repaired in accordance with Taupō District Council standards and at the consent holders expense within one month of the damage occurring with an inspection prior to commencement of trade from the BP and / or QSR activities. Photographic evidence shall be provided to Council s Consents and Regulatory Manager of the repairs prior to commencement of trade from the BP and/or QSR activities. 13 Water Supply individual metered / backflow protected (testable) water supply connections shall be established to Council s reticulated water supply system for the BP service station and QSR activities generally in accordance with the Three Waters report prepared by Opus and submitted with the application. 14 Water Supply Firefighting sufficient water volume, pressure and flows for firefighting purposes shall be provided (including carrying out any necessary upgrades to the existing public water supply network) to meet the requirements of New Zealand Fire Service Firefighting Water Supplies Code of Practice SNZ PAS 4509:2008. [Advice Note: Should the consent holder determine the reticulated network does not have sufficient capacity or pressure in accordance with the New Zealand Fire Service Firefighting Water Supplies Code of Practice SNZ PAS 4509:2008, consultation and agreement on a lesser standard or an alternative supply will need to be sought from the Fire and Emergency New Zealand and evidence of this agreement provided to Taupo District Council for its consideration and agreement when determining whether the consent condition has been satisfied.] 15 As-Built Water Plan As-built plans of the water supply connections shall be provided to Taupo District Council s Development Engineer with the application for building consent for the BP and / or QSR buildings. The as-built water system is to be tested and the actual fire protection firefighting water rating achieved in the hydrant flow testing recorded and provided with the building consent application. 16 Wastewater Disposal individual wastewater connections with grease traps of sufficient capacity to meet the Trade Waste Bylaw requirements shall be established to Council s reticulated system for the BP service station and QSR activities in accordance with the Three Waters report prepared by Opus and submitted with the application. 17 Trade Waste Bylaw Private infrastructure is to be installed, operated and maintained as necessary to ensure that all wastewater discharged from the development will comply with the Taupo District Council Trade Waste Bylaw.

5 18 Wastewater As- Built Plan 19 Stormwater Disposal Detailed Plan 20 Stormwater Disposal Implementation 21 Parking & Onsite Vehicle Movement Layout As-built plans of the wastewater connections shall be provided to Taupo District Council s Development Engineer with the application for building consent for the BP and / or QSR buildings. Stormwater runoff from a 10 year, return period event of one hour duration (45mm depth of rainfall) event is to be contained onsite. Design of this stormwater management system (including the piped system, pre-treatment system, soakage systems and secondary flow paths) and the ongoing operation and maintenance of the stormwater rmanagement system is to be submitted to Taupo District Council s Development Engineer for approval prior to application for building consent for the BP and / or QSR buildings. the approved detailed stormwater disposal design [Condition 19] shall be constructed. all parking and loading spaces, footpaths, traffic islands and internal vehicle movement layout shall be established i.e. formed, sealed and marked, as shown on the approved Site Plan Drawing No 2947-G1 Rev E. 22 Vehicle access the vehicle crossing onto Te Arahori Street and the slip lane of State Highway 1 shall be established i.e. formed, sealed and marked, as shown on the approved Site Plan Drawing No 2947-G1 Rev E. 23 Directional & Safety Signage 24 Code of Practice for the Development of Land all directional and safety signage shall be erected. All works shall be in accordance with the Taupo District Council Code of Practice for the Development of Land (2009) or its successor. 25 Landscaping Plan Prior to any works commencing on the site, a detailed Landscaping Plan shall be submitted for approval to Taupo District Council s Consents & Regulatory Manager for approval. The detailed Landscaping Plan shall be generally in accordance with the Greenscene Landscaping Plan Drawing Nos L100, L110, L115 and L120 and shall include, but not be limited to: a. formation of the earth mounds b. timing of planting c. plant heights at time of planting and at maturity d. planting methods for the specimen trees i.e. tree pit size, staking, mulching e. maintenance methodology for plants 26 Landscaping Implementation the earth mounds and site planting as detailed within the approved Landscaping Plan [Condition 25] shall be formed and established. 27 Inspections The first planting inspection shall be six months post completion of the planting on site.

6 Further inspection of the planting shall be undertaken on an annual basis. Annual inspections of the implemented planting [Condition 26] shall be undertaken by Taupō District Council during the month when the planting was implemented for five years following the implementation of the planting. Should the planting not achieve a healthy standard so as to achieve and maintain the maturity heights stated within the approved Landscaping Plan, the consent holder shall carry out additional planting and maintenance measures to ensure compliance with the approved Landscaping Plan. 28 Landscaping Maintenance Should the Taupō District Council become aware outside of the annual inspection cycle that planting is failing, further inspections shall be undertaken and remedial action as detailed above shall be undertaken. The planted areas shall be maintained in perpetuity in accordance with the approved Landscaping Plan and shall be generally preserved to a healthy standard so as to achieve and maintain the maturity heights stated within the Landscaping Plan. 29 Roundabout the roundabout at the intersection of State Highway 1, Te Arahori Street and Pihanga Road shall be completed and operational in accordance with the final NZTA approved design. 30 Underpass the works to extend and re-grade the underpass shall be completed in accordance with the final NZTA approved pedestrian movement plan [Condition 3]. 31 Te Arahori Street works the works within Te Arahori Street including the pedestrian refuge and footpath as shown on the approved plans and described in the application shall be completed. 32 Acoustic Fencing the acoustic fencing of as detailed on the Marshall Day Acoustic Assessment and shown on Figure 2: Site, Barriers, Receivers and Predicted Peak Period Sound Levels, shall be erected. [Advice Note: Suitable materials for the acoustic fencing include a minimum of 7mm thick fibre cement sheet, 17.5mm construction grade plywood or a minimum of 20mm thick timber. If timber boards are used, the boards should be butted together and battened or lapped so as the timber dries out and shrinks that gaps do not open in the fence reducing its ability to absorb noise.] 33 Site Management Prior to commencement of trade from the BP and/or QSR activities, evidence of an employment contract for a person employed to regularly clean and keep the site in a tidy state shall be provided to Taupo District Council s Consents and Regulatory Manager. 34 Site Management - Security Prior to commencement of trade from the BP and/or QSR activities, evidence of a security company engaged to undertake regular night

7 35 Operational Management BP time patrols of the site (between 8.00pm to 8.00am) shall be provided to Consents and Regulatory Manager. The BP service station shall be operated in accordance with the approved Operational Management Plan. 36 Review Condition The conditions of this consent may be reviewed by Taupo District Council pursuant to Section 128 of the Resource Management Act 1991 (with the costs of the review process being borne by the consent holder) by given notice pursuant to section 129 of the Act, at any time within the first year of commencement of this consent and within one month of the first anniversary of the commencement of trade for the BP service station and QSR activities, up to and including the fifth anniversary of the commencement. The purpose of the review may for any of the following purposes: To deal with any adverse effects on the environment that may arise from the exercise of the consent and which it is appropriate to deal with at a later stage. To deal with any adverse effects on the environment which may arise from the exercise of the consent and which could not be properly assessed at the time the application was considered. ADVICE NOTES 1 The resource consent shall lapse five years after the date of consent unless: a b it is given effect to before the end of that period, or upon application made prior to the expiry of that period, the Council fixes a longer period. 2 The reasonable costs incurred by Taupō District Council arising from the supervision and monitoring of this consent will be charged to the consent holder. This may include routine site inspections to review and assess compliance with the conditions of consent, and responding to complaints or enquiries relating to the consented activity. 3 Subject to any legal requirements of the Taupō District Council, the Police, Heritage New Zealand Pouhere Taonga Act 2014, Antiquities Act 1975 and any other governing legislation, should a wāhi tapu or archaeological site be uncovered during earthworks or other construction work, work in the affected area shall stop immediately and the consent holder shall seek advice from Taupō District Council s Strategic Communications Officer, tangata whenua, Heritage New Zealand and/or the New Zealand Police (as appropriate) to determine what further actions are appropriate to safeguard the site or its contents before work recommences. 4 A Development Contribution will be payable for transportation under the Taupo District Council Development Contributions Policy RECOMMENDED CONDITIONS SUBDIVISION [RM180024]

8 General Conditions No / Title 1 General Accordance Requirement The three lot subdivision for the existing motel, BP Service Station and Quick Service Restaurant on 25 Te Arahori Street, Turangi shall be undertaken in accordance with: a b The application prepared by CKL - Hamilton and received by Taupō District Council on 25 January The further information provided by CKL - Hamilton and received on 27 April, 7 May, 18 and 25 July c The plans prepared by CKL - Hamilton, dated March 2018, referenced: Proposed Subdivision of Lot 2 DP Drawing No 150 Rev 5 Proposed Easements Drawing No 151 Rev 5 2 NZTA Approval Prior to application for section 223 approval, written confirmation from the New Zealand Transport Agency (NZTA) shall be provided to Taupō District Council District Council s Consents and Regulatory Manager of NZTA s approval to the easements and allotment layout of the subdivision. 3 Land Use Conditions 4 Segregation Strips All conditions of the Land Use consent RM shall be complied with prior to application for section 224c approval. Segregation strips shall be established along the State Highway 1 frontage, except for the location of the slip lane access and along the Te Arahori Street frontage, except for the location of the vehicle crossing. 5 Easements Easements A-H as shown on the approved scheme plan shall be duly granted and reserved. 6 Sewer Easement Gross in The actual position of the Taupo District Council sewer line crossing Lot 3 shall be located. A 3 metre wide easement in gross shall be granted to Taupo District Council along the full length of the sewer. The easement shall be positioned centrally along the alignment of the sewer pipe. [Advice Note: Local narrowing of the easement may be permitted with the agreement of the Taupo District Council s Development Engineer if existing buildings encroach on this area.] 7 Consent Notice If the firefighting water supply infrastructure provided cannot meet the requirements of FW3 of New Zealand Fire Service Firefighting Water Supplies Code of Practice SNZ PAS 4509:2008 then pursuant to section 221 of the Resource Management Act 1991 the following consent notice shall be imposed on the titles of Lots 1 and 2: The firefighting water supply may not meet the recommended guidelines of SNZ PAS 4509:2008 ADVICE NOTES

9 1 The resource consent shall lapse five years after the date of consent unless: a b it is given effect to before the end of that period, or upon application made prior to the expiry of that period, the Council fixes a longer period. 2 Subject to any legal requirements of the Taupō District Council, the Police, Heritage New Zealand Pouhere Taonga Act 2014, Antiquities Act 1975 and any other governing legislation, should a wāhi tapu or archaeological site be uncovered during earthworks or other construction work, work in the affected area shall stop immediately and the consent holder shall seek advice from Taupō District Council s Strategic Communications Officer, tangata whenua, Heritage New Zealand and/or the New Zealand Police (as appropriate) to determine what further actions are appropriate to safeguard the site or its contents before work recommences.
