1 CHAPTER 13 BUILDING CODE BUILDING STREET SET-BACKS The set-backs for all structures placed in the Village of Stockbridge shall be governed by those established by the Village Zoning Ordinance, Chapter 24, and any amendments thereto BUILDING SIDE YARD SET-BACKS The set-backs for all structures placed in the Village of Stockbridge shall be governed by those established by the Village Zoning Ordinance, Chapter 24 and any amendments thereto MINIMUM LOT SIZES Lot sizes for all lots in the Village of Stockbridge shall be governed by the Village Zoning Ordinance, Chapter 24, and any amendments thereto BUILDING PERMITS 1. No building or structure or any part thereof, except as herein provided shall hereinafter be erected, enlarged, altered, repaired or moved within the Village until a building permit shall have been applied for in writing, obtained from the Village Clerk, and approved by the Village Building Inspector, as provided in Section of Chapter 24, Zoning Ordinance. The cost of a building permit is established in Section (c) of Chapter 24, Zoning Code. The term of a building permit shall be one year from the date of issuance. If the project is not completed within that one-year term, an extension can be requested. The fee for the extension shall be one-half of the cost of the original permit. The issuance of the building permit provided herein shall require that landscaping on a newly constructed single family or multi-family residence shall be completed within the time frame of the building permit and shall be subject to the same provision for the request for extension and payment of an additional fee. 2. Chapter 22, Chapter Comm 22, Wisconsin Administrative Code Energy Conservation Standards of the One- and Two-Family Dwelling Code, as adopted and effective December 1, 1978, and Chapters Comm 20, 21, 23, 24 and 25, adopted and effective June 1, 1980, and all amendments thereto, are adopted and incorporated in this code by reference. 3. Any existing ordinances pertaining to the construction of new dwellings that conflict with the Uniform Dwelling Code are hereby repealed.

2 13.05 BUILDING PERMIT REQUIRED No person shall build or cause to be built any one- or two-family dwelling without first obtaining a state uniform building permit for such dwellings. Such building permit shall be furnished by the village. A copy of such permit shall be filed with the Village Clerk-Treasurer BUILDING PERMIT FEE 1. STANDARD FEE. The permit fee for the particular project shall be determined as listed on the currently adopted Village Form 97-BP01/2006 or any amendments thereto. Such expenses shall include the cost of the State Building Permit Seal. The above fee shall cover the cost of the plan review, the issuance of the permit, the required inspections to a maximum number of eight (8), and the necessary administration overhead. 2. ADDITIONAL INSPECTION FEE. Any inspection trips required over the initial eight provided for in the Standard Fee which are required due to non-compliance or uncoordinated work will be charged to the owner at an additional fee of $25.00 per trip. Such fee/fees shall be deducted from the construction bond at the time of final inspection and issuance of any occupancy permit. 3. PERMIT TO START CONSTRUCTION FEE. The fee for the issuance of a permit to start construction prior to the issuance of a uniform dwelling code permit shall be $50.00, payable to the Clerk-Treasurer. 4. VARIANCE REQUEST FEE. The fee for processing a variance is established in Section (c)(5) and is payable to the Clerk-Treasurer. 5. FAILURE TO REMIT FEES. No occupancy permit shall be granted unless all fees have been paid to the Clerk-Treasurer OCCUPANCY PERMIT If no violations of this or any other ordinance, law or rule are found, the Building Inspector, if his final inspection finds no violations, shall issue a CERTIFICATE OF OCCUPANCY. No dwelling shall be occupied until such certificate is issued except with the written consent of the Building Inspector COMPLETION BOND Prior to the issuance of the building permit the owner shall deliver to the Clerk-Treasurer a $1, bond to be held by the Village until the project is complete, the final inspection has been made and the Certificate of Occupancy has been issued. The Clerk-Treasurer shall return the bond

3 or portion thereof to the owner upon receipt of written verification from the Building Inspector that the Certificate of Occupancy has been issued. The Clerk-Treasurer shall deduct from the bond amount prior to said return any charges outstanding for additional inspection. Should the bond be insufficient to cover the additional inspection fees, the balance delinquent shall be entered on the next annual tax roll as a special charge against the property and such sum shall be levied and collected as other special charges against real estate TEMPORARY SHELTERS No tent, shack, garage, barn or other building shall be used temporarily or permanently as a residence. No basement shall be used as a residence CONSTRUCTION STANDARDS The Wisconsin State Building Code or Uniform Dwelling Code as well as all state codes regulating plumbing or electrical construction are hereby adopted and shall apply to all construction within the Village of Stockbridge. In addition to these the following standards shall apply to all One and Two- Family Dwellings, whether manufactured or site-built: 1. All such dwellings shall be built upon foundations or basements which meet or exceed the State Uniform Dwelling Code requirements. 2. Roofs shall be constructed so as to include overhangs of at least 12" on the eves and gable sides of the structure, exclusive to the gutters. 3. Roofs shall be covered with materials made of asphalt, fiberglass, slate, tile, concrete, wood or other materials approved by the Village Building Committee. 4. Minimum living area of the structure shall be established by the standards set by Chapter 24 Zoning Code, applicable for the specified zoning area. 5. The roof over the core living area shall have a minimum pitch of 4 (rise) to 12 (run) PROHIBITION AGAINST QUONSET CONSTRUCTION No accessory structure shall be placed in any zoning district within the Village of Stockbridge that is of the Quonset construction type. This prohibition is intended to prohibit any construction of a long, arched, metal shelter other than in the Agricultural District. The only exception shall be in the Agricultural District, and then only in the instance where the property is actively being farmed and the placement is incidental to the farming activity.

4 13.12 SUMP PUMP INSTALLATION All buildings connected to the Village sewer system shall have a sump pump installed thereon as affirmed by Section (c), Chapter 24, Zoning Code. No clear and/or surface waters shall be permitted to run into the sanitary sewer lines. Whenever possible, drainage from the sump shall be directed to the back of the property and not to the street. Whenever sump drainage is directed to the street, it shall be done in such a fashion that it drains directly into a storm sewer, and does not enter upon the sidewalk PERMIT APPLICATIONS Regardless of costs of construction, a building plan and specifications must be submitted in writing to the building inspector before construction or repairs of any buildings. Applications shall be in accordance with Section (g), Chapter 24, Zoning Code. No building permit shall be issued for construction on a lot in the Village of Stockbridge which is provided public access by a street that has not yet been constructed and formally accepted by the Village of Stockbridge Board of Trustees as a Village right of way and has met the construction standards of the Village of Stockbridge as set forth in Chapter 24, Ordinance Establishing Standards for the Approval and Acceptance of Plats, Certified Surveys and Roads SANITARY SEWER & MUNICIPAL WATER CONNECTION All dwellings placed within the service area of either the municipal water or sewer shall connect and be served by such. No new wells or private sanitary systems shall be established within such areas. The regulations and cost of such connection to the municipal sanitary system is governed by Chapter 24 or any amendments thereto. All connection charges shall be paid prior to the issuance of a building permit for new construction BUILDING GRADES The grades of all buildings constructed after the passage of this ordinance shall be as follows: the grade at the horizontal center of the structure shall be fifteen inches above the grade at the center of the street upon which the structure fronts, and shall be in accordance with the Village grade lines as set by the Village Building Inspector or designated engineer. Exceptions shall be considered and approved by the Village Building Inspector.

5 13.16 SANITARY SEWER/MUNICIPAL WATER SERVICE Any area which can be reasonably served by the present utilities must be connected to same. In areas where service is not available, a properly installed sewage disposal system as approved by the Calumet County Planning Department must be installed in accordance with the State Plumbing Code. All replacements, repairs, and any installations must be installed in accordance with the State Plumbing Code. All private sanitary sewer system plans shall be submitted to the Calumet County Planning Department for approval before installation COMMERCIAL STRUCTURES All plans and specifications for commercial building construction, alterations, and repairs shall be submitted to the Village after such plans have been submitted for State approval, and prior to commencement of construction. Village zoning code standards must be met BUILDING INSPECTOR APPOINTMENT & GENERAL POWERS The appointment and powers of the building inspector are provided in Section (f), Chapter 24, Zoning Code INSPECTION AND ENFORCEMENT OF BUILDING CODE In the event a property owner is found to be in violation of this portion of the Code of Ordinances, the Village of Stockbridge shall have the right to make periodic inspections of the subject property. No notice of the inspection must be given but the property owner will be permitted to be present during the inspection PENALTIES Any person violating the above ordinance or any part thereof, shall be forced to comply with the ordinance and shall pay all expenses involved in correcting the same. A fine of not less than $25.00 nor more than $ for each violation together with the costs of prosecution shall be levied and in the event of non-payment of the fine and/or the costs of prosecution, the violator shall be imprisoned in the Calumet County Jail until such fine has been paid not to exceed 30 days. Each day that the violation continues, after notice, constitutes a separate offense. The fee for a building permit for any person who has already commenced construction before obtaining a permit shall be doubled.

6 13.21 SEVERABILITY If any section, clause, provision or portion of this ordinance of Wisconsin Administrative Code Chapters Ind 20, 21, 22, 23, 24 and 25 is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions shall not be affected thereby ENFORCEMENT Enforcement of this Ordinance shall be in accordance with the provisions provided in Section , Chapter 24, Zoning Ordinance.
