1 ADDENDUM #1 CRUISE TERMINAL NO. 10 DESIGN/BUILD MOBILE PASSENGER GANGWAY for CANAVERAL PORT AUTHORITY PUR-RFP October 16, 2015 This addendum is issued as part of the Bidding Documents for the above described project. The changes incorporated in this addendum shall be considered as a part of the documents and shall supersede, amend, add to, clarify, or subtract from those conditions shown in the original documents. The bidder shall take care to coordinate modifications herein with all trades and disciplines related to the work. The Bidder shall acknowledge receipt of this addendum on the Bid Form by addendum number and date. Failure to do so may subject Bidder to disqualification. Section , Table of Contents: Add to the listing for Appendix A, G1.2 CT 10 SURVEY. 2. Section , Form of Agreement Between Buyer and Seller for Procurement Contracts: Article A6: Add G1.2 to the list of drawings. 3. Section , Pre-Engineered Mobile Passenger Boarding Bridge: Replace paragraph 1.4 A9 with the following: 1.4 A9. Bogey Wheel Load and Geometry: Twin wheel bogeys shall consist of two wheels mounted one to each side of an axle assembly that can swivel to steer the Gangway. Each corner of the Gangway shall be equipped with a minimum of two twin wheel bogeys, for a total of four wheels, mounted to a fixed tandem beam as shown on the drawings. Tandem beams shall be oriented parallel with the face of the pier. Minimum separation of the twin wheel bogies on the tandem beam shall be 8.5 feet (2.59 meters) measured from the centerlines of each twin wheel bogey axle. The lateral spacing between the centerlines of the wheels on a typical bogey shall not be more than 3.28 feet (1 meter). Twin wheel bogeys and the tandem beam shall be mounted so that column reactions are evenly distributed to all wheels. Total load carried by each individual wheel shall not exceed 45,000 lbs. for any load combination. Width of tires and contact area shall be as required to satisfy Paragraph 1.04Z. The position of additional wheels will be subject to approval by the Engineer based upon the geometry of the prestressed concrete deck ribs. 1. Replace drawings sheets G1.0, S2.1, S3.0, S5.0, and insert new drawing G1.2. QUESTIONS AND RESPONSES: 1. CIF-001: Specification Section: Tab 17. Please confirm if Proposal Tender Form shall be completed and submitted in this RFP. RESPONSE: Proposal Tender form is NOT required. Tab 17 to be removed. 2. CIF-002: Specification Section: Tab 27. Please confirm if Detailed Cost Estimate is to be provided under Tab 27. RESPONSE: Detailed cost under Tab 27 shall reflect the Schedule of Values as outlined in the Contract under ARTICLE 10 - PAYMENT A. 1. through CIF-003: Specification Section: Exhibit A-2, Please confirm if the liquidated damages for delay can be lowered to USD 3000 for each calendar day? RESPONSE: Liquidated Damages shall remain at $5,000 (USD) per day. 4. CIF-004: Specification Section: Exhibit A-2, Please confirm if the liquidated damages for delay can be limited to not exceed 7.5 percent of the Lump Sum Price (which then would be the maximum amount of liquidated damages for delay)? RESPONSE: Liquidated damages will continue to be assessed for each day beyond the substantial completion date until the gangways are substantially complete. 5. CIF-005: Specification Section: Exhibit A-2, Page 2, 7.01 A. Please confirm if payment schedule can be revised to the following: 20% approval of shop drawings, 30% after first factory visit, 25% after second factory visit, 10% after installation testing and commissioning, 5% after completion of training, 10% after delivery of spare parts? RESPONSE: Payment schedule percentages will remain as outlined in the contract under ARTICLE CIF-006: Specification Section: , Please confirm if the Seller s indemnification can be limited to an amount corresponding to 15% of the Total Contract Amount? RESPONSE: Currently no limit exists. 7. CIF-007: Specification Section: , Please confirm if the Seller shall have no liability for indirect losses or consequential losses. 3 CRUISE TERMINAL NO. 5 DESIGN/BUILD MOBILE PASSENGER GANGWAY PUR-RFP-15-3/CN CIF-008: Specification Section: , Please confirm that Seller has no obligation to perform changes in work until written agreement between Seller and Buyer exists including variations in price and/or time. RESPONSE: Changes in the work shall be by written agreement. 9. CIF-009: Specification Section: , Please accept that 45 days can be changed to 30 days and 60 days can be changed to 30 days. RESPONSE: Timing of progress payments shall remain as written. 10. CIF-010: Specification Section: , Art.14. Please confirm if disputes can be finally settled by arbitration. RESPONSE: Yes, as a last resort. Other methods for settlement of claims shall be attempted first. 11. CIF-011: Specification Section MM. Tier4 F type generators not available in suitable sizes. Can Tier 3 be accepted? RESPONSE: As long as the new engine meets the EPA emissions requirement and CPA receives certification of compliance per 40CFR Part 60 Subpart IIII-Standards of Performance for Stationary Compression Ignition Internal Combustion Engines. (Non-emergency) 12. CIF-012: Specification Section: Tender Drawings S2.1. If we deliver the gangway complete, what is the minimum distance from the quay edge we are allowed to place the first set of wheels? This is for calculation of ship cranes reach. RESPONSE: Please provide load imposed by each wheel and we will determine the distance. 13. CIF-013: Specification Section: Please provide the recent topographical study described on page of the RFP. A recent topographical survey of this area is shown on the drawings. Seller shall design the mobile gangway, including but not limited to the frame structure, adjustable tunnels, wheels and bogies, drive system, and steering system, to accommodate the changes in elevations shown with an additional allowance of plus or minus 1 inch (25 mm) to the elevations shown. Any required changes or modifications to the existing elevations and/or surfaces shall be made at Seller s expense, and shall be subject to approval by the Buyer. RESPONSE: See drawings issued herein. 14. CIF-014: Specification Section Related to the construction cranes, the specifications say 1.08 EXISTINGT BULKHEAD AND PIERS: The Seller is cautioned that the existing bulkhead and piers were not designed in anticipation of the construction activities required by this Contract. Allowable superimposed load is 600 PSF. Seller shall submit crane loads to the Port Harbormaster (cpa.harbormater@portcanaveral.org) prior to placing cranes on pier or adjacent to bulkhead wall. Is 600 PSF the total allowable load on the dock? ADDENDUM 1/PAGE 3 OF 5

4 CRUISE TERMINAL NO. 5 DESIGN/BUILD MOBILE PASSENGER GANGWAY PUR-RFP-15-3/CN RESPONSE: Yes, if the entire dock surface is loaded. The dock can accommodate higher concentrated loads over a small area if the loads are located over pile caps and properly designed mats are used to reduce the pressure to no higher than 1000 PSF. Proposed loads will be evaluated on a case by case basis and the seller will have to adjust means and methods to satisfy the evaluation. 15. CIF-015: Specification Section Can CPA clarify that all bogey wheels must rotate 90 degrees (parallel to the building to perpendicular to the building)? Once the tires turn 90 degrees is there a required tire spacing as stated in Section 9? RESPONSE: See drawings and change to specification issued herein. Due to limitations of the pier s prestressed deck planks, bogie wheels must remain in line with the ribs of the deck planks. The requirement to rotate 90 degrees is needed to make minor adjustments of only one or two feet when positioning the gangway for a particular ship. 16. CIF-016: Specification Section Is CPA requiring four (4) sets of tires per bogey? Drawings show four (4) but specifications say twin tires. RESPONSE: See drawings and change to specification issued herein. 17. CIF-017: Drawing S3.0. According to Drawing S3.0 the wheel sets of the gangway are located out of the requested parameters. We understand that the correct parameters to consider are the ones on Drawing S2.1. Is this correct? RESPONSE: Correct. Drawing S3.0 has been corrected as part of this Addendum. 18. CIF-018: Specification Section , Tab 17 & 24: According to Section , Tab 17 and Tab 24 appear to be equal. Please confirm which of these tabs should be submitted and which omitted? RESPONSE: Tab 17 to be omitted. 19. CIF-019: Specification Section According to Section , Page 1 15% of the payment is done upon delivery of spare parts inventory. From this we understand that the Contractor should include spare parts inventory in the contract. This inventory is however not specified in the tender document and can be seen as very variable. Can the Port indicate a specific inventory or a fixed amount in dollars to include for a spare parts inventory? RESPONSE: The spare parts inventory is based on the manufacturer s recommended spare parts and is to be mutually agreed upon with the Canaveral Port Authority with a total value equal to 15% of the total cost of the project. 20. CIF-020: Specification Section Clause 10 states that a recent topographical survey is reflected in the drawings. The topographical information however appears not to be included in the drawing package. Can this be delivered? And, are elevations along the proposed wheel tracks included? RESPONSE: See new drawing G1.2 issued with this Addendum. ADDENDUM 1/PAGE 4 OF 5

According to Specification Section , Clause 10, it is stated that any required changes or modifications to the existing elevations or surfaces shall be made at Seller s expense. Should the Seller then include in their budget the reinforcement of wheel tracks? RESPONSE: As part of the pier renovation, a portion of the apron will be replaced that will follow the landside wheel track of the gangway. The Buyer will design this slab for the Seller s wheel loads and the construction cost will be paid by the Buyer. However, the surface of this new slab cannot deviate significantly from the elevations and the slopes that can be derived from the elevations shown on the new drawing issued in this Addendum. The new wheel track must allow sheet flow drainage to the slot drain, and forklifts must be able to cross the wheel track without spilling luggage and stores. If the Seller s gangway cannot accommodate the elevations and slopes as specified in this paragraph, then the Seller will be required to pay for modifications to the new wheel track and modifications to the adjacent apron that may be needed to provide a smooth transition across the wheel track. 22. CIF-022: We would like to request one additional week to prepare our proposal. Can the proposal submittal date be postponed from October 27 th to November 3 rd? RESPONSE: Due to the timing of the Commission Meeting, dates must remain as is.
