1 SOUTH BROOKLYN RESILIENCY PROJECTS Project #6253/ Contract # Questions & Answers August 18, Relative to the Staff and Fee Schedule (Exhibit 2-6) - Can we supplement the list of labor classifications with additional classifications? Are rates for all positions to be completed even if some of these are not anticipated to be needed for performance of the work? Answer: Yes additional labor classifications can be added to the Staff and Fee Schedule (Exhibit 2-6). Yes all rates are to be completed. 2. Appendix B-7 references ongoing utility reconstruction projects. What is the status of these projects? Answer: Brooklyn Army Terminal there is an ongoing renovation of the middle section of Building A (500,000 square feet). There is future work related to parking lot upgrades that will have to be coordinated with the design of this scope. Currently the parking lot upgrade is in schematic design. Design documents will be made available after award. Bush Terminal - There is currently one ongoing project related to the infrastructure upgrade work related to buildings 39, 40, & 45 that is currently in design. The designer will be responsible for coordinating work between ongoing design and proposed scope in this RFP. Design documents will be made available after award. 3. Appendix B-9 refers to completion of design documents by winter 2016/spring Contract execution is anticipated in November Assuming there is additional time needed for contract registration and issuance of NTP, should we assume that initial work is to proceed at risk in order to meet the design schedule requirements? Answer: No work will be performed at risk. The anticipated contract execution date of November 2016 accounts for all contract compliance requirements. 4. Other than the desire to complete the work and protect the assets, are there any other drivers or time constraints impacting the design and construction schedule? Answer: No. Page 1 of 9

2 5. Relative to the Bush Terminal drawings provided in the RFP package, has any of this work been performed? Were borings and survey work performed to support these designs? Assuming so, can you provide the boring and geotechnical information available? This will help us refine our work effort and associated fees. Answer: Refer to answer to question #2 above. There is currently one ongoing project related to the infrastructure upgrade work related to buildings 39, 40, & 45 that is currently in design. The designer will be responsible for coordinating work between ongoing design and proposed scope in this RFP. Design documents will be made available after award. Survey work is ongoing under the design for buildings 39, 40, &45. All survey documents will be made available after award. 6. Have there been studies performed/developed to support the recommendations for the improvements to be designed at the Brooklyn Army Terminal and Bush terminal? Were these studies done in-house or by a Consultant; and if so, which Consultant? Please provide these materials so we can refine our scope and fee estimate. Answer: No studies were performed. 7. Have you considered permanent flood barriers which don t require deployment? Answer: We are open to design recommendations. This will be refined during the design process. 8. What is the basis for the 5 foot height of the flood wall? Answer: Current average elevation at the sites is approximately 9.3 feet. An approximate 5 foot high barrier will protect the buildings approximately 2 to 3 feet above observed flood levels. Please note that this number will have to be validated during the design process. Barriers are to be designed relative to the FEMA 100 year flood elevation. 9. We understand that the City has ongoing efforts to refine the PFIRM/FEMA maps; what is the current status of this effort relative to implications for this site? Answer: This is ongoing, and will be coordinated during the design process. Page 2 of 9

3 10. Has any storm water or drainage analyses or studies been performed at either location to date? If so, can you provide the summary information? Answer: No storm water or drainage analyses have been performed. 11. Have Section 3 requirements been removed from the RFP as indicated at the pre-proposal meeting? Answer: Section 3 requirements do not pertain to this contract. 12. What is your timeframe for selection of a CM firm? Answer: Selection will be made by the end of September Will there be schedule requirements and liquidated damages as part of their contract? Answer: Please refer to the RFP documents for any schedule requirements and liquidated damages. 14. What is your anticipated construction schedule? Answer: 12 to 14 months. It is projected that both sites Bush Terminal and Brooklyn Army Terminal will be performed concurrently. 15. Please confirm the project schedule including design and construction services is anticipated to be 2 years. Answer: Confirmed. 16. Will the CM firm hold the construction contracts? Answer: Yes the CM firm will hold the construction contracts. 17. Proposed sanitary sewer work is shown on sheets GDP-4 and GDP-5. Please confirm whether this work is part of the project. Answer: Confirmed this is a part of the scope. 18. Will drawings provided for reference in Appendix B (B-41 through B-69) be provided to winning bidder in a CAD format? Answer: Yes CAD format will be provided. Page 3 of 9

Please confirm that all site and roadway construction shown on RCP3, 4 and 5 labeled as the Bush Terminal Campus Project Phase 1b limits and respective pavement markings and signage are included in this project. Answer: Confirmed this is a part of the scope. 20. Could the existing site survey of Bush Terminals be made available to us for the preparation of our proposals? Answer: The survey is underway and will be made available after award. 21. Regarding storm drainage at BAT: Are new outfalls anticipated or are new tide gates proposed to be installed on existing outfalls? Answer: No new outfalls are anticipated. Tide gates are proposed to be installed on existing outfalls. 22. In bullet number 4 for Bush Terminal Install storm drainage on southern end of campus (RFP) (incl. underground water detention and flood gates as needed and approved by DEP) was the intention to state underground water detention and tide gates as needed? If so are new outfalls and new tide gates anticipated at Bush Terminal? Answer: No new outfalls are anticipated. This will have to be refined and validated during the design process. Coordination with the water detention system is anticipated to be coordinated with NYCDEP. 23. Please clarify the limits the new storm drainage on southern end of Bush Terminal campus (including detention and flood gates as needed and approved by DEP). Are the limits bounded by Marginal Street, Building 58 and 57, and Bush Terminal Park? Answer: Refer to drainage drawings GDP-1, GDP-2, GDP-3, GDP-4, GDP-5 provided in the RFP. 24. Please clarify the scope delineation provided on drawing RCP-3. Is Phase 1b under construction or to be constructed as designed? Answer: Phase 1b is to constructed as designed 25. Please clarify the scope for the Bush Terminal Park Roadway project as stated on RCP-3. Answer: The intent of the scope is to provide heavy duty asphalt pavement and regular concrete pavement as delineated on drawing RCP-3 Page 4 of 9

5 26. Will the flood wall be limited to a 5ft height or relative to the FEMA 100yr flood elevation? Answer: Refer to question #8. Barriers to be designed relative to the FEMA 100 year flood elevation. 27. Will the flood elevation design require to incorporate the FEMA 100yr flood elevation, sea level rise, wave action, and/or free board? Answer: Yes. 28. On page Appendix B-22, IV. Task 4 Item C it states that The Consultant shall submit, for approval, the names and experience portfolios of all key persons, subcontractors, and sub-consultants proposed for use in connection with the Project prior to start of work (including project manager, project engineer and key designers).. Is the submission of resumes with the proposal sufficient for this item or will we be required to submit this information again if awarded the contract? Answer: The submission of resumes with the proposal is sufficient. 29. In appendix B Scope of Services page Appendix B-3, there is Proposed Solution which starts at the bottom of page B-3. The last bullet is on top of page B-4, which reads as follows: Replace entry and garage doors at flood gates (Building "A" only). Is their replacement due to flooding or because of their age? Answer: The replacement is due to flooding. 30. Are site surveys showing the boundaries of the two project sites available? We need to know the answer so our sub-consultants can provide us with their cost estimates. Answer: Site survey is underway and will be made available after award. 31. The M/WBE participation goal on this project is 25%-35%. Will the NYCEDC consider granting a waiver to M/WBE firms for the excess coverage as mentioned in Appendix E Insurance requirement or can the limits be reduced? Answer: NYCEDC will evaluate on a case by case basis. Page 5 of 9

6 32. Several uninsurable indemnity clauses were noted in the contract. Acceptance of these provisions could risk the survival of small firms. After contract designation of the Prime, will it be possible to negotiate the indemnification clauses in the contract? Answer: No. 33. The description of services for this contract for the Brooklyn Army Terminal and the Bush Terminal is shown in Appendix B. However at the walkthrough on Tuesday, August 9th, there were other items mentioned such as the replacement of the 40+ louvres/garage doors in the BAT. Would it be possible to provide a scope that includes all items to be addressed in this contract, and preferably sorted by discipline? Answer: Refer to answer to question #29 and refer to Appendix B Is there a reason why DOT standards are being required for this contract? Answer: This is standard for NYCEDC projects. 35. Is the project being submitted to DOT for review? Answer: No. 36. When DOT standards are specified, is it for NYS or NYC DOT? Answer: NYCDOT 37. I was hoping to acquire the surveys and the addendum you spoke about providing on the site walk through. Answer: Site survey is underway and will be made available after award. Page 6 of 9

7 38. Please let me know if the links and the addendum have been made available at this time. Answer: As discussed at site visit there is overlapping scope for the Bush Terminal project. An Addendum will be issued to remove the following scope from the Bush Terminal Scope page Appendix B- 7: Elevate and install new substation (Refer to electrical drawings, E001, E100, E200, E201, E300, E301, E302, E500) Current documents will need to be modified to elevate the substation Furnish and install watertight duct bank Furnish and install new cable from substation to buildings. Addendum will be available at the same site the RFP was downloaded from: On VIII. Task 8: Construction Administration and Construction Observation: The Consultant is required to attend weekly meetings with the Corporation and others throughout the duration of the design and construction process. Can the consultant schedule a conference as part of the weekly meetings or is it required to attend a physical meeting. Answer: Typically we alternate between a physical meeting and a conference call other words we have a physical meeting every two weeks. 40. Is this project design to budget, or design to scope? Is $20M an upset limit; at first review there may be budget challenges. Answer: Design to budget and scope. 41. Is the site environmentally clean, or is there an environmental remediation element of the flood barrier installation? Answer: No environmental remediation is anticipated. 42. Do the buildings have basements or cellars? Answer: No 43. For which buildings, if any, are foundation/structural plans available? Will they be provided to all bidders or after award? Answer: There are no foundation plans available. Page 7 of 9

8 44. Are there condition inspection reports for the facilities that will be made available? Including dive reports on waterfront structures? Answer: Conditions surveys are underway and will be made available. Dive reports will also be made available. 45. What is the extent of the desired site lighting; does it cover the area between the Admin Building and the substation, or does it extend to Buildings 57 and 58? Answer: Refer to street lighting drawings SLN-1, SL-1, SL-2, SL-3, SL-4, SL-5 provided in the RFP 46. RFP requires topographical survey, but does not specifically require property line survey. Will property line surveys be provided? Answer: Site survey is underway and will be made available after award. 47. On page three of the RFP document, required consultant team members and possible consultant team members are listed. In the Staff and Fee Schedule document, additional consultants are mentioned that are not included on page three, such as Signage and Graphics Designer and Sustainable Design Engineer. Would their fees be hourly since their scope is not really defined or do they need to be included in Exhibit 2? Answer: Refer to question #1. Additional labor classifications can be added to the Staff and Fee Schedule (Exhibit 2-6). Include rates as shown on the fee schedule. 48. What is the construction budget for the Bush Terminal project? Answer: The complete project budget is $13.9M for Bush Terminal. 49. What is the construction budget for the Brooklyn Army Terminal project? Answer: The complete project budget is $6.5M for Brooklyn Army Terminal. 50. Can you clarify if we are redoing the docks and the rocks or are we building a wall? Answer: We are open to design recommendations. This will be refined during the design process. 51. What Marine Engineering services are required? Answer: Marine engineering services are not anticipated at this time. Page 8 of 9

9 52. What is the budget for this project? Answer: The complete project budget is estimated at $13.9M for Bush Terminal The complete project budget is estimated at $6.5M for Brooklyn Army Terminal 53. Is BIM required for this project? Answer: No. 54. Part of the RFP says that the respondents M/W/DBE Subcontractor Participation Plan is 25% of the selection criteria. Part says that M/WBE selection criteria accounts for 15% of respondents total score. Please clarify. Answer: The Subcontractor Participation Plan is 25% of the selection criteria. Page 9 of 9
