1 MPA Project No. M574-C1 Project Title: Black Falcon Cruise Terminal Façade Repairs and Coating Location: Black Falcon Cruise Terminal, South Boston, MA RESPONSES TO QUESTIONS and/or RFI s Date: 26 January 2017 The attention of Contractors submitting General Bids and or Filed Sub-Bids for the above referenced project is called to the following Responses to Questions and/or RFI s. Responses to Questions and/or RFI s: Contracting Specialists Incorporated electronic mail to CPBidQuestions from Don T. Kearney dated 01/11/2017: Item #1 Summary of Question: It appears that the Elastomeric coating portion of the work has been misclassified in the bid documents for the aforementioned work. The Elastomeric coating is currently classified under the Painting filed sub bid section whereas it should be part of the waterproofing filed sub bid. The primary function of the elastomeric coating is to protect the concrete façade and scheduled concrete repairs from the effects of the elements and thus is primarily applied for its waterproofing characteristics. This work is traditionally performed by the waterproofing trades and not the painting trades. Given also that the concrete repairs are performed by the waterproofing trades, signatory with BAC Local 3, and that the concrete repairs / elastomeric coating are integral to the warranties and the entire repair it therefore follows that the elastomeric coating should be part of the Waterproofing Filed sub bid. With protective coatings of Concrete and Masonry, traditionally MA public bids have characterized this work as waterproofing. We respectively ask that an addendum be issued to change the categorization of the elastomeric coating from Painting FSB to Waterproofing FSB. Response: The Executive Office of Labor & Workforce Development advised via an dated 1/24/2017 that the work falls under the auspices of Painting. The Aulson Company, LLC electronic mail to CPBidQuestions from Chad Lampert dated 01/13/2017: Item #2 Summary of Question: During the pre-bid conference held on 01/13/17 there were incorrect statements made, in describing the Elastomeric Coatings material scheduled for Concrete Surfaces, as Waterproofing. These comments where apparently based one description of the coating system and its benefits to a given substrate. It should be noted that, the Elastomeric Coatings System Application is correctly categorized as coatings application as intended for this project and is appropriately included in the Filed-Sub Bid for Painting, and shall require a DCAM Certified Contractor in the category of Painting. 2 Chapman Waterproofing Company electronic mail to CPBidQuestions from Adam Packard dated 01/16/2017: Item #3 Summary of Question: Please confirm that the route out and caulk per detail # 4 on drawing CR501 is to be performed by filed bid section Is this caulking work part of the 1500 linear feet of unit price work? Response: See Specification Section JOINT SEALANTS Marked Addendum No. 3. Item #4 Summary of Question: Will any hazardous caulking materials need to be abated? If so, what section is responsible for abatement? Response: Yes. This work will be performed by an abatement contractor, coordinated by the General Contractor. The Abatement Specification Section will be part of a forth coming Addendum. Item #5 Summary of Question: Will any hazardous paint materials need to be abated? If so, what section is responsible for abatement? Response: All bidding contractors are referred to the Project Manual, Appendix B, Limited ACM and Lead Paint Chips sampling report for additional information. It is not the intent of this scope that lead paint be removed, but that new coatings are applied with proper attention to all applicable health and safety, including OSHA, requirements for working with Lead and as listed in recommendations section of Appendix B. Item #6 Summary of Question: Will saw cutting and chipping out of the failed concrete be able to be performed during normal working hours for base bid work and alternate # 1? Response: Yes. Please Note: Alternate 1 was deleted through Addendum No. 3. Item #7 Summary of Question: Will the miscellaneous metals section be a filed bid? Response: No. This has been updated in Addendum No. 3. Do we need to carry the cost of Access, Traffic control, Pedestrian Protection and Police detail or can we assume that will be the responsibility of the GC? Response: The responsibility of the GC. Item #9 Summary of Question: The number and extent of cracks and patching and voids required to be filled in the paint specification is not quantifiable. Can this item on the bid document be changed to a unit number quote? Response: See Addendum No. 3. Surety Association of Massachusetts electronic mail to CPBidQuestions from Alissa Wood dated 01/17/2017: Item #10 Summary of Question: It has been brought to our attention that there is a 10 year installer s warranty provisions for the sealant on the Black Falcon Cruise Terminal Project. The Surety Association of Massachusetts is eager to work with the MBTA to find an suitable solution. We ask that you consider modifying the installer s warranty to something closer to the standard warranty of one (1) or two (2) years. 2

3 The change will benefit all parties involved. Response: The warranty timeframe has been updated through Addendum No. 3. It should be noted that this is not an MBTA project. Section PAINTING: Pg.6 Part 3-Execution Par. 3.1 Inspection and Preparation Par, F. Fill cracks and irregularities- Is it the intent to fill cracks as part of the work of Spec. Section Response: See Addendum No 3. Item #12 Summary of Question: Is it your intent under Spec. Section to touch-up Only EIFS per drawing A3.01-Note #4? Response: Yes. Item #13 Summary of Question: Is there any work on the surfaces of the connecting bridges? Response: No. Item #14 Summary of Question: Is there any work on the exterior surfaces of the windows? Response: Paint work is indicated on Architectural drawings on existing painted glass window surfaces and at glass window muntins. Existing windows at levels 2 and 3 are N.I.C. Item #15 Summary of Question: Spec. Section Elastomeric coating, Pg.3 Par. 1.6 Submittals Par D Applicator Qualifications- How does this apply? Does info need to be submitted at the time of bid? Response: It allows the Owner and their representatives greater understanding of each contractor s experience with similar projects. The Qualifications are to be provided during the construction submittal process. Item #16 Summary of Question: Spec. Section Elastomeric coating, Pg.7 Par.3.2 Protection Par. E Erection of temporary Protective canopies. Is it the intent that Painter provides this protection normally provided by GC? Response: The responsibility of the GC. Item #17 Summary of Question: Spec. Section Elastomeric coating, Pg.9 Par. 3.4 Application Par. C.4 Prime surface as necessary. Is primer necessary? If yes provide product as well as the location for the application of primer. Response: The use of primer as part of the elastomeric coating system is based on each specific manufacturer's recommendations and requirements. Item #18 Summary of Question: Is the work of Spec. Section to be on a unit price basis? Does the square footage of 62,100 on the Form for Sub-Bid Pg. 15 represent the total area of Elastomeric Coating? We could not locate any specs for any abatement issues. Could you provide information on this and who carries the abatement for the project and for Sec (joint Sealants) Response: Abatement specification will be provided via a forthcoming addenda. Response: It was issued separately or, depending upon when each firm picked up Bid Documents, with the Bid Document Package. Item #25 Summary of Question: Is a subcontractor required to file a performance and payment bond? 4

5 Response: All requirements for a Filed Sub-bidder are indicated in the Proposal form included in the Bid Document package and as described in the Bid Document Specifications. Item #26 Summary of Question: What forms are specifically required for a filed sub-bid? Response: All forms required for a Filed Sub-bid are indicated in the Proposal form included in the Bid Document package and as described in the Bid Document Specifications. Item #27 Summary of Question: Article 6, Page i-9 of General Requirements indicates special envelope for bidders. Does this apply to filed sub-bidders or General Bids or both? If it applies to FSBs, how do we obtain this special envelope? Response: The use of the special envelope applies to both Filed Sub-bidders and General Contractor bidders. They can be obtained from Office of Director of Capital Programs and Environmental Affairs, Massachusetts Port Authority. Conversely, if bidders choose to use a different envelope, it must be identified appropriately as a bid submission. Item #30 Summary of Question: General Bid page P-8 Unit Price ii and iii what is the difference between the two? Is there 1400 CF. of concrete removal, surface preparation and concrete placement and 1400.CF.of just Concrete patch? Is the total of concrete patch 2800 CF. Response: See Addendum No. 3. Item #31 Summary of Question: General Bid Form, where do I insert the total for alternate #1? Same for Sub bids. Response: See Addendum No. 3. Please Note: Alternate 1 was deleted through Addendum No. 3. Item #32 Summary of Question: II B 4.3 Commencement and Completion of Work. How do I identify the home port ship on the schedule calendar? Response: All Port of Call ships are listed POC in the Calendar. If not labeled as such, the ships are considered Home Port Ships. Item #33 Summary of Question: same section last paragraph work may be performed at parts of the building not serving ship in port. If the work is to be done in three phases, how can we jump into another phase two if we are working on phase one. Is Massport allow that? Response: See Division IIB Section 4 and Section 51. 5

6 Item #34 Summary of Question: On days that home port ship and or multiple ships are in is that possible to work 3rd shift say 9 PM to 4:30 AM? Response: See Division IIB Section 4 and Section 51.
