1 Page 1 of SCOPE This standard practice sets the pay adjustment for out of specification performance graded asphalt cement used in the construction and maintenance of Manitoba Provincial highways. 2.0 DEFINITIONS Asphalt Cement: A dark brown to black cementitious material in which the predominating constituents are bitumens. Asphalt cement may occur in nature or be obtained in crude petroleum refining process. Asphalt cement, which is semisolid to solid, gradually liquefies when heated and is used for most paving projects on Manitoba provincial highways. 2 Page 2 of 5 APL Standards Performance Graded Asphalt Cement Specification MEB Standards P028 Supplier Certification for Performance Graded Asphalt Cement S010 Standard Practice for Asphalt Cement, Emulsified Asphalt Sampling and Testing. 5.0 GENERAL Unless otherwise specified, the asphalt cement shall conform to the latest specifications for asphalt cements on APL101-2 Performance Graded Asphalt Cement Specification. All asphalt binders will be subject to testing for acceptance as per MEB-S010 Standard Practice for Asphalt Cement, Emulsified Asphalt Sampling and Testing during their use. Acceptance of materials is contingent upon satisfactory compliance to materials requirements as determined by conformance test results on samples collected from field by project personnel. 6.0 Out of Specification Results MI will notify the Supplier of out-of-specification test results as per MEB-S010. The supplier shall respond to the notification of out-of-specification results within five business days identifying the following: The terminal and/or refinery supplying the asphalt cement. The quantity and location(s) of material in question affecting the Department. Any changes to their quality control plan and procedures. Quality control test results relating to the out-of-specification asphalt cement in question. 6.1 Deficiency and Payment Reduction Factors Pay adjustment on each load of the supplied asphalt cement will be calculated based on samples with test results falling within the ranges shown in Tables 1 through 5. When test results on a sample for multiple criteria are out of the specification, the greatest percent reduction from Tables 1 through 5 will be used in the calculation. When the PG asphalt binder is identified with the suffix P, Table 6 shall also apply. The percent reduction shall be applied in addition to the reduction incurred in Tables 1 through 5.

(2) Department willl review test results to determine pay reduction or removal of supplier or terminal from the APL.

5 Page 5 of Payment Adjustment Payment adjustment will be calculated using the following equation: = where: FullPMT= Full Payment Test results and memorandum indicating deficiencies and payment adjustment will be provided to the Supplier. The pay adjustment will be deducted from unpaid invoices. When there are no unpaid invoices the Department will request back payment from the Supplier. 6.3 Dispute Resolution If any test results falls within the ranges shown in Tables 1 through 6, the sample is eligible for dispute resolution. The process is as follows: 1) The supplier shall submit a request for asphalt binder dispute resolution testing by within fifteen working days. The request must include test results from the lot or batch corresponding to the disputed PG asphalt cement grade. 2) MI will arrange for the laboratory to send the asphalt binder sample in question to a second laboratory for PG grade verification testing. 3) The second laboratory test results will be used to calculate the pay adjustment and no further dispute resolution will be entertained. 4) If any of the dispute resolution results fall within the limits shown in Tables 1 through 6, all cost associated with the dispute resolution tests shall be born by the Supplier.
