1 Agreement Greer s Liquors MLK Jr. Way West Oakland Effective as of: January 7, 2005 Within 10 days of this agreement Greer s Liquor must no longer sell any alcoholic beverages. Any future use of the property to sell alcohol must be first submitted to the City of Oakland s planning process for new land use. San Pablo Liquor San Pablo Ave. West Oakland Effective as of: May 5, 2005 Discouraging Loitering Manager, employees, and security guards must make appropriate effort to discourage loitering; including calling the police if problem persists. Video Monitoring Exterior video surveillance system shall be maintained in working order and signs with block lettering at least three inches tall must be posted informing public that activities are being videotaped. Lighting Exterior lighting of building shall be maintained for all hours of darkness during which the business is open to properly illuminate the appearance and conduct of all persons on or about the premises. Signage At least one sign shall be posted at each public entrance to the building prohibiting littering and loitering. Required signage regarding open containers and drinking in public shall also be posted with at least one sign on each side of the public entrance. Sale of Alcoholic Beverages The display of alcoholic products (excluding the alcohol displayed behind the counter and refrigeration units) shall be less than 15% of the total floor space. The other 85% shall be for sale of groceries and convenience items.

2 Hours of Operation The hours of operation shall commence no earlier than 8:00 a.m. and end no later then 12:00 midnight, Monday through Saturday; Sundays no later than 10:30 p.m. Trash and Litter A permanent and non-flammable trash container shall be installed and maintained on the exterior of the building. Operator of building must sweep the sidewalks adjoining the property as well as 20 feet beyond entrance to building twice daily or more. Graffiti All graffiti shall be removed within 72 hours of its application to the property. Natural Surveillance The cash register shall be located so that the clerk standing at the register will have a clear unobstructed view of the entire premises and the sidewalk in front of the entire length of the building. Shelving shall not be higher than 5 feet. A wall-to-wall mirror at ceiling height shall be installed along the entire back wall to allow visibility down aisles between shelving by the clerk standing at the cash register and by officers looking through the front window. Visibility into the Market No more than 10% of the windows to the building are to be covered and clear visibility from the windows to the clerk shall be available. 100% visibility through the doors, open or closed, is required at all hours open for business. There shall not be any external security bars or mesh and in order to ensure that the glass in the windows are secure, a clear protective film may be applied as long as the view into the facility is not obstructed. Roll-down gates may be used during hours the market is not open for business.

3 Kibby s 3237 Foothill Blvd. Fruitvale Effective as of: August 26, 2004 Private Patrol Operator Whenever Kibby s is open for business there shall be a licensed security guard(s) in or about the property. This guard(s) shall maintain order and prevent harassment of pedestrians, prevent loiterers and smoking within 20 feet of the bar, prevent the sidewalk within 20 feet of the bar from being blocked, and prevent activities that would interfere with the quiet enjoyment of the bar by customers, nearby residents, and owner and occupants of the enjoining properties. All signs shall be maintained in legible condition, be at least one square-foot

All employees must wear valid identification at all times. Hours of operation shall commence no earlier then 6:00 p.m. Monday through Thursday. Graffiti All graffiti shall be removed within 72 hours of its application to the property.

No signage advertising any products on the exterior of the premises or alcohol or tobacco advertisements on the interior visible from the street are permitted. Freestanding displays and sandwich boards on the exterior of the building are also not permitted. Employee Identification All employees must wear valid identification at all times. Disabled and Senior Access The shelving inside the premises shall be no taller than 4 ½ feet and must be spaced a minimum of 3 feet apart with a minimum turning area at each end of

7 the aisles of 5 feet. The entrance and doorway must be clear of obstructions at all times.

Video Monitoring Exterior video surveillance system shall be maintained in working order and signs with block lettering at least two inches tall must be posted informing public in both Spanish and English that all activities are being videotaped. Lighting Exterior lighting of building shall be maintained for all hours of darkness during which the business is open to properly illuminate the appearance and conduct of all persons on or about the premises. Set of House Rules Visible to Public A sign posting the house rules must be posted in a place visible to the public. Signage At least two signs, one square-foot minimum shall be posted at the entrance to the building prohibiting littering and loitering. Employees All employees must have valid identification at all times. No employees working in market shall have known history of criminal activity, including Adel Ali and Futhle Nagi. Hours of Operation Market shall strictly obey closing time of 12:00 a.m. and there shall be no customers remaining in the market at 12:01 a.m. Trash and Litter A permanent and non-flammable trash container shall be installed and maintained on the exterior of the building. Operator of building must sweep the sidewalks adjoining the property as well as 20 feet beyond entrance to building twice daily or more. There is to be no furniture or

10 items that may be used as furniture on streets that may encourage loitering. Graffiti All graffiti shall be removed within 72 hours of its application to the property. Sale of Items No single cigars or cigarettes as well as any drug paraphernalia are to be sold.
