5 SECTION HAZARDOUS MATERIALS ABATEMENT Addendum No. 2 Notice to Bidder: All work related to hazardous material abatement shall be the responsibility of the General Contractor and its Sub-contractors. River Architects, Berners Schobers, and any other design consultant will not be held responsible in any manner for the documentation or abatement of hazardous materials. A full report of all hazardous materials has been provided by the Owner and included in these construction documents for reference. PART 1 GENERAL 1.1 RELATED DOCUMENTS A. General provisions of the Contract, including Division 00 and Division 01 Specification Sections, apply to this Section. 1.2 WORK INCLUDED A. The Contractor shall furnish all labor, materials, services, permits, and equipment necessary for the removal, transportation, and disposal of paint with lead and materials containing lead as specified herein prior to building restoration of the structures listed below. The Contractor shall complete a report of all abatement activities. B. The structures include the following: 1. Privy a. Remove paint finishes from exterior brick masonry. b. Remove paint finishes from door and window frames and trim. c. Encapsulate/Stabilize paint from wood facisa, soffit and roof edges boards. d. Remove paint from interior walls and wood trim. 2. Oil House a. Remove paint finishes from exterior stone masonry. b. Remove paint finishes from wood door frame and trim. c. Remove paint from concrete floor. 3. Storage Shed a. Encapsulate/Stabilize paint for all interior painted wood surfaces. 1.3 GENERAL REQUIREMENTS, CODES AND STANDARDS A. All work under this contract shall be done in strict accordance with State of Wisconsin Department of Natural Resources (DNR), Federal Environmental Protection Agency (EPA) Clean Air Act, Occupational Safety and Health Administration (OSHA) worker safety codes and regulations, and all applicable Federal, State, and local regulations, standards and codes governing lead abatement, and any other trade work done in conjunction with the abatement. All applicable codes, regulations and standards are adopted into this specification and will have the same force and effect as this specification. B. The Abatement Contractor shall apply for and have on-site all required permits and licenses to perform abatement work as required by Federal, State, and Local regulations. 6 C. It is the contractors responsibility to provide all materials, equipment, and labor necessary to achieve lead clearance per the Department of Housing and Urban Development Lead-Based Paint Regulation (24 CFR Part 35) standards. D. Abatement procedures shall refer to the Secretary of Interior s Standards for the Treatment of Historic Properties and/or brief 37, Appropriate Methods for Reducing Lead-Paint Hazards in Historic housing as appropriate. E. The Abatement Contractor shall maintain Environmental and Pollution liability insurance covering claims from third party injury and property damage as a result of conditions airising out of operations or completed operations. 1.4 PRECONSTRUCTION MEETING A. Prior to commencing the work, the Contractor shall meet with the Owner to present and review, as appropriate, the items following this paragraph. The Contractor's Competent Person(s) who will be on-site shall participate in the pre-construction meeting. The pre-construction meeting is to discuss and determine procedures to be used during the project. At this meeting, the Contractor shall provide: 1. Proof of Contractor licensing. 2. Proof the Competent Person(s) is trained and accredited and approved for working in this State. Verification of the experience of the Competent Person(s) shall also be presented. 3. A list of all workers who will participate in the project, including experience and verification of training and accreditation. 4. A copy of the Contractor's Hazard Abatement Plan. In these procedures, the following information must be detailed, specific for this project. a. Regulated area preparation procedures; b. Decontamination area set-up/layout and decontamination procedures for employees; c. Abatement methods/procedures and equipment to be used; and d. Personal protective equipment to be used. 5. At this meeting the Contractor shall provide all submittals as required. 6. Procedures for handling, packaging and disposal of waste. 1.5 PROJECT CONDITIONS A. Provide and maintain protection for the public from hazards caused by this work. PART 2 MATERIALS 2.1 PROTECTIVE BARRIERS AND COVERS A. Provide demolition materials, barriers and covers, etc. to complete the work assigned. B. Provide all necessary containment measures necessary to protect occupants, workers, and property. C. Install containment measures as required by state and local regulations. See Section for additional containment information. 2.2 PERSONAL PROTECTIVE EQUIPMENT A. Provide, at a minimum, steel toe boots, hard hats, safety glasses, protective clothing, respiratory protection and all other personal protective equipment. PART 3 EXECUTION Cana Island Light Station Hazardous Materials Abatement RA 1372.A

7 3.1 PREPARATION A. The abatement contractor shall provide a schedule indicating the approximate dates of all the key functions for each abatement area (preparatory work, abatement, clearance, etc.) B. The contractor shall provide an abatement plan with methods and procedures covering each of the identifiable abatement areas. All procedures must provide containment of lead debris and not allow airborne contamination of adjacent areas. 3.2 REMOVAL A. Removal of hazardous materials shall be performed by wetting materials prior to removal. B. Chemical paint removers shall be used for all lead-based paint removal unless noted otherwise. C. Care must be taken so that leaded materials are neither burned, nor dusted, nor result in further exposure to workers, residents, children, or observers. 3.3 DISPOSAL A. The contractor shall be responsible for the safe handling and transportation of all waste generated by this contract to designated waste disposal site and all required permits including E.P.A identification number as a generator of hazardous waste. B. As work progresses, the contractor shall remove all hazardous waste at an approved disposal site in accordance with the requirements of the disposal authority. Submit documentation regarding the disposal to the Owner. C. Any ground areas external to the buildings that may become contaminated with hazardous materials shall be tested and decontaminated at the contractor s expense. D. The contractor shall bear the cost for all claims, damages, losses and expenses to against the Owner, consultants, or the Owner s representatives, including but not limited to attorney s fees arising out of or resulting from spills en-route to the waste disposal site. 3.4 RESTORATION WORK A. Damaged areas shall be repaired or replaced to the satisfaction of the Owner. 3.5 REPORTS A. Upon completion of the work, and prior to the project being considered complete, the contractor shall prepare a report and submit it to the Owner: The report shall contain: 1. A copy of all notifications to or permits received from Federal, State and local agencies for the project. 2. A copy of signed waste manifests indicating the place, time, and exact quantity of hazardous materials received by an approved landfill. 3. A copy of all logs maintained at the job site throughout the work. 4. A copy of the log for any air monitoring performed by the contractor, and the lab s analysis and credentials. *** Cana Island Light Station Hazardous Materials Abatement RA 1372.A
